Pursuant to Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Resolution No. 59/NQ-CP dated December 17, 2010 of the Government on simplifying administrative procedures within the scope of functions of the Ministry of Industry and Trade;
The Ministry of Industry and Trade amends and supplements some articles of The Technical Safety Management Regulation for machinery, equipment, and hazardous chemicals with specialized industrial safety requirements issued together with Decision No. 136/2004/QĐ-BCN dated November 19, 2004 of the Minister of Industry promulgating the List of machinery, equipment, and hazardous chemicals with specialized industrial safety requirements and the Technical Safety Management Regulation for machinery, equipment, and hazardous chemicals with specialized industrial safety requirements (hereinafter referred to as the Regulation accompanying Decision No. 136/2004/QĐ-BCN) as follows:
Article 1. Amending and supplementing some articles of the Regulation accompanying Decision No. 136/2004/QĐ-BCN
1. Abolishing the provisions from Chapter II, Article 3 to Article 7.
2. Amending and supplementing Article 19 as follows:
"Article 19. The Department of Industry and Trade shall be responsible for guiding and inspecting the implementation of this Regulation by units within the province and reporting to the Ministry of Industry and Trade on inspection work within the province on May 30 and November 30 each year."
3. Amending and supplementing Clause 9 of Article 21 as follows:
"9. Prepare statistical reports on technical safety inspections in the year and plans for the next year's inspections to be submitted to the Department of Industry and Trade by November 30 each year."
4. Abolishing the "Registration number" field in the Technical Safety Inspection Certificate model at Appendix 6 issued together with Decision No. 136/2004/QĐ-BCN dated November 19, 2004 of the Minister of Industry.
5. Abolishing Appendices 1, 2, 3, 5, and 7 issued together with Decision No. 136/2004/QĐ-BCN dated November 19, 2004 of the Minister of Industry.
Article 2. Implementation clause
This Circular takes effect from May 15, 2011.
The Head of the Ministry’s Office, Heads of agencies under the Ministry, and related organizations and individuals are responsible for implementing this Circular./.
