PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 63/2003/NĐ-CP dated June 11, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;

Considering the proposal of the Minister of Culture, Sports and Tourism and the Minister of Home Affairs,

DECISION:

Article 1. Position and Functions

1. The Management Board of the Ethnic Cultural Village - Tourism is an agency under the Ministry of Culture, Sports and Tourism, performing state management functions directly over the Ethnic Cultural Village - Tourism according to the provisions of law.

2. The Management Board of the Ethnic Cultural Village - Tourism (equivalent to a General Department) has legal personality, uses a seal with the national emblem, opens accounts at the State Treasury and banks; it is a planning and budgetary unit directly subordinate to the Central Government (Class I budget unit), and is authorized to decide on revenue and expenditure from the state budget within investment development fields, administrative services, target programs, and other areas as prescribed by law.

Article 2. Tasks and Powers

1. Draft for the Minister of Culture, Sports and Tourism to submit to the Prime Minister for decision:

a) Master plans, annual and long-term development plans for the Ethnic Cultural Village - Tourism;

b) Mechanisms and preferential policies for the Ethnic Cultural Village - Tourism that are appropriate to actual conditions of development during each period;

c) Schemes for issuing construction bonds and government bonds to meet the development needs of the Ethnic Cultural Village - Tourism.

2. Submit to the Minister of Culture, Sports and Tourism for approval:

a) Group A investment projects within the Ethnic Cultural Village - Tourism as stipulated by law;

b) Regulations on organization and operation, and management and exploitation regulations of the Ethnic Cultural Village - Tourism.

3. The Management Board of the Ethnic Cultural Village - Tourism directs and organizes the implementation of the following tasks:

a) Planning management:

- Directing the preparation and approval of detailed planning for functional zones in the Ethnic Cultural Village - Tourism; organizing management and supervision of implementation;

- Issuing, adjusting, and revoking construction planning certificates for projects in the Ethnic Cultural Village - Tourism.

b) Investment and construction management:

- Directing and organizing the implementation of investment and construction projects funded by the state budget according to the provisions of law;

- Issuing, adjusting, revoking licenses and certificates pursuant to the delegation or decentralization of competent state agencies as prescribed by law:

+ Investment licenses for foreign direct investment projects in the Vietnam Ethnic Cultural Village with a capital investment up to forty million US dollars (excluding projects not authorized or decentralized according to the provisions of the law);

+ Investment registration certificates and investment incentive certificates for domestic investment projects in the Vietnam Ethnic Cultural Village;

+ Business registration certificates for organizations and individuals establishing and managing enterprises within the Vietnam Ethnic Cultural Village;

+ Construction permits for projects within the Vietnam Ethnic Cultural Village;

+ Work permits for foreigners and overseas Vietnamese residing abroad to work or invest in the Vietnam Ethnic Cultural Village;

+ Other licenses and certificates.

- Directly receiving and managing and using ODA funds;

- For investment projects not authorized or decentralized, the Management Board of the Vietnam Ethnic Cultural Village shall be responsible for coordinating with investors to resolve difficulties and obstacles during the implementation of investment procedures according to the one-stop-shop principle on-site.

c) Land management and use:

- The Management Board of the Vietnam Ethnic Cultural Village is allocated land (including water surface land according to approved planning) once to organize construction and development of the Vietnam Ethnic Cultural Village; it can allocate land, water surface land with payment and without payment; lease land, water surface land, transfer land use rights, water surface land use rights, and certify land use rights for investors in accordance with the Land Law;

- Take the lead and coordinate with local authorities and relevant agencies to implement compensation, land clearance, and land management (including water surfaces) within the Vietnam Ethnic Cultural Village;

- Direct the preparation and approval of detailed land use plans and water surface use plans for areas of land and water surface allocated at the Vietnam Ethnic Cultural Village;

- Approve land prices within the framework set by competent state agencies; organize bidding for land use rights within the scope of the Vietnam Ethnic Cultural Village.

d) Management and protection of natural resources and environment:

- Approving environmental impact assessment reports for investment projects in the Vietnam Ethnic Cultural Village as prescribed by law;

- Managing and inspecting the implementation of measures to protect natural resources and the environment within the Vietnam Ethnic Cultural Village; handling or recommending competent authorities to handle violations of regulations on protecting natural resources and the environment.

đ) Organizing management and exploitation:

- Uniformly managing exploitation, business, service activities, and use of investment facilities within the Vietnam Ethnic Cultural Village; directly exploiting, operating, and using facilities invested by the State and those assigned by the Ministry of Culture, Sports and Tourism;

- Coordinating with local authorities and related agencies, project sponsors to ensure public security, fire prevention and fighting, and cultural living habits during the construction and management of facilities within the Vietnam Ethnic Cultural Village.

e) Collecting fees and charges and managing their use in accordance with the law.

g) Organizing cultural information activities, scientific research, collecting, preserving, disseminating, and promoting ethnic cultural values.

h) Cooperate, joint venture, and associate with organizations and individuals both within and outside the country in areas related to investment, construction, and management and exploitation of the Village of Culture and Tourism of Ethnic Groups in Vietnam.

i) Organize investment promotion, trade, tourism, publicity, and introduction activities both domestically and internationally to attract investment capital for the Village of Culture and Tourism of Ethnic Groups in Vietnam through appropriate forms in accordance with the law; receive applications and resolve issues within their authority that arise during operations at the Village of Culture and Tourism of Ethnic Groups in Vietnam.

k) Manage and organize training for human resources serving the operation and development of the Village of Culture and Tourism of Ethnic Groups in Vietnam.

l) Manage organizational structure and staffing; implement policies and regulations for cadres, civil servants, public officials, and employees under the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam in accordance with the law.

m) Organize and coordinate with state management agencies in inspection, supervision, handling complaints, accusations, anti-corruption, waste, and negative practices, and administrative violations concerning planning, investment, environment, land, and other fields at the Village of Culture and Tourism of Ethnic Groups in Vietnam within the assigned authority or delegated authority.

n) Manage and utilize financial resources and assets allocated according to the law.

o) Report periodically to the Minister of Culture and Information, relevant ministries, and agencies on the implementation of planning, construction, and development plans for the Village of Culture and Tourism of Ethnic Groups in Vietnam.

p) Perform other tasks assigned by the Minister of Culture and Information.

Article 3. Organization and Staffing

1. The Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall have a Director, Deputy Directors, administrative support staff, affiliated units, and companies.

The Director shall be appointed by the Prime Minister upon the recommendation of the Minister of Culture and Information and shall be responsible to the Minister of Culture and Information for all activities of the Village of Culture and Tourism of Ethnic Groups in Vietnam.

Deputy Directors shall be appointed by the Minister of Culture and Information upon the recommendation of the Director of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam and shall be responsible to the Director for the assigned areas of work.

2. Administrative support staff shall include:

- Office;

- Inspection;

- Specialized and professional departments.

3. Affiliated units.

4. Service and development companies of the Village of Culture and Tourism of Ethnic Groups in Vietnam.

Based on development requirements, the Director of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall submit to the Minister of Culture and Information for decision on the specific organizational structure and affiliated units after obtaining the consensus of the Minister of Home Affairs.

The Director of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall define the functions, responsibilities, authorities, and organizational structure of the administrative support staff and affiliated units.

5. Staffing of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam:

a) Administrative staffing of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall be allocated by the Minister of Culture and Information within the total administrative staffing of the Ministry of Culture and Information.

b) Non-administrative staffing of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall be decided by the Director of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam according to the分级无法显示完整内容，以下是直接翻译结果：

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision shall take effect 15 days from the date of publication in the Official Gazette. Previous provisions contrary to this Decision are hereby abolished.

2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of the People's Committees of Ha Tay Province, and the Director of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall be responsible for implementing this Decision./.
