CIRCULAR
AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 127/2018/TT-BTC DATED DECEMBER 27, 2018 OF THE MINISTER OF FINANCE ON SERVICE PRICES IN THE SECURITIES SECTOR APPLICABLE AT THE HO CHI MINH CITY SECURITIES EXCHANGE AND VIETNAM SECURITIES DEPOSITORY TO SUPPORT ORGANIZATIONS AND INDIVIDUALS AFFECTED BY THE COVID-19 OUTBREAK
The Government issues this Decree amending and supplementing Clause 2, Article 12 of Decree No. 91/2015/NĐ-CP dated October 13, 2015 of the Government on state capital investment in enterprises and management and use of capital and assets in enterprises, which has been amended and supplemented at Clause 5, Article 1 of Decree No. 32/2018/NĐ-CP dated March 8, 2018 of the Government amending and supplementing some articles of Decree No. 91/2015/NĐ-CP.
Pursuant to the Law on Fees and Registration Fees dated November 25, 2015;
Pursuant to the Price Law dated June 20, 2012;
Pursuant to the Law on Public Debt Management dated November 23, 2017;
WHEREAS, Decree No. 177/2013/NĐ-CP dated November 14, 2013 and Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain articles of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;
WHEREAS, Decree No. 58/2012/NĐ-CP dated July 20, 2012 and Decree No. 60/2015/NĐ-CP dated June 26, 2015 of the Government amending and supplementing certain articles of Decree No. 58/2012/NĐ-CP dated July 20, 2012 detailing and guiding the implementation of certain provisions of the Securities Law and the Law Amending and Supplementing Certain Provisions of the Securities Law;
WHEREAS, Decree No. 86/2016/NĐ-CP dated July 1, 2016 of the Government on conditions for investment and business in securities and Decree No. 151/2018/NĐ-CP dated November 7, 2018 of the Government amending and supplementing certain decrees on conditions for investment and business under the management of the Ministry of Finance;
WHEREAS, Decree No. 42/2015/NĐ-CP dated May 5, 2017 of the Government on derivative securities and the derivative securities market;
WHEREAS, Decree No. 91/2018/NĐ-CP dated June 26, 2018 of the Government on issuance and management of government guarantees;
WHEREAS, Decree No. 93/2018/NĐ-CP dated June 30, 2018 of the Government on management of local government debt;
Pursuant to Decree No. 95/2018/NĐ-CP dated June 30, 2018 of the Government on the issuance, registration, registration custody, listing, and trading of government debt instruments on the securities market;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Price Management Department, Chairman of the State Securities Commission;
The Minister of Finance hereby promulgates this Circular to amend and supplement certain articles of Circular No. 127/2018/TT-BTC dated December 27, 2018 of the Minister of Finance on service prices in the securities sector applicable at the Ho Chi Minh City Securities Exchange and Vietnam Securities Depository to support organizations and individuals affected by the COVID-19 outbreak.
Article 1. Amend the service price levels stipulated in
Point 2, 3.4, 4, 5.1, 7, 12, 13, 14, 15, 18 Part A; Point 1, 3, 4, 6, 7 Part B of the Service Price List in the securities sector applicable at the Ho Chi Minh City Securities Exchange and Vietnam Securities Depository issued together with Circular No. 127/2018/TT-BTCdated December 27, 2018 of the Minister of Finance as follows:

Article 2. Implementation clause
1. This Circular shall take effect from March 19, 2020 until August 31, 2020. From September 1, 2020 onwards, the service fee levels in the securities sector at the Securities Trading Exchange and the Vietnam Securities Depository shall be implemented according to the provisions of Circular No. 127/2018/TT-BTC dated December 27, 2018 issued by the Minister of Finance. Based on the development of the COVID-19 situation, the Minister of Finance shall consider and decide to extend the application period of this Circular if necessary.
2. On the basis of the service fee levels stipulated in Article 1 of this Circular, organizations providing services in the securities sector as specified in Article 2 of Circular No. 128/2018/TT-BTC dated December 27, 2018 issued by the Minister of Finance shall reduce service fees for securities trading organizations and commercial banks participating in the Vietnamese securities market to support organizations and individuals using services affected by the COVID-19 pandemic in accordance with actual service supply conditions, pricing laws, and related laws.
3. Other contents not provided for in this Circular shall continue to be implemented in accordance with the provisions of Circular No. 127/2018/TT-BTC dated December 27, 2018 issued by the Minister of Finance regarding service fee levels applicable at the Securities Trading Exchange and the Vietnam Securities Depository.
4. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly reflect them to the Ministry of Finance for research and supplementary guidance.
