DECISION OF THE PRIME MINISTER

Regulations on standards and quotas for the use of office premises

at state agencies and public service units

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Ordinance on thrift and anti-waste No. 02/1998/PL-UBTVQH10 dated February 26, 1998; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Pursuant to Decree No. 86/CP dated December 19, 1996 of the Government on the issuance of Auction Rules for Assets;

Pursuant to the Government Decree on State asset management No. 14/1998/NĐ-CP dated March 6, 1998;

At the proposal of the Minister of Finance, the Minister of Home Affairs, the Chairman of the Personnel and Civil Servants Board of the Government, and the Minister of Construction;

 

DECISION:

Article 1. State agencies and public service units that are allocated office premises according to the standards and quotas set forth in this Decision are state management agencies at all levels, public service units, political organizations, and political-social organizations whose operational costs are guaranteed by the state budget (hereinafter referred to as agencies and units).

Article 2. Based on the standards and quotas for the use of office premises stipulated in this Decision and the nature and characteristics of activities of agencies and units under the armed forces and diplomatic missions of Vietnam abroad, the Ministry of Finance is hereby instructed:

1. To take the lead in coordinating with the Ministry of National Defense, the Ministry of Public Security, the Ministry of Foreign Affairs, and relevant ministries and sectors to establish standards and quotas for the use of office premises for agencies and units under the armed forces and diplomatic missions of Vietnam abroad.

2. To establish standards and quotas for the use of office premises for commune and ward-level agencies.

Article 3. In this Decision, the following terms shall be understood as follows:

1. Office premises include the land plot and the total area of buildings constructed on the land.

2. The total working area of each agency or unit includes:

Working space for officials and civil servants. This area is determined based on the number of officials and civil servants within the approved staffing level of the agency or unit by the competent state authority and the standard quota for each workspace.

Areas for service and auxiliary functions, public and technical spaces such as: common reception areas, meeting rooms, libraries, archives, permanent offices, security, health services, warehouses, places for specialized equipment, main entrance halls, secondary entrance halls, corridors, sanitary facilities...

3. The land plot is the total area of land allocated to the agency or unit by the competent state authority in accordance with the laws on land.

Article 4. Annually, the competent state authority shall base its decision on the budget capacity of each level, the current total area of working buildings, the total approved staffing and positions of the agencies and units, and the standards and quotas for the use of office premises set forth in this Decision to decide on new construction, supplementary construction, or allocation of office premises to each agency or unit in accordance with the current regulations of the State to gradually ensure sufficient working space for agencies and units at each level of management.

Article 5. Standards and quotas for the use of working space for the following positions shall be arranged by the agencies based on their usage requirements based on the current working space of the agency:

General Secretary of the Central Committee of the Communist Party of Vietnam;

Member of the Politburo of the Central Committee of the Communist Party of Vietnam;

President, Vice President;

Chairperson of the National Assembly, Vice Chairperson of the National Assembly;

Prime Minister, Deputy Prime Minister;

Article 6. Standards and quotas for the use of working space for other positions are specified as follows:

Article 7. The area for service, auxiliary, public, and technical spaces of each agency or unit is determined as follows:

1. For newly constructed office premises, the area for service, auxiliary, public, and technical spaces is calculated at a maximum of 35% of the total working area determined based on the approved staffing level and the standard quota for each workspace prescribed in Article 6 of this Decision;

2. For existing office premises currently in use, the area is determined based on actual usage.

3. The auxiliary area used for international reception, public reception, court proceedings, storage archives, reserve warehouses, specialized warehouses... belonging to state agencies with special characteristics such as: Diplomacy, Judiciary, State Archives, National Reserve, State Treasury... The Ministry of Finance shall coordinate with relevant ministries and sectors to stipulate standards and usage norms suitable to the necessary requirements, ensuring the effective performance of the tasks of each sector.

Article 8. Organizations under political-social organizations that are guaranteed operational funds from the state budget shall base on the standards and usage norms for office premises prescribed in this Decision to allocate working space areas for their staff positions equivalent to those of other agencies and units as prescribed in this Decision; arrange and utilize areas for service, auxiliary, communal, and technical sections of their own agencies and units according to the provisions of Clause 1 and 2, Article 7 of this Decision.

Article 9. The land plot for office premises of agencies and units is regulated as follows:

1. For office premises already constructed and currently in use, the land plot shall be determined based on actual usage by the competent state authority.

2. For newly constructed office premises, the allocation and use of land must comply with current laws on land.

Article 10. The Minister, Head of a ministry-level agency, head of a government-affiliated agency, head of central bodies of mass organizations, Chairperson of provincial People's Committees directly under the Central Government, based on the standards and norms set out in this Decision and guiding documents issued by the Ministry of Finance, shall direct subordinate units within their management scope to rearrange existing office premises to effectively and economically utilize state assets.

Article 11. By no later than December 31, 1999, agencies and units mentioned in Article 1 of this Decision, which have been assigned by the State to manage and use office premises, must register and report the current area of their office premises (including areas they are leasing or lending out) to the financial authority in accordance with current State regulations. In the first quarter of 2000, the Ministry of Finance will compile and report to the Prime Minister on the situation of managing and using existing office premises at state agencies nationwide.

Article 12. Based on the standards and norms for using office premises in this Decision and the annual state budget capacity, the financial authority has the responsibility to review the budget estimate for repair and renovation costs of office premises and to take the lead in coordinating with the Planning and Investment Authority to examine the need for investment in construction and expansion of working areas for each state agency to decide or submit to the competent authority for decision on the project list and investment capital for new construction, renovation, and repair of office premises to be included in the state budget estimate for such expenditures in accordance with the State Budget Law.

Article 13. Agencies and units using office premises according to the standards and norms in this Decision shall be responsible for:

Managing and using office premises in accordance with regulations, absolutely not to use office premises for: leasing; transferring; joint venture capital contribution; allocating to staff members as housing or transferring land and buildings belonging to office premises beyond their authority;

Implementing land management within the office premises' land plot in accordance with current laws on land and other current State regulations;

Heads of agencies and persons signing decisions contrary to the provisions of this Decision or beyond their authority shall bear responsibility, and if material damage occurs, they shall compensate in accordance with the law.

Article 14. This Decision takes effect fifteen days from the date of signature. Previous regulations inconsistent with this Decision are abolished.

Article 15. Ministers, Heads of ministry-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the Central Government, and Heads of related organizations and agencies are responsible for implementing this Decision./.
