CIRCULAR

JOINT MINISTRY OF INTERIOR AND MINISTRY OF TRANSPORTATION

Regarding the transfer of tasks and coordination of work between

the Ministry of Interior and the Ministry of Transportation to implement Decree No. 36/CP dated May 29, 1995 of the Government

To implement Article 5 and Article 6 of Decree No. 36/CP dated May 29, 1995 of the Government stipulating the tasks, responsibilities, and authorities of the Ministry of Transport and the Ministry of Interior in ensuring traffic safety and order on roads and urban traffic safety and order. The Joint Ministry of Interior and Ministry of Transportation guides the transfer of tasks and coordination of work between the two Ministries as follows:

I. General Provisions

1. From August 1, 1995, the Ministry of Transport shall organize the implementation of tasks assigned by the Government, including technical inspection and issuance of circulation permits for motor vehicles; organizing management of training, examination, and issuance of driving licenses for motor vehicles (except for vehicles and drivers used for military purposes by the Ministry of Defense and for security and social order purposes by the Public Security sector).

2. The handover of job contents and related issues from the Ministry of Interior (the transferring party) to the Ministry of Transport (the receiving party) will be carried out simultaneously at central and local levels (provinces and cities) to ensure that motor vehicles and drivers can operate without interruption.

3. The Ministry of Interior and the Ministry of Transport shall closely coordinate and direct public security forces and transportation forces (Public Works Transportation) in areas related to the work of ensuring road traffic safety and order and urban traffic safety and order.

II. Provisions on the Handover from the Ministry of Interior to the Ministry of Transport

1. Contents of the handover.

a. Handover of periodic technical inspection and issuance of circulation permits:

The Ministry of Interior shall notify the Ministry of Transport in writing:

- The total number of motor vehicles that have been issued circulation permits over time, categorized by vehicle type and province/city. The Traffic Police Corps directly hands over to the Vietnam Highway Administration, while the Provincial/City Traffic Police Corps hands over to the local Department of Transport (Public Works Transportation). When handing over, clearly inform the number of vehicles whose circulation permits expire in August 1995.

- Regulations on technical standards for various types of motor vehicles serving as the basis for issuing circulation permits; relevant documents and ledgers, templates for circulation permits.

b. Handover of examination and issuance of driving licenses:

The Ministry of Interior shall hand over to the Ministry of Transport:

- Regulations on standards and conditions for issuing driving licenses, regulations on renewal, issuance, and reissuance of driving licenses.

- Regulations on monitoring driving schools (schools, centers), regulations on managing motor vehicle drivers (methods, principles, procedures...).

- List of drivers who have been issued driving licenses, categorized by license type and province/city. Distinguish between non-professional and professional driving licenses.

- Notify the number of driving schools and training centers in each province/city and nationwide monitored by traffic police.

2. Method and schedule of handover:

- The Traffic Police Corps directly hands over to the Vietnam Highway Administration.

- Provincial/City Public Security directly hands over to the Department of Transport (Public Works Transportation).

- Organize handover between the Traffic Police Corps and the Vietnam Highway Administration; then draw lessons to guide localities.

- The handover process will be conducted separately for each type of job content. Staff directly responsible for handing over a specific job content must sign the handover record for that content. The general record must be signed by the heads of both parties' agencies. The Directors of the two Public Security Departments and the Director of the Department of Transport (Public Works Transportation) must be responsible for the handover and report the results to the Ministry of Interior and the Ministry of Transport.

III. Provisions on Coordination of Work Between the Ministry of Interior and the Ministry of Transport in Certain Areas

1. Provisions on coordination in monitoring registration of vehicles, periodic technical inspection, issuance of circulation permits, and examination for issuance of driving licenses.

- For motor vehicles after registration, the Traffic Police Corps and local traffic police shall notify the Vietnam Highway Administration and local Departments of Transport (Public Works Transportation) in writing about the number and types of vehicles registered monthly on days 3 to 5 for technical inspection and issuance of circulation permits.

- The Vietnam Highway Administration and local Departments of Transport (Public Works Transportation) shall notify the Traffic Police Corps and local public security departments (traffic police) in writing on days 3 and 5 of the expiration date and number of vehicles issued circulation permits, and the number of different types of driving licenses issued for traffic police to monitor and control.

- Once the two ministries complete their information systems and establish a direct computer network between the two ministries and between the ministries and localities, notifications will be made directly, continuously, and regularly.

2. Coordination in organizing and directing traffic:

- The Transportation sector shall take the lead and cooperate with the Public Security sector in organizing traffic, setting routes, placing traffic signs, defining parking and stopping points, and ensuring safe passage on roads and urban streets.

- The Department of Transport (Public Works Transportation) shall proactively cooperate with traffic police in establishing traffic signal systems and ensuring continuous operation of these systems. Traffic police shall be responsible for managing and using traffic signal systems effectively.

- When constructing new roads, the Ministry of Transport shall cooperate with the Ministry of Interior regarding measures to ensure traffic safety and installation of traffic signs along the entire route.

3. Coordination in monitoring, analyzing traffic accidents, and proposing preventive measures against traffic accidents:

- On a monthly basis from the 3rd to the 5th, the Provincial Police shall notify in writing to the Department of Transport (Public Works) regarding the number of traffic accidents, the extent of casualties and property damage, and the causes of traffic accidents (due to drivers, vehicles, pedestrians, road works...). For traffic accidents causing serious casualties and property damage, the Traffic Police must promptly inform the Department of Transport (Public Works) to coordinate in resolving the aftermath.

- When the computer system is networked: information exchange on traffic accidents is regular and direct, with the reporting entity responsible for initial statistical data.

IV. Implementation Organization

The Ministry of Interior directs the Highway Police Corps, and the provincial police under the central government's jurisdiction, in the handover and coordination of work with the Department of Transport (Public Works).

The Ministry of Transport directs the Vietnam Highway Administration, the Vietnam Vehicle Inspection Agency, and the Departments of Transport (Public Works) in the handover and coordination of work with the Ministry of Interior.

Files and documents not directly related to daily business operations should be handed over early, and all other matters must be completed by no later than July 31, 1995.

The two Ministries of Transport and Interior agree to maintain and strengthen the operation of the Central Road Safety Committee established by Joint Circular No. 44/QĐ/LB dated May 28, 1991, to coordinate activities between the two ministries in the field of traffic safety and order.

The Joint Ministry requests that all Bureaus, Departments, Departments of Transport (Public Works), and Provincial and City Police organize the implementation of the above regulations effectively.

Any difficulties encountered during implementation should be reported promptly for the Joint Ministry to study and resolve or supplement and adjust.

This Circular takes effect from the date of signature.
