THE MINISTER OF TRANSPORTATION
On the basis of Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks of state management and the organizational structure of the Ministry of Transport;
On the basis of Decree No. 77/CP dated June 18, 1997 of the Government promulgating regulations on investment under the Build-Operate-Transfer (BOT) contract form applicable to domestic investment;
On the basis of Circular No. 5372/KTN dated October 24, 1996 and Circular No. 1460/KTN dated March 28, 1997 of the Government regarding the BOT investment in the Co May Bridge and the connecting road to the Co May Bridge;
On the basis of Circular No. 5179/KTN dated October 15, 1997 of the Government regarding the BOT construction contract for the Co May Bridge and road;
On the basis of Contract No. 1084/HĐ-QLXD dated August 23, 1997 between the Vietnam Highway Administration and Hai Chau Limited Liability Company;
On the basis of Circular No. 1825/VPCP-CN dated April 29, 1999 of the Government Office regarding the organization of fee collection for the Co May Bridge and road on National Highway 51;
On the basis of Circular No. 2298/TC/TCT dated May 13, 1999 of the Ministry of Finance regarding the collection of fees for the Co May Bridge and the connecting road;
On the basis of Circular No. 2171/UB-VP dated June 11, 1999 of the Chairman of the People's Committee of Ba Ria-Vung Tau Province regarding the organization of fee collection for the BOT project of the Co May Bridge and road;
In accordance with the proposal of the Director of the Vietnam Highway Administration and the Director of the Financial Accounting Department regarding the organization of traffic fee collection on National Highway 51 (BOT contract).
DECISION:
Article 1. Now, assign Hai Chau Limited Liability Company to establish Toll Station No. 2 on National Highway 51 at Kilometer 67 to collect fees according to the BOT contract. The fee collection period starts from June 19, 1999, and during the collection process, it must ensure that vehicles can pass smoothly, safely, and without causing traffic congestion.
After the operation period specified in Contract No. 1084/HĐ-QLDA dated August 23, 1997 and the amendments to the contract signed, Toll Station No. 2 will be transferred to the Vietnam Highway Administration to continue collecting fees according to Circular No. 3328/KTN dated July 3, 1997 of the Prime Minister.
Article 2. The objects subject to collection, exemption, and reduction shall be implemented in accordance with Circular No. 57/1998/TT-BTC dated April 27, 1998 of the Minister of Finance.
Article 3. The toll rates at Toll Station No. 2 on National Highway 51 shall be implemented according to Circular No. 5179/KTN dated October 15, 1997 of the Prime Minister (attached table).
Article 4. Hai Chau Limited Liability Company must maintain accounting records and report and manage the collected toll fees in accordance with the prescribed state regulations.
Article 5. Directors of the Vietnam Highway Administration, Directors of the Financial Accounting Department, Head of the Ministry's Office, Director of Hai Chau Limited Liability Company, and related units are responsible for implementing this decision.
