CIRCULAR

Amending and supplementing certain articles of Circular No. 33/2012/TT-BCA dated June 11, 2012, issued by the Minister of Public Security on the regulations regarding payment for annual leave in the People's Public Security Forces

Pursuant to Decree No. 60/2003/NĐ-CP dated 06 the 6 year 2003 of the Government detailing and guiding the implementation of the Law on State Budget Management;FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSto implement the Law on State Budget;âThis Circular takes effect from April 29, 2016.

means the failure of a civil servant to perform or perform inadequately their assigned duties or fail to comply with relevant legal provisions while carrying out specific public service activities. ahereby promulgates this Circular amending and supplementing Circular No., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPprovisions of Circular No. 24/2015/TT-BTTTT dated August 18, 2015 of the Minister of Information and Communications đ1. Supplement Clause 25 to Article 3 as follows:No. 33/2012/TT-BCA dated 11 ENVIRONMENTJune 2024;June 11, 2012, issued by the Minister of Public Security on the regulations concerning payment for annual leave in the People's Public Security Forces (Circular No. 33/2012/TT-BCA).ngArticle 1. Amend and supplement certain articles of Circular No. 33/2012/TT-BCA as follows:on 1. Amend Clause 1 of Article 6 as follows:无效 roadDeclaration, re-declaration"Cadres and soldiers who work in mountainous, remote, border, and island areas with a regional allowance coefficient of 0.5 or higher (as prescribed in Joint Circular No. 11/2005/TTLT-BNV-BLDTBXH-BTC-UBDT dated January 5, 2005, issued by the Ministry of Home Affairs, the Ministry of Labor, Invalids and Social Affairs, the Ministry of Finance, and the Committee for Ethnic Minorities guiding the implementation of regional allowances) and those from mountainous, remote, border, and island areas with a regional allowance coefficient of 0.5 or higher working in lowland areas, if they meet the conditions for annual leave as stipulated by current laws, shall be granted leave by their unit leaders to visit family, parents, spouse, children, or their hometown."â2. Amend Clause 1 of Article 8 as follows:

"1. The subjects entitled to salary payment:

a) Officers awaiting retirement; officers, non-commissioned officers, and soldiers who have been discharged due to disability, demobilized to their place of origin, deceased, or for other reasons without having taken annual leave or without having completed their annual leave;"

b) Police workers and contractual employees entitled to salary payment for days not taken as annual leave as stipulated in Article 114 of the Labor Code 2012."

3. Amend Clause 1 of Article 11 as follows:

"1. The procedures for salary payment for days not taken as annual leave include:

a) Decision on retirement;

b) Decision on disability discharge;

c) Decision on demobilization to place of origin;

d) Death certificate;

e) Recruitment decision;

f) Labor contract;

g) Confirmation from the agency or unit regarding the termination of employment, loss of job, or other reasons."

4. Amend Clause 3 of Article 12 as follows:

"3. If cadres and soldiers have a need and obtain approval from their unit leaders, they may take leave in a lump sum over a maximum period of three years and will only be paid once for annual leave according to the provisions of Article 7 of this Circular. The leave period should be scheduled for the last year within the combined period."

5. Supplement Clause 3 of Article 15 as follows:

"3. During the implementation process, if the referenced documents applied in this Circular are amended, supplemented, or replaced by new documents, then the new documents shall be applied."

This Circular takes effect from April 29, 2016.

1. The Director of the Financial Department is responsible for leading and coordinating with relevant units to urge and inspect the implementation of this Circular.

2. Directors of General Departments, Commanders, and Heads of Units under the Ministry; Directors of Public Security, Fire Prevention and Fighting in provinces and centrally-administered cities are responsible for implementing this Circular. In the course of implementation, if there are difficulties or obstacles, local public security units shall report to the Ministry of Public Security (through the Financial Department) for timely guidance.

Article 2. Effective Date

1. The Director of the Financial Department shall be responsible for leading and coordinating with relevant units to urge and inspect the implementation of this Circular.

Article 3. Responsibility for Implementation

2. The Heads of General Departments, Commanders, and Heads of units under the Ministry; Directors of Public Security, Fire Prevention and Fighting Departments of provinces and centrally governed cities shall be responsible for implementing this Circular. In case of difficulties or obstacles during the implementation process, local public security units shall report to the Ministry of Public Security (through the Financial Department) for timely guidance.
