Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Science and Technology dated June 18, 2013;
Pursuant to Decision No. 650/QĐ-TTg dated April 24, 2006 of the Prime Minister approving the Charter of the Vietnam Union of Science and Technology Associations;
At the proposal of the Minister of Science and Technology,
The Prime Minister promulgates this Decision on advisory, critical review, and social appraisal activities of the Vietnam Union of Science and Technology Associations.
Article 1. Scope of Regulation and Applicability
2. Applicability:
This Decision stipulates advisory, critical review, and social appraisal activities of the Vietnam Union of Science and Technology Associations concerning important policies and major programs and projects on science and technology, education and training, and policies for building and developing intellectual personnel.

This Decision applies to the Vietnam Union of Science and Technology Associations (referred to as the Union of Associations) and national specialized science and technology associations and provincial-level unions of science and technology associations under central cities (hereinafter referred to as member associations), relevant agencies, organizations, and individuals.
Article 2. General Provisions
1. Advisory activity involves providing knowledge, experience, information, materials, analysis, evaluation, and recommendations to competent individuals or organizations.
2. Critical review activity involves making comments, evaluations, criticisms, and recommendations regarding the appropriateness of project content with respect to established goals and conditions or current realities.
3. Appraisal activity involves determining the scientific nature, practicality, and feasibility of a project or specific issue or event.
4. Advisory, critical review, and appraisal activities of the Union of Associations and member associations are social activities (collectively referred to as social advisory, critical review, and appraisal activities), independent and objective, not for profit.
5. The Union of Associations and member associations have the responsibility to organize and mobilize the intellect of Vietnamese science and technology intellectuals to carry out social advisory, critical review, and appraisal activities contributing to policy and legal formulation by the Party and State.
Article 3. Types of Projects Subject to Social Advisory, Critical Review, and Appraisal
1. Projects requiring social advisory, critical review, and appraisal by the Union of Associations and member associations:
a) Projects concerning important policies of the Party;
b) Major national programs, projects, and works; large-scale programs, projects, strategies, plans for the development of science and technology, education and training, and policies for building and developing intellectual personnel within the decision-making and approval authority of the National Assembly, Government, and Prime Minister;
c) Large-scale programs, projects, and important policies of provinces and centrally-administered cities related to science and technology, education and training, and intellectual personnel development.
2. Projects commissioned by central and provincial-level Party and State agencies for the Union of Associations and member associations to conduct social advisory, critical review, and appraisal.
3. Projects not specified in Clause 1 and Clause 2 of this Article proposed by the Union of Associations and member associations for social advisory, critical review, and appraisal, with the consent of the competent authority.
Article 4. Requirements for the Content of Advisory, Critical Review, and Social Appraisal Reports
1. To have scientific and practical bases, be independent and objective to provide additional information and grounds for agencies receiving advisory, critical review, and social appraisal services in building, reviewing, approving, and implementing projects.
2. To propose solutions and recommendations to ensure the feasibility of the project.
Article 5. Procedures and Formalities for Soliciting Advisory, Critical Review, and Social Appraisal Opinions
1. For projects specified in Points a and b Clause 1 Article 3 of this Decision, the main agencies of the projects shall seek opinions from the Vietnam Association for Science and Technology and its member associations; for projects specified in Point c Clause 1 Article 3 of this Decision, local main agencies shall seek opinions from the Provincial or Central City Association for Science and Technology (referred to as the local association).
2. The procedures, formalities, time for soliciting opinions, and deadlines for submitting advisory, critical review, and social appraisal reports for projects specified in Clause 1 of this Article shall be carried out similarly to the process of soliciting participation and responses from Ministries, Sectoral Agencies.
3. For projects specified in Clause 2 Article 3 of this Decision, the solicitation of advisory, critical review, and social appraisal opinions shall be conducted according to the requirements of the ordering agency.
4. For projects specified in Clause 3 Article 3 of this Decision, the Vietnam Association for Science and Technology and its member associations shall proactively organize advisory, critical review, and social appraisal activities and submit the results to competent authorities for consideration and decision.
Article 6. Responsibilities of Agencies Soliciting Advisory, Critical Review, and Social Appraisal Opinions
1. To provide sufficient and timely information and materials, ensuring conditions regarding time, funding, and the use of facilities (based on prior agreement) for the Vietnam Association for Science and Technology or its member associations.
For projects specified in Clause 3 Article 3 of this Decision, depending on specific capabilities, the main agency of the project or the competent authority shall facilitate the Vietnam Association for Science and Technology and its member associations in conducting advisory, critical review, and social appraisal activities.
2. To receive, study, and adopt recommendations and proposals in advisory, critical review, and social appraisal documents to improve the project; to respond to dissenting opinions.
Article 7. Responsibilities of the Vietnam Association for Science and Technology and Its Member Associations
1. To comply with the requirements for the content and time of submitting advisory, critical review, and social appraisal reports as stipulated in Article 4 and Clauses 2 and 3 Article 5 of this Decision and to ensure the objectives of advisory, critical review, and social appraisal activities.
2. To manage and keep confidential project files and materials provided in accordance with regulations, and return technical means if they were assigned to use upon completion of the task.
Article 8. Financial Mechanism
1. The financial resources for implementing advisory, critical review, and social appraisal activities for projects specified in Article 3 of this Decision shall be allocated annually from the state budget for science and technology affairs. The Vietnam Association for Science and Technology has the responsibility to mobilize other legitimate sources of funds to implement advisory, critical review, and social appraisal activities.
Annually, the Vietnam Association for Science and Technology shall prepare plans for the content and budget estimates for advisory, critical review, and social appraisal activities for projects specified in Points a and b Clause 1, Clause 2, and Clause 3 Article 3 of this Decision, and send them to the Ministry of Science and Technology and the Ministry of Finance for consolidation in the state budget expenditure plan for implementation.
For provinces and centrally-administered cities, local associations shall prepare plans for the content and budget estimates for advisory, critical review, and social appraisal activities for projects specified in Point c Clause 1, Clause 2, and Clause 3 Article 3 of this Decision, and send them to the Department of Finance for consolidation in the local budget expenditure plan for implementation.
2. The financial resources for implementing advisory, critical review, and social appraisal activities of the Vietnam Association for Science and Technology and its member associations for projects not ordered by the agencies specified in Clause 2 Article 3 of this Decision shall be implemented based on contracts in accordance with the law.
3. The Ministry of Finance shall issue guidelines for implementing the financial mechanism for advisory, critical review, and social appraisal activities of the Vietnam Association for Science and Technology and local associations as stipulated in this Article.
Article 9. Effective Date
This Decision takes effect from April 5, 2014. Decision No. 22/2002/QĐ-TTg dated January 30, 2002 of the Prime Minister ceases to be effective from the date this Decision comes into force.
Article 10. Implementation Organization
The Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Heads of Central Agencies, Chairpersons of People's Committees of provinces and centrally-administered cities, and related agencies and organizations are responsible for enforcing this Decision./.
