Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003, promulgated by the Government detailing and guiding the implementation of the Law on State Budget;
Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the application of information technology in state agency activities;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Administrative and Public Service Financial Department;
The Minister of Finance issues this Circular to regulate the content and expenditure levels for establishing, converting electronic information, and digitizing information on the internet to serve the regular operations of agencies and units funded by the state budget.
Article 1. Scope of application
This Circular applies to administrative agencies, public service organizations; other agencies and organizations that use state budget funds to establish electronic information on the internet to serve the regular operations of agencies and units at central and local levels.
Establishing, converting electronic information, and digitizing information (hereinafter referred to collectively as establishing electronic information) is creating electronic databases used to provide information on the internet, serving management, operation, and specialized activities of agencies and units.
Article 2. Scope of Application
1. The expenditure levels prescribed in this Circular apply to calculating costs for hiring external individuals or organizations (excluding civil servants and employees within the agency or unit and affiliated organizations) to perform tasks of establishing electronic information on computer networks.
2. Civil servants, employees who work overtime to establish electronic information on computer networks shall be paid overtime wages according to Circular No. 08/2005/TTLT-BNV-BTC dated January 5, 2005, jointly issued by the Ministry of Finance and the Ministry of Home Affairs guiding the implementation of wage payment systems for night work and overtime for civil servants, employees.
In cases where safety requirements for information security or special professional requirements make it impossible to hire externally for establishing electronic information, the head of the agency or unit shall consider selecting the method of paying overtime wages according to Circular No. 08/2005/TTLT-BNV-BTC mentioned above or decide specific expenditure levels but not exceeding 50% of the expenditure level applicable to external hires for corresponding tasks to pay civil servants and employees within the unit and bear responsibility for their decisions based on the tasks to be performed without affecting professional work and ensuring quality, security, and information safety during the establishment of electronic information.
Article 4. Contents of Expenditure
1. Expenditure for data entry.
2. Expenditure for establishing hypertext pages.
4. Expenditure for digitizing information.
1. For data entry work:
a) Structured data entry: Structured data refers to data organized according to a consistent structure that does not or rarely changes over time. The expenditure level for structured data entry is calculated per field of data based on the number of characters in one field, specifically as follows:
- For fields with up to 15 characters (n ≤ 15): maximum VND 300 per field.
- For fields with more than 15 characters up to 50 characters (15 < n ≤ 50): maximum VND 375 per field.
- For fields with more than 50 characters (n > 50): maximum VND 450 per field.
The unit price includes proofreading and verification of information; one page of text corresponds to 46 lines x 70 characters per line, equivalent to an average.
b) Unstructured data entry: Unstructured data refers to data in a free form without predefined structure, such as video files, image files, audio files...
The expenditure level for unstructured data entry is calculated per page of data, specifically as follows:
- For pages consisting only of letters and numbers: maximum VND 9,500 per page.
- For pages with accompanying tables: maximum VND 11,700 per page.
- For special pages with many mathematical formulas or special characters: maximum VND 14,000 per page.
The unit price includes proofreading and verification of information.
2. For hypertext page creation (Web): Hypertext pages are a type of data described using hypertext markup language (HTML), primarily designed to create connections to other resources on the network. Specific expenditure levels for creating hypertext pages are defined for each type of hypertext page. Specifically as follows:
a) Simple hypertext pages: These are mainly textual documents aimed at presenting information. The maximum expenditure level is VND 12,000 per original A4 page converted into a hypertext page (unstructured text converted into a hypertext page, depending on the complexity of structure and descriptive techniques).
b) Complex hypertext pages: These are documents utilizing advanced features of hypertext markup language, creating an intuitive, aesthetically pleasing interface, easy to use, serving as a basis for users to efficiently search and utilize information. The maximum expenditure level is VND 42,000 per original A4 page converted into a complex hypertext page (depending on the complexity of layout aesthetics, numerous images, use of advanced technologies, complex links).
The expenditure levels specified in points a and b of this clause do not include design interface and overall page structure costs.
3. For work involving the creation of electronic information in foreign languages or ethnic minority languages, the expenditure levels may be increased by 10% to 30% from the prescribed levels (excluding design interface and overall page structure costs).
4. For the creation of electronic information from existing electronic data sources, the expenditure level is calculated at a maximum of 15% of the initial expenditure level for creating information as stipulated in this Circular.
6. Digitizing information: In cases where peripheral devices are used to digitize images and store them in a file format for potential integration into texts or hypertexts, the maximum expenditure level shall be equal to 30% of the expenditure level for establishing hypertext pages as stipulated in Clause 5 of this Article.
7. The head of the unit shall examine and decide on specific expenditure levels based on financial capacity and actual needs, ensuring that they do not exceed the prescribed expenditure levels set forth in this Circular. Based on these specific expenditure decisions, taking into account the volume of work, the head of the unit may apply lump-sum payments for each volume of work. Such lump-sum payments must be conducted transparently within the unit and reflected in the internal expenditure regulations of the unit.
Article 5. Management, utilization, and settlement of funds:
1. Funds allocated for this task shall be utilized within the annual budget estimates of agencies and units assigned by the competent authority. Management and expenditure shall comply with current provisions of the State Budget Law and related implementing documents.
2. Expenditures shall be settled according to contracts between agencies, units, and suppliers, ensuring compliance with invoice and receipt regulations and procurement laws governing the purchase of goods, assets, and services.
3. Expenditures for staff, civil servants, and officials under the overtime pay system shall be settled in accordance with current regulations and the Joint Circular No. 08/2005/TTLT-BNV-BTC dated January 5, 2005, issued by the Ministry of Finance and the Ministry of Home Affairs, guiding the implementation of the overtime pay system for staff, civil servants, and officials working at night and during overtime.
Article 6. Implementation Organization
1. This Circular takes effect from January 1, 2013, and replaces Circular No. 137/2007/TT-BTC dated November 28, 2007, issued by the Ministry of Finance, guiding the expenditure levels for establishing electronic information.
2. In case of difficulties during implementation, agencies and units are requested to reflect them to the Ministry of Finance for study and resolution./.
