DECREE-LAW

NO.: 140/SL DATE: DECEMBER 21, 1949

OF THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

CHAIRMAN

THE DEMOCRATIC REPUBLIC OF VIETNAM

 

Pursuant to Decree-Law No. 50 - SL dated June 18, 1949 organizing the Ministry of National Defense;

Pursuant to Decree-Laws Nos. 33 dated March 22, 1946 and No. 71 dated May 22, 1946 establishing and regulating the rules for the Vietnamese National Army;

Pursuant to Decree-Law No. 126 - SL dated November 4, 1949 imposing military service obligations;

At the proposal of the Minister of National Defense;

In accordance with the resolution of the Council of Ministers after consultation with the Standing Committee of the National Assembly;

 

ISSUES THE FOLLOWING DECREE-LAW

Article 1

Articles 19 and 20 of the Rules for the Vietnamese National Army established by Decree-Law No. 71 dated May 22, 1946 are hereby amended as follows:

"New Article 19"

Persons without military service obligations, including women, those who have not yet reached military age but are over sixteen years old, and persons with military service obligations who are not currently called up for enlistment may volunteer to join the army for a period of three years.

After this period, they can re-enlist voluntarily for two-year periods until the age of 45. During wartime, those aged over 45 wishing to volunteer will be decided by the Minister of National Defense.

At the age of 45, if they are at the rank of Lieutenant Colonel, they may remain in service up to the age of 50.

At the age of 50, if they are at the rank of General, they may remain in service until this final age limit.

"New Article 20"

Conditions for voluntary enlistment:

Age: throughout the period of military service obligation.

Conduct: must have good conduct.

Health: must be certified by a medical officer in the army.

Each time re-enlisting, they must undergo another health examination and their conduct and performance must be assessed by a commanding officer.

Article 2

All provisions contrary to this Decree-Law are hereby abolished.

Article 3

The Minister of National Defense shall implement this Decree-Law in accordance with its provisions.
