CIRCULAR

Regulations on driver training; supplementary training, examination, and issuance of certificates for supplementary legal knowledge on road traffic

BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of state administrative bodies;

Pursuant to Decree No. 160/2024/NĐ-CP dated December 18, 2024 of the Government on driver training and examination activities;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Transport and Road Safety Department and the Director of the Vietnam Highway Administration,

The Minister of Construction hereby promulgates this Circular on driver training; supplementary training, examination, and issuance of certificates for supplementary legal knowledge on road traffic.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates regulations on driver training; supplementary training, examination, and issuance and reissuance of certificates for supplementary legal knowledge on road traffic; standards for institutions conducting supplementary training, examination, and issuance of certificates for supplementary legal knowledge on road traffic for operators of specialized motor vehicles and standards for driver training institutions.

Article 2. Applicability

1. This Circular applies to organizations and individuals related to driver training; supplementary training, examination, and issuance and reissuance of certificates for supplementary legal knowledge on road traffic and standards for institutions conducting supplementary training, examination, and issuance of certificates for supplementary legal knowledge on road traffic for operators of specialized motor vehicles.

2. This Circular does not apply to driver training institutions and organizations providing supplementary training, examination, and issuance of certificates for supplementary legal knowledge on road traffic for military and police forces performing national defense and security duties.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Safe driving timerefers to the period during which the holder of a valid driver's license does not cause serious, very serious, or particularly serious road traffic accidents according to the Ministry of Public Security's regulations on statistics, compilation, management, exploitation, and utilization of databases on road traffic accidents.

2. DAT Data is a collection of information about identification and practical driving training process on roads of trainees, transmitted from the DAT device installed on training cars to the server of the driver training institution.

3. DAT Management Data is a collection of information about identification and practical driving training process on roads of trainees, transmitted from the server of the driver training institution to the server of the Vietnam Highway Administration.

4. Night driving training time is the time counted from 18:00 on the previous day to 05:00 on the following morning.

5. Driver Training Information System, Supplementary Legal Knowledge Certificate on Road Traffic is a collection of hardware, system software, application software, database, and transmission lines serving the management of information on driver training and supplementary legal knowledge certificate on road traffic, including: Driver Training Management and Supervision Information System and Supplementary Legal Knowledge Certificate on Road Traffic Information System.

6. Driver Training Management and Supervision Information System b) Explanation and calculation of cost components and profit of Electricity Corporation i, including:

a) Driver Training Management and Supervision Information System at the driver training institution serving the management and supervision of the driver training process of courses and trainees;

b) Driver Training Management and Supervision Information System at the Construction Department serving the receipt of data on driver training provided by the driver training institution; management and supervision of the results of driver training of courses and trainees;

c) Driver Training Management and Supervision Information System at the Vietnam Highway Administration serving the receipt of data on: driver training institutions, driving instructors, training cars, and trainees who have been issued confirmation of completion of driver training courses provided by the Construction Department; DAT management data provided by the driver training institution to serve the compilation and reporting work of the Vietnam Highway Administration, management work of the Construction Departments, and data sharing with authorized agencies as prescribed.

7. Supplementary Legal Knowledge Certificate on Road Traffic Information System includes the Supplementary Legal Knowledge Certificate on Road Traffic Information System at the Vietnam Highway Administration, the Supplementary Legal Knowledge Certificate on Road Traffic Information System at the Construction Department, and the Supplementary Legal Knowledge Certificate on Road Traffic Information System at the institution providing supplementary legal knowledge training on road traffic.

8. Institution Providing Supplementary Legal Knowledge Training on Road Traffic is a driver training institution for automobiles or an institution training operators of specialized motor vehicles that performs the function of providing supplementary legal knowledge training on road traffic.

Chapter II

DRIVER TRAINING CREATION OF A DRIVER LICENSE

Article 4. Training Forms

1. Persons who wish to be trained for obtaining motorcycle driving licenses of categories A1, A, and B1:

a) For theoretical learning content, they must complete the training program as prescribed in this Circular and may choose one of the following forms of study: self-study of theoretical subjects according to the Government's regulations on driver training activities or concentrated study at a driving school;

b) For practical driving training content: through concentrated training at a driving school.

2. Persons who wish to be trained for obtaining driving licenses of categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, and DE:

a) For theoretical learning content, they must complete the training program as prescribed in this Circular and may choose one of the following forms of study: concentrated study at a driving school or remote training, guided self-study according to the Government's regulations on driver training activities;

b) For practical driving training content: through concentrated training at a driving school.

Article 5. Motorcycle Driving License Training for Categories A1, A, and B1

2. Organization of Training Courses

The driving school bases its course organization on the contents including: the program volume and minimum allocation of training time as stipulated in Clause 1 of this Article and Appendix I issued together with this Circular, review time, final examination time, and holiday time to establish the total duration of the training course within the driver training program not exceeding 10 days.

3. Course Registration Report

a) For motorcycle driving license training of categories A1 and A: the driving school accepts the application files of eligible students and file components as prescribed in Articles 13 and 14 of this Circular; prepares the course registration report according to Model 1 and Model 2 in Appendix II issued together with this Circular and sends it to the Construction Department via one of the following methods: direct submission, postal service, or electronic environment; simultaneously transmitting data through the Driver Training Management and Supervision Information System;

b) For category B1 driving license training: the driving school accepts the application files of eligible students and file components as prescribed in Articles 13 and 14 of this Circular; prepares the course registration report along with a list of students and a training plan according to Model 1, Model 2 in Appendix II and Model 3 in Appendix III issued together with this Circular and sends it to the Construction Department via one of the following methods: direct submission, postal service, or electronic environment; simultaneously transmitting data through the Driver Training Management and Supervision Information System;

c) The course registration report, student list, and training plan as stipulated in points a and b of this clause must bear the seal of the driving school and be sent to the Construction Department on the day of the course opening; the head of the unit assigned by the Construction Department to manage driver training shall check and sign each page (except for reports received through the electronic environment);

4. Completion Examination

a) For category B1 driving license training: an examination of the theoretical and practical training content must be conducted at the driving school to assess completion of the course, including: theoretical training content based on the theory test question bank issued by the Ministry of Public Security; practical driving training content with the forward and reverse parking maneuver;

Evaluation of student learning outcomes for theoretical and practical training content: for the theory test based on the theory test question bank, it is evaluated according to the driver examination procedures issued by the Ministry of Public Security; for the forward and reverse parking maneuver test, it is scored out of 10 (from 1 to 10) by the driving school, taking into account one decimal place;

Assessment of completion of the course: a student who achieves the required score in the theory test based on the theory test question bank corresponding to their category according to the driver examination procedures issued by the Ministry of Public Security, and scores 5.0 or higher in the forward and reverse parking maneuver test;

b) For category A1 and A driving license training: a student who attends all scheduled training hours in the program will be considered to have completed the course.

Article 6. Training for Categories B and C1 drivers

2. Organization of Training Courses:

a) Driving training institutions base their course contents on the program volume and training time allocation stipulated in Clause 1 of this Article and Appendix I issued with this Circular, including review time, final exam time, and holiday breaks to establish a total training course duration not exceeding ninety days;

b) The number of trainees in a practical driving training group on a Category B practice vehicle shall not exceed five trainees, and on a Category C1 practice vehicle shall not exceed eight trainees; the driving practice distance is calculated for each trainee, and the driving practice time on the practice field is calculated for the group of trainees on the practice vehicle.

3. Course Registration Report

a) Driving training institutions must accept the application files of trainees ensuring they meet the conditions and file components as prescribed in Articles 13 and 14 of this Circular; prepare a registration report for the driving training course along with a list of trainees and a training plan according to Model No. 01, Model No. 02, and Model No. 03 of Appendix III issued with this Circular, and send it to the Department of Construction via one of the following methods: direct submission, postal service, or electronic environment; simultaneously transmit data through the Driver Training Management and Supervision Information System;

b) The registration report for the driving training course, the list of trainees, and the training plan must be stamped with the seal of the driving training institution and sent to the Department of Construction within seven working days from the start date; the head of the unit assigned by the Department of Construction to manage driver training must check and sign each page (except for reports submitted through an electronic environment).

4. Completion Course Examination

Examine the theoretical and practical training content at the driving training institution, to be considered as completing the course, including:

a) Examining upon completion of theoretical training content based on the set of theory examination questions and simulated traffic situations issued by the Ministry of Public Security;

b) Examining upon completion of practical driving training content including continuous driving exercises, reverse parking exercises, and road driving;

c) Trainees must attend at least seventy percent of the theoretical training content study time; complete the required driving practice distance on the practice field and at least fifty percent of the road driving practice distance; complete the required driving practice distance and at least fifty percent of the road driving practice time;

d) Evaluation of trainees' learning results for theoretical and practical training content: for the examination based on the set of theory examination questions, simulated traffic situations, continuous driving exercises, and road driving, the evaluation follows the driver examination procedures issued by the Ministry of Public Security; for the reverse parking exercise, the evaluation is based on a ten-point scale (from 1 to 10) established by the training institution, considering decimal points up to one digit;

đ) Course completion assessment: trainees must achieve the required scores in the theory examination questions, simulated traffic situations, continuous driving exercises, and road driving according to the driver examination procedures issued by the Ministry of Public Security; the reverse parking exercise score must be five or higher.

5. If a trainee does not meet the conditions for course completion within one year from the date the driving training institution first organizes the course completion assessment, the trainee must retake the course in a new training session.

Article 7. Training for upgrading driving licenses

2. Organization of Training Courses:

a) Driving schools shall base their programs on the contents including: volume of the program and minimum time allocation as prescribed in Clause 1 of this Article and Appendix I issued together with this Circular, review time, final examination time, and holiday time to establish the total duration of the training course for upgrading not exceeding 60 days;

b) The number of trainees in each practical driving group arranged on one training vehicle for upgrading: B to BE not more than 05 trainees; B to C1, B to C, C1 to C, C1 to C1E, C to CE not more than 08 trainees; B to D1, B to D2, C1 to D1, C1 to D2, C to D1, C to D2, C to D, D1 to D2, D1 to D, D1 to D1E, D2 to D, D2 to D2E, D to DE not more than 10 trainees. In which, the distance for training driving is calculated for each trainee and the time for training driving on the training ground is calculated for the group of trainees on the training vehicle.

3. Course Registration Report

a) Driving training institutions must accept the application files of trainees ensuring they meet the conditions and file components as prescribed in Articles 13 and 14 of this Circular; prepare a registration report for the driving training course along with a list of trainees and a training plan according to Model No. 01, Model No. 02, and Model No. 03 of Appendix III issued with this Circular, and send it to the Department of Construction via one of the following methods: direct submission, postal service, or electronic environment; simultaneously transmit data through the Driver Training Management and Supervision Information System;

b) The registration report for the driving training course, the list of trainees, and the training plan must be stamped with the seal of the driving training institution and sent to the Department of Construction within seven working days from the start date; the head of the unit assigned by the Department of Construction to manage driver training must check and sign each page (except for reports submitted through an electronic environment).

4. Completion Course Examination

Examination of theoretical and practical training content at the driving school to be considered as completing the training course, including:

a) Examination upon completion of theoretical training content according to the set of theoretical examination questions, simulating traffic situations issued by the Ministry of Public Security;

b) Examination upon completion of practical driving training content: for categories C, D1, D2, D including continuous exercises, reverse parking exercises, and driving on the road; for categories BE, C1E, CE, D1E, D2E, DE including continuous exercises and driving on the road;

c) Trainees must attend at least 70% of the time allocated for theoretical training content; complete the required time and at least 50% of the distance for practical driving training on the training ground; complete the required distance and at least 50% of the time for practical driving training on the road;

d) Evaluation of trainees' learning results for theoretical and practical training content: for the examination based on the set of theory examination questions, simulated traffic situations, continuous driving exercises, and road driving, the evaluation follows the driver examination procedures issued by the Ministry of Public Security; for the reverse parking exercise, the evaluation is based on a ten-point scale (from 1 to 10) established by the training institution, considering decimal points up to one digit;

đ) Course completion assessment: trainees must achieve the required scores in the theory examination questions, simulated traffic situations, continuous driving exercises, and road driving according to the driver examination procedures issued by the Ministry of Public Security; the reverse parking exercise score must be five or higher.

5. If the training institution fails to meet the conditions for completing the training course within one year from the date of the first assessment, the trainee must undergo retraining according to a new training course.

Article 8. Standards for motorcycle driving training institutions

1. Specialized classrooms system:

a) Theoretical classroom: equipped with teaching aids such as information technology devices to support teaching on traffic laws; if these devices do not describe traffic signs, diagrams, then there must be a drawing system;

b) Driving technique classroom: equipped with information technology devices as teaching aids to support teaching on construction; if these devices do not describe, then there must be a drawing system;

c) Practical maintenance and repair classroom for category B1: equipped with ventilation and lighting systems ensuring safety and hygiene requirements; floor does not cause dust; equipped with specialized tools for maintenance and repair; equipped with disassembly tables, boards, chairs for teaching and practice; equipped with specialized tools to guide trainees in tire disassembly and oil check practices;

d) In case the motorcycle driving training institution also serves as a car driving training institution, it may share the specialized classrooms;

2. Training vehicles: suitable for the categories of vehicles specified in point a, point b, point c of Clause 1 of Article 57 of the Road Traffic Law;

3. Motorcycle training grounds: technical specifications of training shapes comply with the dimensions of examination shapes according to the National Technical Regulations on motor vehicle driving examination centers for corresponding vehicle categories.

Article 9. Training materials and training management documents for driving schools

1. Driving training textbooks that comply with the framework training program for drivers stipulated in Appendix I issued together with this Circular; driving schools shall carry out the preparation, review, and issuance of training textbooks according to the procedures prescribed in Article 10 of this Circular.

2. Forms and record books used by automobile driving schools include:

a) Course registration report for driver training according to Form No. 01 prescribed in Appendix III issued together with this Circular;

b) Training plan according to Form No. 03 prescribed in Appendix III issued together with this Circular;

c) Teacher assignment book and driving practice vehicle teaching schedule according to the form prescribed in Appendix IV issued together with this Circular;

d) Driver training progress form according to the form prescribed in Appendix V issued together with this Circular;

đ) Student performance tracking book according to the form prescribed in Appendix VI issued together with this Circular;

e) Instructor handbook according to the provisions in Appendix VII issued together with this Circular (used for theoretical courses conducted in a centralized manner except for traffic law subjects, and for practical driving lessons on the driving practice field except for driving practice in the car driving simulator);

g) Student completion tracking book for training courses according to the provisions in Appendix VIII issued together with this Circular.

3. Motorcycle driving schools for categories A1, A, and B1 shall use the documents specified in points a and e of Clause 2 of this Article as training management documents.

4. Automobile driving schools shall use the documents specified in Clause 2 of this Article, data managing time spent on theoretical traffic law subjects (for centralized study), student management data on software (for distance learning and self-study with guidance), data monitoring time and distance driven on roads, and data on practical driving lessons on the car driving simulator as training management documents.

Article 10. Procedures for preparing, reviewing, and issuing training textbooks and training programs

1. Preparation of training textbooks and detailed training programs.

2. Review of training textbooks and detailed training programs.

3. Issuance of training textbooks and detailed training programs.

4. The procedures for preparing, reviewing, and issuing training textbooks and detailed training programs shall be carried out according to the provisions in Appendix IX issued together with this Circular.

Article 11. Training for issuing category A1 and automatic transmission category B driver's licenses for persons with disabilities

1. Category A1 motorcycle training for persons with disabilities controlling three-wheeled motorcycles designed for persons with disabilities:

a) Students must choose the training method according to the provisions of Clause 1 of Article 4 of this Circular;

b) Students must be trained on disability-specific training vehicles according to the Government’s regulations on driver training and examination activities; they must complete all required content and programs as stipulated in Article 5 of this Circular.

2. Automatic transmission category B training:

a) Automatic transmission category B training for persons with disabilities affecting their right foot, right hand, or left hand:

Students must choose the training method according to the provisions of Clause 2 of Article 4 of this Circular;

Students must be trained on disability-specific training vehicles according to the Government’s regulations on driver training and examination activities; they must complete all required content and programs as stipulated in Article 6 of this Circular and replace training on the car driving simulator with training on the disability-specific training vehicle;

b) Automatic transmission category B training for persons with disabilities other than those specified in point a of Clause 2 of this Article:

Students must choose the training method according to the provisions of Clause 2 of Article 4 of this Circular;

Students must be trained on automatic transmission category B training vehicles; they must complete all required content and programs as stipulated in Article 6 of this Circular.

Article 12. Training for A1 motorcycle license for ethnic minority people who cannot read or write Vietnamese

1. Training form: Individuals requiring a driving license must register at a driving training facility to undergo review and practice according to the driving training program specified in Article 5 and Section A of Appendix I issued together with this Circular. Classes for ethnic minority people who cannot read or write Vietnamese must be taught separately and have an interpreter for the ethnic minority language.

2. Training method: Through visual images, drawings of traffic signs, models, road scenarios, and traffic situation handling skills; question-and-answer sessions and demonstration practices to implement the driving training program content.

Article 13. Requirements for learners

1. Vietnamese citizens or foreigners permitted to reside or work, study in Vietnam.

2. Learners seeking to upgrade their driving license category must comply with the provisions set out in Clause 4 of Article 60 of the Road Traffic Safety Law, wherein the safe driving period for each driving license category is specifically defined as follows:

a) From B to C1, B to C, B to D1, B to BE, C1 to C, C1 to D1, C1 to D2, C1 to C1E, C to D1, C to D2, D1 to D2, D1 to D, D1 to D1E, D2 to D, D2 to D2E, D to DE: a safe driving period of two years or more;

b) From B to D2, C to CE, C to D: a safe driving period of three years or more.

3. Individuals holding an automatic transmission B license may register to obtain a new manual transmission B license (stick shift), and those holding a B license may register to obtain a new C1 license in accordance with Article 6 of this Circular; the learner's application materials shall be processed in accordance with Clause 1 of Article 14 of this Circular.

Article 14. Application Materials for Learners

1. First-time learners prepare one set of application materials, which they submit to the training facility through one of the following methods: in person, postal service, or electronically. The application includes:

a) An application form for driving training as prescribed in Appendix X issued together with this Circular;

b) A certified copy or electronic certified copy from the original or an electronic certified copy issued from the original record of one of the following documents: temporary residence card, permanent residence card, diplomatic identification card, official identification card (for foreigners).

2. Upgrading learners prepare one set of application materials, which they submit to the training facility through one of the following methods: in person, postal service, or electronically. The application includes:

a) Documents stipulated in Clause 1 of this Article;

b) A certified copy of a secondary school graduation certificate or equivalent qualification for upgrading to categories D1, D2, and D (presented with a certified copy or original for verification or a certified copy from the original or an electronic certified copy from the original record);

c) A declaration of safe driving period as prescribed in Appendix XI issued together with this Circular.

Article 15. Storage of Driving Training Documentation

1. Driving training facilities store documentation related to the training course:

a) Permanently store records of trainees completing the training course; operational plans for motorcycle driving training facilities for categories A1, A, and B1;

b) For three years: completion examination records, documents specified in Points a, b, c, d, and e of Clause 2 of Article 9 of this Circular, and Form 6 of Appendix XVII issued together with this Circular.

2. The Construction Department stores training documentation for three years, including:

a) Reports on registered driving training courses from training facilities;

b) Training plans from training facilities;

c) Inspection records of training facilities conducted by the Construction Department.

Article 16. Management of trainees at driving training institutions that are dissolved or have their training licenses revoked

1. Driving training institutions that are dissolved shall be responsible for:

a) Within ten days from the date of issuance of the decision to dissolve the institution, conduct a review, compile a list of candidates who have been issued a basic vocational certificate or a training certificate or confirmation of completion of a training course, and hand over the files of current trainees under management to the Construction Department for continued monitoring and management;

b) Ensure the rights of learners according to the training contract. In case the trainee agrees with the plan to continue training, negotiate with other driving training institutions in the area to transfer the obligation to train. If the trainee does not agree with the plan to continue training, reach an agreement with the trainee and terminate the contract;

c) Within ten days from the date of issuance of the decision to dissolve the institution, fully hand over the files to the driving training institution that has agreed to take on the training obligation, including: reports on driver license examination registration or reports on driving training course registration and learner files; simultaneously report to the Construction Department for monitoring and management.

2. Driving training institutions when their training licenses are revoked shall be responsible for:

a) Within ten days from the effective date of the decision to revoke the training license, conduct a review, summarize, and compile a list of current trainees under management; develop a solution to address the rights of trainees currently undergoing training and report to the Construction Department for monitoring and management;

b) Ensure the rights of learners according to the training contract. In case the trainee agrees with the plan to continue training, negotiate with other driving training institutions in the area to transfer the obligation to train. If the trainee does not agree with the plan to continue training, reach an agreement with the trainee and terminate the contract;

c) Within twenty days from the effective date of the decision to revoke the training license, fully hand over the files to the driving training institution that has agreed to take on the training obligation, including: reports on driver license examination registration or reports on driving training course registration and learner files; simultaneously report to the Construction Department for monitoring and management.

3. Driving training institutions that take on the obligation to train trainees from dissolved driving training institutions or those whose training licenses have been revoked shall be responsible for:

a) Accepting the files and materials specified in Clause 1 and Clause 2 of this Article and continuing to manage trainees according to current regulations;

b) The handover must be documented, including the following contents: fully and clearly record the transferred documents; commitments and responsibilities of each party (both the transferring and receiving parties have obligations and responsibilities related to the transferred files, materials, and assets).

Chapter III

TRAINING ON ROAD TRAFFIC LAWS FOR SPECIAL PURPOSE MOTORCYCLE DRIVERS PARTICIPATING IN ROAD TRAFFIC

Article 17. Forms and programs for training on road traffic laws

1. Persons participating in training on road traffic laws must undergo training at a training center for road traffic laws.

Article 18. Standards for training institutions for motorcycle operators to provide legal knowledge training, conduct examinations, and issue certificates on road traffic laws

Training institutions for motorcycle operators providing legal knowledge training, conducting examinations, and issuing certificates on road traffic laws must have theoretical classrooms, teaching materials, simulated scenarios, and a system of road traffic signs according to regulations.

Article 19. Organization of legal knowledge training on road traffic laws for motorcycle operators participating in road traffic

1. Report on opening a legal knowledge training class on road traffic laws: the legal knowledge training institution on road traffic laws receives the application files of participants meeting the conditions stipulated in point b, Clause 1, Article 59 of the Road Traffic Safety Law and the file components as prescribed in Article 20 of this Circular; prepares a report on opening a legal knowledge training class on road traffic laws according to the model prescribed in Appendix XII issued together with this Circular and sends it to the Construction Department through one of the following methods: direct submission, postal service, or electronic environment.

2. The legal knowledge training institution on road traffic laws bases on the training program prescribed in Article 17 of this Circular to develop teaching materials and detailed training program contents.

3. Organize examinations, prepare minutes of examination results on legal knowledge training on road traffic laws according to the model prescribed in Appendix XIII issued together with this Circular, and issue certificates on legal knowledge training on road traffic laws to learners who meet the requirements. In cases where the requirements are not met, another examination will be organized within seven working days from the date of the examination results.

4. Examination:

a) Examination content according to the legal knowledge training program on road traffic laws prescribed in Clause 2, Article 17 of this Circular;

b) Evaluation score for examination results on legal knowledge training on road traffic laws of trainees according to a ten-point scale (from 1 to 10) established by the training institution, taking into account one decimal place. An examination score of 5.0 points or higher meets the requirements.

Article 20. Learner's File

Participants in legal knowledge training on road traffic laws establish one set of files and submit them to the legal knowledge training institution on road traffic laws through one of the following methods: direct submission, postal service, or electronic environment. The file includes:

1. Application form for legal knowledge training on road traffic laws according to the model prescribed in Appendix XIV issued together with this Circular.

2. Three color photographs measuring 2x3 cm taken within six months, in identification card format.

Article 21. Storage of Examination Result Files

1. Legal knowledge training institution on road traffic laws:

a) Report on opening a legal knowledge training class on road traffic laws;

b) List of candidates participating in the examination;

c) Decision to organize the examination;

d) Certificate issuance record book.

2. Construction Department:

a) Materials prescribed in point a, Clause 1 of this Article;

b) Materials prescribed in point d, Clause 1 of this Article in cases where the Construction Department reissues certificates.

3. Retention period for materials:

a) No time limit for the certificate issuance record book;

b) Two years for materials prescribed in points a, b, and c, Clause 1 of this Article.

4. For cases where the legal knowledge training institution on road traffic laws is dissolved: within ten days from the date of issuance of the dissolution decision, the legal knowledge training institution on road traffic laws shall review, compile a list, and hand over the materials prescribed in Clause 1 of this Article to the Construction Department for continued monitoring and management.

Article 22. Issuing Certificates

Within five working days from the date when the examination results meet the requirements, the head of the traffic law knowledge training institution shall issue certificates to learners.

Article 23. Reissuing Certificates

1. Persons whose certificates are damaged or contain incorrect information as recorded in the files at the issuing institution shall be reissued certificates according to the certificate number already issued. The application for reissuance includes:

a) A request for reissuance of the certificate in accordance with the form prescribed in Appendix XVI attached to this Circular;

b) Three color photographs measuring 2x3 cm taken within six months.

2. Persons who have lost their certificates, as recorded in the files at the issuing institution, shall be reissued certificates according to the certificate number already issued. The reissuance procedures shall be carried out in accordance with Clause 1 of this Article.

3. Procedures for implementation:

a) Individuals submit one set of application documents to the traffic law knowledge training institution that issued the certificate; if the training institution has ceased operations, the documents should be submitted to the Construction Department managing the issuing institution;

b) The traffic law knowledge training institution or the Construction Department shall check the application documents upon receipt; if the certificate does not fall within the scope of reissuance or the documents do not comply with the regulations, they must notify the individual directly or in writing about the necessary supplements or corrections within two working days from the date of receiving the documents;

c) Within three working days from the date of receiving complete and valid application documents, the head of the traffic law knowledge training institution or the Construction Department shall reissue the certificate; if the certificate is not reissued, a written response with the reasons must be provided;

d) The issuance of the certificate shall be conducted at the traffic law knowledge training institution or the agency receiving the application documents or through postal services upon the individual's request.

Article 24. Printing and Managing Traffic Law Knowledge Training Certificates

1. The traffic law knowledge training institutions shall print and manage traffic law knowledge training certificates for issuing new and reissuing certificates as follows:

a) Based on the model of the traffic law knowledge training certificate prescribed in Appendix XV attached to this Circular, the traffic law knowledge training institution designs the certificate template, including its logo (if any);

b) The head of the traffic law knowledge training institution approves the certificate template of the institution and sends it to the Construction Department and provincial-level public security agencies where the main office is located for reporting; responsible for managing the certificate templates of the institution;

c) The printing of certificate templates must ensure strictness, safety, confidentiality, and must be recorded in a management ledger.

2. The Construction Department shall print and manage traffic law knowledge training certificates for reissuing certificates as follows:

a) Based on the model of the traffic law knowledge training certificate prescribed in Appendix XV attached to this Circular, the Construction Department designs the certificate template;

b) The Construction Department approves the certificate template and sends it to provincial-level public security agencies where the main office is located for reporting; responsible for managing the certificate templates of the department;

c) The printing of certificate templates must ensure strictness, safety, confidentiality, and must be recorded in a management ledger.

Chapter IV

SYSTEM OF DRIVER TRAINING INFORMATION, TRAFFIC LAW KNOWLEDGE TRAINING CERTIFICATES

Article 25. Requirements for the Driver Training Information System and Legal Knowledge Enhancement Certificate System

1. The driver training management and supervision information system at the training institution:

a) Shall manage at least the following information about trainees: trainee code (established according to the principle specified in Appendix XXVII issued together with this Circular); surname, given name; personal identification number; date of birth; nationality; place of residence; driving license number (in the case of upgrading); completion certificate number (established according to the principle specified in Appendix XXVII issued together with this Circular); training course; vehicle category trained; safe driving time for driving license upgrade cases; training institution name; portrait photograph;

b) Shall manage at least the following information about the training course: report registration number, month, year of the driver training course; driver training course code (established according to the principle specified in Appendix XXVII issued together with this Circular); type of training (new or upgrade); vehicle category trained; number of trainees; learning form of trainees; opening date; closing date;

c) Shall manage at least the following information about driver training: training results (including theoretical examination results and practical driving examination results); DAT data; time spent on traffic law theory study; practical driving results on driving simulators;

d) Shall manage at least the following information about driving instructors: practical driving instructor certification number (if applicable); surname, given name; personal identification number; date of birth; permitted training category; recruitment form; educational level; teaching qualification; driving license category; date of successful recruitment; years of driving instruction experience; subjects taught;

đ) Shall manage at least the following information about training vehicles: training vehicle permit number; vehicle registration number; vehicle label; vehicle category; year of manufacture; owner/contract; auxiliary braking system;

e) Shall have the function of managing, connecting, and transmitting DAT management data to the driver training management and supervision information system at the Vietnam Highway Administration;

g) Shall have the function of generating and providing construction departments with reports on registered driver training courses;

h) Shall have the function of providing construction departments with trainee information who have been issued a completion certificate for driver training courses, including at least: surname, given name; personal identification number; date of birth; nationality; place of residence; driving license number (if applicable); completion certificate number; training institution; vehicle category trained; training course;

i) Shall have the function of controlling instructors' work schedules and training vehicle usage history;

k) Shall accurately and fully store all managed information;

l) Shall have the capability to connect and share data with the driver training management and supervision information system at the construction department and related information systems;

m) Shall ensure information security, network security regulations as stipulated by law;

2. The driver training management and supervision information system at the construction department:

a) Shall receive and manage trainee information who have been issued a completion certificate for driver training courses from training institutions, including at least the information specified in point h, Clause 1 of this Article;

b) Shall manage at least the following information about training institutions: training permit number; training institution management code; training institution name; address; direct supervising authority; permitted training category, permitted training capacity;

c) Shall manage at least the following information about driving instructors: practical driving instructor certification number (if applicable); surname, given name; personal identification number; date of birth; permitted training category; recruitment form; educational level; teaching qualification; driving license category; date of successful recruitment; years of driving instruction experience; subjects taught;

d) Shall manage at least the following information about training vehicles: training vehicle permit number; vehicle registration number; vehicle label; vehicle category; year of manufacture; owner/contract; auxiliary braking system;

đ) Shall have the function of receiving, managing, and storing: trainee information as specified in point a, Clause 1 of this Article; training course information as specified in point b, Clause 1 of this Article; driver training course registration report as specified in point g, Clause 1 of this Article;

e) Shall have the function of creating training institution management codes;

g) Shall have the function of checking and updating completion certificates for driver training courses that meet the conditions for synchronization to the driver training management and supervision information system at the Vietnam Highway Administration and notifying training institutions about completion certificates that do not meet the synchronization conditions;

h) Shall have the function of connecting and sharing data with the driver training management and supervision information system at the Vietnam Highway Administration and related information systems;

i) Shall ensure information security, network security regulations as stipulated by law;

k) Shall have the ability to compile and export reports according to Model 1 and Model 2 in Appendix XXVI issued together with this Circular;

3. The driver training management and supervision information system at the Vietnam Highway Administration:

a) Shall have the function of receiving and storing at least the following information provided by construction departments, including the information specified in points a, b, c, and d, Clause 2 of this Article;

b) Shall have the function of storing at least DAT management data according to the provisions in Appendix XVII issued together with this Circular;

c) Shall accurately and fully store all managed information;

d) Shall have the ability to connect and share data with related information systems;

đ) Shall ensure information security, network security regulations as stipulated by law;

4. The legal knowledge enhancement certificate information system at the legal knowledge enhancement training institution:

a) Shall manage at least the following information about trainees: surname, given name; date of birth; enhancement class; completion time of the enhancement class; certification examination result; date of certification examination result; certificate number; date of issuance; issuing institution; date of reissuance; reissuing authority;

b) Has the function of creating training classes, organizing examinations, and printing certificates for traffic law knowledge training;

c) Has the function of issuing and reissuing certificates for traffic law knowledge training;

d) Has the function of accurately storing all managed information;

đ) Has the capability to connect and share data with the Traffic Law Knowledge Training Certificate Information System at the Department of Construction and related information systems;

e) Ensures current legal provisions on information security, network security, and cybersecurity;

5. The Traffic Law Knowledge Training Certificate Information System at the Department of Construction:

a) Has the function of receiving, managing, and storing at least the information specified in point a, Clause 4, Article 5 of this Decree and information about the date of reissue of the certificate, the issuing authority of the certificate for each trainee when the Department of Construction is the reissuing authority;

b) Manages at least the information of automobile driving schools participating in issuing training certificates: license number; management code of the driving school; name of the driving school; address; direct supervising authority;

c) Manages at least the information of specialized motorcycle driving training schools implementing training, examination, and issuance of traffic law knowledge training certificates: name of the specialized motorcycle driving training school; address; direct supervising authority;

d) Has the function of reissuing traffic law knowledge training certificates;

đ) Has the function of connecting and sharing data with related information systems;

6. The Traffic Law Knowledge Training Certificate Information System at the Vietnam Highway Administration:

a) Has the function of receiving and storing the information at points a, b, and c, Clause 5, Article 5 of this Decree provided by the Departments of Construction;

b) Has the capability to connect and share data with related information systems;

Article 26. Principles and Forms of Data Exploitation on the Information System

1. Principles of exploitation:

a) Data exploitation concerning driver training shall be carried out in accordance with laws on information technology and cybersecurity;

b) Authorities managing the information system as stipulated in Articles 28, 29, 30, and 31 of this Circular have the responsibility to protect personal information in the driver training database and the traffic law knowledge training certificate database on the internet in accordance with laws on information technology;

c) Services for exploiting information and data on driver training and traffic law knowledge training certificate issuance are provided to agencies, organizations, and individuals on the internet in accordance with laws on information technology and cybersecurity;

2. Forms of exploitation:

a) Direct exploitation: agencies, organizations, and individuals can directly exploit data on driver training and traffic law knowledge training certificate issuance from the electronic driver training information website according to the level of data security and user permissions for exploiting driver training data and traffic law knowledge training certificate issuance;

b) Indirect exploitation: agencies, organizations, and individuals requiring exploitation of data on driver training and traffic law knowledge training certificate issuance are provided with information extracted from the driver training database and the traffic law knowledge training certificate database, including: surname, given name; individual identification number; date of birth; place of permanent residence; confirmation of completion of the training course; safe driving time for upgrading driving license categories; information recorded on the traffic law knowledge training certificate (in cases where authorized authorities require additional information, beyond what is printed on the traffic law knowledge training certificate, information on the training process and examination results will also be provided).

Article 27. Data Storage Period on Information Systems

1. Data storage period at driving training institutions:

a) DAT data must be stored for a minimum of three years;

b) Data of the information specified in points a, b, c, d, and đ Clause 1, Article 25 of this Circular (excluding DAT data) must be stored for a minimum of fifty years.

2. Data storage period at the Department of Construction:

a) Data of the information specified in points a and b Clause 2, Article 25 of this Circular must be stored for a minimum of fifty years;

b) Data on legal knowledge enhancement, examination, and issuance of certificates for legal knowledge enhancement on road traffic must be stored for a minimum of three years.

3. Data storage period at legal knowledge enhancement institutions on road traffic:

Data on legal knowledge enhancement, examination, and issuance of certificates for legal knowledge enhancement on road traffic must be stored for a minimum of three years.

4. Data storage period at the Vietnam Highway Administration:

a) Data of the information specified in point a Clause 3, Article 25 of this Circular must be stored for a minimum of ten years; management DAT data must be stored for a minimum of three years;

RESPONSIBILITIES OF THE AGENCIES AND UNITS

b) Data on legal knowledge enhancement, examination, and issuance of certificates for legal knowledge enhancement on road traffic must be stored for a minimum of three years.

Article 28. Vietnam Highway Administration

1. In relation to driver training and legal knowledge enhancement on road traffic:

a) Organize training and guide professional activities related to driver training and legal knowledge enhancement on road traffic;

b) Apply information technology in managing driver training and legal knowledge enhancement on road traffic;

c) Announce and update the list of automobile driving training institutions that have been granted or had their training licenses revoked on the electronic information website.

2. In relation to information system management:

a) Construct, upgrade, and maintain the operation of the Driver Training Management and Supervision Information System at the Vietnam Highway Administration and the Legal Knowledge Enhancement Certificate Information System at the Vietnam Highway Administration to receive data, share, and connect with the examination management agencies of the Public Security sector, completing before July 1, 2026; integrate and apply digital transformation technology in driver training;

b) Operate the system at point a of this clause, ensuring continuous and stable system operation;

c) Construct, upgrade, and train the transfer of software in the Driver Training Management and Supervision Information System, the Legal Knowledge Enhancement Certificate Information System at the Department of Construction, driving training institutions, and legal knowledge enhancement institutions, completing before July 1, 2026;

d) Provide accounts for Departments of Construction, driving training institutions, and legal knowledge enhancement institutions to log in, update, transmit, and exploit data on the Driver Training Management and Supervision Information System and the Legal Knowledge Enhancement Certificate Information System at the Vietnam Highway Administration;

đ) Utilize data from the Driver Training Management and Supervision Information System at the Vietnam Highway Administration to serve the work of summarizing, reporting, and inspecting;

e) Issue operational regulations and ensure information security and safety; account usage and data exploitation regulations for the information system according to laws on information technology and network security.

Article 29. Department of Construction

1. Regarding driver training work:

a) Be responsible for managing driver training work within the province or centrally governed city; inspect and issue driver training permits to ensure maximum training capacity consistent with the number of classrooms and driving practice fields as prescribed by the Government on driver training and examination activities;

b) Implement the acceptance, review, inspection, and coordination with the Vietnam Highway Corporation to create management codes for driver training facilities according to Appendix XXVII issued together with this Circular; announce the list of driver training facilities for categories A1, A, and B1 that meet or do not meet the conditions for operation within the jurisdiction on the Department of Construction's electronic information website;

c) Exploit and utilize data from the Driver Training Management and Supervision Information System at the Vietnam Highway Corporation, the Department of Construction, and driver training facilities to serve management, inspection, and supervision of the driver training process, issuance of certificates of completion of driver training courses. In case the Vietnam Highway Corporation announces the suspension of the Driver Training Management and Supervision Information System for maintenance, repair, or due to an incident, the Department of Construction will use the DAT data of the driver training facility to perform these tasks;

d) Within seven days from receiving the list of trainees who have been issued certificates of completion of driver training courses by the training facility, the Department of Construction will exploit and utilize the DAT management data from the Driver Training Management and Supervision Information System at the Vietnam Highway Corporation according to Model Number 06 in Appendix XVII issued together with this Circular, and the trainee registration information for driving training courses sent by the training facility to check and evaluate the results of practical driving training on the road for trainees who have received certificates of completion from the training facility, update the information of trainees meeting the regulations on training time and distance on the Driver Training Management and Supervision Information System at the Vietnam Highway Corporation; simultaneously notify the driver training facility regarding trainees who do not meet the regulations on training time and distance for additional training. In case the Vietnam Highway Corporation suspends the Driver Training Management and Supervision Information System for maintenance, repair, or due to an incident, the Department of Construction will use the DAT data of the driver training facility to perform these tasks;

đ) Accept, inspect, and evaluate the organizational form and detailed training program of driver training facilities according to point n, Clause 1, Article 30 of this Circular;

2. Regarding the work of supplementary training, inspection, and issuance of supplementary knowledge certificates on traffic laws:

a) Reissue supplementary knowledge certificates on traffic laws according to point a, Clause 3, Article 23 of this Circular;

b) Implement the acceptance, review, inspection, and announcement of the list of supplementary knowledge training facilities operating within the jurisdiction on the Department of Construction's electronic information website;

c) Access the Supplementary Knowledge Certificate Information System on Traffic Laws at the Department of Construction to manage and exploit data on supplementary legal knowledge certificates of training facilities under its management;

d) Establish a Record of Issuance of Supplementary Knowledge Certificates on Traffic Laws according to the model prescribed in Appendix XXIV issued together with this Circular;

3. Regarding information system management work:

a) Invest in, maintain, and upgrade the Driver Training Management and Supervision Information System and the Supplementary Knowledge Certificate Information System on Traffic Laws at the Department of Construction; accept and organize the implementation of application software for driver training management and supplementary knowledge certificate management transferred by the Vietnam Highway Corporation before July 1, 2026, and transmit all required data as stipulated in points a, b, c, d, Clause 2, and points a, b, c, Clause 5, Article 25 to the Vietnam Highway Corporation starting July 1, 2026;

b) Operate the Driver Training Management and Supervision Information System at the Department of Construction in accordance with regulations;

c) Utilize software in the Driver Training Management and Supervision Information System at the Department of Construction to accept reports on registered driver training courses; inspect and compare information on learners, training processes, and training outcomes;

d) Utilize data from the Driver Training Management and Supervision Information System at the Department of Construction and driver training facilities to serve inspection and supervision work and provide information to relevant authorities when requested;

đ) Issue operational regulations and ensure information security and safety; usage regulations and data exploitation for the Department of Construction's information systems and shared information systems according to laws on information technology and network security;

e) Fully store information as prescribed in Clause 2, Article 27 of this Circular and legal provisions on storage;

4. Regarding inspection work: organize regular or spot inspections of driver training work at driver training facilities; supplementary training, inspection, and issuance of supplementary knowledge certificates on traffic laws at supplementary knowledge training facilities on the territory.

Article 30. Driving Training Institutions

1. Regarding driver training work:

a) Organize admissions for training to ensure requirements for driving students as stipulated in Article 13 of this Circular;

b) Enter into a training contract with driving students including the following main contents: category of driving license being trained; training location; completion time of the course; tuition fee level and payment method; liability for compensation of losses of each party when breaching the contract; termination of the contract; other agreements not contrary to laws and social ethics;

c) Publicize the admission regulations, tuition fee levels, and training management on the website of the driving training institution;

d) Driving training institutions for categories A1, A, B1 motorcycles must maintain and enhance facilities and equipment to ensure conditions as prescribed for teaching;

đ) Notify the training operation plan according to the model prescribed in Appendix XVIII issued together with this Circular to the Department of Construction before organizing motorcycle driving training for categories A1, A, B1; in case of changes in information in the training operation plan, notify the substitute training operation plan to the Department of Construction; organize motorcycle driving training strictly according to the registered training operation plan;

e) Organize new training and upgrading driving license training for cars ensuring implementation according to the flow rate, location, and category of driving license recorded in the driving training permit and issue a certificate of completion of the training course to those who meet the requirements according to the model prescribed in Appendix XIX issued together with this Circular; arrange the number of practical learners for each category of driving license not exceeding the capacity to provide training vehicles and practical driving instructors;

g) Apply technology in training management to identify and track theoretical study time on traffic law subjects for car driving students studying in concentrated classes; ensure facilities and equipment to serve teaching and learning to improve the quality of driving training; use simulation software for traffic situations to train drivers;

h) Ensure that practical driving instructors wear the badge "Driving Instructor" and carry the training vehicle permit; practical driving students on the road must wear the badge "Practical Driving Student". Badges are issued and managed by the driving training institution according to Model No. 01 and Model No. 02 prescribed in Appendix XX issued together with this Circular; post the name of the driving training institution on the training vehicle according to the model prescribed in Appendix XXI issued together with this Circular;

i) Based on the inspection content prescribed in Clause 4 of Article 5, Clause 4 of Article 6, and Clause 4 of Article 7 of this Circular, establish an inspection procedure and organize the completion of the training course inspection;

k) Use tracking results during the learning process, inspection results, and practical driving test results on the road through DAT data and DAT management data (on the Driver Training Management and Supervision Information System at the driving training institution and the Driver Training Management and Supervision Information System at the Vietnam Highway Administration), practical driving test results in the driving simulator (extracted from the car driving simulator) to serve driver training management, assess the completion of the driver training course for car driving students, ensuring the content, duration, and distance of training as prescribed in Article 6 and Article 7 of this Circular;

l) Transmit DAT management data as prescribed in Appendix XXII issued together with this Circular; be responsible for the accuracy, completeness, and truthfulness of DAT data and DAT management data; ensure data security and confidentiality for the information system; keep login names and passwords to access the Driver Training Management and Supervision Information System at the Vietnam Highway Administration confidential; provide timely and accurate DAT information and data to competent state management agencies when requested;

m) Provide and be responsible for the confirmation certificate (extracted from the car driving simulator) of student information having completed the required time and content of practical driving training in the car driving simulator to the driver training management agency;

n) Develop and approve detailed training forms and programs according to the compilation, review, and issuance procedures of the training program prescribed in Article 10 and Appendix IX of this Circular, report to the Department of Construction for monitoring and management. The organization of remote and self-study driving training with guidance shall be implemented according to the provisions in Appendix XXIII issued together with this Circular;

o) Send lists and be responsible for the truthfulness and accuracy of student information who have been granted certificates of completion of the driver training course to the Department of Construction and send to the examination management agency of the Public Security sector when requested;

c) Announce and update the list of automobile driving training institutions that have been granted or had their training licenses revoked on the electronic information website.

a) Invest in, maintain, and upgrade the Driver Training Management and Supervision Information System at the driving training institution; accept and organize the application software provided by the Vietnam Highway Administration to serve driver training management and supervision at the driving training institution and transmit all required data as prescribed in Points a, b, g, and h of Clause 1 of Article 25 to the Department of Construction before July 1, 2026;

b) Establish, compare, and be responsible for the accuracy of student information, training process, training results, and registration reports for training courses as prescribed;

c) Store all information as prescribed in Clause 1 of Article 27 of this Circular and as prescribed by laws on record keeping;

d) Issue operational rules and ensure information security and safety; rules for account usage and data exploitation for the information system of the driving training institution and shared information systems according to laws on information technology and cybersecurity;

đ) Provide data from the Driver Training Management and Supervision Information System at the driving training institution to serve inspection and supervision work and provide information to functional agencies (when requested).

Article 31. Legal Knowledge Training Bases for Road Traffic Law

1. Regarding the training, inspection, and issuance of certificates for legal knowledge on road traffic:

a) Enroll and train legal knowledge on road traffic according to the program stipulated in this Circular;

b) Report the opening of legal knowledge training classes on road traffic to the Department of Construction in accordance with the model prescribed in Appendix XII issued together with this Circular;

c) Establish a Record for Managing the Issuance of Certificates for Legal Knowledge Training on Road Traffic according to the model prescribed in Appendix XXIV issued together with this Circular;

d) Announce the operation plan for legal knowledge training on road traffic according to the model prescribed in Appendix XXV issued together with this Circular to the Department of Construction before organizing the training; in case there are changes to the information in the legal knowledge training operation plan, must announce the replacement operation plan for legal knowledge training on road traffic to the Department of Construction; organize legal knowledge training on road traffic strictly according to the registered operation plan for legal knowledge training on road traffic.

c) Announce and update the list of automobile driving training institutions that have been granted or had their training licenses revoked on the electronic information website.

a) Invest, maintain, and upgrade the Certificate Information System for Legal Knowledge Training on Road Traffic at the legal knowledge training base; accept and organize the implementation of application software serving the management of certificate issuance for legal knowledge training on road traffic transferred by the Vietnam Highway Administration and transmit all data as prescribed in point a, Clause 4, Article 25 to the Department of Construction before July 1, 2026;

b) Store all information as prescribed in Clause 3, Article 27 of this Circular and the regulations on storage;

c) Issue operational regulations and ensure information security and safety; regulations on account usage and data exploitation for the information system of the training base and shared information systems in accordance with the laws on information technology and cybersecurity;

d) Provide data on the Certificate Information System for Legal Knowledge Training on Road Traffic at the training base to serve inspection and supervision work and provide information to competent authorities (upon request).

Article 32. Reporting Regime

1. The Department of Construction sends reports on driver training work to the Vietnam Highway Administration, including:

a) Report name: report on driver training work;

b) Content required in the report includes the number of driving schools under management, driving school licenses, learner vehicle permits, instructor certification for practical driving lessons, the number of completion certificates issued; evaluation of the management of driver training work;

c) Method of sending the report: direct delivery or through postal services or electronic environment;

d) Deadline for submitting the report: before June 20 each year for the mid-year report; before December 20 each year for the annual report;

đ) Frequency of reporting: semi-annual report for the first six months of the year and annual report;

e) Time to finalize the report data: for the mid-year report, from December 15 of the previous year to June 14 of the reporting period; for the annual report, from December 15 of the previous year to December 14 of the reporting year;

g) Reporting form: according to Form No. 01 in Appendix XXVI issued together with this Circular.

2. The Department of Construction sends reports on legal knowledge training and certificate issuance for legal knowledge on road traffic to the Vietnam Highway Administration, including:

a) Report name: report on legal knowledge training and certificate issuance for legal knowledge on road traffic;

b) Content required in the report: number of training bases, management of training, number of trainees, number of certificates issued and reissued;

c) Method of sending the report: direct delivery or through postal services or electronic environment;

d) Deadline for submitting the report: before June 20 each year for the mid-year report; before December 20 each year for the annual summary report;

đ) Frequency of reporting: semi-annual report for the first six months of the year and annual report;

e) Time to finalize the report data: for the mid-year report, from December 15 of the previous year to June 14 of the reporting period; for the annual report, from December 15 of the previous year to December 14 of the reporting year;

g) Reporting form: according to Form No. 02 in Appendix XXVI issued together with this Circular.

Chapter VI

IMPLEMENTING PROVISIONS

Article 33. Effective Date

1. This Circular takes effect from September 1, 2025.

2. This Circular abolishes Circular No. 35/2024/TT-BGTVT dated November 15, 2024 of the Minister of Transport on the regulations regarding driver training, examination, and license issuance; international driver's license issuance; legal knowledge training, examination, and certificate issuance for road traffic law.

Article 34. Transitional Provisions

1. For courses that have commenced before the effective date of this Circular but have not completed the final examination before the effective date of this Circular, the training institution may independently choose the assessment process for theoretical and practical training content of students to determine course completion according to this Circular or according to Circular No. 35/2024/TT-BGTVT dated November 15, 2024 of the Minister of Transport.

2. For courses that have completed the final examination before the effective date of this Circular, continue to confirm course completion according to Circular No. 35/2024/TT-BGTVT dated November 15, 2024 of the Minister of Transport.

3. For completion certificates and legal knowledge training certificates issued before the effective date of this Circular, they remain valid for use according to the regulations.

4. The Department of Construction and driving school training institutions will continue to transmit and receive data related to driver training through the driver's license information system until June 30, 2026./.
