THE MINISTER OF INDUSTRY AND TRADE

Pursuant to Resolution No. 01/2007/QH12 dated July 31, 2007 of the National Assembly of the Socialist Republic of Vietnam, the twelfth session, first meeting, concerning the structure and organization of the Government and the number of Deputy Prime Ministers for the twelfth term;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to the Electricity Law dated December 3, 2004;

Pursuant to Decree No. 105/2005/NĐ-CP dated August 17, 2005 of the Government detailing and guiding the implementation of certain provisions of the Electricity Law;

Pursuant to Decision No. 276/2006/QĐ-TTg dated December 4, 2006 of the Prime Minister on electricity prices;

At the proposal of the Director of the Electricity Regulatory Authority,

DECISION:

Article 1. Issuing the framework for wholesale electricity prices for industrial zones, specifically as follows:

The framework for wholesale electricity prices at the 110kV busbar of the 110kV industrial zone substation shall be applied in cases where the industrial zone management board purchases wholesale electricity at the 110kV busbar of the industrial zone and resells it to end-users within the industrial zone at medium voltage transformer substations, according to the capacity of the substation, as follows:

In cases where the industrial zone management board purchases wholesale electricity and resells it at the same voltage level, the wholesale electricity price shall be applied according to the electricity selling price at that voltage level for production sectors as stipulated in Decision No. 276/2006/QĐ-TTg dated December 4, 2006 of the Prime Minister on electricity prices (hereinafter referred to as Decision No. 276/2006/QĐ-TTg), reduced by 2%.

3. In cases where the industrial zone management board purchases wholesale electricity at medium voltage and resells it to end-users at low voltage, the wholesale electricity price shall be applied according to the electricity selling price at the purchasing voltage level for production sectors as stipulated in Decision No. 276/2006/QĐ-TTg.

4. Guidelines for applying the framework for wholesale electricity prices for industrial zones (Annex attached).

Article 2. Effective Date

1. This Decision takes effect 15 days after its publication in the Official Gazette.

2. This Decision abolishes Clause 1, Section VI of Circular No. 11/2006/TT-BCN dated December 20, 2006 of the Minister of Industry guiding the implementation of electricity prices; and abolishes previous regulations that conflict with this Decision.

3. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments and Bureaus under the Ministry, the General Director of the Vietnam Electricity Corporation, and related power units are responsible for implementing this Decision./.
