THE MINISTER OF JUSTICE

Pursuant to Decree No. 38/CP dated June 4, 1993 of the Government on the functions, tasks, powers, and organization of the Ministry of Justice;

Pursuant to Decree No. 68/2002/NĐ-CP dated July 10, 2002 of the Government detailing the implementation of certain provisions of the Law on Marriage and Family regarding marriage and family relations involving foreign elements;

After reaching consensus with the Ministry of Foreign Affairs;

At the proposal of the Director of the Office and the Head of the Notarization, Registration, Citizenship, and Personal Record Department.

Article 1.

Attached hereto are 24 forms and registers for managing and registering family matters in accordance with Decree No. 68/2002/NĐ-CP dated July 10, 2002 of the Government detailing the implementation of certain provisions of the Law on Marriage and Family regarding marriage and family relations involving foreign elements (hereinafter referred to as Forms for Family Matters Involving Foreign Elements), listed and numbered in the attached List.

Article 2.

The Forms for Family Matters Involving Foreign Elements prescribed in Article 1 of this Decision shall be uniformly used at provincial Departments of Justice throughout the country and at diplomatic missions and consular offices of Vietnam abroad.

Article 3.

1. The Ministry of Justice shall organize the printing and distribution of 12 Forms for Family Matters Involving Foreign Elements listed in Section I of the attached List.

2. Provincial Departments of Justice, central city departments, diplomatic missions, and consular offices of Vietnam abroad shall organize the printing and distribution of 12 Forms for Family Matters Involving Foreign Elements listed in Section II of the attached List, in accordance with the specifications and contents prescribed in the attached Forms accompanying this Decision.

Article 4.

The Head of the Notarization, Registration, Citizenship, and Personal Record Department shall coordinate with the Director of the Consular Department of the Ministry of Foreign Affairs to adjust the Forms for Family Matters Involving Foreign Elements (the section recording the name of the registration authority) to suit their use at diplomatic missions and consular offices of Vietnam abroad. The Consular Department of the Ministry of Foreign Affairs shall implement the printing and distribution of the Forms for Family Matters Involving Foreign Elements for use at diplomatic missions and consular offices of Vietnam abroad as stipulated in Clause 1, Article 3 of this Decision.

Article 5.

It is strictly prohibited to print, distribute, and use the Forms for Family Matters Involving Foreign Elements contrary to the provisions of this Decision.

Article 6.

This Decision shall take effect 15 days from the date of publication in the Official Gazette and shall replace Decision No. 571/QĐ-HT dated August 4, 1995, Decision No. 650/QĐ-HT dated September 16, 1995, and Decision No. 615/QĐ-HT dated May 4, 1996 of the Minister of Justice on the issuance of forms and certificates concerning marriage and family relations between Vietnamese citizens and foreigners.

Article 7.

The Director of the Office, the Head of the Notarization, Registration, Citizenship, and Personal Record Department, the Directors of provincial Departments of Justice, and the Heads of diplomatic missions and consular offices of Vietnam abroad are responsible for implementing this Decision.
