CIRCULAR

Regulations on the organization and management of national vocational skill certification

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;

Pursuant to Resolution No. 48/NQ-CP dated December 9, 2010 of the Government on simplifying administrative procedures within the scope of functions under the Ministry of Labor, War Invalids and Social Affairs' management;

The Ministry of Labor, War Invalids and Social Affairs stipulates the regulations on the organization and management of national vocational skill certification as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope and Applicability

Article 1. This Circular specifies the implementation of vocational skill assessment for workers in occupations that have national vocational skill standards established and promulgated in accordance with Decision No. 09/2008/QĐ-BLĐTBXH dated March 27, 2008 of the Minister of Labor, War Invalids and Social Affairs on principles and procedures for establishing and promulgating national vocational skill standards; management of vocational skill assessment and certification.

Article 2. This Circular applies to organizations and individuals participating in activities related to the implementation and management of vocational skill assessment and certification.

Article 3. Purpose of vocational skill assessment and certification

The implementation of vocational skill assessment and certification aims at:

Clause 1. Recognizing the vocational skills accumulated by workers through their education and work experience, encouraging workers to continuously improve their vocational skill levels, contributing to enhancing the quality of human resources and strengthening competitiveness during integration with regional and global markets.

Clause 2. Identifying deficiencies in workers' vocational skills compared to the established national vocational skill standards, thereby providing information to workers, enterprises, production, business, service establishments, and vocational training institutions to take measures to supplement missing vocational skills.

Clause 3. Serving as a basis for employers when recruiting, assigning jobs, and paying wages commensurate with the vocational skill level achieved by workers.

Article 4. Principles of implementing vocational skill assessment and certification

Clause 1. Vocational skill assessment and certification for workers who request it shall be conducted according to each occupation and each skill level specified in the national vocational skill standards of that occupation.

Clause 2. Vocational skill assessment of workers shall be carried out at Skill Assessment Centers as prescribed in this Circular.

Clause 3. Workers participating in national vocational skill assessment (hereinafter referred to as candidates) who meet the requirements at a certain skill level shall be issued a national vocational skill certificate at that skill level.

Clause 4. National vocational skill assessment and certification shall be organized as follows:

Point a. National vocational skill assessment and certification for workers participating in skill assessments at skill levels from Level 4 to Level 5 shall be held twice a year in April and October.

Point b. National vocational skill assessment and certification for workers participating in skill assessments at skill levels from Level 1 to Level 3 shall be held multiple times a year.

Chapter II

ORGANIZATIONS IMPLEMENTING VOCATIONAL SKILL ASSESSMENTS FOR WORKERS

Article 4. Skill Assessment Center

1. Vocational training institutions; educational and training institutions; scientific research, technology, and industrial institutions or enterprises shall be granted a Skill Assessment Center Certificate by the General Department of Vocational Training when they meet the following conditions:

a) Having necessary infrastructure to conduct skill assessment, including theoretical examination rooms and practical examination rooms or workshops equipped with sufficient tools, equipment, and materials that comply with the requirements set forth in the examination questions for each level of skills in each trade, allowing candidates to take theoretical and practical examinations during the national skill assessment period;

b) Having a team of experts holding skill assessor cards, at least one person for each level of skills in each trade, to organize the skill assessment of workers;

c) Having financial resources to ensure the provision and supply of necessary materials corresponding to the number of candidates participating in the national skill assessment at the Center;

d) Being able to provide candidates with services such as renting or borrowing compulsory personal protective equipment or permitted hand tools during the examination, or guiding candidates on how to answer multiple-choice questions on computers before the examination, in accordance with the requirements of each trade's examination questions;

đ) Having its own website and the ability to connect to the information management network with the department responsible for skill assessment and issuing national skill certificates at the General Department of Vocational Training.

2. The Skill Assessment Center Certificate issued by the Director of the General Department of Vocational Training shall have a validity period of five years.

3. The application dossier for the Skill Assessment Center Certificate includes:

a) A document from vocational training institutions; educational and training institutions; scientific research, technology, and industrial institutions or enterprises sent to the General Department of Vocational Training requesting to organize the skill assessment of candidates according to Model No. 1 issued together with this Circular;

b) A report on the current status of vocational training institutions; educational and training institutions; scientific research, technology, and industrial institutions or enterprises regarding the conditions ensuring the operation of skill assessment activities for workers according to Model No. 2 issued together with this Circular.

4. The procedure and formalities for issuing the Skill Assessment Center Certificate are as follows:

a) Vocational training institutions; educational and training institutions; scientific research, technology, and industrial institutions or enterprises meeting the conditions stipulated in Clause 1 of this Article shall prepare one application dossier for the Skill Assessment Center Certificate according to Clause 3 of this Article and submit it directly or send it via postal service to the General Department of Vocational Training;

b) Within fifteen working days from the date of receiving complete and valid dossiers, the General Department of Vocational Training shall organize an evaluation and issue the Skill Assessment Center Certificate according to Model No. 3 issued together with this Circular; in cases where the Skill Assessment Center Certificate is not issued, the General Department of Vocational Training must provide a written response stating the reasons;

c) Within five working days from the date of issuing the Skill Assessment Center Certificate, the General Department of Vocational Training shall send one copy of the Skill Assessment Center Certificate to the Department of Labor, Invalids, and Social Affairs of the locality where the main office of the vocational training institution; educational and training institution; scientific research, technology, and industrial institution or enterprise is located to coordinate with the General Department of Vocational Training in managing the activities of the Skill Assessment Center in the locality.

5. The Skill Assessment Center shall be responsible for:

a) Developing plans to organize national skill assessment periods for each trade and each level of skills at the Center and submitting them to the General Department of Vocational Training;

b) Publicly announcing at the main office of the Center and through mass media about the trades being organized for the skill assessment of workers according to each level of skills and the locations where the skill assessment will be conducted;

c) Organizing the acceptance of registration dossiers for candidates participating in the national skill assessment period according to point c, Clause 1, Article 8 of this Circular;

d) Preparing all necessary materials according to the examination requirements corresponding to the number of candidates participating in each national skill assessment period at the Center;

đ) Cooperating and creating conditions for the Skill Assessment Board (hereinafter referred to as the Board) to conduct the skill assessment of candidates according to the schedule;

e) Ensuring safety during the national skill assessment period; coordinating with the Board and related organizations in handling incidents occurring during the national skill assessment period;

g) Publicly announcing the fee for participating in the national skill assessment period and the prices of related services;

h) Providing services supporting the skill assessment activities;

i) Organizing the awarding of national skill certificates to candidates who meet the requirements at the Center according to Clause 3, Article 11 of this Circular;

k) Summarizing and reporting periodically and annually on the number of candidates registering for skill assessment and the number of candidates at the Center who meet the requirements and are awarded national skill certificates according to each trade and each level of skills;

l) Retaining the registration dossiers of workers participating in skill assessment, the assessment results of candidates by the Board, and the list of candidates who have met the requirements and received national skill certificates at the Center according to regulations.

Article 5. Examination Board assesses vocational skills

1. The Examination Board is the entity directly responsible for assessing the vocational skills of workers participating in the national vocational skill assessment at one or several levels of skill proficiency depending on the requirements and actual conditions of each trade. For each trade being assessed, there is an Examination Board at a Vocational Skill Assessment Center issuing a national vocational skill certificate. The Examination Board is established by the General Department of Vocational Training. The Examination Board will dissolve itself after completing the national vocational skill assessment period at that Vocational Skill Assessment Center.

2. The number of members of the Examination Board depends on the number of candidates and the nature and characteristics of the trade being assessed, but must ensure a minimum of three members. Members of the Examination Board are those who have been issued a vocational skill assessor card by the General Department of Vocational Training.

3. The composition of the Examination Board includes: Chairperson, Secretary, and other members. The Chairperson and at least half (one-half) of the members of the Examination Board are individuals not under the management of that Vocational Skill Assessment Center.

4. The Examination Board has the following responsibilities:

a) Inspect the conditions serving the implementation of the national vocational skill assessment period at the Vocational Skill Assessment Center, such as: theoretical examination rooms; workshops or practical examination rooms; equipment, devices, tools, utensils; security and safety plans for the national vocational skill assessment period at the Vocational Skill Assessment Center;

b) Coordinate with the Vocational Skill Assessment Center to inspect materials and supplies according to point d, Clause 5, Article 4 of this Circular;

c) Carry out preparatory work for the national vocational skill assessment period in accordance with Clause 2, Article 9 of this Circular;

d) Implement and comply with examination supervision regulations such as: regularly being present in the examination room to monitor candidates while they are taking the test to detect and take timely measures to prevent actions that may cause damage to equipment, devices, tools, utensils or loss of safety during the test; check and remind candidates to follow and implement all regulations during theoretical and practical examinations which they must adhere to; prepare records for handling or propose handling of candidates who violate regulations during the examination according to point a and point b, Clause 2, Article 12 of this Circular; not assist candidates in completing their tests in any form; not engage in personal matters and not use mobile phones or other communication devices; not smoke or consume alcoholic beverages or stimulants.

e) Carry out marking work according to Clause 3, Article 10 of this Circular;

f) Publicly announce the results of the national vocational skill assessment period at the Vocational Skill Assessment Center to candidates;

g) Collect and submit relevant documents and records for handling cases of violations of regulations during theoretical and practical examinations (if any) to the General Department of Vocational Training before the end of the national vocational skill assessment period at the Vocational Skill Assessment Center;

h) When performing tasks, members of the Examination Board must wear an examiner badge and directly bear responsibility for the performance of the assigned tasks according to the division of labor by the Chairperson. The Chairperson is responsible for the overall results of the national vocational skill assessment period at the Vocational Skill Assessment Center.

Article 6. Supervision of the Skill Assessment of Workers

1. Organizations shall supervise the national skill assessment period at the Skill Assessment Centers:

a) The General Department of Vocational Training shall establish Monitoring Teams to conduct regular or spot supervision of the national skill assessment period at the Skill Assessment Centers;

b) Each Monitoring Team shall consist of at least three members, including a team leader;

c) Members of the Monitoring Team must have good moral character, honesty, and objectivity; they must have knowledge and practical experience in the profession related to worker skill assessment introduced by the Ministry, ministry-level agency, agency under the Government (hereinafter referred to collectively as the Ministry), professional association, Department of Labor - Invalids and Social Affairs, and enterprises.

2. Duties and powers of the Monitoring Team:

a) To supervise the organization and implementation of the national skill assessment period at the Skill Assessment Center to ensure that the skill assessment of workers is conducted correctly, objectively, and fairly;

b) When detecting violations within the responsibility scope of the Examination Board or the Skill Assessment Center, the Monitoring Team shall report in writing to the General Department of Vocational Training for consideration and handling according to regulations;

c) At the end of the national skill assessment period at the Skill Assessment Center, the Monitoring Team shall report in writing the supervision results to the General Department of Vocational Training;

d) Members of the Monitoring Team must carry identification cards and work independently without interfering with tasks performed by the Examination Board.

Chapter III

PROCEDURES AND PROCESS FOR SKILL ASSESSMENT AND ISSUANCE OF NATIONAL SKILL CERTIFICATES

Article 7. Conditions for Registration to Participate in Skill Assessment According to Skill Levels

Workers in all economic sectors have the right to register to participate in the national skill assessment period. Depending on each skill level, when registering to participate in the national skill assessment period, workers need to meet specific conditions as follows:

1. For those who register to participate in the national skill assessment period at Level 1 skill, they must satisfy at least one of the following conditions:

a) They have completed the basic vocational training program;

b) They have worked in their profession for at least one year.

2. For those who register to participate in the national skill assessment period at Level 2 skill, they must satisfy at least one of the following conditions:

a) They have completed the intermediate vocational training program or the intermediate specialized program corresponding to the profession they are registering to assess skills;

b) They hold a National Skill Certificate Level 1 or at least one of the following certificates: basic vocational certificate, trade certificate (hereinafter collectively referred to as basic certificate) and have worked in their profession for at least two years since obtaining the National Skill Certificate Level 1 or the basic certificate;

c) They have worked in their profession for at least four years.

3. For those who register to participate in the national skill assessment period at Level 3 skill, they must satisfy at least one of the following conditions:

a) They have completed the college vocational training program or the college program corresponding to the profession they are registering to assess skills;

b) They hold a National Skill Certificate Level 2 or at least one of the following diplomas: intermediate vocational diploma, intermediate specialized diploma, intermediate professional diploma, trade diploma, technical worker graduation diploma (hereinafter collectively referred to as intermediate diploma) and have worked in their profession for at least two years since obtaining the National Skill Certificate Level 2 or the intermediate diploma;

c) They hold a National Skill Certificate Level 1 or a basic certificate and have worked in their profession for at least six years since obtaining the National Skill Certificate Level 1 or the basic certificate;

d) They have worked in the profession they are registering to assess skills for at least eight years.

4. For those who register to participate in the national skill assessment period at Level 4 skill, they must satisfy at least one of the following conditions:

a) They hold a National Skill Certificate Level 3 or a college vocational diploma or a college diploma (hereinafter collectively referred to as college diploma) and have worked in their profession for at least two years since obtaining the National Skill Certificate Level 3 or the college diploma;

b) They hold a National Skill Certificate Level 2 or an intermediate diploma and have worked in their profession for at least six years since obtaining the National Skill Certificate Level 2 or the intermediate diploma;

c) They hold a National Skill Certificate Level 1 or a basic certificate and have worked in their profession for at least eight years since obtaining the National Skill Certificate Level 1 or the basic certificate;

d) They have worked in their profession for at least eleven years.

5. For those who register to participate in the national skill assessment period at Level 5 skill, they must satisfy at least one of the following conditions:

a) They hold a National Skill Certificate Level 4 and have worked in their profession for at least two years since obtaining the National Skill Certificate Level 4;

b) They hold a National Skill Certificate Level 3 or a college diploma and have worked in their profession for at least five years since obtaining the National Skill Certificate Level 3 or the college diploma;

c) They hold a National Skill Certificate Level 2 or an intermediate diploma and have worked in their profession for at least eight years since obtaining the National Skill Certificate Level 2 or the intermediate diploma;

d) They hold a National Skill Certificate Level 1 or a basic certificate and have worked in their profession for at least eleven years since obtaining the National Skill Certificate Level 1 or the basic certificate;

đ) They have worked in their profession for at least fourteen years.

Article 8. Procedures and Documents for Registering to Participate in the National Occupational Skill Assessment Period

1. The procedure for workers to register to participate in the national occupational skill assessment period shall be carried out as follows:

a) Workers who wish to participate in the national occupational skill assessment period shall obtain the application form for participating in the national occupational skill assessment period according to Form No. 4 issued together with this Circular from the Skill Assessment Center or download the form from the national occupational skill assessment information website of the Vocational Training General Department and the Skill Assessment Center, print it out, complete one set of documents in accordance with Clause 2 of this Article, and directly submit or send via postal service to the Skill Assessment Center;

b) Employers have the right to register workers currently employed at their unit to participate in the national occupational skill assessment if the worker meets the requirements of a certain level of occupational skill, they will be granted a national occupational skill certificate at that level;

c) The Skill Assessment Center shall organize the receipt of applications for participation in the national occupational skill assessment period from workers; check the validity of the application forms for participation in the national occupational skill assessment period of workers based on the provisions of Article 7 of this Circular.

2. The documents for registering to participate in the national occupational skill assessment period of workers include:

a) An application form for participating in the national occupational skill assessment period of workers with a photograph attached and all required information filled in; accompanied by one (01) photograph submitted to the Skill Assessment Center to make a test card;

b) One (01) copy of one of the types of documents to prove the conditions stipulated in Article 7 of this Circular.

Article 9. Preparation Work for the National Occupational Skill Assessment Period

The preparation work for the national occupational skill assessment period shall be carried out as follows:

1. For the Skill Assessment Center:

a) Schedule the occupational skill assessment of workers at the Skill Assessment Center and send the attendance notice for the occupational skill assessment through postal service or deliver directly to the examinee at least twenty (20) days before the organization of the national occupational skill assessment period. The attendance notice for the occupational skill assessment must clearly state the requirements that the examinee needs to prepare before taking the theoretical and practical exams;

b) Prepare sufficient materials necessary to serve the national occupational skill assessment period at the Center in accordance with Point d, Clause 5, Article 4 of this Circular;

c) Make and distribute test cards to the examinees;

d) Collect examination fees from the examinees in accordance with regulations.

2. For the Examination Board:

a) Carry out procedures to verify and supplement or adjust any errors regarding personal information of the examinees;

b) Verify and prohibit examinees from bringing or using alcoholic beverages and stimulants, mobile phones, and other communication devices during the exam;

c) Guide examinees to the examination room and inform them of the rules they must follow during the theoretical and practical exams.

3. For the examinees:

a) Be present at the Skill Assessment Center at the time specified in the attendance notice for the occupational skill assessment to complete the registration procedures, bring the original of one of the types of documents proving compliance with the provisions of Point b, Clause 2, Article 8 of this Circular for verification and payment of the examination fee;

b) Present the test card to the Examination Board at the Skill Assessment Center and request supplementation or adjustment of any errors in personal information if there are any;

c) Receive the examination room and listen to the Examination Board's announcement of the rules to be followed during the theoretical and practical exams.

Article 10. Implementation of occupational skill assessment for workers

The occupational skill assessment for workers shall be carried out as follows:

1. For cases participating in occupational skill assessment at levels from level 1 to level 3, theoretical exams shall be conducted in the form of computer-based multiple-choice tests. For cases participating in occupational skill assessment at levels 4 and 5, theoretical exams shall be conducted in the form of written tests on paper.

2. Practical exams shall be conducted after candidates pass the theoretical exam requirements. The methods and procedures for practical exams are specified in the examination outline.

3. Grading of theoretical exams conducted in the form of computer-based multiple-choice tests shall be automatically performed on computers. Grading of theoretical exams conducted in the form of written tests on paper and practical exams shall be conducted by the Examination Board according to the procedures and guidelines of the Vocational Training General Department.

Article 11. Recognition of Assessment Results and Issuance of National Occupational Skill Certificates

1. Immediately after completing the grading work as stipulated in Clause 3 of Article 10 of this Circular, the Examination Board shall submit the examination grading minutes and summary of examination results to the Vocational Training General Department for recognition and issuance of national occupational skill certificates to those candidates who meet the requirements.

2. Within the latest five working days from the date of receipt of the examination grading minutes and summary of examination results from the Examination Board, the Director of the Vocational Training General Department shall decide to recognize and issue national occupational skill certificates to those candidates who meet the requirements according to Model No. 5 issued together with this Circular.

3. The Skill Assessment Center shall present the national occupational skill certificates to those candidates who meet the requirements within the latest five working days from the date of receipt of the national occupational skill certificates issued by the Director of the Vocational Training General Department.

Article 12. Complaints, Reports, and Handling of Violations

1. Complaints and Reports:

a) Organizations and individuals participating in activities related to the implementation and management of national occupational skill certification have the right to complain about unlawful acts or decisions of individuals, agencies, or organizations with authority regarding the assessment and issuance of national occupational skill certificates.

b) Candidates have the right to report violations of laws concerning the assessment and issuance of national occupational skill certificates and bear legal responsibility for the content of their reports.

c) Complaints and reports and the resolution of complaints and reports shall be carried out in accordance with the provisions of the law on complaints and reports.

2. Handling Violations:

a) Candidates who violate regulations during theoretical or practical exams shall be warned or have their examination rights revoked or their examination results annulled depending on the nature and degree of violation by the Examination Board.

b) Candidates who cause damage to machinery, equipment, tools, or accidents due to violations of procedures during theoretical or practical exams or violations of safety regulations during exams shall, in addition to being handled according to point a of this clause, also be required to compensate for damages caused according to the extent of the damage.

c) Individuals participating in activities related to the implementation and management of national occupational skill certification who violate the provisions of this Circular shall be subject to disciplinary action, administrative penalties, or criminal prosecution depending on the nature and degree of violation; if causing damage, they must compensate according to the law.

d) Organizations participating in activities related to the implementation and management of national occupational skill certification who violate the provisions of this Circular shall be subject to administrative penalties depending on the nature and degree of violation; if causing damage, they must compensate according to the law.

Chapter IV

RESPONSIBILITIES OF AUTHORITIES AND ORGANIZATIONS RELATED TO THE IMPLEMENTATION AND MANAGEMENT

OF SKILL ASSESSMENT AND ISSUANCE OF NATIONAL OCCUPATIONAL SKILL CERTIFICATES

Article 13. Responsibilities of the Vocational Training General Department

1. Establishing the process for creating examination questions, using and managing skill assessment examination papers for workers; establishing training programs for skill assessors; establishing the process for organizing examinations, grading, and guiding the consistent implementation of examination grading tasks according to the process for practical and written theoretical examinations on paper; establishing and guiding the application of a system of forms and record books serving the organization and management of skill assessment and issuance of national vocational skill certificates.

2. Organizing the compilation of theoretical questions and practical examination papers for each trade at each level of skill proficiency; establishing and managing a bank of examination questions, answers, and evaluation criteria; ensuring the security and transferring skill assessment examination papers for each trade to Skill Assessment Centers for worker skill assessments.

3. Annually, developing plans and guiding and directing the organization of skill assessment periods for workers; publishing on mass media the list and addresses of Skill Assessment Centers and trades organized for worker skill assessments at each level of skill proficiency.

4. Establishing criteria, standards, and guidelines for implementing conditions as stipulated in Clause 1, Article 4 of this Circular.

5. Organizing the printing, issuance, and management of the issuance of national vocational skill certificates.

6. Organizing research and application of information technology in the management of skill assessment and certification activities; establishing an information network system connecting with Skill Assessment Centers nationwide.

7. Organizing training and issuing National Skill Assessor Cards according to Model No. 6 issued together with this Circular; implementing mobilization and management of a team of experts who have been issued Skill Assessor Cards to participate in Examination Boards.

8. Specifying report models and managing, storing documentation related to the implementation and management of skill assessment and certification activities.

9. Performing other tasks as prescribed in this Circular.

Article 14. Responsibilities of Ministries and Departments of Labor, Invalids, and Social Affairs

1. Responsibilities of Ministries in implementing and managing skill assessment and certification activities:

a) Cooperating with the Vocational Training General Department to review conditions as stipulated in Clause 1, Article 4 of this Circular to issue Certificates of Skill Assessment Centers to vocational training institutions; educational and training institutions; scientific, technical, and technological research institutions under their management authority.

b) Appointing persons meeting the required conditions to join the Monitoring Team upon the request of the Vocational Training General Department.

c) Recommending or appointing persons with high levels of vocational skill proficiency or experienced specialists or engineers in the relevant trades to participate in skill assessor training courses and Examination Boards upon the request of the Vocational Training General Department.

2. Responsibilities of Departments of Labor, Invalids, and Social Affairs in implementing and managing skill assessment and certification activities:

a) Cooperating with the Vocational Training General Department to review conditions as stipulated in Clause 1, Article 4 of this Circular to issue Certificates of Skill Assessment Centers to vocational training institutions; educational and training institutions; scientific, technical, and technological research institutions under local management or enterprises within their jurisdiction.

b) Appointing persons meeting the required conditions to join the Monitoring Team upon the request of the Vocational Training General Department.

Article 15. Responsibilities of Trade Associations and Enterprises

1. Nominate individuals meeting the required qualifications to participate in the Supervision Team upon the request of the General Department of Vocational Training.

2. Recommend or nominate individuals with high levels of vocational skills or experienced professionals and engineers to conduct vocational skill assessments of workers participating in vocational assessor training courses and join Assessment Boards upon the request of the General Department of Vocational Training.

Chapter V

REPORTING AND RECORD KEEPING REGIME

Article 16. Reporting System

1. Within no more than twenty days from the end of the national vocational skill assessment period, the Skill Assessment Centers report the results of the national vocational skill assessment period to the General Department of Vocational Training.

2. Annually, at the beginning of December, the General Department of Vocational Training compiles and publishes the results of the national vocational skill assessment and certification for workers nationwide.

Article 17. Record Keeping

All documents related to the national vocational skill assessment period and the issuance of national vocational skill certificates to qualified candidates shall be preserved, stored, and destroyed according to the regulations on record keeping. Specifically, documents regarding the assessment results of candidates, confirmation lists of qualified candidates, and lists of qualified candidates who have received national vocational skill certificates at Skill Assessment Centers shall be stored according to the regulations.

Chapter VI

IMPLEMENTATION

Article 18. Effective Date

This Circular takes effect forty-five days from the date of issuance. The Decision No. 69/2008/QD-BLDTBXH dated December 30, 2008 issued by the Minister of Labor, Invalids, and Social Affairs on the organization and management of national vocational skill assessment and certification is hereby repealed.

Article 19. Implementation Provisions

1. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Leaders of central-level organizations of political and social organizations, Chairpersons of People's Committees of provinces and centrally-administered cities, Directors of Labor, Invalids, and Social Affairs Departments of provinces and centrally-administered cities, Chiefs of the Ministry's Office, General Directors of the General Department of Vocational Training, Heads of agencies, organizations, and individuals involved are responsible for implementing this Circular.

2. The General Department of Vocational Training is responsible for organizing, directing, urging, and supervising the implementation of this Circular.

3. In case of difficulties during implementation, agencies, organizations, and individuals are requested to promptly reflect such issues to the Ministry of Labor, Invalids, and Social Affairs for research, supplementation, and amendment./.
