Approving the Charter of the Vietnam Atomic Energy Association
THE MINISTER OF THE MINISTRY OF HOME AFFAIRS
Pursuant to Decree No. 102/SL-L004 dated May 20, 1957 promulgating the Law on the Right to Establish Associations;
Pursuant to Government Decree No. 45/2003/ND-CP dated May 9, 2003 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Government Decree No. 88/2003/ND-CP dated July 30, 2003 stipulating the organization, operation, and management of associations;
Considering the proposal of the Chairman of the Vietnam Atomic Energy Association and the Director of the Department for Non-Governmental Organizations,
DECISION:
Article 1. Approves the Charter of the Vietnam Atomic Energy Association which was adopted at the First Congress on April 9, 2005.
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Chairman of the Vietnam Atomic Energy Association and the Director of the Department for Non-Governmental Organizations shall be responsible for implementing this Decision.

CHARTER
VIETNAM ATOMIC ENERGY ASSOCIATION

PART I
NAME, AIMS, AND OBJECTIVES
Article 1. The Association takes the name of the Vietnam Atomic Energy Association.
The international trade name is Vietnam Atomic Energy Association.
Abbreviation: VAEA.
Article 2. Aims and Objectives:
The Vietnam Atomic Energy Association is a professional, voluntary organization of citizens working in the field of atomic energy aimed at uniting and assisting each other in study, research, and practice to contribute to promoting the research, implementation, and application of atomic energy for the construction and development of the country.
Article 3. Scope and Field of Operation:
The Vietnam Atomic Energy Association operates throughout the country in the field of atomic energy.
Article 4. Principles of Organization and Operation:
The Association operates within the framework of Vietnamese law and the Charter of the Vietnam Atomic Energy Association.
The Association is organized according to the principle of centralized democratic self-management, self-financing, and self-responsibility under the law for all its activities.
Article 5. The Vietnam Atomic Energy Association is subject to state management by the Ministry of Science and Technology.
Article 6. Legal Status, Seal, and Account:
The Vietnam Atomic Energy Association operates in accordance with the laws of the Socialist Republic of Vietnam. The Association has legal status, a seal, and an account. The headquarters of the Association is located in Hanoi City.
Chapter II
TASKS AND POWERS OF THE ASSOCIATION
Article 7. The Vietnam Atomic Energy Association has the following tasks:
1. To gather, unite, and assist each other in creative labor to promote research, implementation, and application of atomic energy for peaceful purposes; apply nuclear science and technology to serve production and daily life.
2. To participate in providing opinions and proposals to state management agencies regarding policies, laws, mechanisms, planning, measures to strengthen technical infrastructure; training human resources to develop the atomic energy industry; coordinating and supporting activities for organizations and units operating in the atomic field; organizing and developing advisory and service activities in the field of nuclear science and technology.
3. To perform the function of social consultation, criticism, and appraisal in the field of atomic energy for Party and state agencies and other organizations when requested.
4. To implement the function of researching, implementing, and providing scientific and technological services in nuclear science and technology to serve economic and social sectors.
5. To organize scientific information and public information activities on atomic energy.
6. To train and enhance professional expertise in nuclear science.
7. To represent members in activities related to the aims, objectives, and tasks of the Association; protect the honor, rights, and legitimate interests of members in accordance with current laws.
8. To cooperate with domestic and foreign organizations and individuals in accordance with the law to exchange, learn, and seek assistance in the field of atomic energy.
9. To award commendations and recommend state authorities to award individual and collective members who have outstanding achievements in research, training personnel, implementing and applying nuclear science and technology.
Article 8. Powers and Responsibilities of the Association:
1. To represent member organizations and members in activities related to the aims, objectives, and tasks of the Vietnam Atomic Energy Association.
2. To implement scientific research projects and provide services to organizations and individuals in accordance with the law.
3. To support members in implementing scientific research activities and participating in evaluating scientific research works and projects in the field of atomic energy.
4. To take the lead or participate in building programs and projects to propose solutions to state management agencies for the development of the atomic energy industry.
5. To publish books and journals of the Association in accordance with the law to enhance knowledge and update information.
6. To organize training and knowledge enhancement, improve professional skills, and provide information to members.
7. To develop the Association in accordance with occupational requirements within the scope of the law.
8. To join international associations on atomic energy as provided by law.
Chapter III
MEMBERS
Article 9. Members of the Association include:
1. Regular Members:
- Organizations of Vietnam operating in the field of atomic energy that agree with the Charter of the Association may request to join the Association through authorized representatives and become collective members of the Association.
- Vietnamese citizens working in the field of atomic energy and related fields, whether currently employed or retired, who agree with the Charter of the Association and voluntarily submit applications to join the Association can be admitted as members of the Association.
2. Honorary Members are those engaged in political and social activities, having extensive experience and prestige, making positive contributions to the development of atomic energy but unable to become regular members of the Association. The Standing Committee of the Association decides on the recognition of honorary members. Honorary members do not have the right to run for election or vote in the Board of Directors and do not participate in voting on Association matters.
Article 10. Benefits of Members:
Members enjoy the following benefits:
1. Discuss and vote on all matters of the Association, including candidacy and election to the Executive Board of the Association.
2. Be provided with information and professional training, encouraged and supported to develop their capabilities to contribute to the atomic energy industry and serve the economic and social development cause.
3. Present their scientific research topics at the Association's scientific and technological meetings. Participate in specialized activities or conferences organized by the Association.
4. Have the Association review their works to recommend state awards, recognition of authorship, and patents. Be introduced to publish their works in the Association’s journals.
5. Be protected by the Association against any infringement of their legitimate rights and interests if such infringement is identified. Enjoy all other benefits stipulated by the Association. 6. Have the right to request withdrawal from the Association when they no longer meet the conditions for participation.

Article 11. Obligations of Members:
1. Strictly implement the Party's policies and state laws. Fulfill the Charter and resolutions of the Association, participate in Association activities and pay membership fees fully and on time. Promote membership recruitment and mobilize public support for the Association's activities.
2. Foster a spirit of solidarity within the Association, combat thoughts and actions detrimental to the Association's reputation, credibility, and unity.
3. Actively engage in scientific research, continuously improve their scientific expertise to contribute to the application of atomic energy for economic and social development and peaceful purposes.
Article 12. Procedures for joining and leaving the Association:
- Individuals wishing to join the Association must voluntarily submit an application to join the Association.
- Members who no longer meet the conditions for participation and wish to leave the Association must submit an application to withdraw from the Association.
- The Standing Committee of the Association prescribes the procedures for admitting members and decides on the withdrawal of members from the Association.
Chapter IV
ORGANIZATION OF THE ASSOCIATION
Article 13. The organization of the Association includes the General Assembly or the Representative Assembly, the Executive Board of the Association, local branches (with five members or more), and affiliated organizations.
In provinces and centrally-administered cities, if necessary, atomic energy associations or branches may be established. The establishment of associations in provinces and cities is decided by the People's Committees of those provinces and cities in accordance with the law.
Member Associations operate according to their own charters, comply with the charter of the Vietnam Atomic Energy Association, and are subject to professional guidance from the Vietnam Atomic Energy Association.
Article 14. Congress
1. The General Assembly or the Representative Assembly is the highest governing body of the Association. The General Assembly or Representative Assembly of the Association convenes once every five years, convened by the Executive Board of the Association.
2. An extraordinary congress may be convened if more than two-thirds of the Executive Board members or more than half of the branches request it.
3. Main contents of the Congress:
- Summarize and evaluate the Association's activities during the previous term and decide on the direction and activities for the new term.
- Amend and supplement the charter if deemed necessary.
- Elect the Executive Board of the Association.
Article 15. Executive Board of the Association:
The Executive Board of the Association is the governing body between two congresses. The number of Executive Board members is determined by the General Assembly or the National Representative Assembly. In case of necessity or vacancy, the Executive Board may elect additional members, but the number of additional members elected shall not exceed one-fifth of the total number of members elected by the Congress. The Executive Board meets regularly once a year, convened by the President of the Association. Extraordinary meetings of the Executive Board are decided by the Standing Committee of the Association.
Article 16. Standing Committee of the Association:
1. The Standing Committee of the Association is elected by the Executive Board, consisting of the President, Vice Presidents, Secretary-General, and some members. The number of members of the Standing Committee is decided by the Executive Board. The Standing Committee meets regularly every six months. Extraordinary meetings of the Standing Committee are decided by the President of the Association.
The Standing Committee of the Association has the following responsibilities:
- Organize the implementation of the resolutions of the Executive Board between two meetings.
- Represent the Executive Board to handle and decide on matters between regular meetings of the Executive Board and report to the Executive Board at the next meeting.
- Manage the Association's finances.
2. The President of the Association has the following powers and responsibilities:
- Represent the Association before the law.
- Organize and implement the resolutions of the Congress and the Executive Board.
- Convene and chair meetings of the Executive Board and the Standing Committee.
- Be responsible to the Executive Board and all members for the Association's activities.
3. The Vice Presidents assist the President in specific tasks assigned by the President.
4. The Secretary-General assists the President in leading the implementation of the resolutions and decisions of the Executive Board; manages and directs the operations of the Association's Office; assists the President in preparing the agenda for meetings of the Executive Board and the Standing Committee.
Article 17. Audit Board of the Association.
The Audit Board of the Association is elected by the Executive Board, consisting of a Chairperson who is a member of the Standing Committee and some members.
The Audit Board assists the Executive Board in auditing and supervising the Association's activities, the implementation of the Charter and resolutions of the Association, auditing members, financial management and usage, and proposing solutions to complaints and reports within the Association in accordance with the law.
The Audit Board meets regularly every six months and can hold extraordinary meetings upon the request of the President or the Chairperson of the Audit Board.
The term of office of the Audit Board follows the term of the Association's Congress.
Article 18. Specialized Boards and Affiliated Organizations.
Depending on work requirements, the Standing Committee of the Association may establish specialized boards and affiliated organizations.
The establishment of affiliated organizations is carried out in accordance with the provisions of the law.
Chapter V
ASSETS AND FINANCES OF THE ASSOCIATION
Article 19. Sources of assets and finances.
1. The sources of the Association's finances include the following revenues:
- Membership fees paid by members in accordance with regulations. The level of membership fees is determined by the Executive Board.
- Revenues from consulting services, research activities, and other activities of the Association.
- Donations, sponsorships, and contributions from domestic and foreign organizations and individuals.
2. Expenditures:
- Expenses for the Association's activities.
- Payment of salaries and allowances for dedicated staff of the Association shall be decided by the Executive Board of the Association.
- Other reasonable expenditures shall be decided by the Standing Committee of the Association.
Article 20. Management and utilization of assets and finances.
The assets and finances of the Association shall be managed and utilized in accordance with the regulations of the Executive Board of the Association and the guidance of the state financial authority in compliance with the law.
Article 21. Method of handling assets when the Association is dissolved.
When the Association is dissolved and ceases its activities, the Executive Board of the Association shall have the responsibility to report to the competent authority to handle necessary procedures and settle accounts of assets in accordance with the law.
Chapter VI
REWARD AND DISCIPLINE
Article 22. Awards
Units and members who achieve outstanding results in the activities of the Association shall be awarded or recommended for awards by the competent authorities in accordance with the regulations.
The Executive Board of the Association shall specify the specific forms and authority of awards within the Association.
Article 23. Handling violations.
Units and members violating the Charter of the Association, damaging the reputation and honor of the Association, depending on the level of violation, shall be subject to disciplinary measures ranging from reprimand, warning to expulsion from the Association. Members expelled shall have their names removed from the member list and their membership cards revoked.
If a branch does not submit activity reports to the Executive Board of the Association for two consecutive years, that branch will no longer be considered a member unit of the Association.
The Executive Board of the Association shall specify the specific forms and authority of disciplinary measures within the Association.
Chapter VII
IMPLEMENTING PROVISIONS
Article 24. Effectiveness
The Charter of the Vietnam Atomic Energy Association consists of seven chapters and twenty-four articles, which were adopted at the First General Assembly of the Vietnam Atomic Energy Association on April 9, 2005, in Hanoi, and became effective upon approval by the Ministry of Home Affairs.
Only the General Assembly or the Representative Assembly of the Association has the right to amend and supplement this Charter.
The Executive Board of the Association is responsible for guiding members and branches in implementing the Charter of the Association./.
