DECISION

Regarding the organization restructuring and supplementation of functions and tasks

of the Institute for Occupational Safety and Health Science and Technology Research

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decision No. 324/CT dated September 11, 1992 of the Chairman of the Council of Ministers (now the Prime Minister) on the reorganization of the network of scientific research institutions and technology development, and Decision No. 782/TTg dated October 24, 1996 of the Prime Minister on the restructuring of scientific research and technology deployment agencies;

Pursuant to Decision No. 82/CP dated May 1, 1971 of the Council of Ministers (now the Government) on the establishment of the Institute for Occupational Safety and Health Science and Technology Research;

Considering the proposal of the General Confederation of Labor Vietnam's Executive Board, the Minister of Science, Technology and Environment, and the Head of the Civil Service Organization and Cadre Department of the Government,

DECISION:

Article 1. Supplementing the Institute for Occupational Safety and Health Science and Technology Research into the list of Institutes specified in Section 1, Article 1 of Decision No. 782/TTg dated October 24, 1996 of the Prime Minister on the restructuring of scientific research and technology deployment agencies.

Article 2. The Institute for Occupational Safety and Health Science and Technology Research shall be under the management of the General Confederation of Labor Vietnam and subject to the direction of the Ministry of Science, Technology and Environment regarding scientific and technological activities.

Article 3. The Institute for Occupational Safety and Health Science and Technology Research shall have the following tasks:

1. Implementing the scientific and technological research tasks related to occupational safety and health assigned by the State:

- Developing and applying science and technology in occupational safety and health.

- Participating in drafting and evaluating occupational safety and health standards, environmental impact assessments, and working conditions of workers; compiling occupational safety and health standards.

- Building and developing the scientific and technological capacity of the Institute to meet the requirements of occupational safety and health research and development.

2. Implementing tasks assigned by the General Confederation of Labor Vietnam:

- Assisting the General Confederation of Labor Vietnam in participating with state authorities in formulating policies, regulations, and legal documents on occupational safety and health.

- Studying and applying organizational, management, guidance, and inspection measures for labor protection work within the trade union system.

3. Providing information, consulting, propaganda, training, and upgrading knowledge on occupational safety and health for managers, employers, and workers; participating with educational institutions in training personnel on occupational safety and health according to state regulations.

4. Implementing scientific and technological services and international cooperation in occupational safety and health and environmental protection in accordance with state regulations.

Article 4. The staffing of the Institute for Occupational Safety and Health Science and Technology Research shall be included in the scientific public service sector determined annually by the Civil Service Organization and Cadre Department of the Government and the Ministry of Science, Technology and Environment.

The operating funds of the Institute for Occupational Safety and Health Science and Technology Research include funds allocated from the state budget, provided by the General Confederation of Labor Vietnam, and other sources.

Article 5. The structure and organization of the Institute for Occupational Safety and Health Science and Technology Research:

1. The leadership of the Institute consists of the Director and Deputy Directors. The Director and Deputy Directors are appointed and relieved of their duties by the General Confederation of Labor Vietnam's Executive Board.

The Director is responsible to the State and the General Confederation of Labor Vietnam's Executive Board for all activities of the Institute. The Deputy Directors assist the Director as assigned by the Director.

2. The structure, organization, and operation of the Institute shall be proposed by the Director and decided upon by the General Confederation of Labor Vietnam's Executive Board.

Article 6. This Decision shall take effect fifteen days from the date of signature. All previous regulations that conflict with this Decision are hereby abolished.

The General Confederation of Labor Vietnam's Executive Board shall promulgate the Charter of the Institute for Occupational Safety and Health Science and Technology Research based on this Decision, in accordance with general regulations.

Article 7. The General Confederation of Labor Vietnam's Executive Board, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of provincial and centrally-administered city People's Committees, and the Director of the Institute for Occupational Safety and Health Science and Technology Research are responsible for implementing this Decision./.
