AMENDING AND COMPLEMENTING CERTAIN ARTICLES OF THE REGULATIONS ON REVIEW AND ISSUE OF FILM DISTRIBUTION LICENSES ISSUED TOGETHER WITH DECISION NO. 49/2008/QĐ-BVHTTDL DATED SEPTEMBER 9, 2008 OF THE MINISTER OF CULTURE, SPORTS AND TOURISM
Pursuant to the Cinema Law No. 62/2006/QH11 dated June 29, 2006, the Law Amending Certain Articles of the Cinema Law No. sửa đổi một số Article of the Cinema Law number 31/2009/QH12 dated June 18 ARTICLE 4. Finished traditional medicine is a form of traditional medicine that has undergone production processes, including packaging and labeling, using traditional or modern methods, belonging to one of the following forms: pills, liquids, tea, powder, extract, and other forms.
Pursuant to Decree No. 54/2010/NĐ-CP dated May 21, 2010 of the Government detailing certain provisions of the Cinema Law No. 62/2006/QH11 and the Law Amending Certain Articles of the Cinema Law No. 31/2009/QH12;
Decree No. 76/2013/NĐ-CP dated July 16m 2013 of the Government stipulating functions, tasks, and powers termination of validity or expiration of the contract term;1. APPLICATION FOR REVIEW OF LITERARY SCREENPLAYS FOR FILMS USING STATE BUDGET FUNDS (FORM NO. 01).2. DECISION PERMITTING THE PRODUCTION OF FILMS USING STATE BUDGET FUNDS (FORM NO. 02).
At the proposal of the Director of the National Cinema Office,
The Minister of Culture, Sports and Tourism promulgates this Circular amending, bổ sung một số articles of the Regulations on review and issue of film distribution licenses issued together with Decision No. 49/2008/QĐ-BVHTTDL dated July 9, 2008 of the Minister of Culture, Sports and Tourism.Article 1. Amend and supplement Point c Clause 1 Article 10 of the Regulations on review and issue of film distribution licenses as follows:
"c) Permitting the distribution of films with conditions prohibiting distribution to audiences under the age of 13 years (C13), under 16 years (C16), or under 18 years (C18) if the film contains content unsuitable for psychological, physiological development or affecting the formation of personality at each age group. Film classification for distribution according to age groups shall be based on the criteria set forth in the Appendix attached hereto."
This Circular takes effect from March 15, 2016.
Article 2. The Head of the Ministry's Office, the Director of the National Cinema Office, Heads of agencies and units directly under the Ministry, Directors of Provincial Departments of Culture, Sports and Tourism, and relevant organizations and individuals are responsible for implementing this Circular./.

In the Classification Criteria Table, the following terms are understood as follows:
"Occurring frequently"
1. refers to similar images, language, and sounds appearing multiple times in a film. Sexual activity"
2. “refers to actions, sounds, words, gestures that arouse or stimulate sexual desire in a film aimed at satisfying sexual needs. Detailed description"
3. “refers to the level of using clear, direct, detailed images and sounds at close range to describe people, scenes, and actions in a film. "Coarse language, sound, and image"
4. refers to dialogue, writing, sounds, and images used in a film that express vulgarity, disgust, and lack of culture. "Extended duration"

C13 Films prohibited from being distributed to audiences under the age of 13. - The theme of the film is not suitable for audiences under the age of 13; - The content of the film reflects issues that distort the perception and emotions of audiences under the age of 13, causing psychological disturbance or leading to fear, pessimism, and depression. |

Does not accept images, sounds, and language depicting violent actions causing pain and injury described in detail, tense, and extended duration, except when such images, sounds, and language are depicted at a moderate level and are appropriate to the film's content. Does not accept images, sounds, and language depicting sexual activities. d) Drugs, stimulants, addictive substances Does not accept images, sounds, and language depicting horror scenes causing fear described in detail, occurring frequently, and having extended duration. - For the depiction of smoking in films, it shall comply with the provisions of Circular No. 02/2014/TT-BVHTTDL dated May 14, 2014 of the Ministry of Culture, Sports and Tourism on Limiting Smoking in Stage Performances and Cinematic Works. e) Coarse language, sound, and image C16Films prohibited from being distributed to audiences under the age of 16.- The theme of the film is not suitable for audiences under the age of 16;drug addiction The depiction of images, sounds, and language showing the use of drugs and stimulants that cause addiction shall not be accepted, except when such depictions aim to denounce and oppose these behaviors without detailing them, occurring frequently, or having prolonged duration. Does not accept the use of coarse language, sound, and image. C13 The depiction of detailed, frequent, and prolonged scenes of horror causing fear shall not be accepted. e) Coarse images, sounds, and language t 7specialized agency under the People's Committee of the province/city. - The content of the film reflects issues that distort the perception and emotions of audiences under the age of 13, causing psychological disturbance or leading to fear, pessimism, and depression. |

Does not accept images, sounds, and language depicting threatening or intimidating others, except when such images, sounds, and language are depicted at a light level and are appropriate to the film's content. - The film's theme is not suitable for audiences under the age of 16; The film's content reflects deeper issues of adults such as political, social, psychological, and criminal problems but is not suitable for the perception, psychology, and physiology of viewers under 16 years old. Does not accept images of nudity, except for images of male upper body nudity, female rear upper body nudity unrelated to sex, without offensive tattoos. Do not accept images, sounds, or language depicting violent actions like killing, causing pain, injury, bleeding that occur frequently and have a prolonged duration, except when such images, sounds, or language are appropriate to the film's content and at a moderate level of tension. Does not accept images, sounds, and language depicting sexual activities. d) Drugs, stimulants, addictive substances Do not accept detailed depictions of nude scenes that occur frequently and have a prolonged duration, except in the following cases: rear nudity of males and frontal upper nudity of females unrelated to sexual activities, without offensive tattoos. - Sexuality Do not accept images, sounds, or language depicting sexual activities, except when such images, sounds, or language are appropriate to the film's content but are not detailed, do not occur frequently, and do not have a prolonged duration. Does not accept images, sounds, and language depicting horror scenes, except when such images, sounds, and language are depicted at a light level and do not affect the psychology or health of children. Do not accept images, sounds, or language depicting drug trafficking, storage, and use, and other addictive substances, except when such images, sounds, or language are appropriate to the film's content with the purpose of opposing and condemning such behaviors but are not detailed, do not occur frequently, and do not have a prolonged duration. Does not accept the use of coarse language, sound, and image. C13 Do not accept detailed, frequent, and prolonged depictions of frightening, horrific, terrifying, and stressful scenes, except when such images, sounds, and language are necessary for the film's content and are appropriate for the age group. e) Vulgar Language, Sounds, Images Do not accept the use of vulgar language, sounds, or images, except when using some swear words or slang from antagonistic characters that are appropriate to the film's content but are not excessively vulgar, do not harm individuals or communities, are not used frequently, and do not use language for harassment or sexual abuse. |

a) Theme - The theme of the film is not suitable for viewers under 18 years old; - The film's content reflects adult issues such as political, social, psychological, and sexual criminal problems but is not suitable for the perception, psychology, and physiology of viewers under 18 years old. Does not accept images of nudity, except for images of male upper body nudity, female rear upper body nudity unrelated to sex, without offensive tattoos. Do not accept realistic depictions of violent scenes that strongly impact the viewer, except when such images, sounds, or language are appropriate to the film's content and do not delve deeply. c) Nudity, Sexual Contentục d) Drugs, stimulants, addictive substances Do not accept full nudity images, except when such full nudity images are appropriate to the film's content, do not detail genital parts, do not have offensive tattoos, and do not have a prolonged duration. - For the depiction of smoking in films, it shall comply with the provisions of Circular No. 02/2014/TT-BVHTTDL dated May 14, 2014 of the Ministry of Culture, Sports and Tourism on Limiting Smoking in Stage Performances and Cinematic Works. Do not accept explicit, detailed depictions of sexual activities, except when such images, sounds, or language are appropriate to the film's content and do not have a prolonged duration. For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;) Drugs, Stimulants, Addictive Substances Do not accept images, sounds, or language depicting drug trafficking, storage, and use, and other stimulants, addictive substances, except when such images, sounds, or language are appropriate to the film's content or aim to oppose and condemn such behaviors but are not detailed and do not have a prolonged duration. Does not accept the use of coarse language, sound, and image. C13 Do not accept detailed, frequent, and prolonged depictions of frightening, horrific, terrifying, and stressful scenes, except when such images, sounds, and language are necessary for the film's content and are appropriate for the age group. e) Vulgar Language, Sounds, Images Do not accept the use of vulgar language, sounds, or images, except for some stronger swear words or slang in dialogue or writing compared to films classified at the C16 level. |
