Circular No. 14/2019/TT-BKHCN promulgates the "National technical regulation on liquefied petroleum gas (LPG)"

CIRCULAR

Issuing the "National Technical Regulation on Liquefied Petroleum Gas (LPG)"       On the basis of the Law on Standards and Technical Regulations dated June 29, 2006; ”

      On the basis of Decree No.

127/2007/ND-CP 78/2018/ND-CP dated August 1, 2007, issued by the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations and Decree No. dated May 16, 2018 of the Government amending and supplementing some articles of Decree No.          On the basis of Decree No. 78/2018/ND-CP dated August 1, 2007, issued by the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

95/2017/ND-CP dated August 16, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;         Pursuant to the proposal of the Director General of the Standardization and Quality Control Agency and the Director of the Legal Department.

        The Minister of Science and Technology issues this Circular to issue the "National Technical Regulation on Liquefied Petroleum Gas (LPG)".

This Circular promulgates the National Technical Regulation on Liquefied Petroleum Gas (LPG) (QCVN 08:2019/BKHCN) along with it.

Article 1. This Circular takes effect from January 1, 2020.

Article 2. Effectiveness

a) Circular No. 10/2012/TT-BKHCN dated April 12, 2012, issued by the Minister of Science and Technology on the issuance and implementation of the National Technical Regulation on Liquefied Petroleum Gas (QCVN 8:2012/BKHCN).

2. The following provisions shall cease to be effective from the date this Circular takes effect:

b) Article 2 of Circular No. 13/2013/TT-BKHCN dated April 12, 2013, issued by the Minister of Science and Technology amending and supplementing certain provisions of Circulars No. 21/2011/TT-BKHCN, No. 10/2012/TT-BKHCN, and No. 11/2012/TT-BKHCN issued by the Minister of Science and Technology.

Transitory Provisions

Article 3. Liquefied Petroleum Gas (LPG) imported, produced, processed, and blended before January 1, 2021 shall continue to be circulated in the market until December 31, 2021, subject to management under the legal regulations defined in points a and b of Clause 2, Article 2 of this Circular.

Implementation Schedule for QCVN

Article 4. 1. As of January 1, 2021, LPG imported, produced, processed, and blended must meet the requirements set forth in QCVN 08:2019/BKHCN when circulating in the market.

2. Encourage enterprises, organizations, and individuals importing, producing, processing, and blending LPG to apply the requirements stipulated in QCVN 08:2019/BKHCN from the date this Circular takes effect.

1. The Director General of the Standardization and Quality Control Agency is responsible for organizing guidance and implementation of this Circular.

Article 5. Implementation

2. The Minister, Heads of Ministries equivalent to ministries, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities, and related organizations and individuals are responsible for implementing this Circular.

3. During the implementation process, if any issues arise, agencies, organizations, and individuals should reflect them in writing to the Ministry of Science and Technology for guidance or research to amend and supplement accordingly./.

3. During the implementation process, if aquatic organisms that mimic others are discovered, agencies, organizations, and individuals shall report in writing to the Ministry of Science and Technology for guidance or to study amendments and supplements as appropriate./.
