CIRCULAR

Supplementing Circular Jointly Issued by the Ministry of Administration and Finance No. 43-TT/LB dated November 30, 1957 on Certain Temporary Regulations for Cadres, Workers, and Employees Working in Mountainous Areas and Remote Islands

While awaiting the study of a comprehensive policy for cadres, workers, and employees working in mountainous areas and remote islands, with the agreement of the Standing Committee of the Council of Ministers, the Joint Ministry of Administration - Labor - Finance issues this circular to supplement Circular No. 43-TT/LB jointly issued by the Ministry of Administration and Finance on November 30, 1957. This supplementation is based on the following principles:

- Addressing certain specific and urgent regulations without hindering the improvement of salary and social insurance policies in 1960.

- Paying attention to the working conditions in highland and remote island areas, distinguishing between highland and lowland regions, and between remote islands and nearby islands.

I. CERTAIN SPECIFIC REGULATIONS.

1. Travel Allowance.

Due to the special circumstances of mountainous areas, travel allowance is not calculated based on kilometers or meals outside the office as in lowland areas but is determined according to the specific journey as follows:

- Increasing the allowance from 1đ20 to 1đ60 for cadres, workers, and employees traveling on a journey that takes one day in highland areas, half a day is counted as half a meal, regardless of whether they eat inside or outside the office. In cases of emergency requiring night travel from 2 to 3 hours, a half-day allowance is granted, more than 3 hours grants a full-day allowance. Traveling from one commune to another also qualifies for travel expenses according to the specified route and time, but days spent staying at the work commune are not counted.

- Increasing the daily allowance from 0đ40 to 0đ80 for cadres, workers, and employees who regularly travel in highland areas, and 0đ40 per day for those traveling in lowland areas; half a day counts as half a meal, regardless of whether they eat inside or outside the office. Days spent working at one place do not qualify for an allowance.

2. Sick Leave Allowance.

Increasing the sick leave allowance from 0đ40 to 0đ80 per day for cadres, workers, and employees working in highland and remote island areas, and from 0đ30 to 0đ50 for those in lowland areas when they are ill and stay at the office, factory, cooperative, farm, forest, or village house, with certification from the office, factory, cooperative, farm, forest, or commune administrative committee.

3. Work Equipment.

For cadres, workers, and employees in highland and remote island areas who frequently travel on work, one person will be provided with: 1 cotton coat, 1 raincoat or 2.5 meters of nylon, 2.5 meters of Nam Dinh canvas, 1 water bottle. The review period for provision is every three years; during this period, if they change their work to lowland or plain areas, the office must reclaim these items to provide them to others.

As for cadres, workers, and employees working in highland and remote island areas but not required to travel far, such as those working in offices, shops, factories, cooperatives, farms, forests, tax stations, etc., this provision does not apply.

II. APPLICANTS AND IMPLEMENTATION TIME

This circular applies to cadres, workers, and employees in administrative bodies, organizations, enterprises, cooperatives, farms, and forests in mountainous areas. However, each sector and locality must base their specific implementation on the characteristics of their own sector and locality, and not all sectors and localities need to fully implement all supplementary regulations in this circular.

For survey teams and geological exploration teams which already have mobile allowance regulations, if this circular is applied, the relevant ministries must consult and reach consensus with the Ministry of Labor before guiding its implementation.

The classification of highland and lowland areas remains as defined by the local administrative committees in applying Circular No. 43-TT/LB dated November 30, 1957. Specifically, for remote islands, the Joint Ministry stipulates that the three islands: Bai Tu Chinh, Long Chau, Co To shall apply Points 2 and 3 of this circular.

This circular begins implementation upon issuance, without retroactive claims.
