Establishment of the Management Board for Industrial Zones of Kien Giang Province

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

Considering the proposal of the Chairman of the People's Committee of Kien Giang Province at Proposal No. 60/TTr-UBND dated September 26, 2007 and that of the Minister of Home Affairs at Proposal No. 3030/TTr-BNV dated October 22, 2007,

DECISION:

Article 1. Establishment of the Management Board for Industrial Zones of Kien Giang Province

1. Establish the Management Board for Industrial Zones of Kien Giang Province (hereinafter referred to as the Management Board), under the Kien Giang Provincial People's Committee, to manage industrial zones within the province.

2. The Management Board shall have legal personality, bank accounts, office premises, and a seal with the National Emblem; it shall be the focal point for budget planning of the Kien Giang Provincial People's Committee, and shall be allocated separate development investment capital from the central budget (as stipulated in Decision No. 183/2004/QĐ-TTg dated October 19, 2004 of the Prime Minister on mechanisms to support central budget capital for the construction of technical infrastructure in industrial zones in economically disadvantaged areas and other relevant legal documents); it shall be subject to management by the Kien Giang Provincial People's Committee regarding organization, staffing, programs, work plans, and operational funding.

Article 2. Tasks and Powers

1. The Management Board shall have the tasks and powers to manage investment in industrial zones within the province according to Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law, and shall perform other related tasks and powers concerning the management and development of industrial zones as prescribed by law and delegated authority.

2. The Kien Giang Provincial People's Committee shall specify the functions, tasks, powers, and organizational structure of the Management Board in accordance with the law.

Article 3. Organizational Structure and Staffing

1. Organizational Structure:

a) The Management Board shall have a Director and two Deputy Directors appointed and relieved of their positions by the Chairman of the Kien Giang Provincial People's Committee in accordance with Decision No. 45/2007/QĐ-TTg dated April 3, 2007 of the Prime Minister on the authority to manage cadres of industrial zone management boards, export processing zone management boards, high-tech park management boards, economic zone management boards, and other management boards with different names under ministries and provincial/municipal people's committees directly under the central government;

b) The Management Board shall have an administrative support staff including an office and specialized departments;

c) Affiliated units.

Depending on the requirements for managing and developing industrial zones in each stage, the Director of the Management Board shall submit to the Chairman of the Kien Giang Provincial People's Committee for decision on the organizational structure of the Management Board.

2. The staffing of the Management Board shall be decided by the Chairman of the Kien Giang Provincial People's Committee in accordance with the law on the delegation of administrative and public service staffing management and the staffing mechanism for state-owned public service units.

Article 4. Effectiveness

This Decision takes effect from the date of issuance.

Article 5. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, the Chairman of the Kien Giang Provincial People's Committee, and the Director of the Kien Giang Provincial Industrial Zone Management Board are responsible for implementing this Decision.
