THE MINISTER OF POSTS AND TELECOMMUNICATIONS

Pursuant to Decree No. 90/2002/ND-CP dated November 11, 2002 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 217/2003/QĐ-TTg dated October 27, 2003 of the Prime Minister on managing service charge prices for postal and telecommunications services;

Considering the proposal of Vietnam Post and Telecommunications Corporation at Document No. 86/GCTT dated January 8, 2004 regarding mobile phone service rates for 2004;

At the proposal of the Director of the Department of Planning and Finance,

DECISION:

Article 1.  Issuing the prepaid GSM mobile phone service rates of Vietnam Post and Telecommunications Corporation as follows:

1.1. The outgoing call rates from prepaid mobile phone subscribers shall be determined by the enterprise itself subject to the following conditions:

Intra-zone call rates:

Maximum rate not exceeding 3,000 VND/minute (1,500 VND/block of 30 seconds).

Minimum rate not less than 2,364 VND/minute (1,182 VND/block of 30 seconds).

Inter-zone call rates:

Maximum rate not exceeding 3,818 VND/minute (1,909 VND/block of 30 seconds).

Minimum rate not less than 3,182 VND/minute (1,591 VND/block of 30 seconds).

1.2. The billing unit is a block of 30 seconds; any remainder of the last block of the call that is less than 30 seconds shall be rounded up to 30 seconds. A call shorter than 30 seconds shall be charged for one block of 30 seconds.

1.3. International call rates for prepaid mobile services shall be calculated based on the domestic mobile information service rates plus international call rates according to the current international telephone tariff table. Calculation method as follows:

Prepaid mobile call  = Domestic zone rate + International telephone rate (IDD or VOIP)  international call            

1.4. No connection fee or monthly subscription fee shall be charged for prepaid mobile phone subscribers.

1.5. Information call rates from postpaid GSM mobile subscribers of the Corporation, from fixed network subscribers, from mobile subscribers of Callink, Mobilenet networks, from mobile subscribers using CDMA technology of the Corporation, from mobile end-user terminal wireless city subscribers calling prepaid mobile subscribers shall be applied according to the current postpaid GSM mobile information service rates of the Corporation.

1.6. Information call rates from subscribers of other mobile networks calling prepaid GSM mobile subscribers of the Corporation shall be applied according to the rates of those mobile networks.

1.7. Information and service call rates at public points (post offices, agents, commune cultural-post offices, card phone stations) for prepaid GSM mobiles shall be applied according to the rates for postpaid GSM mobiles at public points.

1.8. After adding value-added tax, prepaid mobile call rates in cases specified in Points 1.1, 1.2, 1.3, 1.5, 1.6, and 1.7 above shall be rounded off according to the following principles:

+ Any fraction greater than or equal to 50 VND shall be rounded up to 100 VND.

+ Any fraction less than 50 VND shall be rounded down to 0 VND.

1.9. Tariff zones are defined as follows:

Zone 1: includes provinces from Northern region to Quang Binh province

Zone 3: includes provinces and cities: Quang Tri, Thua Thien-Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Gia Lai, Kon Tum, Dak Lak, and Dak Nong.

Zone 2: includes remaining provinces and cities outside Zone 1 and Zone 3.

Intra-zone rates apply to calls within each zone.

Inter-zone rates apply to calls between zones:  From Zone 1 to Zone 2, Zone 3 and vice versa.

From Zone 2 to Zone 3 and vice versa.

1.10. Mobile prepaid information charges are collected from the originating subscriber.

Specifying specific rates within the tariff framework set out in Article 1. When issuing the tariff table within its authority, the Corporation shall notify the Ministry of Posts and Telecommunications before the decision takes effect.

Article 2. The rates specified in this Decision do not include value-added tax.

Article 3. Vietnam Post and Telecommunications Corporation:

Specifying the issuance of various card denominations, card usage periods, and reporting to the Ministry of Posts and Telecommunications.

Specifying the reduction in rates for outgoing calls from prepaid mobile phone subscribers:

For domestic calls from 11 PM the previous night to 7 AM the next morning on weekdays from Monday to Saturday, and for calls during holidays, holiday make-up days, Saturdays, and Sundays, but the maximum reduction shall not exceed 30% of the rates specified in Article 1.

For international calls, in addition to the reductions in mobile information rates as stipulated in this Decision, the reduction in international call rates shall be applied according to the current international telephone tariff table.

This Decision shall take effect from May 1, 2004. Previous regulations contrary to this Decision are hereby abolished.

Article 4. These provisions in this Decision apply to users of prepaid mobile information services of Vietnam Post and Telecommunications Corporation.

Article 5. The Director of the Office, Heads of the Planning and Finance Department, General Director of Vietnam Post and Telecommunications Corporation, and Heads of related units are responsible for implementing this Decision./.

Article 6. The Head of the Office, the Director of the Planning and Finance Department, the General Director of Vietnam Post and Telecommunications Corporation, and the Heads of related units shall be responsible for implementing this Decision./.
