OF THE MINISTRY OF FINANCE NO. 15/2001/TT-BTC DATE MARCH 21, 2001 GUIDING MANAGEMENT AND SETTLEMENT OF BUDGET FUNDS FOR SUPPORTING THE CONSTRUCTION OF LEGAL DOCUMENTS
Pursuant to Decision No. 69/2000/QĐ-TTg dated June 19, 2000 of the Prime Minister on the Regulation on Management and Use of Funds for Supporting the Construction of Legal Documents.
The Ministry of Finance guides the management and use of state budget funds for supporting the construction of legal documents as follows:
1. Objectives and scope of application of this Circular:
This Circular applies to agencies, organizations, and units using funds supported by the state budget to construct legal documents of the National Assembly, Standing Committee of the National Assembly, Government, and Prime Minister. These include:
+ Draft laws and ordinances according to the legislative program of the National Assembly.
+ Draft resolutions containing legal provisions of the National Assembly, Standing Committee of the National Assembly.
+ Draft resolutions and decrees of the Government according to the program of constructing legal documents of the Government..
+ Draft decisions and directives of the Prime Minister containing legal provisions.
(Hereinafter referred to as legal documents)
In cases where projects to construct legal documents need to be issued urgently and are not included in the annual legislative program of the National Assembly and the Government, the drafting agency must promptly notify the Ministry of Finance, the National Assembly Office, the Government Office, and the Ministry of Justice for consolidation, supplementation, and adjustment of funds accordingly..
Agencies, units, and organizations assigned tasks to construct legal documents may use funds from their annual regular budget estimates to construct legal documents.
Other sources of funding such as domestic and foreign donations and sponsorships for constructing legal documents shall be balanced within the project construction budget. The use and management of these sources of funding shall be applied similarly to the use and management of state budget support funds for the work of constructing legal documents.
Agencies, units, and organizations assigned the main responsibility for constructing legal documents have the responsibility to use the supported funds for the intended purpose, in accordance with the content, current financial expenditure regulations, and the provisions of this Circular.
2. The support funds for constructing legal documents shall be used for the following purposes:
a) Drafting work of legal documents:
- Survey and investigation costs
- Translation and preparation of materials.
- Drafting, seminars, and preparation of documents.
- Printing of materials.
- Other expenses (if any).
b) Organizing the introduction of draft contents of legal documents to solicit opinions from agencies, mass organizations, and the public.
c) Review and verification work: responsible agencies shall research and send written reports to the drafting agencies.
d) Organizing the promulgation of laws and ordinances: publication through mass media such as newspapers, radio, television, and direct propaganda through meetings, classes, etc.
3. Levels of expenditure for constructing legal documents:
The use of support funds for constructing legal documents must comply fully with current financial expenditure regulations (such as travel expenses, conference fees, night work, overtime pay, printing costs, office supplies, etc.)...); Additionally, this Circular stipulates certain special-purpose expenditures in the construction of legal documents as follows:
3.1. Research and drafting of outlines (approved by the drafting board):
a) For draft laws and ordinances:
+ New draft laws and ordinances or draft laws and ordinances for amendment and supplementation (replacement):
Expenditure level: VND 700,000 - VND 1,500,000 per outline.
+ Draft laws and ordinances for amendment and supplementation of some articles: Expenditure level: VND 400,000 - VND 1,000,000 per outline.
b) For draft resolutions of the National Assembly, Standing Committee of the National Assembly, draft resolutions and decrees of the Government, and draft decisions and directives of the Prime Minister: Expenditure level: VND 400,000 - VND 1,000,000 per outline.
3.2. Expenditure for drafting, specialized reports, revision reports, summary reports, review and verification reports of legal documents:
a) For draft laws and ordinances:
+ New draft laws and ordinances or laws and ordinances for amendment and supplementation (replacement):
* Expenditure level: VND 300,000 - VND 700,000 per specialized report, summary report, review, and verification.
* Expenditure level: VND 100,000 - VND 200,000 per revision report..
+ Draft laws and ordinances for amendment and supplementation of some articles:
* Expenditure level: VND 200,000 - VND 300,000 per specialized report, summary report, review, and verification.
* Expenditure level: VND 100,000 - VND 200,000 per revision report..
b) For draft resolutions of the National Assembly, resolutions and decrees of the Government:
* Expenditure level: VND 200,000 - VND 300,000 per summary report, review report, and verification report.
* Expenditure level: VND 100,000 - VND 200,000 per revision report.
3.3. Expenditure for seminars serving drafting, revision, review, and organizing press conferences to announce laws, ordinances, resolutions of the National Assembly, resolutions and decrees of the Government:
- Host of the meeting: VND 100,000 per person per session.
- Participants: VND 50,000 per session.
3.4. Expenditure for renting reference materials (if any):
- Translation from foreign languages (English, French, German, Russian, etc.) into Vietnamese: VND 50,000 per page (300 words).
The expenditure levels specified in this Circular are maximum levels. Heads of agencies, units, and organizations assigned the main responsibility for drafting legal documents shall determine specific expenditure levels based on the total amount of support funds for constructing legal documents, taking into account the requirements of content and complexity of each document, but not exceeding the levels specified in this Circular.
4. Budget preparation, allocation, and settlement of funds:
- Pursuant to the legislative drafting program of the National Assembly and the Government, the National Assembly Office and the Government Office announce the annual legislative drafting program of the National Assembly and the Government to the relevant units for implementation; The agencies, units, and organizations assigned to take the lead in drafting legislative texts within the legislative drafting program of the National Assembly and the Government shall base on the current financial expenditure regime and the funding level specified above to prepare the budget estimate for supporting the drafting of legislative texts to be submitted to the Ministry of Finance, the National Assembly Office, the Government Office, and the Ministry of Justice at the same time as preparing the annual state budget estimate.
- The Ministry of Finance shall take the lead in coordinating with the National Assembly Office, the Government Office, and the Ministry of Justice to allocate and announce the funding support for drafting legislative texts for each agency and unit in the annual state budget estimate of the relevant units.
- The Ministry of Finance shall coordinate with the National Assembly Office, the Government Office, and the Ministry of Justice to organize the inspection of the use of funds for drafting legislative texts.
- Specifically, for the funding for drafting Laws and Ordinances in the legislative drafting program of the National Assembly in 2001: The Ministry of Finance shall coordinate with the National Assembly Office, the Government Office, and the Ministry of Justice to allocate and announce outside the state budget estimate already allocated to the relevant agencies and units. For other legislative texts besides Laws and Ordinances, the agencies shall arrange within the scope of the state budget estimate for 2001 already allocated by the competent authority to implement.
5/ Implementation clauses:
This Circular takes effect from January 1, 2001; During the implementation period, if there are difficulties or obstacles, please report to the Ministry of Finance for consideration and resolution.
