Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 87/2013/NĐ-CP dated July 30, 2013 of the Government on the regime and policies for families and relatives of non-commissioned officers and soldiers serving with a fixed term in the People's Public Security Force;

The Minister of Public Security and the Minister of Finance guide the implementation of the regime and policies for families and relatives of non-commissioned officers and soldiers serving with a fixed term in the People's Public Security Force as follows:

Article 1. Scope of Regulation

This Circular guides the implementation of the one-time hardship allowance regime for families and relatives of non-commissioned officers and soldiers serving with a fixed term in the People's Public Security Force and the tuition fee exemption regime for children of non-commissioned officers and soldiers serving with a fixed term in the People's Public Security Force (hereinafter referred to as non-commissioned officers and soldiers) as stipulated in Decree No. 87/2013/NĐ-CP dated July 30, 2013 of the Government.

Article 2. Applicability

1. Relatives of non-commissioned officers and soldiers include: father, mother; father-in-law, mother-in-law or father, mother-in-law; legal foster parent; wife or husband; biological child, legally adopted child of non-commissioned officers and soldiers.

2. Family of non-commissioned officers and soldiers (is the place where non-commissioned officers and soldiers usually reside before serving with a fixed term in the People's Public Security Force).

Article 3. Subjects not subject to application

Families and relatives of non-commissioned officers and soldiers (as provided for in Article 2 of this Circular) cease to enjoy the regimes and policies stipulated in this Circular when non-commissioned officers and soldiers transfer to a professional regime; become students receiving living expenses at schools; discharge from service, lose their status as members of the People's Public Security Force, or die.

Article 4. One-time Hardship Allowance Regime

1. Families and relatives of non-commissioned officers and soldiers shall be granted one-time hardship allowances in the following cases:

a) If the family of a non-commissioned officer or soldier suffers from accidents, fires, natural disasters leading to house collapse, displacement, or house burning, they shall be granted a one-time hardship allowance of 2,000,000 VND per case;

b) If a relative of a non-commissioned officer or soldier is ill for one month or more or is hospitalized (including both inpatient and outpatient treatment) for seven days or more, they shall be granted a one-time hardship allowance of 500,000 VND per case;

The one-time hardship allowance regime prescribed in Points a and b of Clause 1 of this Article shall be implemented not more than twice a year for each individual.

c) If a relative of a non-commissioned officer or soldier dies or goes missing, they shall be granted a one-time hardship allowance of 1,000,000 VND per case.

In the event that, at the same time, the family and multiple relatives of a non-commissioned officer or soldier meet the conditions for one-time hardship allowances as prescribed in Points a, b, and c of Clause 1 above, they shall be granted corresponding amounts.

Example: In June 2013, the residence of Comrade Nguyen Van A, a soldier serving with a fixed term at the Public Security Department of Province X, was destroyed by fire, and one relative of Comrade A had to be hospitalized for ten days due to illness. Comrade A's family received a one-time hardship allowance of 2,000,000 VND due to the house being burned down; and a one-time hardship allowance of 500,000 VND due to one relative being ill. The total amount of one-time hardship allowance received is 2,500,000 VND (two million five hundred thousand VND).

2. In the case where a family has multiple non-commissioned officers and soldiers serving with a fixed term, the non-commissioned officer or soldier who enlisted earlier shall be responsible for declaring the application for one-time hardship allowances for the family and relatives. If they enlist at the same time, the person with the highest rank in the family shall be responsible for declaring the application for one-time hardship allowances for the family and relatives.

3. Application Documents for Entitlement

a) Declaration form for one-time hardship allowance of non-commissioned officers and soldiers(according to Form No. 01)certified by the People's Committee of the commune, ward, town (hereinafter collectively referred to as commune level) where the family of the non-commissioned officer or soldier resides.

In the case where the non-commissioned officer or soldier has one of the following documents: certificate from the People's Committee of the commune regarding the family of the non-commissioned officer or soldier suffering from house collapse, displacement, or house burning or having to relocate; hospital discharge certificate from the medical facility where the relative was treated for seven days or more; copy of the death certificate of the relative, then the non-commissioned officer or soldier shall attach those documents along with the declaration form for one-time hardship allowance (no need to obtain certification from the People's Committee of the commune).

b) Request for one-time hardship allowance from the unit directly managing the non-commissioned officer or soldier {at battalion (independent), regiment or equivalent level}.

4. Responsibilities and Implementation Procedures

a) For non-commissioned officers and conscripts

- Prepare the declaration form for one-time hardship allowance(according to Form No. 01).

- Submit the declaration form and related documents- Column (7): Land area in land allocation decisions, lease decisions, or documents of the competent authority or actual land area managed and used (applicable to assets that are buildings and land).to the battalion (independent), regiment or equivalent level.

In the case where the declaration form does not have certification from the People's Committee of the commune or does not have attached documents(as stipulated in Point a, Clause 3, Article 4),the non-commissioned officer or soldier shall submit the declaration form to the battalion (independent), regiment or equivalent level for reporting to the competent authority for review and resolution of the one-time hardship allowance. Within thirty days from the date of the decision on one-time hardship allowance, the non-commissioned officer or soldier is responsible for completing the procedures and submitting them to the financial department for settlement according to regulations. If the non-commissioned officer or soldier fails to complete the procedures within the specified period, they must return the amount of one-time hardship allowance received.

b) Responsibilities of the People's Committee of the Commune

Upon receipt of the declaration form for one-time hardship allowance from the non-commissioned officer or soldier or upon request from the relative of the non-commissioned officer or soldier, within no more than five working days, complete the verification and certification of the contents stated in the declaration form or issue the required certificates as stipulated in Point a, Clause 3, Article 4 of this Circular.

c) For units managing non-commissioned officers and soldiers at battalion (independent), regiment or equivalent level.

- To receive the declaration forms and related documents submitted by non-commissioned officers and conscripts;

- Aggregate, verify, and propose to the immediate superior for examination and granting of one-time hardship allowance within no more than two working days from the date of receipt of the declaration form submitted by the non-commissioned officer or soldier;

- Receive and pay out the one-time hardship allowance to the non-commissioned officer or soldier within no more than two working days from the date of receipt of the decision of the competent authority.

d) For units and local public security organs

Within three working days from the date of receiving complete files from subordinate units, units and local public security organs (at the Bureau level; provincial and centrally governed city levels) where non-commissioned officers and soldiers are serving shall complete the examination and decision on emergency hardship allowances for the families and relatives of such non-commissioned officers and soldiers.

Article 5. Exemption from Tuition Fees

1. The biological children and legally adopted children of non-commissioned officers and soldiers are exempt from tuition fees when studying at public and private educational institutions according to the current laws on tuition fee exemptions and reductions.

a) The period during which the children of non-commissioned officers and soldiers enjoy the exemption from tuition fees is calculated from the date of issuance of the "Certificate of Eligibility for Tuition Fee Exemption" until the non-commissioned officer or soldier completes their limited-term service in the People's Public Security Force.

b) In cases where new eligible subjects for tuition fee exemption arise during the service period of non-commissioned officers and soldiers, they shall prepare supplementary declarations; the duration of the exemption will correspond to the remaining service period of the non-commissioned officer or soldier.

2. Documents and Procedures, Responsibilities

a) For non-commissioned officers and conscripts

- Prepare the declaration form for issuing the certificate of eligibility for tuition fee exemption (according to Form No. 02)- Submit the declaration form and a photocopied birth certificate of the child to the battalion, company, or equivalent unit;;

- After receiving the "Certificate of Eligibility for Tuition Fee Exemption" (according to Form No. 03) from the unit,

it should be sent back to the family to submit to the preschool or primary-secondary school to implement the exemption according to regulations.b) For battalion, company, or equivalent units- Receive the documents submitted by non-commissioned officers and soldiers;

- Within two working days from the date of receiving complete documents from non-commissioned officers and soldiers, compile the request for higher-level units to examine and issue the "Certificate of Eligibility for Tuition Fee Exemption." If, upon reviewing the documents, it is found that they do not comply with the provisions mentioned above, require non-commissioned officers and soldiers to supplement and complete the documents in accordance with the regulations.

- Accept the certificates and hand them over to non-commissioned officers and soldiers.

c) For regimental and equivalent units

Within three working days from the date of receiving complete documents from subordinate units, complete the examination and issuance of the "Certificate of Eligibility for Tuition Fee Exemption" for the children of non-commissioned officers and soldiers.

d) For preschools and primary-secondary schools

- Public preschools and primary-secondary schools

+ Receive the "Certificate of Eligibility for Tuition Fee Exemption" transferred by the families of non-commissioned officers and soldiers;

+ Implement the tuition fee exemption for eligible subjects according to the regulations of the Government.

- Private preschools and primary-secondary schools

+ Receive the application form and "Certificate of Eligibility for Tuition Fee Exemption" transferred by the families of non-commissioned officers and soldiers;

+ Within five working days from the date of receiving complete documents from the families of non-commissioned officers and soldiers, confirm the application form requesting reimbursement of tuition fees so that the competent authority can pay the reimbursement according to the regulations of the Government.

1. The Ministry of Public Security is responsible for directing, guiding, and inspecting units and local public security organs in implementing emergency hardship allowances and tuition fee exemptions for the families and relatives of non-commissioned officers and soldiers; preparing budgets and settling accounts for the implementation of emergency hardship allowances for non-commissioned officers and soldiers in units and local public security organs.

Units and local public security organs shall implement the payment of emergency hardship allowances for the families and relatives of non-commissioned officers and soldiers. Annually, they are responsible for preparing budgets and settling accounts with the Ministry of Public Security (through the Finance Department).

Article 6. Responsibilities for Implementation

2. The Ministry of Finance is responsible for coordinating with the Ministry of Public Security to ensure funds for the implementation of emergency hardship allowances for the relatives of non-commissioned officers and soldiers according to the provisions of the State Budget Law.

3. Provincial and centrally governed city People's Committees are responsible for directing and organizing the implementation of tuition fee exemptions for the children of non-commissioned officers and soldiers within their jurisdiction according to this Circular.

1. Funds for the implementation of emergency hardship allowances for the families and relatives of non-commissioned officers and soldiers are guaranteed by the state budget and allocated in the annual budget of the Ministry of Public Security.

2. Funds for the implementation of tuition fee exemptions for the children of non-commissioned officers and soldiers when studying at public and private preschools and primary-secondary schools are guaranteed by local budgets.

Article 7. Source of funds

1. This Circular takes effect from February 12, 2014.

2. Circular Jointly Issued No. 05/2011/TTLT-BCA-BTC dated August 2, 2011, of the Ministry of Public Security and the Ministry of Finance, guiding the implementation of Decree No. 54/2008/NĐ-CP dated April 24, 2008, of the Government on policies for the relatives of non-commissioned officers and soldiers serving limited terms in the People's Public Security Force, ceases to be effective from the date this Circular takes effect.

Article 8. Effective Date

Policies stipulated in this Circular shall be implemented from September 14, 2013.

During the implementation process, if there are any difficulties, please report to the relevant ministries and agencies for consideration and resolution./.
