CIRCULAR

Provisions on professional standards for ranks of Legal Aid Assistants

Pursuant to the Law on Legal Aid No. 69/2006/QH11 dated June 29, 2006 of the National Assembly;

Pursuant to the Government Decree No. 93/2008/NĐ-CP dated August 22, 2008 on the functions, tasks, powers, and organizational structure of the Ministry of Justice; Pursuant to the Government Decree No. 07/2007/NĐ-CP dated January 12, 2007 on detailed provisions and guidance for implementation of certain articles of the Law on Legal Aid;

On the basis of Pursuant to the Government Decree No. 116/2003/NĐ-CP dated October 10, 2003 on recruitment, utilization, and management of cadres and civil servants in state-owned units and the Government Decree No. 121/2006/NĐ-CP dated October 23, 2006 amending and supplementing some articles of the Government Decree No. 116/2003/NĐ-CP; Pursuant to the Circular No. 06/2010/TT-BNV dated July 26, 2010 of the Minister of Home Affairs on job titles and code numbers for ranks of Legal Aid Assistants;

After receiving the review opinion of the Ministry of Home Affairs in Circular No. 2442/BNV-CCVC dated July 26, 2010, the Minister of Justice promulgates the provisions on professional standards for ranks of Legal Aid Assistants as follows:

1. This Circular stipulates the professional standards for ranks of Legal Aid Assistants, including:

a) Senior Legal Aid Assistant;

Article 1. Scope and Applicability

b) Legal Aid Assistant.

2. The professional standards for ranks of Legal Aid Assistants serve as the basis for recruitment, utilization, and management of the Legal Aid Assistant staff.

Professional standards for the rank of Senior Legal Aid Assistant

A Senior Legal Aid Assistant is a state employee with the highest level of expertise in legal aid services of the State Legal Aid Center (hereinafter referred to as the Center) and its Branches (hereinafter referred to as Branches), directly providing legal aid services through various forms of legal aid for complex cases, involving multiple fields, multiple parties, and legal aid cases with foreign elements.

Article 2. a) Directly providing legal aid services for complex cases,

involving multiple fields, multiple parties, and legal aid cases with foreign elements according to the assignment of the Director of the Center; b) Self-assessing the quality of legal aid cases they handle. Organizing inspections and assessments of the quality of legal aid cases handled by other legal aid providers; guiding inspection and assessment procedures for legal aid cases to Legal Aid Assistants;.

2. Tasks

c) Leading or directly instructing professional skills and legal aid techniques to Legal Aid Assistants and collaborators; d) Leading or participating in researching, building, and implementing legal aid programs and plans within their jurisdiction; participating in drafting legal aid documents, programs, and plans assigned;;

đ) Leading or participating in compiling training programs and materials for legal aid skills; organizing or participating in training and skill development for legal aid providers at the local level;

e) Leading or participating in scientific research, summarizing practical experiences in legal aid implementation, and proposing solutions to improve and perfect legal aid work.

3. Standards for capacity

b) Possessing extensive knowledge about the legal system, proficiently performing specialized legal aid tasks, and effectively leading legal aid activities;

c) d) Organizing effective coordination with relevant agencies, organizations, and legal aid providers when conducting legal aid activities;đ) Having the ability to independently conduct scientific research and summarize practical experiences to serve legal aid work. 4. Standards for qualifications a) Holding a Bachelor's degree in law or higher;;

b) Holding a certificate in senior legal aid assistant training;;

c) Having proficiency in at least one foreign language at level B or higher;.

d) Having computer office skills;

đ) Having at least nine years of experience in the rank of Legal Aid Assistant or equivalent ranks in legal work, or having a continuous total of at least nine years in the rank of Legal Aid Assistant and equivalent ranks in legal work.

b) Hold a certificate for legal aid assistant vocational training;

c) Possess at least level B proficiency in one foreign language;

d) Have office computer skills;

đ) Have at least nine years of experience in the legal assistant civil service rank or equivalent ranks related to legal work, or have a continuous total of at least nine years of experience in the legal assistant civil service rank and equivalent ranks related to legal work;.

Article 3. Professional Standards for Legal Assistant Cadres

1. Responsibilities

A Legal Assistant is a professional cadre specializing in providing legal aid services directly at the Center and Branches, implementing less complex legal aid cases through various forms of legal aid and other legal aid activities as assigned. a) Directly implement legal aid for less complex cases,

related to one or several fields or subjects as assigned by the Center Director or Branch Head; b) Carry out legal aid professional activities within the assigned tasks;

c) Independently assess the quality of legal aid cases handled by themselves; participate in inspecting and evaluating the quality of cases handled by Legal Assistants and cooperating lawyers as assigned;

d) Participate in researching and developing legal aid programs and plans at the local level; compile programs, materials, and participate in training legal aid professionals for cooperating lawyers and legal aid networks at the grassroots level; 

đ) Participate in scientific research serving legal aid work.

b) Possess in-depth knowledge and understanding of the legal fields involved in legal aid; proficiently perform specialized legal aid tasks; independently and proactively implement legal aid cases and other legal aid activities;

self-assess the quality of legal aid cases;

c) effectively coordinate with relevant agencies, organizations, and legal aid providers when carrying out legal aid professional activities;

đ) Have at least two years of experience working in legal affairs.

d) Having computer office skills;

đ) Having at least nine years of experience in the rank of Legal Aid Assistant or equivalent ranks in legal work, or having a continuous total of at least nine years in the rank of Legal Aid Assistant and equivalent ranks in legal work.

The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of Provincial People's Committees under the Central Government are responsible for implementing this Circular./.

đ) Have at least two years of experience in legal work.

Article 4. Effectiveness

This Circular takes effect forty-five days from the date of signature.

The Minister, Head of a ministerial-level agency, agency under the Government, Chairman of the People's Committee of a province or centrally governed city shall be responsible for implementing this Circular./.
