Regarding the amendment of certain Articles of the Regulation on Issuing Legal Normative Documents of the State Bank issued together with Decision No. 180/2005/QĐ-NHNN dated February 21, 2005 of the Governor of the State Bank

GOVERNOR OF THE STATE BANK OF VIETNAM

Pursuant to the Law on the State Bank of Vietnam 1997; the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam 2003;

Pursuant to the Law on Issuing Legal Normative Documents 1996; the Law Amending and Supplementing Certain Provisions of the Law on Issuing Legal Normative Documents 2002;

Pursuant to Decree No. 52/2003/ND-CP dated May 19, 2003, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

Pursuant to Decree No. 101/CP dated September 23, 1997 of the Government detailing the implementation of certain provisions of the Law on Issuing Legal Normative Documents;

Pursuant to Decree No. 135/2003/NĐ-CP dated November 14, 2003 of the Government on inspection and handling of legal normative documents;

Pursuant to Decree No. 122/2004/NĐ-CP dated May 18, 2004 of the Government stipulating functions, tasks, powers, and organization of legal affairs units of Ministries, ministerial-level agencies, government agencies, specialized agencies under provincial people's committees, and state-owned enterprises;

Article 1. Amend certain Articles of the Regulation on Issuing Legal Normative Documents of the State Bank issued together with Decision No. 180/2005/QĐ-NHNN dated February 21, 2005 of the Governor of the State Bank as follows:

1. Replace Model No. 1, Model No. 2, and Model No. 4 accompanying the Regulation with Model No. 1, Model No. 2, and Model No. 4 accompanying this Decision.

Replace Model No. 3 accompanying the Regulation with Model No. 5 accompanying this Decision; replace Model No. 5 accompanying the Regulation with Model No. 3 accompanying this Decision.

2. Point d Clause 2 Article 3 is amended as follows:

“d. Joint Circulars between the State Bank and Ministries, ministerial-level agencies, Supreme People's Court, Supreme People's Procuracy, and political-social organizations to guide the implementation of legal normative documents related to the tasks of the State Bank and those agencies and organizations (according to Model No. 5 accompanying this Regulation).”

3. Abolish the phrase “(according to Model No. 3 accompanying this Regulation)” at Point đ Clause 2 Article 3; abolish the phrase “(according to Model No. 6 accompanying this Regulation)” at Article 18; abolish Model No. 6 accompanying the Regulation.

4. Amend the phrase “Article 15” at Clause 2 Article 15 to “Article 14,” the phrase “Article 20” at Clause 2 Article 18 to “Article 19,” the phrase “Article 15” at Point a Clause 1 Article 21 to “Article 14,” the phrase “Articles 17 and 18” at Point b Clause 1 Article 21 to “Articles 16 and 17,” the phrase “Articles 20 and 21” at Point d Clause 1 Article 21 to “Articles 19 and 20,” the phrase “Article 20” at Point b Clause 2 Article 21 to “Article 19.”

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Director of the Office, Heads of the Legal Affairs Department, and Heads of units under the State Bank shall be responsible for implementing this Decision./.
