CIRCULAR
Regulations on standards and conditions for promotion to higher ranks of the profession of Judicial Records

Pursuant to the Law on Judicial Records dated June 17, 2009;
Pursuant to the Law on Public Servants dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Law on Cadres and Civil Servants and the Law on Public Servants dated November 25, 2019;
Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of public servants; Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain provisions of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of public servants;
Pursuant to Decree No. 98/2022/NĐ-CP dated November 29, 2022 of the Prime Minister; Government Decree No. 26/2024/NĐ-CP dated March 1, 2024 of the Government on international cooperation in law management and judicial reform;
At the proposal of Director of the National Judicial Records Center;
The Minister of Justice issues this Circular stipulating standards and conditions for promotion to higher ranks of the profession of Judicial Records. This Circular applies to public servants performing work in the field of Judicial Records at the National Judicial Records Center under the Ministry of Justice; and other agencies, organizations, and individuals related to the promotion of ranks of the profession of Judicial Records.
Article 1. Scope of Regulation
Article 3. General Standards and Conditions for Promotion to Higher Ranks of the Profession of Judicial Records
Article 2. Applicability
1. Meeting the standards and conditions prescribed in Clause 1, Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of public servants (amended and supplemented in Clause 16, Article 1 of Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain provisions of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government).
2. Meeting the general ethical standards and educational qualifications for the profession of Judicial Records as prescribed in Articles 3 and 4 of Circular No. 13/2024/TT-BTP dated November 25, 2024 of the Ministry of Justice stipulating the code number and standards for the profession of Judicial Records (hereinafter referred to as Circular No. 13/2024/TT-BTP).
3. There is a need for positions for the rank of public servant to be promoted at the National Judicial Records Center.
4. Being nominated by the competent authority to participate in the promotion examination.
Article 4. Standards and Conditions for Promotion from Rank II to Rank I of the Profession of Judicial Records Public Servant
A public servant is eligible to be considered for promotion to the rank of Judicial Records Public Servant Rank I, code V.01.01.01 if they meet the standards and conditions stipulated in Article 3 of this Circular and the following standards and conditions:
1. Currently holding the rank of Judicial Records Public Servant Rank II - code V.01.01.02 at the time of submitting the application for the promotion examination.
2. Meeting the professional competence standards for the rank of Judicial Records Public Servant Rank I - code V.01.01.01 as prescribed in Clause 2, Article 5 of Circular No. 13/2024/TT-BTP.
3. Having held the rank of Judicial Records Public Servant Rank II - code V.01.01.02 for at least six years.
In cases where the period of holding the rank of Judicial Records Public Servant Rank II is less than six years but the candidate has held the rank of Senior Specialist and equivalent for a total period of at least six years, including at least one year (12 months) of holding the rank of Judicial Records Public Servant Rank II up to the date of submission of the application for the promotion examination, such candidates may be considered for promotion.
4. During the period of holding the rank of Judicial Records Public Servant Rank II, Senior Specialist and equivalent, having performed one of the tasks specified in Point c, d, đ, e, Clause 1, Article 5 of Circular No. 13/2024/TT-BTP and having a decision or confirmation in writing regarding the performance of these tasks by the competent authority.
In cases where the time served in the position of Career Officer of Judicial Biography Level II has not reached six years or more, but the person being considered for promotion has served in the position of Senior Specialist and equivalent positions, they may be eligible for promotion if the total time served in these positions reaches six years or more, including at least one year (twelve months) serving in the position of Career Officer of Judicial Biography Level II as of the date of submitting the application to register for the promotion examination.
During the period serving in the position of Career Officer of Judicial Biography Level II, Senior Specialist and equivalent positions have performed one of the tasks specified in point c, d, đ, e Clause 1 Article 5 Circular No. 13/2024/TT-BTP and there is a decision or confirmation in writing about the performance of the task by the competent authority.
Article 5. Criteria and conditions for promotion examination from the third-class judicial record officer position to the second-class judicial record officer position
A civil servant may be considered for promotion to the second-class judicial record officer position, code V.01.01.02, when meeting the criteria and conditions stipulated in Article 3 of this Circular and the following criteria and conditions:
1. Currently holding the third-class judicial record officer position - code V.01.01.03 at the time of submitting the application for promotion examination.
2. Meeting the professional competence criteria for the second-class judicial record officer position - code V.01.01.02 as prescribed in Clause 2, Article 6 of Circular No. 13/2024/TT-BTP.
3. Having held the third-class judicial record officer position with code V.01.01.03 for at least nine years.
In cases where the period of holding the third-class judicial record officer position has not reached nine years but the person applying for promotion has held the specialist position and equivalent positions for a total period of at least nine years, they may be eligible for promotion if the minimum period of holding the third-class judicial record officer position is at least one year (12 months) up to the date of submitting the application for promotion examination.
The period of holding the third-class judicial record officer position specified in this clause does not include the probationary or trial periods.
During the period of holding the third-class judicial record officer position, specialist position, and equivalent positions, the individual must have performed one of the tasks prescribed in point c, d, đ, e, Clause 1, Article 6 of Circular No. 13/2024/TT-BTP and must have a decision or written confirmation from the competent authority regarding the performance of these tasks.
Article 6. Implementation Provisions
1. This Circular takes effect from January 15, 2025.
2. In cases where laws on civil servants or normative legal documents cited in this Circular are amended, supplemented, or replaced, implementation shall follow the new provisions in the amended, supplemented, or replacing normative legal documents.
3. The Director of the National Judicial Record Center, the Head of the Cadres and Civil Servants Organization Department, the Heads of units under the Ministry, and individuals and organizations related to this matter are responsible for implementing this Circular.
4. During the implementation process, if there are any difficulties, please report them to the Ministry of Justice for guidance and resolution./.
