Amending and supplementing certain provisions of the University and College Admissions Regulations for Part-time Study Programsissued together with Decision No. 62/2008/QĐ-GDDĐT dated November 25, 2008Minister of Education and Training

THE MINISTER OF EDUCATION AND TRAINING

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

At the proposal of the Director of the Department of Higher Education,

The Minister of Education and Training decides:

Article 1. Amending and supplementing certain provisions of the University and College Admissions Regulations for Part-time Study Programs issued together with Decision No. 62/2008/QĐ-BGDĐT dated November 25, 2008 of the Minister of Education and Training, as follows:

1. Point a Clause 1 Article 2 shall be amended and supplemented as follows:

"a) The school is permitted to admit students for part-time study programs (hereinafter referred to as VLVH) in majors that have been approved for regular training programs."

2. Point c Clause 2 Article 2 shall be amended and supplemented as follows:

"c) There must be a document assigning the task of setting up classes at localities by the Ministry of Education and Training (hereinafter referred to as the Ministry of Education and Training) for the first time recruiting majors."

3. Point d shall be added to Clause 2 Article 2 as follows:

"d) Schools establishing classes at localities must have at least two years of regular training in that major at the school."

"Article 3. Establishment and abolition of departments and units

"1. Each year, universities and colleges with quotas for admissions to university and college part-time study programs (VLVH) shall organize four admission rounds in March, April, October, and November, each round lasting four days, with daily activities specified in Clause 3 Article 14 of this Regulation. The examination schedule shall be determined by the Rector of the school.

Schools located in regions with difficult economic and social conditions, highland and mountainous areas shall be prioritized in receiving VLVH quotas but shall not use VLVH quotas to collaborate in admissions in other regions.
2. The subjects and subject groups of the admissions examination for part-time study programs are stipulated in Clause 1 and Clause 2 Article 14 of this Regulation.
3. The Directors of universities and academies, and the Principals of colleges (hereinafter collectively referred to as the Principal) shall be responsible for all aspects of the admissions process for part-time study programs: announcing admissions, accepting registration forms, developing admissions plans, preparing examination questions, printing, storing, and using examination papers; organizing the examination; marking and rechecking examinations; selecting candidates and summoning successful candidates; resolving complaints and reports related to the examination.

4. Forty-five days before the examination date, schools shall report to the Ministry of Education and Training their plans for implementing the admissions round, expected enrollment quotas and majors, number of subjects and names of subjects, examination date, location, and location for setting up classes to arrange inspection and supervision plans, and simultaneously announce on mass media all information about the admissions round. Any changes to the admissions plan, examination subjects, quotas, majors, examination date, and location must be reported to the Ministry of Education and Training at least thirty days before the organization of the admissions and publicly announced for candidates to know."

5. Point a Clause 1 Article 4 shall be amended and supplemented as follows:

"a) Having completed secondary general education (high school) through regular education or continuing education, vocational secondary education, intermediate technical education, or vocational secondary education (hereinafter collectively referred to as secondary education); individuals who have completed vocational secondary education must have completed junior secondary education and studied and passed the required subjects of high school cultural courses according to the regulations of the Ministry of Education and Training."

6. Point b Clause 1 Article 4 shall be amended and supplemented as follows:

"b) Being in good health to study according to current regulations. For those with disabilities, depending on their health condition and the requirements of the major, the Principal shall consider and decide."

7. Point d shall be added to Clause 4 Article 6 as follows:

"d) Candidates with disabilities who cannot independently meet their daily living needs: Principals of schools shall base their decisions on the high school academic records (transcripts), health status, and training requirements to determine admission."

8. Point đ shall be added to Clause 4 Article 6 as follows:

"đ) Foreign candidates wishing to study at Vietnamese universities and colleges: Principals of schools shall base their decisions on the high school academic records (grade sheets), knowledge assessment results, and Vietnamese language proficiency tests according to the school's regulations to determine admission."

9. Clause 2 Article 8 shall be amended and supplemented as follows:

"2. Duties and powers of the Admissions Board (AB): The AB has the duty and power to organize and implement all stages: preparing necessary conditions for the examination, preparing examination questions, printing, storing examination papers, organizing the examination; supervising the examination, marking, and rechecking examinations; selecting candidates and summoning successful candidates; resolving inquiries and complaints related to the admissions examination; collecting and using registration fees and examination fees; summarizing the admissions work; deciding on commendations and disciplinary actions according to regulations; promptly reporting the results of the admissions work to the Ministry of Education and Training and the competent authority (ministry, sector, provincial/municipal People's Committee where the school is located)."

10. Point a Clause 3 Article 10 shall be amended and supplemented as follows:

"a) Assisting the Chairman of the Admissions Board in determining the requirements for preparing examination questions and issuing examination questions; organizing the printing, packaging, storage, distribution, and use of examination papers according to the regulations of this Regulation."

11. Point d Clause 3 Article 10 shall be amended and supplemented as follows:

"d) Schools without the conditions to prepare examination questions themselves shall not invite individuals to participate in question preparation and review as individuals but must sign a contract to prepare questions with another school. The contract must clearly state the rights and responsibilities of each party. Each member participating in question preparation from both sides must comply with the provisions of Article 10 of this Regulation, and if violated, will be dealt with according to the provisions of Article 34 of this Regulation."

12. Clause 2 Article 14 shall be amended and supplemented as follows:

"2. Subject groups and subjects of schools and majors in artistic fields:
a) Group N: Literature, Music Knowledge, and Music Talent.
b) Group H: Literature, Fine Arts, and Composition.
c) Group M: Literature, Mathematics, Reading, Oral Expression, and Singing.
d) Group T: Mathematics, Biology, and Sports Talent.
đ) Group V: Mathematics, Physics, and Fine Arts Drawing.
e) Group S: Literature, and two subjects in Film Talent.
g) Group R will take the subjects: Literature, History, Journalism Aptitude.
h) Group K will take the subjects: Mathematics, Physics, Vocational Techniques.

If the school proposes different examination subjects for admission compared to those specified for each group in this regulation, it must report to the Ministry of Education and Training in accordance with Clause 4, Article 3 of this Regulation.

The time allocated for each essay subject is 180 minutes, and for each multiple-choice subject is 90 minutes; the time for performing arts and aptitude subjects shall be determined and publicly announced by the school principal 90 days before the examination period. Candidates must complete all required subjects. Those who do not sit for the required number of subjects will not be considered for admission.

13. Clause 4 of Article 14 is amended and supplemented as follows:

"4. At least seven days prior to the examination, the Examination Board must organize examination venues and prepare sufficient examination rooms. Each room may accommodate a maximum of 40 candidates according to the examination room list, and must have adequate lighting, desks, chairs, chalk, and blackboards. The distance between two adjacent candidates must be at least 1.2 meters. The location of the examination rooms must ensure safety, quietness, and separation from residential and work areas. Each examination room must have two invigilators."

14. The name of Clause 2 of Article 16 is amended and supplemented as follows:

"2. Examination paper preparation process: The compilation of examination papers for university and college admissions in the VLVH form is strictly organized according to the following procedure."

15. Delete point e of Clause 2 of Article 16.

16. The name of Clause 3 of Article 16 is amended and supplemented as follows:

"3. For examination papers of aptitude and art subjects."

17. The first bullet point of point c of Clause 3 of Article 16 is amended and supplemented as follows:

"- The Head of the Examination Paper Committee organizes the review of the examination papers in accordance with Point d of Clause 2 of this Article."

18. Point b of Clause 4 of Article 17 is amended and supplemented as follows:

"b) The schedule for distributing examination papers to each venue on each day is directed by the Head of the Examination Paper Committee according to the schedule prescribed by the Chairman of the Examination Board. A record must be made when handing over and receiving examination papers. When delivering examination papers to the venues, there must be police protection; if the venue is far away, transportation by private car must be used."

19. The second bullet point of point c of Clause 5 of Article 19 is amended and supplemented as follows:

"- The guide for packing bags, the comparison sheet of candidate registration numbers and code sheets, the marking record, and all related information storage materials such as CDs, VCDs, DVDs, memory cards, and programs are highly confidential documents kept by the Chairman of the Examination Board under strict security procedures."

20. Clause 1 of Article 20 is amended and supplemented as follows:

"1. Before the examination date, the Secretariat completes the list of candidates for each examination room, confirmed by the Examination Board, to be posted outside each examination room. Each examination room has a list accompanied by the candidates' photographs to be handed to the invigilators for verification and checking during each examination session."

21. Article 37 is amended and supplemented as follows:

"1. Forty-five days before the examination, the school reports to the Ministry of Education and Training the examination schedule, venue, telephone number, email address, and fax number for direct communication at the school and local area (if the examination is held locally).

2. Within thirty days after the end of the examination period, the school must complete all admission procedures, report the admission results and list of successful candidates to the Ministry of Education and Training and the supervising authority for verification and monitoring. By December each year, schools report on the situation of VLVH admissions for that year and the planned VLVH admissions for the next year."

Article 2. This Circular takes effect from May 24, 2011. All previous regulations contrary to this Circular are abolished.

Article 3. The officials (ladies/gentlemen), Director of the Office, Inspector General, Heads of the Higher Education Department, Director of the Testing and Quality Assurance Department; Heads of relevant units under the Ministry of Education and Training, Ministers of Ministries, Heads of agencies equivalent to ministries, heads of government agencies, Chairmen of provincial/municipal People's Committees directly under the central government, Directors of provincial education and training departments, Directors of universities and academies; Principals of universities and colleges are responsible for implementing this Decision.
