Guidelines for managing and using state budget to implement publication and distribution of the bilingual newspaper "Dân tộc và Miền núi" from 2013 to 2015

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Implementing the guidance of the Prime Minister in Circular No. 10473/VPCP-KTTH dated December 20, 2012 of the Government Office;

At the proposal of the Director of the Department of Administrative and Public Financial Affairs;

The Minister of Finance issues this Circular to regulate the management mechanism and usage of funds for implementing the publication of the bilingual newspaper "Dân tộc và Miền núi" for ethnic minorities with recognized writing systems from 2013 to 2015 as follows.

Article 1. Scope of Regulation and Applicability

Article 1. Scope of Regulation: This Circular guides the management and use of the state budget for the publication and distribution of the bilingual newspaper "Dân tộc và Miền núi" for certain ethnic minorities with recognized writing systems.

a) Ministries, sectors, People's Committees of provinces and centrally governed cities that have ethnic groups with recognized writing systems;

b) Other agencies, organizations, and individuals related to the management and use of the state budget for the publication and distribution of the bilingual newspaper "Dân tộc và Miền núi".

Article 2. Regarding Recipients and Amount of the Bilingual Newspaper "Dân tộc và Miền núi"

1. At the Central Level:

a) Central Committee for Mass Mobilization, Central Propaganda Department, Steering Committees for Southwest, Central Highlands, Northwest, National Ethnic Council, Standing Committee on Ethnic Affairs of the National Assembly, Ministry of Culture, Sports and Tourism, Ministry of Information and Communications: each unit receives two copies per issue of the bilingual edition (hereinafter referred to as bilingual);

b) National Library: five copies per issue of the bilingual edition.

2. Provincial level:

a) Provincial Ethnic Minority Department, Provincial Department of Culture, Sports and Tourism, Provincial Department of Education and Training, Provincial Propaganda Department, Provincial People's Committee for Fatherland Front: each unit receives two copies per issue of the bilingual edition;

b) Provincial schools, provincial libraries: each unit receives five copies per issue of the bilingual edition;

c) Vietnam News Agency branches in provinces, team 123 (Provincial Military Command), translators and proofreaders: each entity receives one copy per issue of the bilingual edition.

3. District level:

a) District libraries, district cultural houses: each unit receives five copies per issue of the bilingual edition;

b) District Ethnic Minority Departments, District People's Committees for Fatherland Front, District Education Departments, District Cultural Departments, District Propaganda Departments: each unit receives one copy per issue of the bilingual edition.

4. Khmer temples, border guard posts: each unit receives three copies per issue of the bilingual edition.

5. Other recipients: minority language classes, teachers teaching minority languages; District People's Committees, Village People's Councils, hamlets, phum socs; village chiefs, respected community members, communal cultural houses, rural post offices, each recipient receives one copy per issue of the bilingual edition.

6. Submission for archival purposes: In accordance with current regulations.

Article 3. Regarding Format, Quality, and Content of the Bilingual Newspaper "Dân tộc và Miền núi"

1. Form:

Dimensions: 20.5 x 28.5 cm.

Inner paper and cover: color printing on 100 g/m2 Couches paper.

100% color photos, clear and sharp.

Number of pages of the publication: 48 pages.

Number of issues: one per month.

2. Content:

Presented in common script and scripts of ethnic minorities with recognized writing systems; content covers the entire country, with depth on ethnic regions; articles are concise, condensed, easy to understand and remember; topics are clearly presented with high guidance value, providing all necessary information.

Article 4. Publishing, distributing, managing and using the bilingual "Dân tộc và Miền núi" Photo Newspaper

1. Annually, based on the subjects entitled to receive the bilingual "Dân tộc và Miền núi" Photo Newspaper as stipulated in Article 2, central ministries, sectors and provincial People's Committees shall compile a list of recipients within their jurisdiction and submit it to Vietnam News Agency for review before June 30 each year to serve as the basis for determining the number of publications and distributions needed for the following year, but not exceeding the maximum number approved by the Prime Minister for each language version.

2. Based on the list of subjects mentioned in Clause 1 of this Article, Vietnam News Agency shall carry out the publication; the Central Press Distribution Company (under Vietnam Post Corporation - Ministry of Information and Communications) shall be responsible for distributing the bilingual "Dân tộc và Miền núi" Photo Newspaper to ensure sufficient quantity, timely delivery, and correct addresses according to the approved list, with confirmation from participating distribution units under economic contracts signed between the two agencies.

3. Managing and using the bilingual "Dân tộc và Miền núi" Photo Newspaper (applicable to the subjects specified in Article 2 of this Circular).

a) At the central level:

Ministries, sectors, and organizations receiving the publication shall be responsible for managing and using it to grasp information to serve advisory, directive, and propaganda dissemination work aimed at organizing the effective implementation of Party guidelines and State policies among ethnic minorities.

b) The bilingual "Dân tộc và Miền núi" Photo Newspaper distributed to localities:

- Individuals receiving the publication shall be responsible for managing and using it to grasp information to serve advisory, directive, and propaganda dissemination work aimed at organizing the effective implementation of Party guidelines and State policies among ethnic minorities in their locality, and also have the responsibility to distribute it down to grassroots levels for everyone to read;

- Localities with libraries, reading rooms, cultural postal points need to concentrate newspapers and magazines for ethnic minorities to have access to read or use the "read aloud, listen together" method. In areas with radio stations, it should be read during radio programs.

c) The bilingual "Dân tộc và Miền núi" Photo Newspaper distributed to border guard posts, stations, teams, and team 123: units shall self-manage and organize reading rooms to facilitate officers and soldiers in receiving information and enhancing their propaganda mobilization capabilities.

d) The bilingual "Dân tộc và Miền núi" Photo Newspaper distributed to schools and classes: bring it back to class for reading during class meetings, then transfer it to the school library. Schools shall be responsible for issuing specific regulations on managing, utilizing, and effectively using the publication so that all students can read, view, and hear it.

Article 5. Content and Levels of Expenditure

1. Content of expenditure:

a) Printing costs (paper, printing fees, binding, completing the "Dân tộc và Miền núi" Photo Newspaper product) shall be carried out in accordance with laws on public bidding. In cases where there is only one printing house capable of printing bilingual newspapers for each ethnic group with its own script, Vietnam News Agency may designate the printing facility, but must comply with current regulations on designated bidding.

b) Fees for article, photo royalties (including Vietnamese language article, photo royalties and ethnic language article, photo royalties);

c) Translation, editing, proofreading fees, and consulting fees for the bilingual "Dân tộc và Miền núi" Photo Newspaper;

d) Costs related to manuscript organization, including: building and planning the entire issue's content program; editing, reviewing, designing pages, technical editing, artistic editing, photograph engraving, page layout, print proofing, printing the entire issue (both Vietnamese and ethnic languages), signing off on proofs;

đ) Costs for editorial management work, including: office supplies, expendable items for the "Dân tộc và Miền núi" Photo Newspaper editorial office; fuel expenses for reporters and editors of the editorial office; loading, transportation, and delivery costs; paper quality inspection costs;

e) Training and seminar costs for collaborators;

g) Labor contract payment costs (if applicable);

h) Distribution and transportation costs to deliver the newspaper to readers and beneficiaries;

i) Other costs related to publishing and distributing the "Dân tộc và Miền núi" Photo Newspaper.

2. Expenditure levels:

a) Paper, printing costs, binding, and completing the "Dân tộc và Miền núi" Photo Newspaper product: based on valid invoices and receipts, in accordance with budget standards and market prices;

b) Article, photo royalties (including Vietnamese language article, photo royalties and ethnic language article, photo royalties); translation, editing, and proofreading fees, consulting fees: implemented in accordance with Decree 61/2002/NĐ-CP dated June 11, 2002 of the Government on remuneration systems and supplementary, amended documents (if any);

c) Training and seminar costs, travel expenses: implemented in accordance with Circular 97/2010/TT-BTC dated July 6, 2010 of the Ministry of Finance on travel expense systems and costs for organizing conferences for state agencies and public service units;

d) Costs related to manuscript organization, including: building and planning the entire issue's content program; editing, reviewing, designing pages (makest), technical editing, artistic editing, photograph engraving, page layout, print proofing, printing the entire issue (both Vietnamese and ethnic languages), signing off on proofs based on actual occurrences and within the budgeted amounts reviewed by the Financial and Price Department;

đ) Editorial management costs, including: office supplies, expendable items; fuel expenses for reporters and editors of the editorial office, loading, transportation, and delivery costs; paper quality inspection costs in accordance with current regulations;

e) Labor contract payment costs: based on actual occurrences, but within the approved budget framework.

i) Expenditure for issuing and delivering newspapers to readers, beneficiaries: The amount of expenditure is based on the number of newspapers issued and the postal rates of the units assigned the task of distributing public welfare products as stipulated in Decision No. 31/2011/QĐ-TTg dated August 8, 2011 of the Prime Minister regarding the designation of enterprises to maintain and manage the public postal network, provide public postal services, and international postal services.

k) Expenditure for organizing surveys and inspections of distribution work: in accordance with the current regulations on travel expenses set out in Circular No. 97/2010/TT-BTC dated July 6, 2010 of the Ministry of Finance and actual incurred costs.

3. All contents and expenditure levels mentioned above shall only be implemented within the scope of the annual budget approved by the Inter-Ministerial Financial-Price Appraisal.

Article 6. Sources of funds and preparation of the budget

1. The funds for publishing the bilingual "Dân tộc và Miền núi" newspaper for some ethnic minorities with their own script shall be guaranteed by the central government budget and allocated in the regular state budget expenditure of Vietnam News Agency annually.

2. The preparation, allocation, and assignment of the state budget (without charge) for the bilingual "Dân tộc và Miền núi" newspaper shall be carried out in accordance with the State Budget Law and guiding documents of the State Budget Law.

3. Based on the objects specified in Article 2, Vietnam News Agency shall prepare the budget for the state budget (without charge) for the bilingual "Dân tộc và Miền núi" newspaper, consolidate it in the regular state budget expenditure of Vietnam News Agency, and submit it to the Ministry of Finance for consolidation, appraisal, and reporting to the Prime Minister for approval by the National Assembly.

4. Based on the budget approved by the competent authority, Vietnam News Agency shall implement the publication and enter into contracts with the Central Press Distribution Company to distribute the bilingual "Dân tộc và Miền núi" newspaper to the objects specified in Article 2 promptly and timely.

Article 7. Management, utilization, and settlement of publication and distribution funds for the bilingual "Dân tộc và Miền núi" newspaper

1. Vietnam News Agency and the Central Press Distribution Company shall separately account for the state budget funds for the publication and distribution of the bilingual "Dân tộc và Miền núi" newspaper according to the current accounting system and fulfill financial obligations (if any) as prescribed.

2. The management, utilization, and settlement of publication and distribution funds for the bilingual "Dân tộc và Miền núi" newspaper shall be carried out in accordance with Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law and other guiding documents.

3. Vietnam News Agency shall be responsible for reviewing the settlement of the funds for the publication and distribution of the bilingual "Dân tộc và Miền núi" newspaper together with the regular expenditure settlement of Vietnam News Agency, and submit them to the Ministry of Finance for appraisal in accordance with the State Budget Law and other guiding documents.

4. The funds for the publication and distribution of the bilingual "Dân tộc và Miền núi" newspaper allocated in the budget of a given year shall be implemented and settled in that same year. Any surplus at the end of the year (if any) shall be handled in accordance with the current regulations on the final settlement of the state budget.

Article 8. Implementation clause

1. This Circular takes effect from December 25, 2013, and shall be applied from the 2013 fiscal year onwards.

2. During the implementation process, if there are any difficulties, Vietnam News Agency is requested to promptly reflect them to the Ministry of Finance for research and resolution./.
