Directive No. 1405/CT-TTg on continuing to manage agricultural and forestry vehicles, three-wheeled motorized vehicles, and three- and four-wheeled non-motorized vehicles in accordance with Government Resolutions No. 32/2007/NQ-CP dated June 29, 2007, and No. 05/2008/NQ-CP dated February 4, 2008.

DIRECTIVE

Regarding the continued implementation of management for agricultural and forestry vehicles, three-wheeled motor vehicles, and three- and four-wheeled non-motorized vehicles in accordance with Resolution No. 32/2007/NQ-CP dated June 29, 2007 and Resolution No. 05/2008/NQ-CP dated February 4, 2008 of the Government

Implementing Resolution No. 32/2007/NQ-CP dated June 29, 2007 and Resolution No. 05/2008/NQ-CP dated February 4, 2008 of the Government, ministries, sectors, and localities have strengthened state management work, organized the implementation of appropriate measures and policies to fit actual conditions and circumstances to concretize the Resolutions and the Government's action program. These efforts have contributed to reducing traffic congestion and controlling traffic accidents.

However, during the implementation process, some difficulties have arisen that need further guidance and instructions, specifically regarding: determining types of vehicles prohibited from participating in traffic; defining the scope and time of operation for registered three-wheeled motor vehicles and unregistered three- and four-wheeled non-motorized vehicles within the locality; issuing and implementing support policies for vehicle conversion and career change for individuals whose vehicles are prohibited from participating in traffic.

To build on the achieved results, continue to strengthen traffic order and safety assurance work, and resolve difficulties, the Prime Minister issues the following directive:

1. Provincial People's Committees and Municipal People's Committees under the Central Government shall promptly implement the following tasks:

a) Strengthen propaganda and mobilization of vehicle owners and local residents to strictly comply with the Government's regulations on managing agricultural and forestry vehicles, three-wheeled motor vehicles, and three- and four-wheeled non-motorized vehicles participating in traffic.

b) Issue and implement mechanisms and policies to support career changes and vehicle conversions for individuals whose vehicles are prohibited from participating in traffic, particularly focusing on individuals with disabilities.

c) Strictly enforce the prohibition of participation in traffic for the following types of vehicles:

- Agricultural and forestry vehicles assembled from single-cylinder diesel engines and reused automobile components, also known as side-mounted vehicles or modified vehicles;

- Unregistered and unnumbered three-wheeled motor vehicles;

- Two-wheeled motor vehicles towing trailers for passenger and cargo transport, also known as motorized carts but without registration and number plates.

d) For small utility motorcycles serving agriculture and forestry production with multiple functions such as plowing, pumping water, generating electricity, and transporting goods;

- Direct relevant local authorities to conduct technical safety inspections, registrations, and issuance of number plates for these vehicles; train, test, and issue driving licenses for drivers according to current regulations;

- Based on local actual conditions, specify the scope and time of operation for this type of vehicle.

đ) For three-wheeled motor vehicles already registered and numbered that are currently in operation (excluding three-wheeled motor vehicles used as personal transportation for individuals with disabilities): based on local actual conditions and requirements for maintaining traffic order and safety, specify the scope, time, and phased reduction leading to prohibition of participation in traffic on national highways with high traffic density, and within urban areas.

e) For three-wheeled motor vehicles driven by individuals with disabilities participating in traffic without registration and number plates:

- Direct relevant authorities to review and tally the number of vehicles in this category, guide technical safety inspections, registrations, issuance of number plates for these vehicles, and training, testing, and issuance of driving licenses for drivers according to current regulations;

- Based on local actual conditions and support policies, set deadlines for prohibiting circulation and procedures for technical safety inspections, registrations, and issuance of number plates. During the implementation of these procedures, allow three-wheeled motor vehicles driven by individuals with disabilities that have not yet undergone technical safety inspections, registrations, and issuance of number plates to temporarily participate in traffic. Individuals with disabilities who own such vehicles must proactively complete the required technical safety inspections, registrations, and issuance of number plates to legally participate in traffic.

g) For motorized carts already registered and numbered that are currently in operation: specify a temporary period for participation in traffic, but not later than June 30, 2009.

h) For three- and four-wheeled non-motorized vehicles, review, issue, and organize the implementation of regulations concerning vehicle safety conditions, scope, and time of operation.

i) Strengthen inspections and strictly handle violations of road traffic laws, especially those involving the types of vehicles specified in point c of this clause participating in traffic.

a) Review, amend, and supplement regulations and standards on technical quality and environmental protection for three-wheeled motor vehicles used as personal transportation for individuals with disabilities, aiming to facilitate their participation in traffic.

b) Organize and guide the training, testing, and issuance of driving licenses for drivers of three-wheeled motor vehicles and small utility motorcycles participating in traffic.

c) Coordinate with the National Traffic Safety Committee to compile the implementation status of this Directive and report to the Prime Minister.

2. The Ministry of Transport:

3. Ministry of Public Security:

a) Strengthen inspections and handling of violations related to the conditions for participation in traffic of road vehicles and their drivers according to current regulations.

b) Organize and guide the registration and issuance of number plates for three-wheeled motor vehicles used as personal transportation for individuals with disabilities and small utility motorcycles ensuring compliance with technical safety regulations.

4. Ministry of Health:

a) Promptly develop Regulations on health standards for individuals with disabilities permitted to drive three-wheeled motor vehicles used as personal transportation for individuals with disabilities participating in traffic, to be issued before December 30, 2008.

b) Organize health examinations for individuals with disabilities who wish to drive three-wheeled motor vehicles used as personal transportation for individuals with disabilities participating in traffic.

4. Ministry of Health:

a) Promptly develop Regulations on health standards for persons with disabilities permitted to operate three-wheeled motor vehicles used as means of transportation for persons with disabilities participating in traffic, to be issued before December 30, 2008.

b) Organize health examinations for persons with disabilities who have the need to operate three-wheeled motor vehicles used as means of transportation for persons with disabilities participating in traffic.

5. Ministry of Finance: urgently develop and issue before December 30, 2008, general policies to support the conversion of vehicles and occupational change for subjects whose means of transportation have been suspended from traffic participation, with particular attention to those who are disabled.

6. Ministry of Labor, Invalids and Social Affairs: guide and urge localities to build and implement training programs and plans for occupational conversion and job creation for subjects whose means of transportation have been suspended from traffic participation.

7. Ministry of Information and Communications directs information and communication agencies to strengthen propaganda and dissemination of the Government's regulations on managing agricultural and forestry vehicles, three-wheeled motor vehicles, and three- and four-wheeled simple vehicles to achieve public consensus.

8. Ministry of Industry and Trade: stipulate conditions and organize the issuance of permits for production facilities that meet the criteria for producing and assembling motorized vehicles for the disabled.

9. Request the Vietnam Fatherland Front, the Vietnam Farmers' Association, the Vietnam Veterans Association, and the Vietnam Disabled Persons' Association to cooperate in supporting relevant ministries, sectors, and People's Committees at all levels in promoting and mobilizing vehicle owners and local residents to strictly adhere to the Government's policy on managing agricultural and forestry vehicles, three-wheeled motor vehicles, and three- and four-wheeled simple vehicles./.
