Guidelines for implementing the level of care expenses

 for persons who have rendered meritorious service to the revolution

Pursuant to Decree No. 28/CP dated April 29, 1995 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution.

Implementing Circular No. 6014/KGVX dated November 29, 1997 of the Prime Minister regarding the supplementation of policies for the care of persons who have rendered meritorious service to the revolution.

After reaching consensus with the Ministry of Labor, Invalids and Social Affairs, the Ministry of Finance provides guidelines for implementing the level of care expenses for persons who have rendered meritorious service to the revolution as follows:

I. ELIGIBLE PERSONS FOR CARE

- Persons who were engaged in revolutionary activities before August 1945 as stipulated in Article 6 and Article 8 of Decree No. 28/CP dated April 29, 1995 of the Government (excluding those eligible for care benefits under the regulations of the Central Organization Committee).

- War invalids, persons enjoying benefits equivalent to war invalids (hereinafter referred to as war invalids) and sick invalids with a disability rate of 81% or more, suffering from severe wounds or diseases as specified in Article 34 and Article 50 of Decree No. 28/CP dated April 29, 1995 of the Government, war invalids and sick invalids with a disability rate of 81% or more suffering from chronic unstable wounds or diseases, deteriorating health.

- Mothers of Martyrs (or fathers of martyrs who are husbands of Mothers of Martyrs), National Hero of Armed Forces, National Labor Hero (excluding those eligible for care benefits under the regulations of the Ministry of Defense, Ministry of Public Security, and the General Confederation of Labor of Vietnam).

- Relatives of two martyrs.

- Persons who were engaged in revolutionary activities or resistance activities and were captured and imprisoned by the enemy for many years, resulting in poor health, or were sentenced to death by the enemy.

- Persons who helped the revolution before August 1945 and were awarded a certificate of merit, persons who helped the revolution during the resistance and are now elderly, lonely, and without support.

II. CARE PERIOD AND EXPENSE LEVEL:

1. Care period: The subjects mentioned in Point 1, Part I of this Circular shall enjoy a rotational care system once a year for a period of 10 days (excluding travel time).

2. Care expense level: VND 500,000 for one person for one care session lasting 10 days (regardless of whether the care is provided at a care center or at home). This includes:

- Breakfast and two main meals throughout the session: VND 350,000.

- Nutritional supplements and common medications throughout the session: VND 50,000.

- Other expenses (including: face towels, soap, toothpaste, toothbrushes, toilet paper, listening to current affairs broadcasts, watching cultural performances, taking commemorative photos, gifts upon return home): VND 100,000.

During the care period, if sudden illness occurs, the subject will be referred for treatment at the nearest hospital according to the current health insurance regulations.

III. SOURCES OF FUNDS FOR CARE EXPENSES

1. The funds allocated according to the care standards specified in Part II of this Circular shall be guaranteed by the State budget annually based on the announced plan.

2. The funds for transportation of persons who have rendered meritorious service to care centers and other expenses (if any) shall be covered by the local government budget from the annual social security fund.

3. Rehabilitation funds shall be issued, used, and settled according to the current regulations of the State.

IV. IMPLEMENTATION ORGANIZATION:

1. In the short term, over several years, based on the total care funds announced by the State and the actual number of eligible subjects in each locality, the Ministry of Labor, Invalids and Social Affairs will coordinate with the Ministry of Finance to allocate and announce these funds to localities for implementation.

Specifically, the care funds (Point 2, Part III) assigned as a local government budget task shall be prepared by the Department of Labor, Invalids and Social Affairs and approved by the People's Committee of the province or city, and included in the annual budget.

Strictly prohibited is the use of care funds for purposes other than those specified in this Circular.

2. Care for persons who have rendered meritorious service to the revolution shall primarily be conducted at care centers for persons who have rendered meritorious service under the Labor, Invalids and Social Affairs sector. For localities far from such centers, care may be organized at healthcare facilities or labor unions within the locality, as decided by the provincial or municipal People's Committee.

3. In addition to centralized care methods mentioned above, to suit the conditions of injury, illness, and health of some very weak individuals, localities may use part of the care funds to provide home-based care.

Based on the care expense level for one person, the Department of Labor, Invalids and Social Affairs of the province or city will coordinate with the Department of Finance and Price Control to organize home visits, issue medication, and guide appropriate dietary regimens suitable for age, health status, and specific illnesses of each individual, ensuring that those receiving home-based care enjoy the same standards as those receiving centralized care.

4. This Circular takes effect 15 days after its date of issuance.

Any issues arising during implementation should be promptly reported to the Ministry of Finance for resolution.
