This Regulation stipulates the organization and operation of Art Councils in the field of Performing Arts throughout the country.

Article 1. Scope of Regulation and Applicability

1. The composition of the Art Council includes managers and professionals with credibility and capability in various specialties within the field of Performing Arts.

2. The structure of the Art Council consists of: Chairperson, Deputy Chairpersons, and Members.

Article 3. Authority to Establish, Number of Members, and Term of Operation of the Art Council

1. The Art Council is established by the head of the agency or unit with authority, including:

a) The National Art Council is established by the Minister of Culture, Sports and Tourism, with a minimum of nine members;

b) The provincial and centrally-administered city Art Councils are established by the Chairman of the People's Committee of the province or centrally-administered city, with a minimum of nine members;

c) The Art Council of the Department of Performing Arts is established by the Director of the Department of Performing Arts, with a minimum of seven members;

d) The Art Council of the Department of Culture, Sports and Tourism is established by the Director of the Department, with a minimum of seven members;

e) The Art Council of central and local specialized literary and artistic associations is established by the Board of Directors of the association and approved by the President of the association, with a minimum of seven members;

f) The Art Council of central and local artistic units and artistic units under the armed forces is established by the head of the unit, with a minimum of five members.

2. The Secretariat is established by the head of the agency or unit, with a minimum of two members.

3. The term of operation of the Art Council is three years.

e) The Art Council of central artistic units, local artistic units, and artistic units under armed forces units shall be established by the head of the unit and shall have at least five members.

Article 4. Functions of the Art Council

1. The Art Council performs the function of advising and consulting on ideology, content, form, and artistic quality for the leadership of agencies and units regarding the staging, publication, and dissemination of artistic works, programs, fashion shows, beauty and model contests, circulation, and business of audio and video recordings of music and dance, theater; proposing solutions for management, creative guidance, and improvement of artistic quality, ideological content, and forms of artistic works and programs within the performing arts field.

2. Specific functions of each Art Council:

a) The State-level Art Council advises and consults on ideology, content, form, and artistic quality of programs, scripts, and works of organizations, entities, and individuals within the performing arts field at the national level.

b) The provincial and centrally-administered city-level Art Council advises and consults on ideology, content, form, and artistic quality of programs, scripts, and works of organizations, entities, and individuals within the performing arts field at the provincial and centrally-administered city levels.

c) The Art Council of the Performing Arts Department advises and consults on ideology, content, form, and artistic quality of programs, scripts, and works of organizations, entities, and individuals within the performing arts field within its authority or as authorized by the Ministry of Culture, Sports and Tourism.

d) The Art Council of the Department of Culture, Sports and Tourism advises and consults on ideology, content, form, and artistic quality of programs, scripts, and works of organizations, entities, and individuals within the performing arts field within the province or centrally-administered city under its authority or as authorized by the provincial People's Committee.

e) The Art Councils of central and local specialized literary and artistic associations advise and consult on ideology, content, form, and artistic quality of scripts and works of organizations and individuals affiliated with the association; annual awards and creative competitions organized by the association.

f) The Art Councils of central and local artistic units and artistic units under armed forces advise and consult on ideology, content, form, and artistic quality of programs, scripts, and works of organizations and individuals within their management scope.

Article 5. Task of A|||rt Council

1. Reviewing and evaluating ideology, content, form, and artistic quality of artistic works and programs using state budget funds when requested by the head of the competent agency as prescribed by law.

2. Reviewing and evaluating ideology, content, form, and artistic quality of programs, scripts, and works of organizations, entities, and individuals before staging, disseminating, publishing, and organizing performances when requested by the head of the competent authority as stipulated in Decree No. 79/2012/ND-CP on artistic performance, fashion shows; beauty and model contests; circulation and business of audio and video recordings of music and dance, theater.

3. Advising and proposing forms of commendation for organizations, entities, and individuals participating in performance activities and organizing performances of programs and works within the performing arts field.

4. Evaluating the degree of violation and proposing forms of handling violations for organizations, entities, and individuals participating in performance activities and organizing performances of programs and works within the performing arts field.

5. Performing other tasks as required by the agency deciding to establish the council.

Article 6. Principles of Work of the Art Council

1. The Art Council operates under the principle of democratic centralism and makes decisions by majority rule.

2. Members of the Art Council must fulfill their assigned tasks and powers; they are responsible for their contributions and evaluations regarding the ideological, content, artistic quality, and form of the works being reviewed to ensure coordination among members to complete their tasks. A review session of the Art Council must have at least two-thirds of the total number of members present.

3. Members of the Art Council shall not review or evaluate programs, scripts, or artistic works in which they are creators or have rights and interests involved.

4. The Art Council compiles the results of reviews and evaluations and prepares the Review Minutes (according to the model attached to this Regulation).

In necessary cases, the Art Council may refer to and adopt written opinions from organizations and individuals related to the matter; opinions from mass media and submit them to the competent authority for consideration and decision.

5. The content and results of the Art Council's review are announced and the responsibility lies with the Chairman or Vice-Chairman authorized by the Chairman of the Art Council; members are not permitted to disclose any information related to the discussion content, review results, and conclusions of the Council.

6. If a member of the Art Council is absent for more than three consecutive working sessions without a valid reason, the person authorized to establish the Council pursuant to Clause 1, Article 3 of this Regulation will decide to remove and replace that member.

7. In certain special cases, the Chairman of the Art Council may decide not to convene a review meeting but instead collect written reviews and evaluations from members.

Members of the Art Council are responsible for reviewing, evaluating, and providing written comments on programs, scripts, and works of units, organizations, and individuals when requested by the Chairman of the Art Council and send them to the Secretariat for consolidation.

8. The Art Council meets periodically to review the process of reviewing and evaluating artistic quality, and to provide guidance on the development direction in the field of performing arts as required by the Chairman and report the results of activities to the competent authority that decided to establish the Council.

Article 7. Powers and Responsibilities of Art Council Members

1. Powers:

a) To evaluate, comment, and retain personal opinions during the review process;

b) To participate in all activities of the Council;

c) To receive remuneration according to current regulations.

2. Responsibilities:

a) The Chairman of the Council has the responsibility:

- To chair meetings of the Art Council;

- To recommend the competent authority to remove and supplement members of the Art Council;

- To invite additional experts to participate in Council meetings to seek advice when necessary.

b) The Vice-Chairman of the Art Council fulfills the responsibilities of the Chairman when delegated by the Chairman and has the responsibility:

- To carry out tasks assigned by the Chairman;

- To assist the Chairman in supervising and inspecting the implementation of Council activities;

- To assist the Chairman in directing the Secretariat to compile, draft plans and programs of activities of the Council for the competent authority to consider and approve;

- To assist the Chairman in conducting research, advising, and compiling suggestions from members during the review process to report to the Chairman for submission to the competent authority for consideration and decision.

c) Members of the Council have the responsibility:

- To fully participate in all Council sessions except in cases stipulated in Clause 7, Article 6 of this Regulation; in case of absence, they must report to the Chairman (or Vice-Chairman) of the Council;

- Other responsibilities according to the principles of work of the Council as stipulated in Article 6 of this Regulation.

d) The Secretariat has the responsibility:

- To prepare all relevant materials for the content of meetings; to record minutes accurately and report the results of reviews to the Chairman of the Council (or Vice-Chairman when authorized by the Chairman);

- To closely cooperate with Art Council members in activities, providing necessary and relevant information to members;

- To assist the Art Council in identifying violations during the review and evaluation process regarding the ideological, form, and artistic quality of works and programs of organizations and individuals participating in performing arts activities;

- To strictly maintain confidentiality about the results of the Art Council's reviews;

- To report periodic, annual, or ad hoc work as required by the Chairman of the Art Council.

Article 8. Budget

1. The budget for the operations of the Art Council shall be allocated annually by the authority that established it.

2. The authority that established the Art Council shall base its payment of remuneration to members of the Council on the actual conditions of the unit, specific activities of the Council, and state regulations on finance.

Article 9. Implementation Organization

The Department of Performing Arts, subordinate agencies and units under the Ministry of Culture, Sports and Tourism, Departments of Culture, Sports and Tourism of provinces and centrally-administered cities, specialized literary and artistic associations within the field of Performing Arts, professional artistic units, and related organizations and individuals shall be responsible for implementing this Regulation; ensuring operational conditions for the Art Council and the Secretariat as prescribed.

During the implementation process, if there are any difficulties, organizations and individuals concerned shall promptly report them to the Ministry of Culture, Sports and Tourism (through the Department of Performing Arts) for review, amendment, and supplementation./.
