On credit for near-poor households
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Credit Organizations dated June 16, 2010;
Pursuant to Decree No. 78/2002/NĐ-CP dated October 4, 2002 of the Government on credit for the poor and other policy beneficiaries;
At the proposal of the Governor of the State Bank of Vietnam;
The Prime Minister issues this Decision on credit for near-poor households.
1. The Vietnam Bank for Social Policies shall provide loans to near-poor households to meet capital needs for production and business activities, thereby contributing to social welfare policies and sustainable poverty reduction.
2. The criteria for near-poor households shall be stipulated by the Prime Minister during each period.
Article 2. Loan Amount
The loan amount for near-poor households shall be agreed upon between the Vietnam Bank for Social Policies and the near-poor households but shall not exceed the maximum loan amount for production and business activities applicable to poor households during each period.
Article 3. Interest Rate on Loans
1. The interest rate on loans for near-poor households shall be 130% of the interest rate on loans for poor households as stipulated during each period.

The loan term shall be agreed upon between the Vietnam Bank for Social Policies and the near-poor households borrowing funds, in accordance with the production and business cycle and the borrower's debt repayment capacity.
Article 5. Conditions, Documents, and Procedures for Loans
1. The conditions, documents, procedures, and loan process for near-poor households shall be implemented similarly to those for poor households.
2. Risk management for near-poor household debts shall be carried out according to the risk management mechanism for bad debts of the Vietnam Bank for Social Policies.
Article 6. Responsibilities of Relevant Units
1. Social Policy Bank:
a) To develop annual funding plans for policy credit programs, including loans for near-poor households, and submit them to the competent authority for approval.
b) To report monthly to the State Bank of Vietnam and the Ministry of Finance on the implementation results of the loan policy for near-poor households by the 15th day of each month.
2. The State Bank of Vietnam:
a) To direct the Vietnam Bank for Social Policies to implement loans in accordance with this Decision.
b) To take the lead and coordinate with the Ministry of Finance in inspecting, supervising, and proposing solutions to issues arising during the implementation process.
3. Ministry of Finance:
a) To take the lead and coordinate with relevant ministries and agencies to submit to the Prime Minister the central government budget allocation for the Vietnam Bank for Social Policies to implement policy credit programs, including loans for near-poor households as prescribed.
b) To coordinate with the State Bank of Vietnam in inspecting, supervising, and proposing solutions to issues arising during the implementation process.
4. The Ministry of Labor - Invalids and Social Affairs:
a) To announce the number of poor and near-poor households as the basis for implementing social welfare policies.
b) To stipulate the survey and review period for poor and near-poor households appropriately to facilitate their access to policy credit funds.
5. Relevant ministries and sectors shall cooperate in implementing this Decision based on their assigned functions and tasks.
6. People's Committees of provinces and centrally-administered cities shall direct competent agencies, People's Committees at all levels, and local political-social organizations to cooperate with the Vietnam Bank for Social Policies in implementing this Decision.
Article 7. Implementation Provisions
1. This Decision shall take effect from April 16, 2013.
2. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-administered cities, Chairmen of the Board of Directors, and General Directors of the Vietnam Bank for Social Policies are responsible for enforcing this Decision./.
