Amending and supplementing some articles of Circular Joint Circular No. 20/2014/TTLT-BGDĐT-BTC-BLĐTBXH dated May 30, 2014 of the joint ministries of Education and Training, Finance, and Labor, Invalids and Social Affairs guiding the implementation of some provisions of Government Decree No. 49/2010/NĐ-CP dated May 14, 2010 on exemption, reduction of tuition fees, support for educational expenses, and mechanisms for collecting and using tuition fees for educational institutions under the national education system from the 2010-2011 academic year to the 2014-2015 academic year and Government Decree No. 74/2013/NĐ-CP dated July 15, 2013 amending and supplementing some provisions of Government Decree No. 49/2010/NĐ-CP The Ministers of Education and Training, Finance, and Labor, Invalids and Social Affairs promulgate this Joint Circular amending and supplementing some provisions of Joint Circular No. 20/2014/TTLT-BGDĐT-BTC-BLĐTBXH guiding the implementation of some provisions of Government Decree No. 49/2010/NĐ-CP dated May 14, 2010 on exemption, reduction of tuition fees, support for educational expenses, and mechanisms for collecting and using tuition fees for educational institutions under the national education system from the 2010-2011 academic year to the 2014-2015 academic year and Government Decree No. 74/2013/NĐ-CP dated July 15, 2013 amending and supplementing some provisions of Government Decree No. 49/2010/NĐ-CP (hereinafter referred to as Joint Circular No. 20). Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
1. Point c Clause 2 Article 5 is amended as follows:
"c) Students graduating from junior high school who enroll in vocational secondary or specialized secondary schools."
2. The first part of Clause 1 Article 7 is amended and supplemented as follows:
"Within thirty days from the start of the academic year, parents (or guardians) of preschool children, primary and secondary students studying at regular education centers; students and trainees studying at vocational education institutions and higher education institutions shall submit applications for exemption, reduction of tuition fees, and support for educational expenses to the educational institution as follows:
- For those eligible for exemption or reduction of tuition fees for preschool, primary, and regular education: Form according to Appendix I.
- For those eligible for support for educational expenses for preschool, primary, and regular education: Form according to Appendix II.
- For those eligible for exemption or reduction of tuition fees at vocational education and higher education institutions: Form according to Appendix III."
3. The second bullet point of Point a Clause 1 Article 7 is amended and supplemented as follows:
"- Decision on social assistance issued by the Chairman of the People's Committee of the district for the subjects specified in Clause 2 Article 4 of this Circular, which are preschool children, orphaned primary school students without guardianship; Certificate issued by the People's Committee of the commune for the subjects being orphaned students and trainees; Conclusion of the Social Assistance Review Board of the commune (Form No. 01 - issued together with Circular No. 26/2012/TT-BLĐTBXH dated November 12, 2012 of the Ministry of Labor, Invalids and Social Affairs) for the subjects specified in Clause 2 Article 4 of this Circular, which are preschool children and disabled students and trainees, and certificate of poverty or near-poor household issued by the People's Committee of the commune."
4. The first bullet point of Clause 1 Article 8 is amended and supplemented as follows:
"- Department of Education and Training: For preschool children, primary school students eligible for support for educational expenses, and junior high school students (model form for reimbursement of exempted or reduced tuition fees according to Appendix IV; model form for support for educational expenses according to Appendix II)."
5. The third paragraph of Article 9 is amended and supplemented as follows:
"The state budget funds allocated to subsidize tuition fees for preschool, primary, and regular education institutions, vocational education institutions, and public higher education institutions shall be recorded in the revenue account of these institutions and may be independently used in accordance with current regulations on financial autonomy of public service units."
6. Clause 1 Article 10 is amended and supplemented as follows:
"1. The Department of Education and Training is responsible for directly paying and settling the educational expense support funds in cash to parents (or guardians) of preschool children, primary school students, and junior high school students, or authorizing educational institutions to pay."
7. Clause 2 Article 10 is amended and supplemented as follows:
"2. The Department of Education and Training is responsible for directly paying and settling the educational expense support funds in cash to parents (or students) of secondary school students, trainees at regular education centers, and students at other educational institutions managed by the Department of Education and Training, or authorizing educational institutions to pay."
8. Clause 1 Article 11 is amended and supplemented as follows:
"1. The Department of Education and Training is responsible for directly paying and settling the funds for subsidizing tuition fees and supporting educational expenses in cash (or authorizing educational institutions to pay) to parents (or guardians) of preschool children, primary school students, and junior high school students."
9. Clause 8 Article 17 is amended and supplemented as follows:
"8. For learners at preschool, primary, vocational, and higher education institutions who have submitted complete application forms before August 31, 2013 but have not yet received support payments as stipulated in Joint Circular No. 29/2010/TTLT-BGDĐT-BTC-BLĐTBXH dated November 15, 2010 of the joint ministries of Education and Training, Finance, and Labor, Invalids and Social Affairs guiding the implementation of some provisions of Government Decree No. 49/2010/NĐ-CP, the following measures will be implemented:
- District-level Departments of Labor, Invalids and Social Affairs continue to pay exempted or reduced tuition fees for the 2012-2013 academic year for learners at vocational and higher education institutions and provide support for educational expenses for the 2012-2013 academic year for learners at preschool and primary education institutions.
"8. For students at preschool, general secondary education, vocational education, and higher education institutions who have submitted complete application files before August 31, 2013 but have not yet received support funds as prescribed in Circular Joint Circular No. 29/2010/TTLT-BGDĐT-BTC-BLĐTBXH dated November 15, 2010 issued by the Ministry of Education and Training, the Ministry of Finance, and the Ministry of Labor, Invalids, and Social Affairs guiding the implementation of certain provisions of Decree No. 49/2010/NĐ-CP, the following shall be carried out:
- The Departments of Labor, Invalids, and Social Affairs at district level shall continue to disburse tuition exemption and reduction funds for the 2012-2013 academic year for students at vocational education and higher education institutions, and provide study cost subsidies for the 2012-2013 academic year for students at preschool and general secondary education institutions."
- The Departments of Education and Training shall continue to pay tuition exemption and reduction for the 2012-2013 academic year for students at non-state-run early childhood education and general education institutions.
10. Supplement Clause 9 to Article 17 as follows:
"9. In cases where there are objective reasons, for the 2012-2013 academic year, students who are eligible for tuition exemption and reduction and financial support for educational expenses submit their application for such exemption, reduction, and support for the 2010-2011 and 2011-2012 academic years: Localities shall only consider and resolve applications submitted with all necessary documents before December 31, 2012, in accordance with Circular Joint Circular No. 29/2010/TTLT-BGDĐT-BTC-BLĐTBXH.
In cases where there are objective reasons, for the 2014-2015 academic year, students who are eligible for tuition exemption and reduction and financial support for educational expenses submit their application for such exemption, reduction, and support for the 2013-2014 and 2014-2015 academic years: Localities and educational institutions shall only consider and resolve applications submitted with all necessary documents before December 31, 2015, in accordance with Joint Circular No. 20.
Article 2. Effective Date
1. This Circular takes effect from September 1, 2015.
The regulations guiding this Circular shall be implemented from September 1, 2013.
2. During the implementation process, if there are any difficulties, ministries, sectors, and localities shall report to the Ministry of Education and Training for coordination with the Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs to study and resolve them./.
