DECREE
Regarding the restructuring of the Investment Development General Department under the Ministry of Finance
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the State Budget Law dated March 20, 1996 and the Law Amending and Supplementing Certain Provisions of the State Budget Law dated May 20, 1998;
Considering the proposal of the Minister of Finance, the Minister, Head of the Government Organization and Cadre Affairs Board,
DECREE:
Article 1. Dissolve the Investment Development General Department under the Ministry of Finance and establish the following organizations:
1. The Investment Department directly under the Ministry of Finance.
2. The Capital Settlement Department for investment directly under the State Treasury at the central level.
3. Entrust the People's Committees of provinces and centrally governed cities to establish the Investment Division under the Department of Finance and Price Control.
Article 2. Transfer tasks, personnel, and staffing of the Investment Development General Department to the following organizations:
1. The Investment Department under the Ministry of Finance shall perform the function of state financial management over investment nationwide.
2. The Capital Settlement Department for investment under the State Treasury at the central level and its affiliated units at local levels shall carry out the task of capital settlement control, accounting, and final accounts of investment funds, public funds with investment characteristics, and construction from state budget sources at all levels.
3. The Department of Finance and Price Control shall assist the People's Committees of provinces and centrally governed cities in performing certain tasks within the scope of state financial management over investment in their respective areas.
4. The Development Support Fund shall implement the task of managing state investment credit according to Decree No. 50/1999/NĐ-CP dated July 8, 1999 on the organization and operation of the Development Support Fund.
Article 3. The Minister of Finance shall stipulate the tasks, powers, and organizational structure of the organizations mentioned in Clauses 1 and 2 of Article 1 of this Decree; guide the tasks and powers of the Department of Finance and Price Control in implementing state financial management over investment in their respective areas.
Article 4. The Minister of Finance shall be responsible for coordinating with the Minister, Head of the Government Organization and Cadre Affairs Board to guide and organize the implementation of the transfer of tasks, files, funds, personnel, staffing, and assets of the Investment Development General Department system to relevant agencies and organizations as prescribed in this Decree; ensure that the Development Support Fund has premises and working facilities.
Article 5. This Decree takes effect from January 1, 2000. Repeal Decree No. 187/CP dated December 10, 1994 of the Government on the tasks, powers, and organizational structure of the Investment Development General Department; Point B.5 Clause 3 of Decree No. 178/CP dated October 28, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Finance, and other provisions in other documents that conflict with this Decree./.
Article 6. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for enforcing this Decree
