CIRCULAR

REGULATIONS ON THE DEVELOPMENT, REVIEW AND ISSUANCE OF ECONOMIC-TECHNICAL STANDARDS FOR TRAINING APPLICABLE IN THE FIELD OF VOCATIONAL EDUCATION

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Decree No. 1Pursuant to Decree No. 6/2015/NĐ-CP dated February 14, 2015 of the Government on the autonomy of public service units;policies Pursuant to Decree No. 48/2015/NĐ-CP dated May 15, 2015 of the Government detailing certain provisions of the Vocational Education Law;

Considering the proposal of the General Department of Vocational Education;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."hereinafter referred to as the DecreeDeputy ministers of ministerial-level agencies, The Minister of Labor, Invalids and Social Affairs issues this Circular on the development, review and issuance of economic-technical standards for training applicable in the field of vocational education.

1. This Circular regulates the development, review and issuance of economic-technical standards for training applicable in the field of vocational education.

2. This Circular applies to agencies, organizations, and individuals implementing the development, review and issuance of economic-technical standards for training applicable in the field of vocational education managed by the Ministry of Labor, Invalids and Social Affairs.rime Minister c1. Economic-technical standards for training applicable in the field of vocational education (hereinafter referred to as economic-technical standards) are the quantities of consumption of factors such as labor, materials, and equipment required to complete the training of one student to meet the criteria and standards set by competent authorities. Economic-technical standards include three basic component standards: labor standards, equipment standards, and material standards.For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.2. Labor standards are the levels of living labor consumption necessary for workers according to their specialties and professions to complete the training of one student to meet the criteria and standards set by competent authorities.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

3. Equipment standards are the periods of time required for the use of equipment necessary for each type of equipment to complete the training of one student to meet the criteria and standards set by competent authorities.

4. Material standards are the levels of consumption of each type of raw materials and materials necessary to complete the training of one student to meet the criteria and standards set by competent authorities.

Article 2. Interpretation of Terms

In this Circular, certain terms are understood as follows:

1. To serve as a basis for determining costs in vocational education activities to enhance effectiveness, thrift, and efficiency.

2. To serve as a basis for developing and implementing plans, managing economics, finance, and quality control in vocational education activities.

3. To promote socialization in the field of vocational education, creating a fair operating environment between public and non-public vocational education institutions.

Article 4. Classification of economic-technical standards

Article 3. Objectives for establishing and promulgating economic and technical norms

1. Sectoral economic-technical standards: These are economic-technical standards developed, reviewed, and issued by the Ministry of Labor, Invalids and Social Affairs in collaboration with relevant ministries and sectors. Sectoral economic-technical standards apply nationwide.

2. Provincial economic-technical standards (hereinafter collectively referred to as localities): These are economic-technical standards developed, reviewed, and issued by localities for industries and trades listed in the catalog of public services funded by the state budget within their jurisdiction. Local economic-technical standards only have effect within the management scope of the locality. Localities may consider applying sectoral economic-technical standards and those of other localities that have been issued.

3. Institutional economic-technical standards: These are economic-technical standards developed, reviewed, and issued by colleges, technical schools, and vocational education centers (collectively referred to as vocational education institutions). Institutional economic-technical standards are only issued for industries and trades registered for vocational education activities or when it is necessary to specify sectoral economic-technical standards or local economic-technical standards to suit the conditions and characteristics of the vocational education institution. Institutional economic-technical standards only apply within the vocational education institution.

1. Ensuring accuracy and completeness to complete the training of students to meet the criteria, standards, and quality as stipulated by current regulations.

2. Meeting general requirements regarding the structure of various types of economic-technical standards, ensuring advanced, stable, consistent, and inherited nature of previous economic-technical standards.

1. National occupational skill standards, national qualification frameworks, minimum knowledge volume requirements, ability requirements that students must achieve upon graduation, output standards, training programs (depending on the type of economic-technical standards specified in Article 4 of this Circular, the agency organizing the development of economic-technical standards may choose one or more of these bases).

2. Current laws and regulations on working hours for vocational education teachers.

Article 5. Principles of establishing economic and technical norms

3. Actual operational conditions of vocational education institutions.

1. Comprehensive statistical method Based on annual statistics or reports (statistical data must be reliable and legally valid over a continuous period of three years prior to the development of economic-technical standards) and based on experience or comparative parameters to develop economic-technical standards.

Article 6. Basis for establishing economic and technical norms

2. Standard method Based on existing standards and regulations to determine consumption levels for each task, from which economic-technical standards are calculated.

3. Experimental analysis method Based on conducting surveys and experiments according to each process and content of work to analyze and calculate each factor constituting the standard (selecting tasks that cannot be determined through the above two methods or can be determined but not accurately enough and require practical verification).

3. Actual conditions of operation of vocational education institutions.

4. Annual statistical data and related documents.

Article 7. Methods for Establishing Economic and Technical Norms

1. Comprehensive statistical method Based on annual statistical data or periodic reports (statistical data must ensure reliability and legality for a continuous period of three years prior to the time of establishing economic and technical norms) and based on experience or comparative parameters to establish economic and technical norms.

2. Standard method Based on established standards and regulations to determine consumption levels for each task, from which to calculate and establish economic and technical norms.

3. Experimental analysis method On the basis of conducting surveys and experiments according to each process and content of work to analyze and calculate each component factor of the norm (selecting tasks that cannot be determined through the above two methods or can be determined but not accurately enough, requiring practical verification).

Article 8. Content of Economic and Technical Norms

Apply one or more methods prescribed in Article 7 of this Circular to establish component norms:

1. Labor norm Labor norm = Direct labor norm (teaching) + Indirect labor norm (management, service).

- Direct labor norm is the time for theoretical and practical teaching;

- Indirect labor norm is defined as a percentage (%) of direct labor;

2. Equipment Quotas

- Determine the type of equipment;

- Determine the basic technical parameters of the equipment;

- Determine the usage time for each type of equipment: Including loaded machine running time (consumption of materials) and unloaded machine running time (no consumption of materials);

- Aggregate equipment norms.

Equipment serving management and service activities of indirect labor at vocational education institutions shall not be included in the equipment norms.

3. Material norm

- Determine the type of materials;

- Determine the quantity/volume of materials according to each type: Based on the type of equipment and the loaded machine running time (material consumption);

- Determine the recovery rate (%) of materials: Based on the characteristics and nature of the materials to calculate the recovery rate (%);

- Determine the basic technical requirements for materials: Describe the technical parameters of each type of material suitable for training.

Chapter II

PROCEDURE FOR BUILDING, REVIEWING AND ISSUING ECONOMIC AND TECHNICAL NORMS IN TRAINING

Article 9. Establishment of the Steering Committee for Building Economic and Technical Norms and the Review Board for Economic and Technical Norms

1. The Steering Committee for Building Economic and Technical Norms

a) The agency assigned the task of organizing the building of economic and technical norms (as stipulated in Article 4 of this Circular) decides to establish the Steering Committee for Building Economic and Technical Norms for each training profession (hereinafter referred to as the Steering Committee).

b) Composition of the Steering Committee

- The Steering Committee has 07 or 09 members. The number of Steering Committee members is determined based on the workload of each profession requiring the establishment of economic and technical norms;

- The Steering Committee consists of: Chairperson, Deputy Chairperson, and members, including one member兼任Steering Committee Secretary;

- Members of the Steering Committee are teachers, managers, and technical scientific staff with professional qualifications in the field of establishing economic and technical norms.

c) Criteria for Steering Committee members

- Hold a bachelor's degree or higher;

- Have at least five years of experience in the field requiring the establishment of economic and technical norms and currently working in relevant fields;

d) Responsibilities and authorities of the Steering Committee

- Responsible for organizing the process of establishing economic and technical norms for the assigned profession;

- Responsible for the content and quality of economic and technical norms; report to the Review Board; complete and hand over draft proposals after being reviewed and found satisfactory for issuance;

- Implement financial expenditures and bear responsibility for the accuracy, reasonableness, and legality of expenditure vouchers in accordance with current regulations.

2. The Review Board for Economic and Technical Norms

a) The agency issuing economic and technical norms (as stipulated in Article 4 of this Circular) decides to establish the Review Board for Economic and Technical Norms (hereinafter referred to as the Review Board) and specifies its functions, tasks, and principles of operation.

b) Composition of the Review Board

- The Review Board has 07 or 09 members, the number of Review Board members depends on the workload of each profession requiring the establishment of economic and technical norms;

- The Review Board consists of: Chairman, Vice-Chairman, and members, including one member兼任Review Board Secretary;

- Members of the Review Board are teachers, managers, and technical scientific staff with professional qualifications in the field of establishing economic and technical norms.

c) Criteria for Review Board members

- Hold a bachelor's degree or higher;

- Have at least five years of experience in the field requiring the establishment of economic and technical norms and currently working in relevant fields.

Article 10. Procedure for organizing the establishment, examination, and issuance of economic and technical norms

Step 1: Preparation

The agency assigned to organize the establishment of economic and technical norms shall provide training on methods and procedures for establishing and examining these norms for the Steering Committee and the Examination Board.

Step 2: Drafting the general outline and detailed outline

The Steering Committee shall lead the implementation of:

- Drafting the general outline and detailed outline;

- Organizing meetings and discussions on the draft outlines and developing implementation plans.

Step 3: Based on the grounds stipulated in Article 6 of this Circular, the Steering Committee shall implement the establishment of economic and technical norms for each specific content (work, subject, module, credit, implementation capacity) of the profession or trade that needs to be established, for each level of education according to the contents specified in Article 8 of this Circular.

Step 4: Soliciting opinions on the draft economic and technical norms

- Organizing a workshop (with at least 20 participants) to perfect the economic and technical norms;

- Soliciting opinions from independent experts (at least 15 experts) on the economic and technical norms.

Step 5: Surveying to evaluate and perfect the draft economic and technical norms

The Steering Committee shall conduct surveys at vocational education institutions, production, business, and service establishments (at least 15 establishments).

Step 6: Editing and compiling the draft economic and technical norms

Based on expert opinions and survey results, the Steering Committee shall revise, perfect, and compile the economic and technical norms according to the format model (Annexes 1 and 2 attached).

Step 7: Examining the economic and technical norms

The agency assigned to organize the establishment of economic and technical norms shall organize the examination of the draft economic and technical norms.

- Prepare an examination plan and send relevant materials to the members.

- Members of the Examination Board shall study the draft economic and technical norms and related materials to prepare written comments and evaluations on the draft economic and technical norms and report to the Chairman of the Examination Board.

- Notify the Steering Committee about the time, location, and content of the examination meeting of the Examination Board.

Step 8: Content of the examination meeting

- The Steering Committee reports the draft economic and technical norms; - The Steering Committee answers questions from the Examination Board;

- Members of the Examination Board discuss and publicly evaluate the draft economic and technical norms;

- Members of the Examination Board assess the quality of the draft economic and technical norms through secret ballot according to the following levels:

Level 1: Meets the requirement for issuance.

Level 2: Meets the requirement but needs revision before issuance.

Level 3: Does not meet the requirement and needs to be rebuilt.

- The Chairman of the Examination Board compiles the opinions of the members of the Examination Board and concludes on the quality of the norms based on the consensus of all members participating in the meeting (according to one of the three levels specified above). If the draft economic and technical norms need to be revised, the Chairman will request detailed revisions. In cases where the draft does not meet requirements and must be rebuilt, the Chairman will decide on the organization of another examination for the Steering Committee to complete the file according to the conclusion of the Chairman of the Examination Board;

- The Chairman of the Examination Board compiles and reports to the agency assigned to organize the establishment of economic and technical norms on the examination results.

Step 9: Issuing the economic and technical norms.

Based on the minutes of the examination, the conclusions of the examination, and the report on revisions (if any), the Minister of Labor, Invalids, and Social Affairs; the Minister or Head of an equivalent agency, the Chairman of the People's Committee of a provincial-level city directly under the Central Government; the head of a vocational education institution shall sign to issue the economic and technical norms within their authority.

The agency assigned to organize the establishment of economic and technical norms shall guide, inspect, and supervise the process of establishing and examining the economic and technical norms.

Article 11. Adjustment and supplementation of economic and technical norms

1. The adjustment and supplementation of economic and technical norms shall be carried out when the issued economic and technical norms are no longer suitable for new conditions regarding organizational implementation and technical standards and quality as prescribed by competent state agencies.

2. When there is a need to adjust and supplement economic and technical norms, the competent agency or unit shall develop plans and implement adjustments and supplements in accordance with the provisions of this Circular.

Chapter III

IMPLEMENTATION

Article 12. Responsibilities of the Ministry of Labor - Invalids and Social Affairs

1. Organize the construction, examination, issuance, and guidance on the implementation and application of sectoral economic and technical norms.

2. Regularly review and promptly adjust and supplement sectoral economic and technical norms that have been issued to suit annual and phase-specific socio-economic conditions, characteristics, and situations.

3. Develop plans according to a timeline and allocate resources to implement the construction and issuance of economic and technical norms; compile comprehensive information on the implementation of economic and technical norms in the vocational education sector nationwide.

4. Inspect and supervise the construction and application of economic and technical norms in the vocational education sector.

Article 13. Responsibilities of Ministries and Sectors

1. Guide and inspect the application of economic and technical norms at vocational education institutions under their management authority.

2. Monitor, compile, and submit periodic reports before December 20 each year on the implementation of economic and technical norms at vocational education institutions under their management to the Ministry of Labor, Invalids, and Social Affairs.

Article 14. Responsibilities of People's Committees of Provinces and Central Cities

1. Guide and inspect the application of economic and technical norms at vocational education institutions under their management authority.

2. Organize the construction and issuance of provincial and central city economic and technical norms in accordance with the authority stipulated in Article 4 of this Circular.

3. Monitor, compile, and submit periodic reports before December 20 each year on the implementation of economic and technical norms at vocational education institutions under their management to the Ministry of Labor, Invalids, and Social Affairs.

Article 15. Responsibilities of Vocational Education Institutions

1. Manage and apply economic and technical norms in training activities and report to the direct management agency and the state management agency for vocational education at the local level before December 15 each year.

2. Organize the construction and issuance of institutional economic and technical norms in accordance with the authority stipulated in Article 4 of this Circular.

Article 16. Implementation expenses

1. The budget for constructing sectoral economic and technical norms shall be guaranteed from the central government budget within the annual budget allocated to the Ministry of Labor, Invalids, and Social Affairs.

2. The budget for constructing provincial and central city economic and technical norms shall be guaranteed within the annual expenditure budget of the agency or unit assigned to construct them.

3. The budget for constructing institutional economic and technical norms shall be guaranteed from the funds of vocational education institutions.

Article 17. Effective Date

This Circular takes effect from July 10, 2017

During implementation, if difficulties arise, they should be reported to the Ministry of Labor, Invalids, and Social Affairs for guidance or coordination in resolution./.
