Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP;

Pursuant to Decree No. 20/2008/NĐ-CP dated February 14, 2008 of the Government on receiving and handling complaints and suggestions from individuals and organizations regarding administrative regulations;

Pursuant to Decree No. 63/2010/ND-CP dated June 4, 2010 of the Government on administrative procedure control;

Pursuant to Circular No. 01/2011/TTLT-VPCP-BNV dated January 26, 2011 of the Government Office and the Ministry of Home Affairs guiding the functions, tasks, powers, organization, and staffing of administrative procedure control units under the Ministry's Office, agencies at the level of ministries, and provincial People's Committee offices directly under the central government;

Pursuant to Circular No. 224/2010/TT-BTC dated December 31, 2010 of the Ministry of Finance stipulating the preparation of budgets, management, and use of funds for implementing administrative procedure control activities;

The Minister of Industry and Trade promulgates the Circular amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade."

DECISION:

Article 1. Attached herewith are the Regulations on the implementation of tasks to control administrative procedures and the reception and handling of complaints and suggestions from individuals and organizations regarding administrative regulations within the scope and functions of management of the Ministry of Agriculture and Rural Development.

Article 2. This Decision takes effect from the date of signature.

Article 3. The Director of the Ministry's Office, Heads of subordinate agencies and units shall be responsible for implementing this Decision./.

REGULATIONS

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope of Regulation

These regulations govern the organization, procedures for implementing tasks to control administrative procedures and the reception and handling of complaints and suggestions from individuals and organizations regarding administrative regulations within the scope and functions of management of the Ministry of Agriculture and Rural Development (hereinafter referred to as the reception and handling of complaints and suggestions from individuals and organizations).

Article 2. Applicability

1. Departments, Bureaus, Divisions, Inspection Units, the Ministry's Office, Centers under the Ministry, the Reform and Enterprise Management Board, the Agricultural Project Management Board, the Forestry Project Management Board, the Central Water Resources Project Management Board (hereinafter referred to as units).

2. Other agencies, units, organizations, and individuals related to the Ministry's administrative procedure control activities.

Article 3. General Requirements

1. An administrative procedure is the sequence, method of execution, file, and requirements, conditions prescribed by state agencies or authorized persons to resolve a specific matter related to individuals and organizations.

2. Administrative procedures as stipulated in Decree No. 63/2010/NĐ-CP must be specified in normative legal documents.

Administrative procedures as stipulated in Decree No. 63/2010/NĐ-CP do not include:

- Internal administrative procedures within each administrative agency; between administrative agencies that do not relate to the resolution of administrative procedures for individuals and organizations;

- Procedures for handling administrative violations;

- Inspection procedures and administrative procedures containing state secrets.

3. The specification of a specific administrative procedure must include the following basic components:

a) Name of the administrative procedure;

b) Implementation process;

c) Methods of implementation;

d) File;

đ) Time limit for resolution;

e) Subjects implementing the administrative procedure;

g) Agency resolving the administrative procedure;

h) The result of resolving the administrative procedure;

i) In cases where the administrative procedure requires forms, administrative declaration forms; result forms of resolving the administrative procedure; requirements, conditions; fees, charges, then these forms, result forms of resolving the administrative procedure; requirements, conditions; fees, charges are components of the administrative procedure.

4. A specific administrative procedure prescribed in normative legal documents within the authority to issue of the Government or the Prime Minister must ensure the completeness of the components as stipulated in Points a, b, d, đ, e, g, h of Clause 3 of this Article.

If the administrative procedure has requirements and conditions, those requirements and conditions must be specified in normative legal documents within the authority to issue of the Government or the Prime Minister. If the requirements and conditions are expressed in technical standards, they must be specified in normative legal documents within the authority to issue of the Minister.

5. A specific administrative procedure prescribed in normative legal documents within the authority to issue of the Minister must clearly specify the remaining components of the administrative procedure.

If the administrative procedure has application forms or administrative declaration forms, those forms must be specified in normative legal documents within the authority to issue of the Minister.

6. When delegated or authorized by the National Assembly, the Standing Committee of the National Assembly, the Government, or the Prime Minister to stipulate or guide the stipulation of administrative procedures, the Ministry must ensure the full stipulation, clear, detailed, and specific guidance on the components of the administrative procedure as stipulated in Clause 3 of this Article.

Chapter 2.

SYSTEM OF MANAGEMENT, DIRECTING, AND IMPLEMENTATION OF TASKS TO CONTROL ADMINISTRATIVE PROCEDURES

Article 4. The system for managing, directing, and organizing the implementation of administrative procedure control tasks of the Ministry

1. The work of administrative procedure control and receiving, handling complaints and suggestions from individuals and organizations shall be under the leadership and management of the Minister; the Minister shall assign a Deputy Minister to directly direct.

2. The Administrative Procedure Control Office under the Ministry's Office shall perform the function of assisting the Ministry in administrative procedure control in accordance with Decree No. 63/2010/ND-CP and receiving, handling complaints and suggestions from individuals and organizations in accordance with Decree No. 20/2008/ND-CP and Circular Joint No. 01/2011/TTLT-VPCP-BNV dated January 26, 2011.

3. The Legal Department shall be responsible for reviewing the content of administrative procedures in draft normative legal documents within the authority of the Minister.

4. Units shall be responsible for implementing administrative procedure control tasks and receiving, handling complaints and suggestions from individuals and organizations in accordance with the law and the functions and tasks of the unit:

a) The head of the unit shall be responsible before the Minister, directly directing the organization to implement administrative procedure control tasks of the unit and receiving, handling complaints and suggestions from individuals and organizations.

b) The head of the unit shall assign a department or staff member to handle administrative procedure control work and receiving, handling complaints and suggestions from individuals and organizations; designate a focal point staff member to directly advise, urge, and compile administrative procedure control work and receiving, handling complaints and suggestions from individuals and organizations. The specific duties of the focal point staff member for administrative procedure control are stipulated in Article 5 of this Regulation.

5. Special Task Teams and Consulting Experts: Shall be established at the request of the Administrative Procedure Control Department, the Minister, or upon the proposal of the Administrative Procedure Control Office to carry out important and specific tasks within a defined period.

Article 5. Focal Point Staff Members for Administrative Procedure Control

1. Allocation of Focal Point Staff Members for Administrative Procedure Control

a) The focal point staff member for administrative procedure control is a civil servant of the unit assigned by the head of the unit, each unit having one (01) focal point staff member. The focal point staff members for administrative procedure control of units must be Heads of Departments or equivalent; they must be responsible, enthusiastic about their work, and have attended training courses on administrative procedure control.

b) Focal Point Staff Members for Administrative Procedure Control in Departments and Bureaus under the General Department

Departments that generate administrative procedures (within the scope of Decree No. 63/2010/ND-CP) in the implementation of state management tasks, and bureaus under the General Department must allocate one (01) focal point staff member for administrative procedure control; the list of focal point staff members of units under the General Department must be registered with the Ministry (through the Administrative Procedure Control Office). The duties, powers, systems, and working relationships of the focal point staff members of units under the General Department are regulated by the General Department; these staff members are invited to attend training sessions, dissemination of business practices, and meetings to deploy administrative procedure control tasks of the Ministry.

2. Duties of Focal Point Staff Members for Administrative Procedure Control:

a) Grasping and studying policies, plans, tasks, and content of administrative procedure control of the Government and the Ministry to proactively advise the head of the unit to develop administrative procedure control plans; budgeting and organizing the implementation;

b) Disseminating relevant documents and materials related to administrative procedure control content to relevant civil servants in the unit, proposing the implementation of training at the unit;

c) Assisting the head in guiding and urging organizations and individuals in the unit to implement administrative procedure control tasks; participating in completing the content of administrative procedures and evaluation forms before sending them to the administrative procedure control agency;

d) Chairing or assisting the administrative procedure control department of the unit to organize the implementation of administrative procedure control tasks assigned by the head of the unit; attending meetings and working sessions of the unit on administrative procedure content;

đ) Receiving complaints and suggestions from individuals and organizations sent directly to the unit; advising leaders to assign departments or individuals related to handle; urging and monitoring the results of handling complaints and suggestions from individuals and organizations;

Receiving complaints and suggestions from individuals and organizations according to the transfer form of the Administrative Procedure Control Office; urging and monitoring the results of handling;

e) Participating in administrative procedure control activities of the Ministry together with the Administrative Procedure Control Office;

g) Monitoring and urging departments and civil servants in the unit to implement the Ministry's and the unit's plans on administrative procedure control, receiving, and handling complaints and suggestions from individuals and organizations to ensure timely and quality completion;

h) Implementing reporting systems as prescribed.

Chapter 3.

PROCEDURE FOR SUBMITTING AND PARTICIPATING IN OPINIONS ON THE CONTENT OF ADMINISTRATIVE PROCEDURES WHEN BUILDING NORMATIVE LEGAL DOCUMENTS

Article 6. Competence to provide comments on the content of administrative procedures when drafting normative legal documents

1. The Administrative Procedure Control Department under the Government Office shall provide comments on administrative procedures stipulated in draft normative legal documents submitted by the Government to the National Assembly and the Standing Committee of the National Assembly; draft normative legal documents within the promulgation authority of the Government and the Prime Minister; draft joint Circulars of Ministries.

2. The Administrative Procedure Control Department under the Ministry's Office shall provide comments on administrative procedures stipulated in draft normative legal documents within the promulgation authority of the Minister.

In this Regulation, the Administrative Procedure Control Department and the Administrative Procedure Control Department are collectively referred to as the administrative procedure control agency.

3. The administrative procedure control unit or focal point of the unit shall guide the drafting unit to perfect and ensure the quality of the content of administrative procedures and the dossier for seeking comments on administrative procedures for all normative legal documents drafted by the unit.

Article 7. Dossier for Seeking Comments on the Content of Administrative Procedures

1. The request for comments shall clearly state the issues requiring comments on the provisions of administrative procedures, specify the criteria achieved for the administrative procedures as set out in Clause 2 and 3 of Article 10 of Decree No. 63/2010/ND-CP, and clearly state the following contents:

a) The number of administrative procedures specified in the draft, specific list (if many, attach the list, specifying each administrative procedure in the draft as new issuance, replacement, or amendment, table summarizing the amended contents. If it is replacement or amendment, clearly indicate whether it follows Project 30 or not);

In case the administrative procedure falls under Project 30 (Resolution No. 57/NQ-CP), the drafting unit shall submit the dossier to the Legal Affairs Department for examination and resolution.

b) List of administrative procedures to be abolished or replaced after the promulgation of the normative legal document (Part I, Appendix 2 of this Regulation).

2. Draft normative legal document containing provisions on administrative procedures and copies of related normative legal documents; if the related document has multiple pages and has been published on the official websites of competent authorities, the reference address must be clearly stated.

3. Impact assessment forms and cost calculation forms for compliance with administrative procedures.

Specifically for draft Circulars, to serve timely publication of administrative procedures, units shall prepare statistical forms for administrative procedures and publication forms (Appendix 1, 2 issued together with this Regulation) and send them to the Administrative Procedure Control Department from the stage of seeking comments on the content of administrative procedures.

These forms are prepared by the civil servants directly responsible for drafting, checked and signed by the focal point of administrative procedure control on each page of the form and draft document, and submitted to the unit leader for signing the official document sent to the Administrative Procedure Control Department.

Article 8. Organization of Providing Comments on the Content of Administrative Procedures in Draft Normative Legal Documents and Incorporating Comments from the Administrative Procedure Control Agency

1. Before initiating the drafting of normative legal documents, the Drafting Board shall thoroughly study relevant documents and materials on administrative procedures and administrative procedure control; consult with focal point administrative procedure control officers on basic aspects of administrative procedures to receive guidance on impact assessment of administrative procedures.

2. During the drafting process or when completing the dossier for seeking comments on administrative procedures to be sent to the administrative procedure control agency, there must be participation of the Team or focal point administrative procedure control officer.

3. When receiving comments from the administrative procedure control agency:

- The main drafting unit shall be responsible for studying and incorporating comments on administrative procedures from the administrative procedure control agency. Disagreements with incorporation must be explained specifically;

- The incorporation and explanation of comments from the administrative procedure control agency must be reflected as a separate part in the document of incorporation and explanation;

- The main drafting unit shall complete the content of administrative procedures, the content of the draft legal document, and the impact assessment forms for administrative procedures to be sent to the administrative procedure control agency, while sending to the appraisal agency (along with other appraisal components of normative legal documents according to regulations).

Article 9. Participation in opinions on administrative procedures in draft Circulars of the Minister

1. The Administrative Procedure Control Department shall participate in opinions on the content of administrative procedures in draft Circulars of the Minister.

2. Civil servants drafting shall directly submit the file to seek opinions on the content of administrative procedures at the Administrative Procedure Control Department, second floor, Building B4, Ministry Office, No. 2 Ngoc Ha, Hanoi.

The official time for submitting files to seek opinions from the Administrative Procedure Control Department is the time when seeking opinions from related units on the content of the draft. The main drafting unit may consult with the Administrative Procedure Control Department on the content of administrative procedures in the draft circular before submitting the file to seek opinions.

3. The civil servant receiving the file belonging to the Administrative Procedure Control Department shall check the validity of the file, guide the person submitting to complete the incomplete contents, supplement missing parts of the file. If the file is valid, the civil servant shall record it in the tracking book and return the receipt to the person submitting.

4. Within seven working days, the Administrative Procedure Control Department shall work directly with the main drafting unit of the regulatory legal document to exchange opinions on the content of administrative procedures (if the draft Circular involves multiple units, the main drafting unit shall invite relevant units to attend).

After the direct meeting, based on the minutes recording the content of the meeting signed by both parties, the main drafting unit shall perfect the content of administrative procedures, impact assessment forms, statistical forms, and the draft Circular and send them back to the Administrative Procedure Control Department.

Upon receiving the completed results from the unit, within three working days, the Administrative Procedure Control Department shall officially respond in writing regarding the content of administrative procedures stipulated in the draft Circular.

5. The Administrative Procedure Control Department shall publicly disclose the progress and results of participating in opinions on the content of administrative procedures for draft Circulars on the website: http://kiemsoattthc.mard.gov.vn.

Article 10. Participation in opinions on the content of administrative procedures stipulated in legislative projects submitted to the National Assembly and the Standing Committee of the National Assembly by the Government; draft regulatory legal documents within the promulgation authority of the Government, the Prime Minister, and Joint Circulars of Ministries.

The main drafting unit shall prepare the file to seek opinions on the content of administrative procedures to be sent to the Administrative Procedure Control Bureau, Government Office.

Article 11. Examination of the content of administrative procedures in draft Circulars

1. The agency examining the draft Circular shall be responsible for examining the content of administrative procedures stipulated in the draft Circular.

The participation opinion on the content of administrative procedures of the Administrative Procedure Control Department does not replace the examination content of the agency examining regulatory legal documents.

In necessary cases, the examining agency may request the Administrative Procedure Control Department to participate in the examination of the content of administrative procedures stipulated in the draft Circular.

2. The examination content regarding the procedural regulations is to review issues as prescribed in Articles 7 and 8 of Decree 63/2010/ND-CP.

3. The examination file includes: the file according to the regulations on issuing regulatory legal documents; the impact assessment report on administrative procedures as prescribed in Article 10 of Decree 63/2010/ND-CP; the explanation and adoption report and the contribution opinions of the Administrative Procedure Control Department; opinions of other agencies, units, organizations, and individuals if any.

4. The authority, procedure, and time limit for examination shall be carried out according to the regulations on issuing regulatory legal documents.

5. The Ministry Office shall only submit to the Ministry Leader for signature on draft Circulars containing administrative procedures that have complete files on the content of administrative procedures (opinion documents on administrative procedures of the administrative procedure control agency, explanation and adoption documents of the main drafting unit, examination content of the examining unit).

Chapter 4.

IMPLEMENTATION OF ADMINISTRATIVE PROCEDURES

Article 12. Publicizing Administrative Procedures

The publicizing of administrative procedures shall be carried out in accordance with Articles 13, 14, and 15 of Decree No. 63/2010/NĐ-CP, with the following main contents:

1. Administrative procedures prescribed in legal normative documents on sectors and fields within the scope of functions and management of the Ministry must be announced by the Minister's decision.

2. Scope of Publicizing Administrative Procedures

The publicizing of administrative procedures includes: announcing new administrative procedures; announcing administrative procedures that have been amended, supplemented, or replaced; and announcing administrative procedures that have been abolished or revoked.

3. Decision to Announce Administrative Procedures

The decision to announce administrative procedures must be issued at least ten working days before the effective date of the legal normative document stipulating such administrative procedures and must follow a uniform model prescribed by the Administrative Procedure Control Department. (Annexes 1 and 2 attached hereto).

After issuance, the decision to announce administrative procedures must be sent one copy to the Administrative Procedure Control Department along with the legal normative document stipulating the administrative procedures.

4. Procedure for Publicizing Administrative Procedures

a) Within ten working days from the date of issuance of the legal normative document stipulating administrative procedures within the scope of state management assigned, units responsible for declaring the Administrative Procedure Statistical Form, compiling the list of administrative procedures, and submitting the draft announcement decision (according to the model) in both paper and electronic formats to the Ministry (Administrative Procedure Control Department) along with related documents (for Circulars of the Ministry, the original version must be submitted);

b) The Administrative Procedure Control Department will check the content of the administrative procedures in the Administrative Procedure Statistical Form to ensure compliance with the provisions in the Circular and other legal normative documents, review accompanying documents (application forms, declaration forms, requirements or conditions for implementing administrative procedures, fees, and charges), and perform the following tasks:

- Reviewing the quality of the draft Decision to Announce Administrative Procedures and accompanying documents; if they do not meet the requirements, a written request for completion must be issued within five working days, with the specific completion time for the unit specified in the document but not exceeding ten working days;

- Submitting the completed dossier to the Minister for signing and issuing the Decision to Announce Administrative Procedures;

- Within five working days from the date the Minister signs the Decision to Announce Administrative Procedures, the Administrative Procedure Control Department will proceed to:

+ Scanning (scanning) the entire text of the document (for Circulars of the Ministry, it must bear the red seal), updating it into the national database of legal normative documents stipulating administrative procedures;

+ Updating the content of each administrative procedure into the national database;

+ Publishing on the website: http://kiemsoattthc.mard.gov.vn.

5. For draft Circulars, to serve the timely announcement of administrative procedures, units must prepare the dossier for announcing administrative procedures and submit it to the Administrative Procedure Control Department during the stage of soliciting internal opinions on the administrative procedures.

Article 13. Publicizing Administrative Procedures

1. Information on administrative procedures that have been published by the Minister in accordance with Article 15 of Decree 63/2010/NĐ-CP and Article 12 of this Regulation must be fully, regularly, clearly disclosed at the correct address, easily accessible, and easy to exploit and use.

2. Forms of disclosure

In addition to the mandatory publicizing form on the National Database for Administrative Procedures and posting at the offices of units directly handling administrative procedures (including subordinate units nationwide), publicizing administrative procedures may also be carried out through one or more of the following forms:

a) Posting on the Government's electronic portal or the electronic information page of the agency issuing regulations on administrative procedures and the agency implementing such procedures;

b) Announcing through mass media;

c) Other forms.

3. The Ministry’s electronic portal shall link and post the entire, original content of administrative procedures based on the national database, website: http://kiemsoattthc.mard.gov.vn.

Article 14. Reviewing and Evaluating Administrative Procedures

1. The Department of Administrative Procedure Control is responsible for coordinating with units to independently review and evaluate administrative procedures in the following cases:

a) As directed by the Government, the Prime Minister, and the Minister;

b) Administrative procedures closely related to each other, where the result of one procedure serves as a prerequisite for another procedure;

c) Administrative procedures identified as cumbersome, difficult to implement, causing hindrances to economic activities of enterprises and people's lives, upon discovery or based on reported information from individuals or organizations.

2. The content, methods of reviewing and evaluating administrative procedures, and the handling of review and evaluation results are detailed in Chapter V of Decree 63/2010/NĐ-CP.

Chapter 5.

PROCEDURE FOR RECEIVING AND HANDLING COMPLAINTS AND PETITIONS REGARDING ADMINISTRATIVE REGULATIONS

Article 15. Agencies Receiving Complaints and Petitions

The Ministry Office and its affiliated units receive complaints and petitions from individuals and organizations regarding administrative regulations within the scope and functions of management of the Ministry and its units.

Article 16. Content of Complaints and Petitions

1. Specific difficulties encountered in implementing administrative regulations due to delays, causing inconvenience, or failure to comply with administrative regulations by state administrative agencies or civil servants.

2. Inconsistency between administrative regulations and reality.

3. Lack of coordination and consistency among administrative regulations.

4. Illegal administrative regulations.

5. Administrative regulations contrary to international treaties to which Vietnam is a party.

6. Other issues related to administrative regulations.

7. Proposals for handling complaints stipulated in Clauses 1, 2, 3, 4, 5, and 6 of this Article.

8. Initiatives for issuing new administrative regulations related to business operations and people's lives.

9. Documents and letters that are not complaints or petitions regarding administrative regulations:

a) Complaints and accusations;

b) Requests for legal clarification;

c) Documents and letters without clear content of complaints or petitions despite efforts by the unit to verify and clarify.

Article 17. Forms of Reflections and Suggestions

Individual and organizational reflections and suggestions on administrative regulations shall be carried out through one of the following forms:

1. Written documents (paper-based or via online environment).

2. Telephone calls.

3. Opinion solicitation forms.

Article 18. Requirements for Reflections and Suggestions

Implement according to the provisions of Article 7 of Decree No. 20/2008/NĐ-CP.

Article 19. Procedure for Receiving Reflections and Suggestions

Implement according to the provisions of Article 9 of Decree No. 20/2008/NĐ-CP.

Article 20. Procedure for Handling Reflections and Suggestions by Administrative State Agencies

Implement according to the provisions of Article 14 of Decree No. 20/2008/NĐ-CP.

Article 21. Publicizing the results of handling complaints and suggestions

1. The head of the unit is responsible for sending a written notification of the handling results to individuals and organizations that have made reflections and suggestions, and related agencies and organizations; report to the Ministry for individual and organizational reflections and suggestions transferred by the Ministry's Office (Administrative Procedures Control Department).

2. Publicize the handling results of individual and organizational reflections and suggestions through one or more of the following forms:

a) Posting on the portal or electronic information website (website) of the agency.

b) Announcement on mass media.

Article 22. Responsibilities of Units Receiving Reflections and Suggestions

1. Assigning civil servants or staff to receive reflections and suggestions.

2. Installing dedicated telephone numbers, connecting to electronic computer networks, and establishing website and email addresses.

3. Publicly announcing the agency address, postal address, dedicated telephone number, website address, email address, and handling results of reflections and suggestions.

4. Organizing the receipt of reflections and suggestions.

Article 23. Inspection of Reflections and Suggestions Reception and Handling

1. Case-by-case inspection: According to the requirements of superiors, individual and organizational suggestions disagreeing with the handling results of the unit, the Administrative Procedures Control Department directly works with the unit and related organizations regarding the requested content.

2. Planned inspection: Implemented according to Clause 2 of Article 27 of this Regulation.

Chapter 6.

IMPLEMENTATION OF THE PLAN FOR ADMINISTRATIVE PROCEDURE CONTROL

Article 24. Plan for Administrative Procedure Control

1. Plan Development: Based on the annual plan for developing normative legal documents of the Ministry, the Administrative Procedures Control Department notifies units to register their administrative procedure control plans. The Administrative Procedures Control Department compiles the administrative procedure control plans of the units, and at the same time, based on general requirements and the plan of the Administrative Procedure Control Department, completes and submits the plan to the Minister for approval.

2. Implementation of the Plan:

The Administrative Procedures Control Department and units implement the Ministry’s issued administrative procedure control plan; in cases where there are unexpected developments outside the plan, the units must proactively coordinate with the Administrative Procedures Control Department to adjust accordingly with the overall plan.

Article 25. Implementation, Evaluation of Results of Plan and Tasks for Administrative Procedure Control

1. Content of administrative procedure control and handling results of individual and organizational reflections and suggestions are part of the regular meetings, mid-term reviews, and annual summaries of the Ministry and units.

2. The Administrative Procedures Control Department urges, compiles the implementation results of administrative procedure control tasks of the units; assists the Ministry in evaluating and implementing the administrative procedure control plan and tasks; organizes quarterly or ad hoc meetings with key personnel for administrative procedure control to deploy the Ministry's administrative procedure control tasks.

Article 26. Reporting System

1. Quarterly reports only reflect the content of administrative procedure control; the report should be sent to the Administrative Procedures Control Department before the 10th day of the last month of each quarter.

2. Six-month and annual reports include the content of administrative procedure control and the results of receiving and handling individual and organizational reflections and suggestions; the report should be sent to the Administrative Procedures Control Department before June 10 (six-month report), before November 30 (annual report).

3. The content of periodic reports is stipulated in Decree No. 63/2010/NĐ-CP, Decree No. 20/2008/NĐ-CP, and guidance from administrative procedure control agencies and units.

Unit reports must clearly state the implementation results, difficulties, suggestions, and the next quarter's, six-month, and annual administrative procedure control plans.

4. Ad hoc reports and special topic reports are implemented according to specific requirements of administrative procedure control agencies and units.

5. The Administrative Procedures Control Department compiles the situation of implementing administrative procedure control tasks and handling individual and organizational reflections and suggestions, and sends it to the permanent office for administrative reform to compile into the monthly administrative reform report of the Ministry as prescribed.

6. In cases where the Administrative Procedure Control Department has regulations on reporting systems and content, they shall be implemented according to the guidance of the Department.

Article 27. Inspection System

1. Units must regularly inspect the implementation of administrative procedures and the results of handling complaints and suggestions from individuals and organizations within subordinate organizations.

2. The Administrative Procedure Control Department shall coordinate with units to propose the Minister approve the organization of inspections on the implementation of administrative procedures and the results of handling complaints and suggestions from individuals and organizations in the agriculture and rural development sector by units under the Ministry at localities.

Article 28. Budget for Administrative Procedure Control

1. The preparation, management, and utilization of the budget for administrative procedure control activities shall be carried out in accordance with Circular No. 224/2010/TT-BTC.

2. The Finance Department shall be responsible for compiling the annual state budget estimate for the Ministry of the budget for administrative procedure control activities proposed by units under the Ministry; allocate and settle the budget for units in accordance with regulations.

Article 29. Publicity Work

The Ministry's Office shall develop a publicity plan regarding the administrative procedure control work of the Ministry; coordinate with the Vietnam Agriculture Newspaper and other mass media agencies to publicize the administrative procedure control work of the Ministry.

The Vietnam Agriculture Newspaper shall proactively publicize the implementation of administrative procedure control, administrative regulations in the agriculture and rural development sector; provide information about difficulties, shortcomings, suggestions, and solutions during the implementation at grassroots levels.

Article 30. Administrative Procedure Control Briefings

1. Regular Briefings

Quarterly, the Administrative Procedure Control Department shall conduct briefings with key staff members of units frequently involved in administrative procedures to assess the implementation of plans and assigned tasks for the quarter and deploy subsequent tasks.

The year-end briefing shall be chaired by the Ministry’s leadership, with the participation of leaders and key staff members of all subordinate units and key staff members of departments and bureaus under the General Department.

2. Extraordinary Meetings

It may be conducted to implement an important, urgent task or upon request of the Ministry’s leadership. Participants will be determined based on the requirements of the work to be implemented.

Chapter 7.

REGIME FOR STAFF AND CIVIL SERVANTS ENGAGED IN ADMINISTRATIVE PROCEDURE CONTROL WORK

Article 31. Regime

1. Staff performing administrative procedure control duties shall enjoy benefits equivalent to the department-level leadership allowance stipulated by the unit head.

2. Staff and civil servants who are rewarded for their performance in administrative procedure control shall be entitled to early salary increments and priority consideration for promotion to higher positions if there is a need from the agency, organization, or unit.

Article 32. Awards and Disciplinary Measures

1. The Administrative Procedure Control Department shall establish and submit to the Minister for promulgation criteria for evaluating the annual performance of units in administrative procedure control tasks; annually assess the completion level of administrative procedure control tasks by units and key civil servants, and recommend the Ministry’s Commendation Council to award collectives and individuals with outstanding achievements.

2. Units under the Ministry that fail to complete administrative procedure control tasks or strictly comply with this Regulation, depending on the severity, the Minister may criticize or impose disciplinary measures.

Chapter 8.

IMPLEMENTING PROVISIONS

Article 33. Implementation Organization

1. Units shall disseminate the Provisions to all cadres, civil servants, and organizations and strictly implement these Provisions. In the course of implementation, if there are any difficulties, units shall promptly report to the Ministry (through the Ministry's Office) for adjustment and supplementation.

2. The Administrative Procedure Control Department shall monitor compliance with these provisions; compile and propose to the Ministry timely solutions to difficulties and obstacles encountered during implementation./.
