Circular No. 14/2011/TT-BTNMT amends and supplements certain Articles of Circular No. 32/2010/TT-BTNMT on the issuance of permits for surveying and mapping activities. CIRCULAR
Amending and supplementing certain provisions of Circular No. 32/2010/TT-BTNMT dated December 8, 2010 of the Minister of Natural Resources and Environment on issuing permits for surveying and mapping activities dated December 8

to issue permits for surveying and mapping activities
Pursuant to Decree No. 25/2008/NĐ-CP dated March 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to Decree No. 12/2002/NĐ-CP dated January 22, 2002 of the Government on surveying and mapping activities;
Pursuant to Resolution No. 56/NQ-CP dated December 15, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the Ministry of Natural Resources and Environment;
Upon the proposal of the Director of the Vietnam National Survey and Mapping Center and the Head of the Legal Department,
c) Enterprises may be granted permission for no more than one block out of the total three dual-frequency blocks (FDD) B
Article 1. Amending and supplementing certain provisions of Circular No. 32/2010/TT-BTNMT dated December 8, 2010 of the Minister of Natural Resources and Environment on issuing permits for surveying and mapping activities:
1. Amend and supplement Point b Clause 1 Article 8 as follows:
"b) A copy accompanied by the original for verification or a certified copy issued by the authority that issued the Decision on establishment or Business Registration Certificate for organizations as stipulated in Clause 1 Article 6; A copy accompanied by the original for verification or a certified copy issued by the authority that issued the Investment License for organizations as stipulated in Clause 2 Article 6; Notarized Contract on surveying and mapping for organizations as stipulated in Clause 3 Article 6 of this Circular."
2. Amending and supplementing Clause 2 Article 8 as follows:
"2. Procedure for submitting applications and issuing permits
a) Organizations requesting issuance of permits for surveying and mapping activities under Ministries, agencies at the level of ministries, government agencies; central agencies of political organizations, political-social organizations and social-professional organizations; State-owned enterprises established by the Prime Minister's decision; foreign organizations shall submit one (01) set of application documents to the Vietnam National Survey and Mapping Center.
The Vietnam National Survey and Mapping Center shall be responsible for examining and checking the application documents; in cases where the application documents are incomplete according to regulations, the Vietnam National Survey and Mapping Center shall be responsible for guiding organizations and individuals to complete the application documents. The requirement for organizations and individuals to supplement application documents shall only be implemented once.
Within five (05) working days from the date of receiving complete and valid application documents, the Vietnam National Survey and Mapping Center shall be responsible for reviewing the application documents, preparing a review record according to Model No. 2 attached to this Circular, issuing permits for surveying and mapping activities to organizations meeting the conditions; in cases where the conditions for issuing permits are not met, the Vietnam National Survey and Mapping Center shall respond in writing to the organization with reasons for not issuing the permit;
b) Organizations requesting issuance of permits for surveying and mapping activities not falling under the category specified in Point a Clause 2 of this Article shall submit two (02) sets of application documents to the Provincial Department of Natural Resources and Environment.
The Provincial Department of Natural Resources and Environment shall be responsible for examining and checking the application documents; in cases where the application documents are incomplete according to regulations, the Provincial Department of Natural Resources and Environment shall be responsible for guiding organizations and individuals to complete the application documents. The requirement for organizations and individuals to supplement application documents shall only be implemented once.
Within five (05) working days from the date of receiving complete and valid application documents, the Provincial Department of Natural Resources and Environment shall be responsible for reviewing the application documents, preparing a review record according to Model No. 2 attached to this Circular, and sending the review record along with one (01) set of application documents to the Vietnam National Survey and Mapping Center; within five (05) working days from the date of receiving complete and valid application documents, the Vietnam National Survey and Mapping Center shall be responsible for examining and issuing permits for surveying and mapping activities to organizations meeting the conditions; in cases where the conditions for issuing permits are not met, the Vietnam National Survey and Mapping Center shall respond in writing to the organization with reasons for not issuing the permit and simultaneously notify the Provincial Department of Natural Resources and Environment.”
3. Amending and supplementing Clause 2 of Article 10 as follows:
"2. Organizations requesting supplementation of content in permits for surveying and mapping activities shall prepare application documents for supplementation of content in permits for surveying and mapping activities. The application documents include:
a) Application form for supplementation of content in permits for surveying and mapping activities according to Model No. 3 attached to this Circular;
b) Report on the operation of surveying and mapping activities of the organization since the issuance of the permit according to Model No. 7 attached to this Circular;
c) Documents and application materials regarding human resources and technological equipment supplemented compared to the time of issuance of the permit as stipulated in Point c and Point d Clause 1 Article 8 of this Circular;
d) Permit for surveying and mapping activities already issued."
"2. The Director of the Department of Police Administration for Social Order Management shall approve requests for searching, exploiting, and providing information and materials in the national identity card archives nationwide and requests from foreign agencies and organizations when authorized by the Ministry of Public Security."
"2. Applications for extension of permits shall be submitted to the Vietnam National Survey and Mapping Center at least thirty (30) days before the expiration of the permit.
The Vietnam National Survey and Mapping Center shall be responsible for examining and checking the application documents; in cases where the application documents are incomplete according to regulations, the Vietnam National Survey and Mapping Center shall be responsible for guiding organizations and individuals to complete the application documents. The requirement for organizations and individuals to supplement application documents shall only be implemented once.
Upon receipt of complete and valid application documents, the Vietnam National Survey and Mapping Center shall complete the extension of permits for surveying and mapping activities within three (03) working days for organizations meeting the conditions; in cases where the conditions for extending the permit are not met, the Vietnam National Survey and Mapping Center shall respond in writing to the organization with reasons for not extending the permit.
When the permit for surveying and mapping activities expires as stipulated in Clause 2 Article 9 of this Circular, organizations wishing to continue surveying and mapping activities shall prepare new application documents for issuance of permits according to Article 8 of this Circular."
Article 2. Implementation
1. This Circular takes effect from May 30, 2011.
2. During implementation, if there are any difficulties, organizations and individuals are requested to report to the Ministry of Natural Resources and Environment for consideration and resolution./.
