Regarding the functions, tasks, powers, and organizational structure of the Administrative and Public Financial Department

DECISION OF THE MINISTER OF FINANCE

Based on Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Based on Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Based on Circular No. 1912/BNV-TCBC dated August 15, 2003 of the Ministry of Home Affairs regarding agreement on establishing rooms at some units under the Ministry of Finance;

Considering the proposal of the Director of the Administrative and Public Financial Department and the Director of the Cadre and Civil Servant Organization Department,

Decide:

Article 1The Administrative and Public Financial Department is a unit within the state management machinery of the Ministry of Finance, assisting the Minister of Finance in performing state management functions concerning finance in the administrative and public sectors nationwide.

Article 2. The Administrative and Public Financial Department has the following tasks:

1. Drafting legal normative documents, mechanisms, policies, systems, standards, and budget expenditure norms applicable to administrative agencies and state-owned public institutions for submission to the Minister of Finance.

2. Drafting legal normative documents, policies, norms, standard frameworks, and state budget support funds for political and social organizations, political and social-professional organizations, social organizations, and social-professional organizations for submission to the Minister of Finance.

3. Drafting documents on policies and management mechanisms concerning the financial activities of Social Insurance Funds, social funds, charitable funds, non-state public institutions as assigned by the Ministry.

4. Drafting strategic directions and plans for state management in the field of finance for the administrative and public sectors; participating with ministries, ministerial-level agencies, government agencies, and other central agencies in developing strategies, planning, and long-term, five-year, and annual plans, and other projects in the administrative and public sectors as assigned by the Ministry.

5. Guiding, inspecting, and evaluating the implementation of legal normative documents, policies, systems, standards, and expenditure norms of administrative agencies, public institutions, and other agencies using state budget funds as assigned by the Ministry.

6. Leading or participating with units under the Ministry in formulating other policies, mechanisms, and systems related to administrative and public finance as assigned by the Ministry.

7. In state budget management:

a. Reviewing and consolidating annual regular revenue and expenditure budgets of ministries, ministerial-level agencies, government agencies, and central political and social organizations within its jurisdiction as assigned by the Ministry.

Reviewing the state budget support funds for central political and social-professional organizations, social organizations, and social-professional organizations within its jurisdiction as assigned by the Ministry.

b. Reviewing the allocation and assignment of annual regular revenue and expenditure budgets of ministries, ministerial-level agencies, government agencies, and central political and social organizations within its jurisdiction; reviewing the allocation and assignment of state budget support funds for central political and social-professional organizations, social organizations, and social-professional organizations within its jurisdiction.

c. Inspecting and evaluating the implementation of annual regular expenditure budgets of ministries, ministerial-level agencies, government agencies, and central political and social organizations; the implementation of state budget support funds for central political and social-professional organizations, social organizations, and social-professional organizations within its jurisdiction.

d. Submitting to the Minister of Finance for supplementary, adjustment, or advance payment (if necessary) of annual administrative and public expenditure budgets of ministries, ministerial-level agencies, government agencies, and central political and social organizations within its jurisdiction.

Submitting to the Minister of Finance for supplementary or adjustment of state budget support funds for central political and social-professional organizations, social organizations, and social-professional organizations according to regulations.

đ. Reviewing or approving (specifically for first-tier budget units which are also third-tier) and announcing the results of the review (or approval) of annual revenue and expenditure settlement reports of ministries, ministerial-level agencies, government agencies, and other central agencies within its jurisdiction.

During the review of settlement reports, if errors are discovered, it has the right to request the approving agency to correct them, and simultaneously recommend to the Minister of Finance to handle violations according to the law.

8. Leading and coordinating with units under the Ministry in summarizing and evaluating the situation of managing and using public economic funds.

9. Implementing forecasting, statistics, and summarization of situations and data; analyzing and evaluating the effectiveness of budget expenditures in the administrative and public sectors according to management requirements.

10. Cooperating and participating in building national financial policies, scientific research, and international cooperation in the field of administrative and public finance as assigned by the Ministry.

Article 3. The Director of the Administrative and Public Financial Department has the following rights:

- Signing circulars approving budgets for managed entities within the scope approved by the Minister.

- Reporting to the Minister for handling or submitting to competent authorities for handling management documents on administrative and public finance issued by central and local agencies that violate state regulations and those of the Ministry of Finance.

- Receiving reports and relevant materials and information as prescribed to perform assigned functions and tasks.

- Signing documents explaining and responding to organizations and individuals about policies and systems in the field of administrative and public finance according to the delegation and authorization of the Minister of Finance.

- Refusing to accept reports that do not comply with regulations and fail to meet the management requirements of the Ministry of Finance.

Article 4

The Administrative and Public Financial Affairs Department has a Director and several Deputy Directors.

The Director of the Administrative and Public Financial Affairs Department is responsible for managing all civil servants of the department; organizing training and enhancing the qualifications of civil servants; being accountable to the Minister for all activities of the department.

The Deputy Director of the Administrative and Public Financial Affairs Department is accountable to the Director for the assigned tasks.

The Administrative and Public Financial Affairs Department has the following divisions:

1. Administrative and Mass Organizations Division (referred to as Administrative and Mass Organizations Division)

2. Social Insurance and Health Division

3. Culture, Training, Science, Radio and Television, Physical Education and Sports Division (referred to as Cultural and Social Services Division)

4. Economic Services Division

Specific tasks of each Division are defined by the Director of the Administrative and Public Financial Affairs Department.

The Administrative and Public Financial Affairs Department organizes the implementation of tasks under a system combining specialist positions with divisional organization; for tasks carried out under the specialist position system, the Director of the Administrative and Public Financial Affairs Department is responsible for organizing work and assigning tasks to civil servants in accordance with their titles, standards, and professional capabilities to fulfill the assigned tasks.

The staffing of the Administrative and Public Financial Affairs Department is decided by the Minister of Finance.

Article 5. This Decision takes effect from the date of signature. Decree No. 1129 TC/QĐ/TCCB dated October 26, 1995 issued by the Minister of Finance on the establishment of the Regulations on the Organization and Operation of the Administrative and Public Financial Affairs Department is hereby abolished.

The Director of the Administrative and Public Financial Affairs Department, the Director of the Cadres and Civil Servants Organization Department, the Head of the Ministry's Office, and the Heads of units and organizations under the Ministry are responsible for implementing this decision./.
