PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the management, use, and exploitation of the Asset Management Software for rural centralized clean water supply works (hereinafter referred to as the Software).
Article 2. Applicability
1. The Ministry of Finance.
2. The Ministry of Agriculture and Rural Development.
3. People's Committees of provinces and centrally governed cities.
4. Departments of Finance; Departments of Agriculture and Rural Development of provinces and centrally governed cities.
5. State agencies, public service units, enterprises, organizations; individuals assigned by the People's Committees of provinces and centrally governed cities to manage rural centralized clean water supply works and other entities related to the management, use, and exploitation of such works.
Article 3. Prohibited acts in the management, use, and exploitation of the Software
1. Intentionally destroying or damaging the Software and the database of state assets that are rural centralized clean water supply works.
2. Intentionally accessing without authorization, causing distortion of information in the database.
3. Using information from the database for personal purposes or other purposes without permission from competent state authorities.
4. Handling cases of violations stipulated in Clauses 1, 2, and 3 of this Article shall be carried out in accordance with Decree No. 192/2013/NĐ-CP dated November 21, 2013 of the Government on administrative penalties in the field of management and use of state assets; thrift and anti-waste; national reserves; state treasury.
Chapter II
SPECIFIC PROVISIONS
Article 4. Conditions for operating the Software
1. Computer conditions and internet connectivity capability: The computer must be installed with the Windows operating system, antivirus software, regularly updated with new virus signature files and security patches for the operating system, using Unicode TCVN 6909:2001 font for typing Vietnamese characters, and must be connected to the internet.
2. Conditions for the Software administrator who is granted an account and access permissions by the Ministry of Finance based on a written request from the provincial or centrally governed city Department of Finance.
3. Conditions for Software users who are granted accounts to access the Software by the Ministry of Agriculture and Rural Development, provincial or centrally governed city Department of Finance based on a written request.
Article 5. Identification Code of Units in the Software
1. The unit code in the Software is the budget-related code issued and managed by the Ministry of Finance and Provincial Finance Departments in the common list, which has been converted correspondingly for use as the unit code in this Software.
2. In cases where the unit is a business entity or organization, individual without a budget-related code, the tax identification number shall be used for identification and assignment of the unit code accordingly.
3. The identification and assignment of unit codes shall be carried out by software administrators according to the guidelines set forth in the User Guide for the Rural Clean Water Supply Project Asset Management Software issued by the Ministry of Finance (State Asset Administration Department) in July 2014.
Article 6. Input, Review, and Standardization of Data into the Software
1. Information on rural clean water supply projects entered into the Software must be information that has been reviewed and confirmed by the Department of Agriculture and Rural Development in accordance with Article 19 of Circular No. 54/2013/TT-BTC dated May 4, 2013, of the Ministry of Finance on the management, use, and operation of rural clean water supply projects (hereinafter referred to as Circular No. 54/2013/TT-BTC).
2. Information to be entered includes:
a) Information from the inspection report and revaluation of project value (Form No. 01 BB/CTNSNT issued together with Circular No. 54/2013/TT-BTC), for cases stipulated in point a, Clause 1, Article 6 of Circular No. 54/2013/TT-BTC;
b) Information from the handover report (Form No. 02 BB/CTNSNT issued together with Circular No. 54/2013/TT-BTC);
c) Information from the initial declaration report on projects (Form No. 01-BC/CTNSNT); the change report on project management units (Form No. 02-BC/CTNSNT); the change report on projects (Form No. 03-BC/CTNSNT); the deletion report on project data in the database (Form No. 04-BC/CTNSNT); the change report on project operation (Form No. 05-BC/CTNSNT) issued together with Circular No. 54/2013/TT-BTC and Appendix No. 01-PL-CTNSNT issued together with Circular No. 4718/BTC-QLCS dated April 11, 2014, of the Ministry of Finance.
3. The process of inputting, reviewing, and standardizing data into the Database is as follows:
a) Provincial Departments of Agriculture and Rural Development are responsible for entering the specified information into the Software within ten working days from the date of receipt of the report from the assigned management and operation units of rural clean water supply projects;
b) Provincial Finance Departments base their review and confirmation of the accuracy of the information entered by the Provincial Departments of Agriculture and Rural Development according to the provisions of Clause 1 and point a, Clause 3 of this Article, and are responsible for the correctness of the information to be included in the Database; they regularly or upon request of competent authorities conduct thorough and accurate checks and standardizations of the entered data.
Article 7. Responsibilities for Managing, Operating, and Exploiting Information in the Database
1. Responsibilities of the Ministry of Finance
a) Take the lead in coordinating with the Ministry of Agriculture and Rural Development to complete the content and procedures for managing state assets as rural clean water supply projects in accordance with laws on the management and use of state assets;
b) Ensure material conditions for organizing safe and secure management and operation of the database on state assets as rural clean water supply projects;
c) Issue accounts for software administrators and users at the request of provincial finance departments. Implement access permissions for those who have been granted accounts;
d) Guide, inspect, urge, and evaluate the results of updating information into the database on state assets as rural clean water supply projects in accordance with laws on the management and use of state assets;
e) Manage, operate, and exploit information from the database on state assets as rural clean water supply projects to serve state management of state assets;
2. Responsibilities of the Ministry of Agriculture and Rural Development
a) Direct, guide, and inspect compliance with laws on the management of state assets as rural clean water supply projects in localities and the updating of information into the database on state assets as rural clean water supply projects in accordance with this Circular;
b) Coordinate with the Ministry of Finance to complete the content and procedures for managing state assets as rural clean water supply projects in accordance with laws on the management and use of state assets;
c) Coordinate with the Ministry of Finance in managing, operating, and exploiting information from the database to serve state management of state assets as rural clean water supply projects.
3. Responsibilities of People's Committees of centrally governed cities and provinces
a) Direct provincial finance departments, provincial agriculture and rural development departments, and related agencies at the local level to strictly implement regulations on managing, operating, and exploiting the national database on state assets as rural clean water supply projects in accordance with this Circular and other relevant laws;
b) Direct provincial finance departments, provincial agriculture and rural development departments, and related agencies at the local level to report on the management and use of state assets as rural clean water supply projects as required by competent authorities.
Article 8. Use and exploitation of information
1. The database on centralized rural clean water supply works is a part of the National Database on State Assets. Information in the database on centralized rural clean water supply works has legal value equivalent to paper files.
2. Information in the database on centralized rural clean water supply works shall be used as a basis for preparing budgets, reviewing final accounts, inspecting, auditing, supervising investment construction, upgrading, renovation, repair, reallocation, leasing exploitation rights, transfer, liquidation of works, and implementing reports on asset management and utilization according to the provisions of the law.
Article 9. Funding for Management and Exploitation of Software
1. Funding for building, managing, upgrading, and maintaining software shall be allocated in the annual state budget estimate of the Ministry of Finance and other sources (if any).
2. Funding for data import, review, and standardization in the software shall be allocated in the annual budget estimates of the Provincial Department of Finance, Provincial Department of Agriculture and Rural Development under the central government. The expenditure level for data import, review, and standardization of assets which are centralized rural clean water supply works, carried out by the unit, shall not exceed 50% of the data import expenditure level prescribed in Point c Clause 3 Article 19 Circular No. 194/2012/TT-BTC dated November 15, 2012 of the Ministry of Finance guiding the expenditure level for creating electronic information to maintain the regular operation of agencies and units using the state budget.
Chapter III
IMPLEMENTATION
Article 10. Effective Date
1. This Circular takes effect from November 7, 2015.
2. This Circular abolishes Point c Clause 3 Article 19 of Circular No. 54/2013/TT-BTC dated May 4, 2013 of the Ministry of Finance regarding the management, use, and exploitation of centralized rural clean water supply works.
3. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the provisions of the amended, supplemented, or replacing documents.
4. People's Committees of provinces and centrally governed cities shall direct relevant agencies, organizations, and units to implement this Circular.
5. In case difficulties arise during implementation, agencies, organizations, and units are advised to promptly report to the Ministry of Finance for coordinated resolution./.
