CIRCULAR

REGULATIONS ON REPORTING OPERATIONS AND STATISTICAL DATA IN THE VIETNAM CIVIL AVIATION INDUSTRY

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006;

Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport hereby promulgates regulations on reporting operations and statistical data in the Vietnam civil aviation industry as follows:

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the reporting of operations and statistical data in the Vietnam civil aviation industry, including regular reports or reports upon request from competent state agencies.

Article 2. Other reporting regulations not within the scope of this Circular shall continue to be implemented according to current regulations.

Article 3. Scope of Application. This Circular applies to the Civil Aviation Authority of Vietnam, air traffic control units, port management corporations, air navigation service providers, Vietnamese airlines, the Civil Aviation Academy, the Civil Aviation Medical Center, and the Civil Aviation Magazine.

Article 4. Terms Used in This Circular

1. Supplementing Point 6a following Article 6 of Circular No. 02/2019/TT-BVHTTDL dated July 5, 2019 of the Minister of Culture, Sports and Tourism on the procedures for legal expertise regarding copyright and related rights as follows: Competent State Agencies: refers to the Ministry of Transport and the Civil Aviation Authority of Vietnam.

b. Air Traffic Control Units: includes the Northern Air Traffic Control Unit, the Central Air Traffic Control Unit, and the Southern Air Traffic Control Unit.

c. Port Management Corporations: includes the Northern Port Management Corporation, the Central Port Management Corporation, and the Southern Port Management Corporation.

d. Vietnamese Airlines: refers to Vietnamese airlines and Vietnamese legal entities permitted to operate civil aircraft.

) Vehicle registration certificate or certificate of vehicle deregistration or export certificate or ownership certificate of the vehicle issued by the competent authority of the exporting country or other documents of equivalent legal value: one certified Vietnamese translation from the original for cases of temporary import of movable property vehicles; Data: refers to production figures determined according to the indicators and time periods specified in the report forms. The content of each indicator and time period is defined in the accompanying reporting guidelines for each form.

e. Time: time mentioned in the report is local time in Hanoi; however, for reports on data from the air navigation service provider, international time (UTC) shall be used.

Article 5. Responsibilities for Implementation and Content of Operation Reports

Clause 1. Responsibilities for Reporting

Point a. The Civil Aviation Authority of Vietnam is responsible for receiving and consolidating reports from agencies and units within the civil aviation industry; it shall submit periodic reports on the operation of the civil aviation industry (monthly, quarterly, and annually) to the Ministry of Transport or submit operational reports as required by the Ministry of Transport. Point b. Agencies and units are responsible for submitting periodic reports (weekly, monthly, quarterly, and annually) or reports as requested to the Civil Aviation Authority of Vietnam, including air traffic control units, port management corporations, air navigation service providers, the Civil Aviation Academy, Vietnamese airlines, the Civil Aviation Medical Center, and the Civil Aviation Magazine.

Point c. Port management corporations shall simultaneously send their operational reports to the Civil Aviation Authority of Vietnam and corresponding air traffic control units.

Clause 2. Contents of Operational Reports

Point a. State management work within their authority;

Point b. Progress of key projects;

Point c. Activities of subordinate units;

Point d. Civil aviation security and safety work, incidents threatening aviation security and safety, and measures taken to address them;

Point đ. Outstanding issues as planned;

Point e. Key tasks for the upcoming period;

Point g. Proposals and recommendations to other units;

Point h. Other contents as required.

Article 4. Responsibilities for Implementation and Content of Statistical Data Reports

1. The Civil Aviation Authority of Vietnam shall submit the following statistical data reports to the Ministry of Transport:

a. Monthly business operation report on transportation and cargo handling (Model HK-1 attached hereto): submitted within the first ten days of the following month;

b. Report on transport vehicles statistics (semi-annual) (Model HK-2 attached hereto): submitted on July 20 for the first six months of the year and January 20 for the last six months of the previous year;

c. Monthly report on delays and cancellations of flights by Vietnamese airlines (Model HK-3 attached hereto): submitted within the first ten days of the following month;

d. Annual report on aircraft accidents registered in Vietnam (Model HK-4 attached hereto): submitted on January 20 for the previous year's statistics.

2. Airports Control Units shall submit the following statistical data reports to the Civil Aviation Authority of Vietnam:

a. Weekly report on flight transportation statistics (Model CV-1 attached hereto);

b. Weekly report on airport traffic statistics (Model CV-2 attached hereto);

c. Estimated monthly report on airport traffic statistics (Model CV-3 attached hereto);

d. Monthly report on cargo transportation volume at international airports and monthly report on cargo transportation volume at domestic airports (Models CV-4 and CV-5 attached hereto).

Airports Control Units shall coordinate with relevant Airport Corporations in determining the point of receiving flight documentation from airlines (Vietnamese and international) operating in Vietnam; they shall either perform or authorize Airport Corporations to perform the reporting tasks according to the aforementioned models.

3. Airport Corporations shall submit the following statistical data reports to the Civil Aviation Authority of Vietnam:

Annual financial report at international airports (Model DNC attached hereto);

4. The Corporation for Air Traffic Management shall submit the following statistical data reports to the Civil Aviation Authority of Vietnam:

a. Weekly report on air traffic control service volume (Model HDB-1 attached hereto);

b. Estimated monthly report on air traffic control service volume (Model HDB-2 attached hereto);

c. Monthly report on air traffic management activities (Model HDB-3 attached hereto);

d. Monthly report on flights through international and domestic airways in Vietnam's Flight Information Regions (FIR) (Model HDB-4 attached hereto);

đ. Daily consolidated report on air traffic operations (Model HDB-5 attached hereto);

e. Annual financial report on air traffic management services (Model HDB-6 attached hereto);

5. Vietnamese airlines shall submit the following statistical data reports to the Civil Aviation Authority of Vietnam:

a. Weekly report on transportation statistics (Model HHK-1 attached hereto);

b. Estimated monthly report on transportation statistics (Model HHK-2 attached hereto);

c. Monthly report on transportation statistics (Model HHK-3 attached hereto);

d. Quarterly report on transportation statistics (Model HHK-4 attached hereto);

đ. Annual report on transportation statistics (Model HHK-5 attached hereto);

e. Monthly report on delays and cancellations (Model HHK-6 attached hereto);

g. Annual report on aircraft fleet and personnel statistics (Model HHK-7 attached hereto);

h. Annual financial report (Model HHK-8 attached hereto).

Article 5. Implementation Provisions

1. This Circular takes effect forty-five (45) days from the date of signature.

Decree No. 16/2001/QĐ/CHK dated September 18, 2001, issued by the Director of the Civil Aviation Administration of Vietnam, regarding the Regulation on Reporting Statistical Data Related to Civil Aviation Activities, is hereby repealed.

2. Civil Aviation Authorities and units shall base this Circular to establish internal reporting regulations.

3. The Director of the Civil Aviation Authority of Vietnam shall provide detailed guidance on deadlines, formats, points of receipt, and other specific issues related to the implementation of operational and statistical data reporting in the civil aviation sector.

4. The Civil Aviation Authority of Vietnam shall be responsible for implementing, inspecting, supervising, and auditing the execution of this Circular, and submitting proposals to the Minister of Transport for amendments and supplements to this Circular when necessary.

5. The Heads of the Ministry’s Office, the Inspector General of the Ministry, the Heads of all Departments, the Director of the Civil Aviation Authority of Vietnam, the Directors of Airports Control Units, the General Directors of Airport Corporations, the General Directors of the Corporation for Air Traffic Management, the General Directors/Directors of Vietnamese Airlines, the Director of the Civil Aviation Academy, the Editor-in-Chief of the Civil Aviation Magazine, the Director of the Civil Aviation Medical Center, the Heads of agencies, units, and individuals concerned shall be responsible for enforcing this Circular./.
