BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;
The National Assembly enacts the Law on Popularizing and Educating on Laws.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Law stipulates citizens' right to information about laws and their responsibility to seek out and study laws; the content and forms of popularizing and educating on laws; the responsibilities of agencies, organizations, and individuals with authority; and the conditions ensuring the work of popularizing and educating on laws.
Article 2. Citizens' Right to Information About Laws and Their Responsibility to Seek Out and Study Laws
1. Citizens have the right to be informed about laws and the responsibility to proactively seek out and study laws.
2. The State ensures and creates conditions for citizens to exercise their right to be informed about laws.
Article 3. State Policy on Popularizing and Educating on Laws
1. Popularizing and educating on laws is the responsibility of the entire political system, with the State playing a core role.
2. The State ensures necessary resources for the work of popularizing and educating on laws.
3. Socialization of the work of popularizing and educating on laws is implemented; agencies, organizations, and individuals contributing positively to this work are rewarded.
4. Legal education in national educational institutions is integrated into the curricula at all levels of education and training programs; it is a component of middle school, high school, vocational education, and higher education curricula.
Article 4. Socialization of the Work of Popularizing and Educating on Laws
The State encourages and supports with policies and creates conditions for agencies, organizations, businesses, and individuals participating in the implementation of popularizing and educating on laws; mobilizes social resources to contribute to the work of popularizing and educating on laws. Based on the economic and social situation of each period, the Government specifies support policies for agencies, organizations, businesses, and individuals participating in the implementation of popularizing and educating on laws.
Article 5. Principles of Popularizing and Educating on Laws
1. Accurate, complete, clear, understandable, practical.
2. Timely, regular, focused.
3. Diverse forms of popularizing and educating on laws suitable to the needs, age groups, and qualifications of the target audience and traditional, cultural customs of the nation.
4. Linked to the enforcement of laws, the implementation of tasks for economic and social development, national defense, security, and daily life of citizens.
5. Close cooperation between agencies, organizations, families, and society.
Article 6. State Management of Popularizing and Educating on Laws
1. The content of state management of popularizing and educating on laws includes:
a) Drafting, promulgating normative legal documents, programs, and plans on popularizing and educating on laws;
b) Directing, guiding, and organizing the implementation of the work of popularizing and educating on laws;
c) Training knowledge of laws and skills in popularizing and educating on laws;
d) Building and managing the national database on laws;
đ) Statistics, summarizing popularizing and educating on laws;
e) Inspecting, supervising, resolving complaints and denunciations, and handling violations in popularizing and educating on laws;
g) International cooperation in popularizing and educating on laws.
2. Agencies responsible for state management of popularizing and educating on laws include:
a) The Government uniformly manages state affairs related to popularizing and educating on laws;
b) The Ministry of Justice is responsible before the Government for managing state affairs related to popularizing and educating on laws; leading the drafting and submitting;
c) Ministries and agencies equivalent to ministries within their respective duties and powers are responsible for coordinating with the Ministry of Justice in managing state affairs related to popularizing and educating on laws;
d) People's Committees at all levels are responsible for managing state affairs related to popularizing and educating on laws in their localities.
Article 7. The Steering Committee for Popularizing and Promulgating Legal Education
1. The Steering Committee for Popularizing and Promulgating Legal Education shall be established at the central level, provincial level, centrally governed cities, districts, towns, and provincial-level cities. It serves as an advisory body to the Government, Provincial People's Committees, and District People's Committees on matters related to popularizing and promulgating legal education and mobilizing resources for such activities.
2. The permanent office of the Steering Committee for Popularizing and Promulgating Legal Education at the central level is the Ministry of Justice, at the provincial level it is the Department of Justice, and at the district level it is the Justice Office.
3. The Prime Minister shall provide detailed regulations regarding the composition, tasks, and powers of the Steering Committee for Popularizing and Promulgating Legal Education.
Article 8. Law Day of the Socialist Republic of Vietnam
November 9th each year is Law Day of the Socialist Republic of Vietnam. Law Day is organized to honor the Constitution and laws, and to educate society about the importance of upholding the rule of law.
The Government shall provide detailed regulations on this matter.
Article 9. Prohibited Acts
1. Misrepresenting, criticizing the content of laws that have been disseminated; failing to provide information and materials as required by law; providing false, illegal, immoral, or socially harmful information and materials that contradict good traditions of the nation.
2. Exploiting the dissemination and education of laws to distort the policies and guidelines of the Party and the State; promoting hostile policies, causing division among the people; infringing upon the interests of the State, the legitimate rights and interests of agencies, organizations, and individuals.
3. Obstructing citizens' right to access information, learn about, and study laws, as well as the activities of agencies, organizations, and individuals in disseminating and educating laws.
4. Using the right to access information, learn about, and study laws to obstruct the normal operations of agencies, organizations, and individuals, causing disorder and social insecurity.
Chapter II
CONTENT AND FORMS OF POPULARIZING AND PROMULGATING LEGAL EDUCATION
Section 1
GENERAL CONTENT AND FORMS OF POPULARIZING AND PROMULGATING LEGAL EDUCATION FOR CITIZENS
Article 10. Content of Popularizing and Promulgating Legal Education
1. Constitutional provisions and legal normative documents, with emphasis on civil, criminal, administrative, family, gender equality, land, construction, environmental protection, labor, education, health, national defense, security, traffic, basic rights and obligations of citizens, authorities and responsibilities of state agencies, newly issued legal normative documents.
2. International treaties and agreements to which the Socialist Republic of Vietnam is a party.
3. Awareness of respecting and complying with the law; awareness of protecting the law; benefits of complying with the law; exemplary acts and deeds in implementing the law.
Article 11. Forms of Popularizing and Promulgating Legal Education
1. Press conferences, press releases.
2. Direct dissemination of laws; legal counseling and guidance; provision of legal information and materials.
3. Through mass media, loudspeakers, the Internet, posters, billboards, propaganda paintings; publishing in the Official Gazette; posting legal information on electronic websites; displaying at the offices and bulletin boards of agencies, organizations, and residential areas.
4. Organizing legal knowledge contests.
5. Through judicial work, administrative violation handling, citizen reception activities, complaint and denunciation resolution, and other activities of state agencies; through legal aid and grassroots mediation activities.
6. Integrating into cultural, artistic, and organizational activities of political bodies and mass organizations, clubs, legal libraries, and other cultural institutions at the grassroots level.
7. Through legal education programs in national education institutions.
8. Other forms of popularizing and promulgating legal education suitable for specific target groups that authorized agencies, organizations, and individuals may apply to ensure effective legal education activities.
Article 12. Press conferences and press releases on legal normative documents
1. The Office of the President shall take the lead in coordinating with the National Assembly Office and the drafting agency to organize press conferences and issue press releases on laws, ordinances, and resolutions containing legal norms of the National Assembly and the Standing Committee of the National Assembly after the President signs the promulgation decree.
2. Monthly, the Ministry of Justice shall take the lead in coordinating with the Government Office and the drafting agency to issue press releases on legal normative documents issued by the Government and the Prime Minister.
3. The content of the press release shall clearly state the necessity, purpose of issuance, and main contents of the legal normative document.
Article 13. Publishing legal information on electronic information websites
1. The following legal information must be published on the electronic information websites of ministries, ministerial-level agencies, government agencies, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Agency, the Vietnam Fatherland Front Central Committee, and central agencies of political-social organizations, provincial People's Councils, and provincial People's Committees:
a) Legal normative documents related to the field of activities of the agency or organization;
b) Legal normative documents issued by the agency or organization, or jointly issued by the agency or organization;
c) Administrative procedures directly related to citizens and businesses under the responsibility of the agency or organization;
d) Draft legal normative documents published for public comment as prescribed by law.
2. In addition to the information specified in Clause 1 of this Article, it is encouraged that agencies and organizations publish other information about legal construction and implementation activities, necessary legal Q&A on their electronic information websites for citizens.
Article 14. Popularizing and educating the law through mass media
The Vietnam Television, Voice of Vietnam Radio, Vietnam News Agency, People's Newspaper, newspapers of law enforcement agencies, provincial radio stations, and television stations shall develop programs, special pages, and sections on the law; diversify forms of popularizing and educating the law to disseminate legal provisions, the situation of law enforcement, and other information about the law.
Article 15. Consulting, guiding understanding of the law, providing information, and legal materials
1. Agencies, organizations, and individuals considering or resolving citizen cases have the responsibility to explain, provide relevant legal provisions directly related to the case being resolved or guide searching and retrieving from the national database on law when requested by the citizen.
2. The State has policies to encourage legal counseling organizations, other legal service organizations, training institutions, and specialized legal research institutions to provide free legal counseling, guidance on understanding the law, and provision of legal information and materials to the people.
Article 16. Popularizing and educating the law through judicial work, administrative violation handling, citizen reception activities, complaint and denunciation resolution
1. People's Courts at all levels shall popularize and educate the law through judicial work at their premises, selecting appropriate cases with high educational value to organize mobile trials aimed at informing and educating the law to participants in court sessions and the public.
2. Competent state agencies shall combine popularizing and educating the law through administrative violation handling, citizen reception activities, complaint and denunciation resolution, and organizing dialogues with the people.
Section 2
CONTENT AND FORMS OF POPULARIZING AND EDUCATING THE LAW FOR CERTAIN SPECIAL GROUPS
Article 17. Popularizing and educating the law for people in ethnic minority areas, mountainous regions, remote areas, border areas, coastal areas, islands, areas with particularly difficult socio-economic conditions, and fishermen
1. The popularization and education of the law for people in ethnic minority areas, mountainous regions, remote areas, border areas, coastal areas, islands, areas with particularly difficult socio-economic conditions, and fishermen shall be based on the characteristics of each group, focusing on legal provisions concerning ethnicity, religion, responsibility for protecting and maintaining national security, defense, borders, national sovereignty, seas, islands, natural resources, minerals, and other fields of law closely related to the daily life and production of the people.
2. Activities to popularize and educate the law for people in ethnic minority areas, mountainous regions, remote areas, border areas, coastal areas, islands, areas with particularly difficult socio-economic conditions, and fishermen shall be emphasized through grassroots mediation, mobile legal aid; legal counseling, providing free legal information and materials in ethnic languages for ethnic minorities; integrating legal popularization and education into traditional cultural activities.
3. The State shall have policies to train, enhance, and support those engaged in legal popularization and education, village elders, community leaders, and respected individuals among ethnic minorities to participate in legal popularization and education at the local level; creating conditions for organizations and individuals to carry out voluntary activities to popularize and educate the law for people in ethnic minority areas, mountainous regions, remote areas, border areas, coastal areas, islands, areas with particularly difficult socio-economic conditions, and fishermen.
4. People's Committees at all levels shall organize the popularization and education of the law for people in ethnic minority areas, mountainous regions, remote areas, and areas with particularly difficult socio-economic conditions, and fishermen; taking the lead in coordinating with Border Guard Forces, Police, Customs, Forest Rangers, Coast Guard to organize the popularization and education of the law for people in border areas, coastal areas, and islands.
Article 18. Popularizing and educating the law for workers in enterprises
1. The popularization and education of the law for workers in enterprises shall focus on the rights and obligations of workers and employers, labor laws, employment laws, occupational safety and health, wage systems, social insurance, health insurance, unemployment insurance, trade union laws, and other relevant legal provisions.
2. Activities to popularize and educate the law for workers in enterprises shall be emphasized through direct dissemination, posting legal regulations at workplaces, legal bookshelves, legal book baskets, pamphlets, and integration into cultural and artistic activities.
3. Employers shall be responsible for allocating time and ensuring necessary conditions for the popularization and education of the law; coordinating with trade unions to organize the popularization and education of the law for workers in enterprises.
4. Trade unions shall be responsible for leading efforts to mobilize workers to learn about and study the law.
Article 19. Popularizing and educating the law for victims of domestic violence
1. The popularization and education of the law for victims of domestic violence shall focus on legal provisions concerning marriage and family, gender equality, prevention and combat against domestic violence, and the responsibilities of the State and society in supporting and protecting victims of domestic violence.
2. Activities to popularize and educate the law for victims of domestic violence shall be emphasized through grassroots mediation, mobile legal aid, free legal counseling, direct popularization and education of the law at temporary shelters, social welfare institutions, and support centers for victims of domestic violence.
3. People's Committees at commune, ward, and town levels, Vietnam Fatherland Front Committees, and member organizations of the Front at grassroots levels shall have the responsibility to organize the popularization and education of the law for victims of domestic violence and individuals committing acts of domestic violence; mobilize organizations and individuals to provide financial support for the popularization and education of the law for these subjects.
4. Families shall have the responsibility to educate their members to comply with legal provisions regarding prevention and combat against domestic violence, marriage and family, and gender equality.
Article 20. Popularizing and educating the law for persons with disabilities
1. The popularization and education of the law for persons with disabilities shall focus on legal provisions concerning the rights of persons with disabilities; state policies and the responsibilities of the State and society in creating conditions and supporting persons with disabilities, and other relevant legal provisions.
2. The popularization and education of the law for persons with disabilities shall be emphasized through appropriate forms, methods, means, and materials suitable for each type of person with disabilities.
3. The State shall have policies for training, capacity building, and supporting those engaged in the popularization and education of the law for persons with disabilities; encourage organizations and individuals to provide financial support for the popularization and education of the law for persons with disabilities.
4. Labor, Invalids, and Social Affairs agencies shall assist local People's Committees in leading and coordinating with disability organizations at all levels and other relevant agencies and organizations to implement the popularization and education of the law for persons with disabilities.
Article 21. Popularizing and educating the law for persons serving sentences, persons subject to placement in educational facilities, compulsory educational centers, and compulsory drug rehabilitation centers
1. The popularization and education of the law for persons serving sentences, persons subject to placement in educational facilities, compulsory educational centers, and compulsory drug rehabilitation centers shall focus on legal provisions concerning the rights and obligations of citizens, criminal law, enforcement of criminal penalties, administrative violation handling; laws on prevention and combat against drugs and social evils, depending on the specific subjects.
2. The popularization and education of the law for persons serving sentences, persons subject to placement in educational facilities, compulsory educational centers, and compulsory drug rehabilitation centers shall be emphasized through legal education programs, civic education, and integration into cultural, vocational education programs, community reintegration education; dissemination of current information and policies; club activities, peer groups, and other appropriate forms.
3. Wardens of prisons, principals of educational facilities, directors of compulsory educational centers, and directors of compulsory drug rehabilitation centers shall have the responsibility to organize the popularization and education of the law for prisoners, persons subject to placement in educational facilities, compulsory educational centers, and compulsory drug rehabilitation centers.
Article 22. Popularizing and educating the law for persons currently subject to educational measures at commune, ward, town level, and those sentenced to suspended imprisonment
1. The popularization and education of the law for persons currently subject to educational measures at commune, ward, town level, and those sentenced to suspended imprisonment shall focus on legal provisions concerning the rights and obligations of citizens, criminal law, enforcement of criminal penalties, and administrative violation handling.
2. The popularization and education of the law for persons currently subject to educational measures at commune, ward, town level, and those sentenced to suspended imprisonment shall be emphasized through direct legal dissemination; club activities, and other appropriate forms.
3. The People's Committee at the commune level shall be responsible for coordinating with relevant agencies, organizations, community, and family members of persons currently subject to educational measures at commune, ward, town level, and those sentenced to suspended imprisonment to organize the popularization and education of the law for these individuals.
Section 3
LEGAL EDUCATION IN EDUCATIONAL INSTITUTIONS OF THE NATIONAL EDUCATION SYSTEM
Article 23. Content of legal education in educational institutions of the national education system
1. The content of legal education in educational institutions of the national education system shall be developed in accordance with each educational level and training level, consistent with educational goals, training fields, ensuring unity, synchronization, universality, fundamentality, practicality, and systematicness.
2. The content of legal education for each educational level and training level of the national education system shall be specified as follows:
a) The content of legal education in preschool and primary school curricula shall be integrated through moral education content, forming habits in line with societal ethical standards, discipline awareness, team spirit, self-discipline, laying the groundwork for legal awareness.
b) The content of legal education in middle school and high school curricula shall provide initial knowledge about the rights and obligations of citizens, cultivating habits and respect for and compliance with the law.
c) The content of legal education in vocational education and higher education curricula shall provide basic knowledge about the state and law, related legal knowledge to the field of study.
Article 24. Forms of legal education in educational institutions of the national education system
1. Curriculum-based education through integration into educational activities at the preschool level; moral education subjects at the primary school level; civic education subjects at the middle school and high school levels; law, general law, and specialized law subjects at vocational education institutions and higher education institutions; subjects in other educational institutions within the national education system.
2. Extracurricular education and educational activities outside regular class hours.
Chapter III
TRESPONSIBILITIES FOR POPULARIZING AND EDUCATING THE LAW OF ORGANIZATIONS, ORGANIZATIONS, AND INDIVIDUALS
Section 1
RESPONSIBILITIES FOR POPULARIZING AND EDUCATING THE LAW OF ORGANIZATIONS AND ORGANIZATIONS
Article 25. Responsibilities of Ministries, ministerial-level agencies, and government agencies
1. Within their respective duties and powers, ministries, ministerial-level agencies, and government agencies shall have the following responsibilities:
a) Issuing programs, projects, and plans for popularizing and educating the law within their authority, directing, and guiding subordinate agencies and units under their management to implement them;
b) Determining the content and form of legal popularization and education suitable for each group of people; compiling materials and disseminating specialized legal knowledge; ensuring the right to information about the law for the people;
c) Organizing the popularization and education of the law for civil servants, public officials, and officers in the people's armed forces under their jurisdiction, emphasizing implementation through direct legal dissemination, providing regulatory legal documents, electronic websites of the agency, courses, training sessions, and seminars;
d) Building, training, and enhancing the cadre of legal lecturers of the ministry or sector;
e) Directing schools and vocational training institutions under their jurisdiction to organize legal education in educational institutions and vocational training institutions; arranging, standardizing, and enhancing the cadre of teachers teaching civic education subjects, teachers, and lecturers teaching law.
2. The Ministry of Education and Training shall issue legal education programs for each educational level and training level; stipulate the time frame and roadmap for standardizing teachers teaching civic education subjects, teachers, and lecturers teaching law.
3. The Ministry of Labor, Invalids, and Social Affairs shall issue legal education programs for vocational training institutions.
Article 26. Responsibilities of People's Courts, People's Procuratorates, and State Audit Office
1. Building, training, and enhancing the cadre of law reporters within their sector.
2. Organizing the dissemination and education of laws for civil servants and employees under their management; disseminating specialized legal knowledge to the people through appropriate forms.
3. Combining the dissemination and education of laws to the people through professional activities.
Article 27. Responsibilities of local authorities at all levels
1. The People's Councils at all levels shall have the following responsibilities:
a) Deciding on measures to enhance the effectiveness of legal dissemination and education work; allocating the local budget estimate for legal dissemination and education work;
b) Supervising the implementation of laws on legal dissemination and education.
2. The People's Committees at all levels shall have the following responsibilities:
a) Issuing programs, plans, and projects on legal dissemination and education within their authority;
b) Directing, guiding, organizing the implementation, and inspecting legal dissemination and education work;
c) Building, training, enhancing, and managing the cadre of law reporters and legal propagandists; implementing standardization of teachers teaching civic education subjects, teachers, and lecturers teaching law according to the provisions of the law;
d) Creating conditions for organizations, individuals, and enterprises to support legal dissemination and education activities.
Article 28. Responsibilities of agencies, organizations, and units directly managing civil servants, public officials, and employees
1. Disseminating and educating laws for civil servants, public officials, employees, and workers under their management, focusing on direct legal dissemination, posting legal information on electronic websites, newspapers, and bulletins of the agency, organization, or unit (if available); combining legal dissemination and education through professional activities.
2. Ensuring necessary conditions for organizing legal dissemination and education for civil servants, public officials, employees, and workers; building, training, and enhancing the cadre of law reporters of their own agency, organization, or unit or regularly inviting law reporters to participate in legal dissemination and education activities at the agency, organization, or unit.
3. Cooperating with state agencies and related organizations to disseminate and educate laws to the people.
Article 29. Responsibilities of the Vietnam Fatherland Front and its member organizations
1. Organizing the dissemination and education of laws for members and affiliates of their organization; mobilizing the people to comply with the law.
2. Cooperating with state agencies and related organizations to disseminate and educate laws to the people.
3. Building, training, and enhancing the cadre of law reporters and legal propagandists of their organization.
4. Mobilizing organizations, individuals, and enterprises to participate in and support legal dissemination and education activities.
5. Participating in supervising the implementation of policies and laws on legal dissemination and education.
Article 30. Responsibilities of organizations practicing law, social professional organizations about law, law training institutions, and judicial training institutions
1. Organizations practicing law, social professional organizations about law, law training institutions, and judicial training institutions shall have the responsibility to participate in disseminating and educating laws to the people; organizing legal dissemination and education through legal counseling and legal assistance activities; combining legal dissemination and education through professional activities; creating conditions for members of the organization, civil servants, employees, lecturers, students, and trainees to participate in voluntary legal dissemination and education activities.
2. Law training institutions and judicial training institutions shall have the responsibility to participate in enhancing the capacity of those engaged in legal dissemination and education work.
Article 31. Responsibilities of educational institutions in the national education system
1. Based on the content and form of legal education at each level of study and training, educational institutions in the national education system shall be responsible for organizing the implementation of legal education, arranging teachers to teach civic education subjects, and teachers and lecturers to teach law according to the provisions of the law.
2. Coordinate with families and society to implement the goals of legal education in educational institutions of the national education system.
Article 32. Responsibilities of Families
Family members have the responsibility to set a good example in complying with the law; grandparents, parents have the responsibility to educate and create conditions for their children and grandchildren to learn about and study the law, and cultivate respect for and compliance with the law.
Section 2
RESPONSIBILITIES FOR THE SPREADING AND EDUCATION OF LAW BY INDIVIDUALS
Article 33. Responsibilities of National Assembly Deputies and People's Council Deputies at all levels
Within the scope of their duties and powers, National Assembly Deputies and People's Council Deputies at all levels shall carry out the dissemination and education of law to the people through activities involving meetings with voters; supervise the implementation of laws.
Article 34. Responsibilities of civil servants, public officials, and military personnel in the People's Armed Forces
1. Actively seek to understand and study the law; participate in courses, training sessions, and seminars on the law; set a good example in complying with the law.
2. Proactively and actively combine the dissemination and education of law through professional activities and the execution of tasks.
3. Support and assist agencies, organizations, and individuals in the work of disseminating and educating the law related to their areas of work.
Article 35. Legal Reporters
1. Legal reporters are civil servants, public officials, and officers in the People's Armed Forces who are recognized by competent authorities to concurrently perform activities in the dissemination and education of law.
2. Legal reporters must meet the following criteria:
a) Have good moral character, firm ideological stance, and prestige in their work;
b) Have communication skills;
c) Hold a bachelor's degree in law and have at least two years of work experience in the field of law; in cases where they do not hold a bachelor's degree in law but hold another bachelor's degree, they must have at least three years of work experience related to law.
3. The authority to recognize legal reporters is stipulated as follows:
a) The Minister of Justice decides to recognize legal reporters for ministries, ministerial-level agencies, government agencies, the Central Committee of the Vietnam Fatherland Front, and central agencies of member organizations of the Front;
b) The Chairman of the People's Committee of a province decides to recognize legal reporters for state agencies, the Vietnam Fatherland Front Committee, and provincial member organizations of the Front;
c) The Chairman of the People's Committee of a district decides to recognize legal reporters for state agencies, the Vietnam Fatherland Front Committee, and district member organizations of the Front.
4. The competent authority issuing the decision to recognize legal reporters has the right to dismiss legal reporters. Agencies and organizations directly managing legal reporters organize reviews and propose to the competent authority issuing the decision to dismiss legal reporters.
5. The procedures for recognizing and dismissing legal reporters are regulated by the Minister of Justice.
Article 36. Rights and Obligations of Legal Reporters
1. Legal reporters have the following rights:
a) To be provided with legal normative documents, information, and legal materials for the purpose of performing tasks related to the dissemination and education of law;
b) To be trained and further educated on legal knowledge, skills, and practices related to the dissemination and education of law;
c) To receive remuneration and benefits as prescribed by law.
2. Legal reporters have the following obligations:
a) To perform tasks related to the dissemination and education of law according to their assigned duties; accurately convey the content of such dissemination and education;
b) Not to disclose state secrets and not to engage in other prohibited acts;
c) Annually report on their activities related to the dissemination and education of law to the directly managing agency or organization.
Article 37. Legal Propagandists and Individuals Invited to Participate in the Dissemination and Education of Law at the Grassroots Level
1. Persons with prestige, knowledge, and understanding of the law may be considered for recognition as legal propagandists at commune, ward, town levels or invited to participate in the dissemination and education of law at grassroots levels.
2. The Chairman of the People's Committee at the commune level decides on the recognition of legal propagandists.
3. Legal propagandists and individuals invited to participate in the dissemination and education of law are provided with legal documents; they are trained and further educated on legal knowledge and practices related to the dissemination and education of law; they receive remuneration and benefits as prescribed by law.
Chapter IV
CONDITIONS TO ENSURE THE WORK OF DISSEMINATING AND EDUCATING LAW
Article 38. Ensuring Organization, Personnel, Material Bases, and Means for the Work of Disseminating and Educating Law
The Minister, Head of a ministerial-level agency, Head of an agency under the Government, Chairmen of People's Committees at all levels, Chairman of the Vietnam Fatherland Front Committee, and heads of member organizations of the Front shall ensure sufficient personnel, civil servants, officials, legal reporters, and legal propagandists to carry out the work of disseminating and educating law in accordance with the needs of law dissemination and education within their respective fields and areas of management; ensuring necessary material bases and means for the work of disseminating and educating law as prescribed by the Government.
Article 39. Ensuring Budgets for the Dissemination and Education of Law
1. The budgets for the dissemination and education of law of agencies and organizations benefiting from the state budget are guaranteed by the state budget and raised from other legitimate sources. The central budget supports the budgets for the dissemination and education of law for localities that cannot balance their budgets independently.
2. Annually, based on the tasks of disseminating and educating law for the following year, agencies and organizations build budget estimates for the dissemination and education of law and consolidate them into their own state budget estimates to submit to the competent authority for decision-making in accordance with the law on the state budget.
3. The State encourages and creates conditions for domestic and foreign organizations and individuals to sponsor and support funds for the activities of disseminating and educating law in accordance with the law.
Chapter V
IMPLEMENTING PROVISIONS
Article 40. Effective Date
This Law takes effect from January 1, 2013.
Article 41. Detailed Provisions and Guidance on Implementation
The Government and competent authorities shall issue detailed regulations and provide guidance on the implementation of the provisions assigned in this Law.
This Law was passed by the National Assembly of the Socialist Republic of Vietnam, the 13th term, third session, on June 20, 2012./.
