Regulations on vehicle registration

BASED ON THE LAW ON TRAFFIC ON ROADS 2008;
Based on Article 167 of the Civil Code 2005;
Based on Decree No. 77/2009/NĐ-CP dated September 15, 2009 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
At the proposal of the Director General of the Administration Police Department under the Ministry of Public Security managing public order and social security;
The Minister of Public Security issues this Circular regulating vehicle registration.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates the issuance, replacement, and revocation of vehicle registration certificates and license plates for motor vehicles according to the provisions of the Road Traffic Law, including: Cars; tractors; trailers or semi-trailers pulled by cars or tractors; two-wheeled motorcycles; three-wheeled motorcycles; motorbikes (including electric motorbikes) and similar types of vehicles; specialized motorbikes used by the Police for security purposes (hereinafter referred to collectively as vehicle registration).
Article 2. Applicability
1. This Circular applies to:
a) Traffic police officers (hereinafter referred to as officers) performing vehicle registration duties.
b) Public Security units and localities.
c) Domestic agencies, organizations, and individuals; foreign organizations and individuals with legitimate offices or residences within the territory of the Socialist Republic of Vietnam related to vehicle registration activities.
2. This Circular does not apply to the registration of motor vehicles of the Military used for national defense purposes.
Article 3. Vehicle Registration Authorities
1. The Highway and Railway Traffic Police Department registers and issues license plates for vehicles of the Ministry of Public Security and cars of diplomatic missions, international organizations' representative offices, and foreigners working in such organizations; cars of agencies and organizations listed in Appendix No. 01 attached to this Circular.
2. The Traffic Police Room, Highway and Railway Traffic Police Room of the Public Security Departments of provinces and centrally-administered cities (hereinafter referred to as the Traffic Police Room) registers and issues license plates for the following types of vehicles (excluding those of agencies, organizations, and individuals specified in Clause 1 of this Article):
a) Cars, tractors, trailers, semi-trailers; motorcycles with cylinder capacity of 175 cm³ or more or vehicles seized by competent state authorities and similar types of vehicles owned by domestic and foreign agencies, organizations, and individuals, including military vehicles with offices or residences in the locality.
b) Motorcycles, motorbikes, electric motorbikes, and similar types of motorcycles, motorbikes, and electric motorbikes owned by foreign agencies, organizations, and individuals, joint ventures with foreign economic organizations in the locality, and organizations and individuals with offices or residences in districts, towns, and provincial cities where the Traffic Police Room is located.
3. County, district, town, and provincial city public security departments (hereinafter referred to as county-level public security departments) register and issue license plates for motorcycles, motorbikes, electric motorbikes, and similar types of vehicles owned by domestic agencies, organizations, and individuals with offices or residences in their locality (excluding those of agencies, organizations, and individuals specified in Clauses 1 and 2 of this Article).
4. In cases where it is necessary due to practical requirements in border counties, remote areas, or localities facing difficulties in material infrastructure, the Director of the Public Security Departments of provinces and centrally-administered cities may, after reporting and obtaining written approval from the Director General of the Administrative Management Bureau under the Ministry of Public Security, decide to have the Traffic Police Room organize vehicle registration and issuance of license plates in clusters to ensure convenience for organizations and individuals seeking vehicle registration.
Article 4. Time limit for issuing registration certificates and license plates
1. Issue license plates immediately upon receipt of valid vehicle registration files.
2. For new issuance, replacement of vehicle registration certificates; transfer of ownership and relocation files; recovery certificates of registration and license plates, the completion time of procedures shall not exceed two working days from the date of receiving complete and valid files.
In case of replacing a lost vehicle registration certificate, the verification and completion time of procedures shall not exceed thirty days from the date of receiving complete and valid files.
3. Replacement of license plates shall be issued immediately upon receipt of complete and valid files; if waiting for production of license plates is required, the issuance and replacement time shall not exceed seven working days from the date of receiving complete and valid files.
4. In case of temporary registration, issue temporary vehicle registration certificates and license plates on the same day.
Article 5. Responsibilities of agencies and staff handling vehicle registration
1. Implement the provisions of this Circular and other relevant laws regarding vehicle registration work. Strictly prohibit the addition of registration procedures contrary to this Circular.
2. Staff handling vehicle registration must check and compare the file with the actual vehicle when receiving the registration file. If the file is complete and meets regulations, it should be accepted and processed.
In cases where the file does not meet the prescribed procedures, specific and detailed guidance must be provided once (recorded on the back of the registration application form) and bear responsibility for such guidance.
Article 6. Responsibilities of the Vehicle Owner
1. Strictly comply with all legal provisions related to vehicle registration; have vehicle files as prescribed and bear legal responsibility for the legality of the vehicle and registration files; bring the vehicle to the registration agency for inspection and payment of registration fees and license plate issuance as prescribed.
In cases where the previous registration agency has managed part of the vehicle files, the owner must return those files when applying for issuance, replacement of registration certificates and license plates; transfer of ownership and relocation of vehicles; recovery of registration certificates and license plates.
2. Upon receiving a decision to transfer, sell, give, or gift a vehicle, the owner must notify in writing according to Model No. 01 issued together with this Circular to the agency that issued the Vehicle Registration Certificate for monitoring. If the owner fails to notify, they will continue to bear legal responsibility for the vehicle until the buyer, transferee, recipient, or donee completes the transfer and relocation registration procedures.
3. Within thirty days from the date of completing the ownership transfer documentation, organizations or individuals purchasing, transferring, giving, or gifting the vehicle must go to the registration agency to complete the transfer and relocation registration procedures.
4. Strictly prohibit any acts of forging files, altering engine numbers, or frame numbers for vehicle registration.
Chapter II
PROCEDURES FOR VEHICLE REGISTRATION, REPLACEMENT, AND RECOVERY OF REGISTRATION CERTIFICATES AND LICENSE PLATES
Section A
VEHICLE REGISTRATION AND ISSUE OF LICENSE PLATES
Article 7. Vehicle Registration Files
The vehicle registration file includes:
1. Vehicle registration application form.
2. Owner's documents.
3. Vehicle documents.
Article 8. Vehicle Registration Application Form
The vehicle owner is responsible for fully filling out all contents specified in the vehicle registration application form (according to Model No. 02 issued together with this Circular), signing, clearly stating their name, and affixing a stamp (if applicable for organizations or institutions).
Article 9. Vehicle Owner Documents
1. The vehicle owner is a Vietnamese citizen, presenting one of the following documents:
a) Identity card. In cases where an identity card has not been issued or the place of permanent residence recorded in the identity card does not match the place of permanent residence recorded in the vehicle registration application form, present a Household Register.
b) An introduction letter from the head of the working unit, accompanied by a People's Public Security Identity Card or Military Identity Card (as stipulated by the Ministry of National Defense).
In cases where there is no People's Public Security Identity Card or Military Identity Card, a confirmation letter from the head of the working unit must be presented.
c) Student ID or student card of full-time students studying at vocational schools, colleges, universities, or academies for two years or more, accompanied by an introduction letter from the school.
2. The vehicle owner is a Vietnamese citizen residing abroad who returns to Vietnam to live or work, presenting a Temporary Residence Booklet or Household Register and Passport (still valid) or other documents equivalent to a Passport.
3. The vehicle owner is a foreigner
a) Foreigners working in diplomatic missions, consular offices, or international organization representative offices in Vietnam, presenting a Diplomatic Identity Card or Service Identity Card (still valid), and submitting an introduction letter from the State Protocol Bureau or Provincial Department of Foreign Affairs.
b) Foreigners living or working in Vietnam, presenting a Passport (still valid) or other documents equivalent to a Passport; Permanent Resident Card, Temporary Resident Card for one year or more, and work permit as prescribed, and submitting an introduction letter from a Vietnamese organization or agency authorized to issue such letters.
4. The vehicle owner is an organization or institution
a) For Vietnamese organizations or institutions, present the identity card of the person registering the vehicle along with an introduction letter from the organization or institution.
b) For diplomatic missions, consular offices, or international organization representative offices in Vietnam, present the Diplomatic Identity Card or Service Identity Card (still valid) of the person registering the vehicle; submit an introduction letter from the State Protocol Bureau or Provincial Department of Foreign Affairs.
c) For joint ventures, wholly foreign-owned enterprises, representative offices, or foreign enterprises winning bids in Vietnam, and non-governmental organizations, present the identity card of the person registering the vehicle and submit an introduction letter; if the organization does not have an introduction letter, it must provide an introduction letter from a higher-level management agency.
5. Persons authorized to register the vehicle must present their own identity card; submit a power of attorney certified by the People's Committee of the commune, ward, or town or confirmed by the working unit or organization.
Article 10. Vehicle Documents
1. Ownership transfer documents for vehicles include one of the following papers:
a) Decision on sale, gift, or purchase and sale contract in accordance with the law.
b) Inheritance document in accordance with the law.
c) Sales invoice in accordance with the Ministry of Finance regulations.
d) Document from the competent authority agreeing to liquidate the vehicle in accordance with the regulations (for police vehicles); from the General Staff (for military vehicles).
đ) Document agreeing to sell the vehicle from the Minister or Chairman of the People's Committee of the province or centrally governed city (hereinafter referred to as the Chairman of the Provincial People's Committee) or the Chairman of the Board of Directors of the enterprise accompanied by the purchase and sale contract and the inventory list of assets handed over for state-owned enterprises assigned, sold, leased, or entrusted for business management.
e) Decision allocating or transferring vehicles of the Ministry of Public Security (vehicles provided) or purchase and sale documents (vehicles purchased by agencies and units themselves) for specialized vehicles serving security purposes of the public security forces.
g) Personal vehicle sale, gift, or donation document must be notarized according to the law on notarization or certified by the People's Committee of the commune, ward, town regarding the signature of the seller, donor, or giver according to the law on certification.
In cases where the vehicle owner is a public security force or military personnel or a foreign individual working at diplomatic missions, consular offices, or international organization representative offices and the vehicle is registered under the address of their workplace, confirmation from the workplace agency, organization, or unit is required.
2. Vehicle stamp duty payment receipt
a) Receipt or payment voucher for state budget funds in cash or check through the state treasury (with confirmation from the state treasury that it has received the money) or payment authorization through a bank for stamp duty payment according to the Ministry of Finance regulations.
In cases where multiple vehicles share one stamp duty payment receipt, each vehicle must have a certified copy or confirmation from the issuing agency.
b) For vehicles exempted from stamp duty, only the stamped declaration form confirmed by the tax authority (instead of the receipt or stamp duty payment voucher) is required.
3. Vehicle origin documents
a) Vehicles imported under commercial contracts, tax-exempt vehicles, specialized vehicles with a zero percent tariff rate, project aid vehicles: Vehicle origin declaration form; motorcycles imported (according to the model of the Ministry of Finance).
b) Vehicles imported under temporary importation and re-exportation regime for individuals entitled to diplomatic privileges and immunities according to the law or international treaties to which Vietnam is a party; vehicles of foreign experts implementing ODA programs in Vietnam, overseas Vietnamese invited back to work: Vehicle import permit issued by the Customs Authority.
c) Non-commercial import vehicles, gifts, donations, or imported movable assets, non-repayable aid, humanitarian vehicles:
- Vehicle import permit issued by the Customs Authority and non-commercial goods declaration form according to the Ministry of Finance regulations.
- Import tax receipt, special consumption tax receipt, and value-added tax receipt for imported goods (if applicable) or record of collection or payment order or payment voucher through the state treasury or bank transfer or payment authorization through a bank clearly stating that taxes have been paid.
If there is no tax receipt, a decision on tax exemption or tax exemption document from the competent authority or a certificate of aid goods according to the Ministry of Finance regulations (substituting for the tax receipt) is required.
For vehicles with a zero percent tariff rate, only the non-commercial goods declaration form according to the Ministry of Finance regulations must be provided, including the brand name and engine number, chassis number.
d) For semi-trailers, semi-trailer trucks, tractors, electric motorcycles, electric cars imported: Certificate of quality and technical safety and environmental protection for imported motor vehicles (used for registration) or notification of exemption from inspection of quality and technical safety and environmental protection for imported motor vehicles according to the Ministry of Transport regulations.
If the certificate of quality and technical safety and environmental protection for imported motor vehicles does not indicate the brand name, the vehicle registration certificate must include the country of manufacture in the type section.
đ) Domestic production or assembly vehicles: Quality inspection certificate for road traffic motor vehicles upon leaving the factory according to the Ministry of Transport regulations.
e) Modified vehicles:
- Vehicle registration certificate (for already registered vehicles) or import origin documents (for used vehicles) as stipulated in point a, Clause 3 of this Article.
- Quality and technical safety and environmental protection certificate for modified motor vehicles issued by the Ministry of Transport or the Ministry of Public Security (for public security force vehicles).
If the vehicle has only replaced the engine assembly or frame assembly (Block), the origin document must also include the export/import declaration form or electronic customs declaration form with detailed inventory of the engine assembly or frame assembly (original or certified copy).
If domestic-made engine assemblies or frame assemblies are used, a quality inspection certificate upon leaving the factory according to the Ministry of Transport regulations is required.
If registered engine assemblies or frame assemblies are used, an additional certificate of vehicle registration cancellation and license plate recovery (clearly indicating the engine assembly or frame assembly) is required.
If confiscated engine assemblies or frame assemblies are used, an additional confiscation decision from the competent authority and sales invoice for confiscated assets transferred to the state treasury according to the regulations is required.
g) Vehicles processed for confiscation and transfer to the state treasury:
- Confiscation decision for transfer to the state treasury issued by the competent authority.
- Sales invoice for confiscated assets transferred to the state treasury issued by the Ministry of Finance (in case of asset processing through liquidation); handover receipt for asset transfer (in case of asset processing through reallocation).
h) Vehicles with a decision on evidence disposal:
- Evidence disposal decision issued by the Investigative Agency, People's Procuratorate, or People's Court (original given to each vehicle).
- Payment receipt or payment voucher or handover record (if the person is a victim).
In case the decision on handling evidence involves confiscation and transfer to the state treasury, there must be a sales invoice for confiscated assets transferred to the state treasury issued by the Ministry of Finance (in cases where assets are handled through liquidation); and a handover receipt (in cases where assets are handled through reallocation).
i) Vehicles subject to handling of excess inventory at bonded warehouses:
- Import origin documents as stipulated in points a, b, c, and point d, Clause 3 of this Article.
- Decision on selling excess inventory at bonded warehouses issued by the Committee for Handling Excess Inventory at Bonded Warehouses, as prescribed by the Ministry of Finance.
For vehicles prohibited from importation according to government regulations, there must be a decision on confiscation and transfer to the state treasury issued by the Customs Department (registration file as stipulated in point g, Clause 3 of this Article).
k) Vehicles subject to handling of excess inventory at seaports: Decision on selling assets issued by the Committee for Handling Excess Inventory at Seaports, signed by the Chairman of the Committee who is a leader of the Department of Finance.
In cases where vehicles subject to handling of excess inventory are confiscated and transferred to the state treasury, the import origin documents shall be implemented as stipulated in point g, Clause 3 of this Article.
l) Vehicles subject to additional collection of import tax (vehicles that have been registered but later discovered to have false import origin documents):
- Receipts for import tax, special consumption tax, and value-added tax on imported goods (if applicable).
- Certificate of vehicle registration or decision on handling evidence or written conclusion of the investigation agency.
m) Vehicles requiring additional collection of import tax:
- Decision on additional tax collection issued by the Customs Department of the province or centrally governed city.
- Payment receipt for import tax deposited into the state budget.
- Original documentation of the vehicle.
n) National reserve vehicles:
- Order for selling national reserve goods issued by the National Reserve Agency; if multiple vehicles share one order, each vehicle must have its own copy (the copy must be confirmed by the National Reserve Agency).
- Declaration of import origin of the vehicle or confirmation letter from the General Department of Customs (one original copy per vehicle specifying brand, engine number, chassis number).
4. In cases where ministries and sectors change forms for import origin documents, tax documents, and other related documents concerning vehicle registration, the General Administration of Public Security for Social Order and Safety Management or the Traffic Police Corps has the responsibility to notify the registration agencies specified in Article 3 of this Circular to implement accordingly.
Section B
REGISTRATION OF TRANSFER AND MOVEMENT OF VEHICLES
Article 11. Registration of Vehicle Transfer within the Same Province or Centrally Governed City
1. Organizations and individuals purchasing, receiving transfers, being given, or gifted vehicles must present the documents specified in Article 9 of this Circular and submit the following files:
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) Certificate of vehicle registration.
c) Proof of transfer of ownership of the vehicle as stipulated in Clause 1 of Article 10 of this Circular.
d) Proof of stamp duty payment as stipulated in Clause 2 of Article 10 of this Circular.
2. When transferring ownership, the original license plate is retained (except for plates with three or four digits or different series plates which must be returned to obtain a new five-digit plate as prescribed) and a new certificate of vehicle registration is issued to the new owner.
Article 12. Transfer of Vehicle Ownership and Movement to Another Province or Central City
1. Organizations and individuals purchasing, being transferred, receiving gifts, or donations of vehicles must present the vehicle registration authority recorded on the certificate of registration to process the procedures, without having to bring the vehicle for inspection but must present the documents specified in Article 9 of this Circular and submit the following dossier:
a) Two vehicle transfer and movement declaration forms (Form No. 04 issued together with this Circular).
b) Certificate of vehicle registration and license plate.
c) Proof of transfer of ownership of the vehicle as stipulated in Clause 1 of Article 10 of this Circular.
In cases where the original owner moves to another province or central city (hereinafter referred to as "province"), there must be a decision on job transfer or Household Registration Booklet instead of the ownership transfer document.
Article 13. Vehicle Registration from Another Province
1. The vehicle owner must present the documents specified in Article 9 of this Circular and submit the following dossier:
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) Proof of stamp duty according to Clause 2, Article 10 of this Circular.
c) Vehicle transfer and movement declaration form (Form No. 04 issued together with this Circular) and the accompanying ownership transfer document as stipulated in Clause 1, Article 10 of this Circular.
d) Original vehicle dossier as prescribed.
Section C
REPLACEMENT AND REISSUANCE OF VEHICLE REGISTRATION CERTIFICATE AND LICENSE PLATE
Article 14. Replacement of Vehicle Registration Certificate and License Plate
1. Situations requiring replacement of the vehicle registration certificate: modified vehicles, repainted vehicles; extension of the validity period of the vehicle registration certificate; blurred, torn, or damaged vehicle registration certificates; or when a jointly owned vehicle registered under one person's name now requires joint ownership registration between spouses or changes in owner information, or when the owner voluntarily replaces the old vehicle registration certificate with a new one as prescribed by this Circular.
2. Situations requiring replacement of the license plate: blurred, broken, or damaged license plates.
3. Procedures for replacing the vehicle registration certificate and license plate
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) Documents as specified in Article 9 of this Circular.
c) Return the vehicle registration certificate (in case of replacing the vehicle registration certificate) or license plate (in case of replacing the license plate).
In cases where the vehicle registration certificate and license plate of diplomatic missions, consular offices, international organization representative offices, and foreign nationals' staff need to be replaced, additional documents must be provided:
- An introduction letter from the State Protocol Department (for diplomatic missions and international organization representative offices) or the Department of Foreign Affairs (for consular offices).
- A diplomatic note from the diplomatic mission, consular office, or international organization representative office.
- For foreign nationals' staff, they must present a valid Diplomatic Identity Card or Service Identity Card.
In cases where the vehicle owner is a People's Public Security officer, People's Army officer, or student who has registered their vehicle at their workplace or school and now has been discharged, transferred, or graduated, they may apply for replacement or reissuance of the vehicle registration certificate at their new permanent or temporary residence address.
When processing the replacement of the vehicle registration certificate and license plate, it is not necessary to bring the vehicle for inspection (except for modified or repainted vehicles), but the owner must submit the chassis and engine number copies as required.
4. When replacing the vehicle registration certificate and license plate, the license plate remains unchanged. If the vehicle currently uses a three-digit or four-digit license plate or a different system license plate, it will be replaced with a five-digit license plate as prescribed.
Article 15. Reissue of Vehicle Registration Certificate and License Plates Lost
1. The dossier for reissuing the Vehicle Registration Certificate and license plates lost includes:
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) Documents as specified in Article 9 of this Circular.
In cases where the Vehicle Registration Certificate and license plates of diplomatic missions, consular offices, international organization representative offices, and foreign employees are reissued, the following must be included:
- An introduction letter from the State Protocol Department (for diplomatic missions and international organization representative offices) or the Department of Foreign Affairs (for consular offices).
- A diplomatic note from the diplomatic mission, consular office, or international organization representative office.
- For foreign nationals' staff, they must present a valid Diplomatic Identity Card or Service Identity Card.
2. When reissuing the Vehicle Registration Certificate and license plates, the original license plate number shall be retained. In cases where the vehicle currently uses a three-digit or four-digit license plate or a different system, it shall be changed to a five-digit license plate according to regulations.
In cases where a vehicle has been registered and issued a license plate but the owner has completed the transfer of ownership or moved to another locality, and now requests to re-register under the original owner's name, the registration will be processed again and the original license plate number retained; if the original license plate is a three-digit or four-digit license plate or a different system, it shall be changed to a five-digit license plate according to regulations.
Section D
1. Exported, imported, or produced and assembled vehicles moving from the factory to the port or warehouse, or from the port, factory, or dealership to the registration office or other storage facilities.
Article 16. Types of Vehicles Required to Register Temporarily
1. Passenger cars; chassis passenger cars with a cab; cargo trucks without a body; trailers, semi-trailers; imported or domestically produced and assembled motorcycles from warehouses, ports, factories, or dealerships to the registration location or other storage facilities.
2. Vehicles bearing foreign license plates that have been permitted by authorized authorities for temporary import and re-export within a specified period (excluding vehicles operating in border areas with checkpoints): vehicles for conferences, trade fairs, sports events, exhibitions, tourism; transit vehicles; right-hand drive vehicles (reverse steering) allowed to participate in traffic according to legal provisions.
3. Newly assembled vehicles in Vietnam undergoing test drives on public roads.
4. Vehicles with transfer and relocation certificates to another locality.
5. Vehicles completing procedures to recover the Vehicle Registration Certificate and license plates for re-export to their home country or transfer in Vietnam.
6. Vehicles permitted by authorized authorities to enter Vietnam for serving conferences, trade fairs, sports events, exhibitions.
7. Examination vehicles, vehicles operating within limited areas (when moving outside the restricted area).
Article 17. Dossiers and Documents for Temporary Vehicle Registration
1. For vehicles produced and assembled in Vietnam, the dossier includes:
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) Quality inspection certificate of motor vehicles from the production facility according to regulations. In cases where newly produced and assembled vehicles in Vietnam undergo test drives on public roads, there must be a design approval document or confirmation from the Vietnam Vehicle Inspection Agency.
c) Sales invoice or dispatch note.
2. For imported vehicles; temporarily imported for re-export within a specified period, transit vehicles, the dossier includes:
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) Customs declaration form or detailed entry list for vehicles.
In cases where the import procedures have been completed, the temporary registration and issuance of temporary license plates include the documents stipulated in Clause 1 and Clause 3 of Article 10 of this Circular.
3. For vehicles permitted by authorized authorities to enter Vietnam to serve conferences, trade fairs, exhibitions, sports events, and foreign vehicles entering Vietnam for tourism, only the Vehicle Registration Certificate or a list of vehicles approved by authorized authorities is required.
4. For vehicles undergoing transfer and relocation to another locality, or vehicles completing procedures to recover the Vehicle Registration Certificate and license plates, the dossier for issuing temporary registration and license plates includes the transfer and relocation certificate or the recovery certificate of the Vehicle Registration Certificate and license plates.
5. Foreign-owned vehicles registered abroad with right-hand drive (reverse steering) permitted to participate in traffic according to legal provisions, the dossier includes:
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) Permit document for participation in traffic in Vietnam issued by the Prime Minister or authorized ministries and sectors by the Prime Minister.
6. Vehicles operating within limited areas according to regulations of authorized authorities, the dossier includes:
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) Copy of the Vehicle Registration Certificate.
7. When applying for temporary registration and issuance of temporary license plates, the owner does not need to bring the vehicle for inspection but must submit a copy of the vehicle dossier (bring the original dossier for verification).
Article 18. Validity period of temporary vehicle registration certificate and place for temporary vehicle registration
1. The temporary vehicle registration certificate is valid for a period of 15 days.
2. Vehicles serving conference, advertising, trade fair, exhibition, sports activities, and other lawful activities shall have the validity period of the temporary vehicle registration certificate recorded according to the period permitted by the competent authority for entry into Vietnam to serve such activities.
3. Temporarily registered vehicles are allowed to participate in traffic according to the period, route, and scope of operation recorded on the temporary vehicle registration certificate.
4. For convenience in temporary registration, the vehicle owner may register at the nearest vehicle registration office.
Section E
RECOVERY OF VEHICLE REGISTRATION CERTIFICATES AND LICENSE PLATES
Article 19. Cases requiring the recovery of vehicle registration certificates and license plates
1. Vehicles that are unusable due to damage or destroyed due to objective reasons.
2. Vehicles whose engines or frames have been removed for replacement on other vehicles.
3. Temporarily imported vehicles of foreign organizations or individuals re-exported or transferred within Vietnam.
4. Vehicles exempt from import tax now being transferred to another purpose.
5. Vehicles registered in special economic zones or international border economic zones according to government regulations when re-exported or transferred into Vietnam.
6. Stolen or seized vehicles not found, with the vehicle owner requesting the recovery of the vehicle registration certificate.
7. Vehicles that have exceeded their service life; vehicles not allowed to circulate according to the provisions of the law; vehicles with a conclusion from the competent authority indicating that both the engine number and chassis number have been cut and welded, or only one of them has been cut and welded.
Article 20. Responsibilities of functional agencies in recovering vehicle registration certificates and license plates
1. Responsibilities of the vehicle registration and management agency
a) Processing procedures to issue a certificate of recovery of vehicle registration certificates and license plates for cases stipulated in Article 19 of this Circular.
b) Based on the list of vehicles exceeding their service life and vehicles not allowed to circulate according to the law provided by the inspection agency, the vehicle registration and management agency must review and process the recovery of vehicle registration certificates and license plates.
c) Coordinate with the Police Station of the commune, ward, town (hereinafter referred to as the Commune Police Station) where the vehicle owner resides to notify and request organizations and individuals owning vehicles exceeding their service life, agricultural and forestry vehicles, self-made three-wheeled and four-wheeled vehicles to go to the traffic police agency to process the recovery of vehicle registration certificates and license plates. Within 15 days from the date of notification, if the vehicle owner does not voluntarily come to process, coordinate with the Commune Police Station to recover the vehicle registration certificates and license plates.
d) Notify the list of vehicles exceeding their service life to the public security units and localities responsible for ensuring traffic order and safety for their knowledge to detect and handle according to the law.
2. Responsibilities of public security units and localities and functional forces responsible for ensuring traffic order and safety
a) Through traffic order and safety work, if they discover vehicles exceeding their service life, agricultural and forestry vehicles, self-made three-wheeled and four-wheeled vehicles participating in traffic within their jurisdiction, public security units and other forces responsible for ensuring traffic order and safety must prepare records, stop circulation of the vehicles, temporarily detain the vehicle registration certificates and license plates, and handle according to the law; at the same time, notify in writing to the traffic police agency where the vehicle was registered to process the recovery of vehicle registration certificates and license plates.
b) In cases where vehicles involved in traffic accidents are destroyed and unusable, the agency handling the accident temporarily detains the vehicle registration certificates and license plates and notifies in writing to the agency where the vehicle was registered to process the recovery of vehicle registration certificates and license plates.
Article 21. Procedure for Revoking Vehicle Registration Certificates and License Plates
1. Form 05 for revoking vehicle registration and license plates (annexed to this Circular); return the vehicle registration certificate and license plates. The vehicle owner does not need to bring the vehicle to the registration authority.
In case the vehicle registration certificate or license plate is lost, a report and a commitment to bear legal responsibility (for individuals) and a request letter (for organizations) must be submitted.
2. Procedure for revoking vehicle registration certificates and license plates in specific cases:
a) In case the vehicle is destroyed due to an accident and cannot be used; the vehicle has exceeded its service life; the vehicle is prohibited from circulation according to the law and is temporarily seized by the competent authority: A notification letter from the competent authority along with the vehicle registration certificate and license plate.
b) In case the engine number and chassis number are cut and welded together or only one of them is cut and welded: A conclusion document from the competent authority is required.
c) In case vehicles of diplomatic missions, consular offices, representative offices of international organizations in Vietnam, and foreign individuals working in these agencies and organizations need to submit an introduction letter from the State Protocol Bureau (for diplomatic missions and representative offices of international organizations) or the Department of Foreign Affairs (for consular offices) when processing the revocation of vehicle registration certificates and license plates.
Chapter III
IN PATROL AND SUPERVISION WORK
Article 22. Cases Related to Engine Numbers and Chassis Numbers of Vehicles
1. Imported Vehicles
a) Vehicles without engine numbers or chassis numbers: If the customs declaration form indicates that there are no engine numbers or chassis numbers or they have not been found, then the numbers should be stamped according to the license plate numbers.
If the engine numbers or chassis numbers are found, a confirmation from the customs authority is required.
b) Vehicles with engine numbers or chassis numbers on the Etekét, marked with paint, faded, or rusted: These numbers can be re-stamped according to the numbers confirmed by the customs authority in the import declaration form.
c) Vehicles confirmed by the customs authority to have only VIN numbers, without engine numbers or chassis numbers: The chassis number should be replaced with the VIN number (photograph the VIN number instead of stamping the chassis number), and the engine number should be re-stamped according to the license plate number.
d) Imported vehicles that have had their engine numbers and chassis numbers re-stamped will not be registered (except in cases where there is a resolution from the Government or the Prime Minister).
2. Domestic Production and Assembly Vehicles
a) Vehicles with engine numbers or chassis numbers stamped with pins (lade) or numbers that are faded and unclear: These numbers can be re-stamped according to the numbers recorded in the quality inspection certificate at the time of factory release.
b) Vehicles with overlapping engine numbers or chassis numbers: An appraisal must be requested. If the appraisal authority concludes that the engine numbers or chassis numbers have been tampered with, registration will not be accepted; if the appraisal concludes that the original numbers remain intact, the numbers can be re-stamped according to the numbers recorded in the quality inspection certificate at the time of factory release.
c) Vehicles with domestic-stamped engine or chassis numbers that have technical issues, subsequently corrected by the manufacturer and confirmed, can be registered.
3. Registered vehicles, if the engine or chassis is replaced without numbers, should have the numbers stamped according to the license plate numbers.
4. Vehicles with confiscation decisions or evidence handling decisions, where the appraisal authority concludes that the engine numbers or chassis numbers have been tampered with, erased, or cannot be identified, should have the numbers re-stamped according to the license plate numbers.
5. Vehicles with confiscation decisions or evidence handling decisions indicating engine numbers or chassis numbers, but during long-term storage, the engine numbers or chassis numbers become corroded, faded, or rusted, should have the numbers re-stamped according to the license plate numbers.
6. Vehicles with both engine numbers and chassis numbers cut and welded, or only one of them cut and welded, will not be registered.
7. In all cases, re-stamping of engine numbers and chassis numbers must be carried out by the vehicle registration authority.
Article 23. Resolution of certain difficulties when registering transfer of ownership or relocation of vehicles
1. When transferring ownership or relocating a vehicle, if the registration file for a vehicle registered before December 31, 2005 lacks a sales invoice or has non-continuous transfers, such a file shall be considered valid according to the regulations of the Ministry of Finance.
2. A vehicle that has completed the procedures for transferring ownership or relocating to another locality but the owner has not yet registered it and sells it again to a new owner, if the purchase and sale procedures and stamp duty comply with the regulations, then the registration and relocation procedures will be accepted and a notification will be sent to the relocated locality to adjust the vehicle registration records.
3. Temporarily imported vehicles; project vehicles whose term has not expired, transferred within Vietnam; vehicles given as gifts, donations, or presents
a) The vehicle owner must complete the procedure to recover the vehicle registration certificate and license plate at the registration authority, then proceed to the customs office to handle import procedures according to regulations and submit the import file to the registration authority to handle the transfer of ownership or relocation procedures.
b) In cases where the vehicle registration certificate and license plate have not been recovered, but the customs office has collected import duties or the competent agency of the Ministry of Finance has issued a written response stating that there is no need to collect additional duties, the vehicle can be transferred and relocated, and the written response will be filed in the vehicle's file.
4. Imported vehicles exempted from tax and used in Vietnam with an import tax value of 0% as stipulated by the Ministry of Finance; vehicles of overseas Vietnamese returning home which arrived at a Vietnamese port before April 1, 2014 may be transferred, registered, and relocated according to the provisions of this Circular.
Vehicles of overseas Vietnamese who returned to Vietnam after April 1, 2014 must first register their vehicles before they can be transferred; when transferring the vehicle, proof of tax collection according to the regulations of the Ministry of Finance must be provided to allow the transfer and relocation according to the provisions of this Circular.
5. For vehicles registered under both spouses' names or only one person's name, if the person named on the vehicle registration certificate has died or gone missing (with a death certificate or a court declaration of disappearance), and now wishes to transfer the vehicle to their spouse or another person without any disputes, the registration procedures will be processed.
6. For illegally imported motorcycles that have paid commercial and industrial taxes as approved by the provincial or centrally-administered municipal People's Committees and were registered before December 31, 1995, the transfer of ownership, relocation, or license plate change procedures will be processed.
7. If a vehicle's import origin certificate (customs document) is found to be forged, the file will be transferred to the investigation agency for investigation and handling according to the law. If the investigation agency issues a conclusion that the vehicle is not stolen or illegally obtained, the registration authority will hand over the case to the Customs Department managing the province or city for tax recovery. After obtaining proof of tax payment, the registration procedures will be processed.
8. Motorcycles registered before December 31, 1995, marked "not for sale, exchange, gift, or transfer" on the vehicle registration certificate, if there are no disputes or complaints, the transfer of ownership, relocation, or license plate change procedures will be processed.
Illegally imported two-wheeled motorcycles that have had their taxes recovered by the customs office and have been registered can have their transfer of ownership, relocation, or license plate change procedures processed.
9. Vehicles modified and registered before June 4, 1996, lacking technical inspection reports as required by Joint Circular No. 223/TT/LB dated December 7, 1979 of the Ministry of Transport and the Ministry of Home Affairs, can have their transfer of ownership, relocation, or license plate change procedures processed.
10. Vehicles assembled in Vietnam and registered before February 19, 1998, if they have a copy of the first product certification or a copy of the acceptance report by the acceptance committee as stipulated by the Ministry of Transport, can have their transfer of ownership, relocation, or license plate change procedures processed.
11. If a vehicle's registration file complies with regulations but lacks the signature of the head of the room, team, or registration officer, or lacks stamps on the registration application form, the transfer application form, the vehicle registration certificate, or the import documents due to clerical errors, or if there are address errors, missing or incorrect characters in the engine number or chassis number compared to the actual vehicle, or if there is a lack of a copy of the special consumption tax receipt (if required), or if the file lacks a sales invoice or a copy of the driver's license, tax receipt, or modification procedures for the cargo box but has received a safety and environmental protection certificate from the transportation department, then the file should be referred to the Director of the Highway Traffic Police Corps Bureau (for vehicles registered with the Highway Traffic Police Corps Bureau) or the Head of the Traffic Police Room, Chief of the County Public Security Office (for vehicles registered locally) for acceptance and processing of the registration procedures.
For automobiles and motorcycles that have completed registration procedures before December 31, 1995, if the owner now wishes to transfer ownership, relocate, or reissue the vehicle registration certificate and license plate, and the original file lacks some procedures but there are no disputes or complaints, the file should be referred to the Director of the Highway Traffic Police Corps Bureau (for vehicles registered with the Highway Traffic Police Corps Bureau) or the Director of the Provincial Public Security Department (for vehicles registered locally) for acceptance and processing of the registration procedures.
12. For electric cars and motorcycles used before July 1, 2009 without origin documents or transfer documents that do not meet the requirements, if the owner provides a commitment confirmed by local authorities, the registration and issuance of license plates will be processed.
13. For vehicles registered as semi-trailer trucks that are now being transferred, relocated, or requesting to separate the file into: tractor truck; trailer; semi-trailer, the original file and license plate of the semi-trailer truck will be used for the tractor truck registration; a copy of the original file of the semi-trailer truck, confirmed by the Traffic Police Room, will be used for the trailer and semi-trailer registration.
Article 24. Registration for Transfer of Vehicle Ownership in Cases Involving Multiple Transfers of Ownership
1. Registration for Transfer of Vehicle Ownership within the Same Province
a) In cases where the current vehicle user has ownership transfer documents from the person named on the vehicle registration certificate and ownership transfer documents from the final seller, the application package includes:
- A vehicle transfer and relocation application form (Form No. 03 issued together with this Circular), with a commitment from the current vehicle user to be responsible under the law for the vehicle being registered, and confirmation of the current residence address of the vehicle user by the police station of the commune where the vehicle user resides.
- Proof of payment of the initial registration fee as prescribed.
- Ownership transfer documents from the person named on the vehicle registration certificate and ownership transfer documents from the final seller.
- The vehicle registration certificate. If the vehicle registration certificate is lost, the reason must be clearly stated in the vehicle transfer and relocation application form (Form No. 03 issued together with this Circular).
b) In cases where the current vehicle user does not have ownership transfer documents, the application package includes:
- A vehicle transfer and relocation application form (Form No. 03 issued together with this Circular), with a commitment from the current vehicle user to be responsible under the law for the vehicle being registered, and confirmation of the current residence address of the vehicle user by the police station of the commune where the vehicle user resides.
- Proof of payment of the initial registration fee as prescribed.
- The vehicle registration certificate. If the vehicle registration certificate is lost, the reason must be clearly stated in the vehicle transfer and relocation application form (Form No. 03 issued together with this Circular).
2. Registration for Transfer and Relocation of Vehicle to Another Province:
a) In cases where the current vehicle user has ownership transfer documents from the person named on the vehicle registration certificate and ownership transfer documents from the final seller, the application package includes:
- Two vehicle transfer and relocation application forms (Form No. 03 issued together with this Circular), with a commitment from the current vehicle user to be responsible under the law for the vehicle being registered, and confirmation of the current residence address of the vehicle user by the police station of the commune where the vehicle user resides.
- Ownership transfer documents from the person named on the vehicle registration certificate and ownership transfer documents from the final seller.
- The vehicle registration certificate and license plate. If the vehicle registration certificate or license plate is lost, the reason must be clearly stated in the vehicle transfer and relocation application form (Form No. 03 issued together with this Circular).
b) In cases where the current vehicle user does not have ownership transfer documents, the application package includes:
- Two vehicle transfer and relocation application forms (Form No. 03 issued together with this Circular), with a commitment from the current vehicle user to be responsible under the law for the vehicle being registered, and confirmation of the current residence address of the vehicle user by the police station of the commune where the vehicle user resides.
- The vehicle registration certificate and license plate. If the vehicle registration certificate or license plate is lost, the reason must be clearly stated in the vehicle transfer and relocation application form (Form No. 03 issued together with this Circular).
3. Registration for Transfer of Vehicle from Another Province to the Current Province:
a) Vehicle registration application form (Form No. 02 issued together with this Circular).
b) A vehicle transfer and relocation application form (Form No. 03 issued together with this Circular) and a transfer and relocation form, along with the original vehicle file.
c) Proof of payment of the initial registration fee as prescribed.
4. Responsibilities of the Registration Agency
a) In cases of registration for transfer of vehicle ownership within the same province
The vehicle registration authority receives the application package for vehicle transfer registration, checks that all required procedures are complete, and issues a notice to the vehicle user:
- In cases where the current vehicle user has ownership transfer documents from the person named on the vehicle registration certificate and ownership transfer documents from the final seller, the vehicle registration authority must complete the issuance of the vehicle registration certificate for the current vehicle user within two working days from the date of receipt of the complete and valid application package; retain the old license plate (except for license plates with three digits, four digits, or different systems, which will be collected to change to a five-digit license plate according to regulations).
- In cases where the current vehicle user does not have ownership transfer documents, the notice allows the use of the vehicle during the waiting period of thirty days for the vehicle registration authority to return the result.
The vehicle registration authority sends a notification to the person named on the registration certificate and publicly posts it at the office of the vehicle registration authority, searches the stolen vehicle database and registration data. Thirty days after sending the notification and public posting, the vehicle registration authority completes the issuance of the vehicle registration certificate for the current vehicle user; retain the old license plate (except for license plates with three digits, four digits, or different systems, which will be collected to change to a five-digit license plate according to regulations).
b) In cases of processing for transfer and relocation of vehicle to another province:
The vehicle registration authority receives the application package, checks that all required procedures are correct, and processes as follows:
- In cases where the application package for vehicle transfer and relocation contains ownership transfer documents from the person named on the vehicle registration certificate and ownership transfer documents from the final seller, the vehicle registration authority must complete the transfer and relocation procedures for the vehicle user within two working days from the date of receipt of the complete and valid application package.
- In cases where the application package for vehicle transfer and relocation does not contain ownership transfer documents as prescribed, a notice is issued and the transfer and relocation procedures for the vehicle user are carried out. The notice allows the use of the vehicle during the waiting period of thirty days for the vehicle registration authority to process the transfer and relocation procedures.
The vehicle registration authority sends a notification to the person named on the registration certificate and publicly posts it at the office of the vehicle registration authority, searches the stolen vehicle database and registration data. Thirty days after sending the notification and public posting, the vehicle registration authority completes the transfer and relocation procedures according to regulations, records the verification results, and signs the confirmation on the vehicle transfer and relocation application form.
- Return to the current vehicle user: One transfer and relocation form and one vehicle transfer and relocation application form (Form No. 03 issued together with this Circular) along with the original vehicle file to process the vehicle registration at the destination location.
- Retain one transfer and relocation form, one vehicle transfer and relocation application form, notification, public posting, and verification results.
The Director of the General Administration of Public Order and Social Security Management under the Ministry of Public Security shall provide detailed guidance on issuing notices as stipulated in points a and b of this clause.
c) In cases of registration for transfer of vehicle from another province to the current province
The vehicle registration authority (at the place where the current vehicle user is registered) receives the application package, checks that all required procedures are complete, and inspects the actual vehicle to ensure it matches the transfer and relocation application package. Within two working days from the date of receipt of the complete and valid application package, the vehicle registration authority must complete the issuance of the license plate and vehicle registration certificate for the current vehicle user.
5. Responsibilities of the Current Vehicle User
a) Submit the vehicle registration transfer application form (Form No. 03 issued together with this Circular) and go to the police station at the place of permanent residence registration to obtain confirmation of the address of permanent residence registration. In cases where the person using the vehicle is a People's Public Security officer or a People's Army officer, obtain confirmation from their unit of employment along with a letter of introduction from the unit.
b) Pay the stamp duty at the tax authority.
c) Submit the vehicle registration file to the vehicle registration authority. If the vehicle has been registered in another province, the applicant must submit the file to the vehicle registration authority indicated on the vehicle registration certificate; after retrieving the original file, submit the vehicle registration file to the vehicle registration authority at the place of permanent residence registration.
6. Responsibilities of the Police Station at the Commune Level
a) Receive the vehicle registration transfer application form (Form No. 3 issued together with this Circular) submitted by the person using the vehicle, which includes a commitment to bear legal responsibility for the vehicle being processed for registration.
b) Verify and confirm the address of permanent residence registration of the person using the vehicle. After verification, if correct, confirm the address of permanent residence registration of the person using the vehicle. The processing time shall not exceed three working days.
Article 25. Resolution of Certain Specific Cases When Registering and Issuing Vehicle Registration Plates
1. Vehicles with a decision to sell at auction by an authorized agency
If the vehicle has a valid original file and proof of lawful ownership of the vehicle by the person whose property was processed, registration will be processed. If the origin of the vehicle is unclear or there is no proof of lawful ownership of the vehicle by the person whose property was processed, the application will not be accepted and the owner of the vehicle will be directed to the place that issued the auction decision for resolution.
a) Vehicles sold at auction by the Enforcement Agency to ensure enforcement of judgments, the file shall comply with the provisions of Article 7 of this Circular and include:
- Vehicle registration certificate (for vehicles already registered). If the vehicle registration cannot be retrieved, a confirmation letter from the Enforcement Agency is required.
- A copy of the court decision or a record of the judgment.
- Decision on enforcement of the civil enforcement agency with jurisdiction.
- Payment receipt or asset handover record.
b) Vehicles pledged by banks sold at auction to recover debts: The file shall comply with the provisions of Article 7 of this Circular.
In cases of disputed vehicles, litigation, or assets subject to enforcement, additional documents such as a record of the judgment or a copy of the judgment or a copy of the court decision, enforcement decision of the enforcement agency, and include:
- Vehicle registration certificate (for vehicles already registered). If the vehicle registration certificate cannot be retrieved, a confirmation letter from the bank selling the asset is required (in lieu of the vehicle registration certificate).
- Copy of the credit agreement or guarantee contract (signed by the financial institution).
- Purchase and sale contract or asset transfer contract or receipt of asset or auction sale document (depending on the specific case).
- Payment receipt according to the regulations of the Ministry of Finance.
- For vehicles registered in another locality, an additional transfer application form and original file of the vehicle must be included.
c) Vehicles with a decision to seize and auction by an authorized agency to ensure payment of overdue taxes and fines according to the law in the customs field: The file shall comply with the provisions of Articles 8 and 9, Clause 2 of Article 10 of this Circular, and include:
- Proof of transfer of ownership of the vehicle; a copy of the administrative compulsory measure decision to seize and auction the asset, auction record of the county finance department or provincial auction center, and sales invoice according to the regulations of the Ministry of Finance.
- Declaration of the origin of imported motor vehicles (copy of Form 1 retained by the customs authority).
2. Vehicles of leasing companies registered at the address of the lessee's business headquarters.
a) The file shall comply with the provisions of Article 7 of this Circular.
b) A letter from the leasing company requesting registration at the residence or operational headquarters of the lessee.
3. Vehicles with similar structures.
a) The file shall comply with the provisions of Article 7 of this Circular.
b) For vehicles produced or self-modified before December 31, 2008, with incomplete origin documents, the vehicle owner must provide a commitment regarding the legitimate origin of the vehicle confirmed by local authorities, accompanied by a traffic inspection report certifying the vehicle meets safety and environmental protection standards (for tractors) or a certificate of technical quality and environmental protection (for disabled persons' vehicles).
4. Foreign leased special purpose vehicles.
a) The file shall comply with the provisions of Articles 8 and 9, Clause 2 of Article 10 of this Circular.
b) Lease agreement.
c) Goods declaration forms for import and export according to the regulations of the Ministry of Finance.
5. Vehicles from foreign aid projects handed over to Vietnam upon expiration.
a) The file shall comply with the provisions of Articles 8 and 9, Clause 2 of Article 10 of this Circular, and include the vehicle registration certificate; a document establishing state ownership of the vehicle (for central agencies, it is a document from the head of the ministry, for local agencies, it is a document from the provincial People's Committee Chairman); handover record of assets received from donors.
b) In cases where aid project vehicles expire and need to be sold, a decision on asset disposal by the competent authority is required.
6. Vehicles registered under this project transferred to another project for continued use.
a) The file shall comply with the provisions of Articles 8 and 9, Clause 2 of Article 10 of this Circular, and include the vehicle registration certificate.
b) Transfer document of the foreign project owner.
c) Confirmation letter of aid goods from the Department of Debt Management and Foreign Financial Affairs - Ministry of Finance.
7. Non-reimbursable aid and humanitarian aid vehicles can be transferred and moved according to the provisions of this Circular.
8. Vehicles registered now have a decision to handle assets by authorized agencies recovered from terminated projects and other state assets.
a) The file shall comply with the provisions of Articles 8 and 9, Clause 2 of Article 10 of this Circular, and include the vehicle registration certificate.
b) Decision on the handling of assets from the competent authority.
c) Sales invoice for state assets issued by the Ministry of Finance when handling assets through sale or liquidation; handover record in cases of asset handling through reallocation.
9. Vehicles registered by dissolved enterprises now liquidating assets.
a) The file shall comply with the provisions of Articles 8 and 9, Clause 2 of Article 10 of this Circular, and include the vehicle registration certificate.
b) Dissolution decision by the competent authority.
c) Proof of transfer of ownership of the vehicle by the organization or individual authorized to resolve the assets according to regulations.
10. Vehicles that have been registered and are now involved in accidents, shall be recovered by insurance agencies and compensated at 100%.
a) The file shall comply with the provisions of Articles 8 and 9, Clause 2 of Article 10 of this Circular, and include the vehicle registration certificate.
b) The vehicle handover certificate from the owner and the registration certificate.
c) Compensation document.
d) Insurance sales invoice to the customer.
11. Registration and management of vehicles of military enterprises engaged in economic activities and military vehicles performing defense tasks requiring civilian license plates shall be implemented in accordance with the provisions of Circular Joint Circular No. 16/2004/TTLT-BCA-BQP dated November 1, 2004 issued by the Ministry of Public Security and the Ministry of National Defense.
12. Vehicle missing registration files.
a) Present the owner's documents as stipulated in Article 9 of this Circular.
b) Certified copies of all documents in the vehicle file (as stipulated in Article 10 of this Circular) with confirmation from the issuing authority.
In cases where the vehicle is produced or assembled domestically, the production facility must issue a new Quality Inspection Certificate for Factory Release (the registration file must be complete as stipulated in Article 7 of this Circular). After thirty days, if no violations or disputes are found, the vehicle registration will be processed.
13. Vehicles that are jointly owned by spouses
a) If the owner voluntarily declares the vehicle as jointly owned property of the couple, both spouses' full names and signatures must be recorded on the registration application form; in cases where the jointly owned vehicle was previously registered under one person's name and now requires re-registration as jointly owned property of the couple, the application form must include signatures of both spouses; the registration agency will collect the old registration certificate and issue a new one.
b) When jointly owned vehicles are sold, given, or gifted, all owners' signatures or a power of attorney for sale from each owner must be present.
14. In cases of modified vehicles.
a) Registration of passenger cars converted from other types of cars or specialized vehicles changing their function before five years (for imported vehicles, three years before conversion).
b) It is not allowed to use engine assemblies or chassis assemblies to replace parts for other vehicles that have exceeded their service life according to the law, tax-exempt vehicles; temporarily imported and re-exported vehicles of diplomatic missions, consular offices, international organization representative offices enjoying diplomatic immunity or consular immunity.
15. For vehicles confiscated and incorporated into state funds, there is no need for original files, but there must be a confiscation decision or a decision to handle evidence as confiscated vehicles (originals provided for each vehicle), which must clearly specify the characteristics of the vehicle such as: Brand, type, model number, frame number, engine number; if these details are not fully recorded, registration will not be accepted.
16. Regarding invoices.
a) For vehicles sold through multiple organizations, agencies, or businesses, only the original invoice issued by the State Treasury Department of the final selling organization, agency, or business is required when registering; if multiple vehicles share one invoice, each vehicle must have its own copy of the invoice, certified, authenticated, or confirmed as valid.
b) Vehicles of businesses or trading establishments must have value-added tax invoices, sales invoices, or self-printed invoices as prescribed by law; in cases of purchasing liquidated assets from administrative or public service agencies, a sales invoice for state assets must be provided; in cases of purchasing national reserve assets, a sales invoice for national reserve assets must be provided; in cases of vehicles confiscated and incorporated into state funds, a sales invoice for confiscated assets incorporated into state funds (originals or certified copies) must be provided.
c) In cases where organizations or individuals contribute capital to a business with motor vehicles and the contribution documents are minutes of the capital contribution certification or asset transfer minutes, when withdrawing capital, an invoice is not required, but sufficient documents proving that the vehicle is withdrawn capital from the business must be provided, such as: Minutes of withdrawal of capital in the form of motor vehicles, asset transfer minutes; in cases where capital is contributed to a business and the contribution documents include value-added tax invoices and the company has declared VAT deductions, when withdrawing capital, the business must issue a value-added tax invoice.
17. For vehicles that have been registered as collateral when transferring ownership, moving, changing, or reissuing the registration certificate, a copy of the certificate of lien release or a discharge document or a consent document from the lienholder must be provided.
Article 26. Issuing control insignia for automobiles bearing special economic zone license plates or international border economic zone license plates for operation within domestic territory in accordance with the Government's regulations.
1. Procedures and documents
a) Identity card or passport (still valid) or other documents that can substitute for a passport.
b) Certificate of registration for vehicles bearing special economic zone or international border economic zone license plates as prescribed by the Government.
c) Vehicle import declaration form.
2. The authority responsible for issuing control stickers (Traffic Police Department) shall check and compare against the list of managed vehicles, record in the tracking book, and issue control stickers on the same day.
3. Control stickers shall not exceed a validity period of 30 days from the date of issuance. The sticker shall be affixed in the upper right corner inside the front windshield of the vehicle.
4. The control sticker issuance certificate and the tracking book for automobiles operating domestically in Vietnam must be numbered sequentially from 01 to the end, bound into volumes, and managed according to the file system of the Ministry of Public Security.
Chapter IV
MANAGEMENT OF RECORDS, FORMS, LICENSE PLATES AND AUTHORITY TO SIGN DOCUMENTS
Article 27. Forms used in vehicle registration
The following forms are hereby issued along with this Circular:
1. Vehicle sale, gift, transfer notification form (Form No. 01).
2. Vehicle registration application form (Form No. 02).
3. Vehicle name change, relocation application form (Form No. 03).
4. Vehicle name change, relocation declaration form (Form No. 04).
5. Vehicle registration certificate and license plate recovery declaration form (Form No. 05).
6. Vehicle registration certificate and license plate recovery confirmation form (Form No. 06).
7. Vehicle control insignia issuance form (Form No. 07).
8. Special Economic Zone Temporary Entry and Re-export Motor Vehicle Tracking Book (Form No. 08).
9. Motorcycle and motorbike registration certificate (Form No. 09).
10. Automobile registration certificate (Form No. 10).
11. Trailer and semi-trailer registration certificate (Form No. 11).
12. Temporary vehicle registration certificate (Form No. 12).
13. Tractor registration certificate (Form No. 13).
14. Special Economic Zone motorcycle and motorbike registration certificate for use in special economic zones or international border economic zones as prescribed by the Government (Form No. 14).
15. Special Economic Zone automobile registration certificate for use in special economic zones or international border economic zones as prescribed by the Government (Form No. 15).
16. Special Economic Zone trailer and semi-trailer registration certificate for use in special economic zones or international border economic zones as prescribed by the Government (Form No. 16).
Vehicles with a similar structure to a certain type of vehicle shall use the registration certificate form of that type of vehicle.
Article 28. Management of vehicle records
Vehicle registration files shall be managed according to the file management system of the Ministry of Public Security. Vehicle information data shall be uniformly managed on computer systems. Monthly, the registration authority shall report vehicle registration and management data to the Highway Police Traffic Corps for monitoring and management.
Article 29. Validity period of vehicle registration certificates
1. The vehicle registration certificate for foreign nationals working in diplomatic missions, consular offices, or international organization representative offices shall be recorded according to the validity period indicated on their diplomatic identification cards or service identification cards; for temporarily imported vehicles of ODA experts or overseas Vietnamese invited back to work, it shall be recorded according to the duration of their work in Vietnam.
2. The vehicle registration certificate for diplomatic missions, consular offices, or international organization representative offices shall be initially recorded for five years and may be extended for three years each time.
3. The vehicle registration certificate (including vehicles produced or assembled based on similar structures or pilot vehicles) for organizations or individuals shall be recorded according to the vehicle's usage lifespan as stipulated by law.
Article 30. Determination of the year of manufacture of vehicles
For imported vehicles and those manufactured or assembled from chassis or complete imported automobiles, the vehicle owner must present the quality certification (or notification of exemption from quality inspection) for mechanical safety and environmental protection issued by the Vietnam Vehicle Inspection Center to determine the year of manufacture of the vehicle; for other cases, the year of manufacture is determined according to the tenth character of the vehicle frame number in accordance with current standards. The Highway Police Traffic Corps is responsible for coordinating with the Vietnam Vehicle Inspection Center to copy and send current standard regulations to the registration authorities for determining the year of manufacture.
Article 31. Provisions on Vehicle Registration Plates
1. Regarding the material of registration plates: Vehicle registration plates shall be produced from metal with reflective paint and security symbols; for temporary registration plates, they shall be printed on paper.
2. The symbols, size of letters and numbers on various types of vehicle registration plates shall comply with the provisions set out in Appendices No. 02, 03, and 04 attached to this Circular.
3. Passenger car registration plates consist of two plates, with the following dimensions: The long type plate has a height of 110 mm and a length of 470 mm; the short type plate has a height of 200 mm and a length of 280 mm. One plate is attached to the front and one plate is attached to the rear of the vehicle, in accordance with the design location for attaching the plates. In cases where the vehicle design does not allow for one short plate and one long plate, two long plates or two short plates may be installed instead, with the additional costs borne by the vehicle owner.
a) Arrangement of letters and numbers on domestic vehicle registration plates: The first two digits are the registration area code, followed by the registration series (letters); the second group of numbers consists of five natural numbers from 000.01 to 999.99.
b) Arrangement of letters and numbers on foreign passenger car registration plates: The first two digits are the registration area code, followed by the country or international organization code consisting of three natural numbers, and the third group is the series indicating the category of foreign organizations or individuals, while the fourth group consists of two natural numbers from 01 to 99.
c) Trailer and semi-trailer registration plates consist of one plate attached to the rear of the vehicle, with dimensions: Height of 200 mm and length of 280 mm; the arrangement of letters and numbers on the plate follows the same pattern as domestic passenger car registration plates.
4. Motorcycle registration plates consist of one plate attached to the rear of the vehicle, with dimensions: Height of 140 mm and length of 190 mm. The first group of numbers includes the registration area code and series, and the second group consists of five natural numbers from 000.01 to 999.99. For foreign motorcycles, the first group includes the registration area code, the second group includes the country code of the owner, the third group includes the series, and the fourth group consists of three natural numbers from 001 to 999.
5. Tractor and electric motorcycle registration plates consist of one plate attached to the rear of the vehicle, with dimensions: Height of 140 mm and length of 190 mm. The first group of numbers includes the registration area code and series, and the second group consists of five natural numbers from 000.01 to 999.99.
6. Registration plates of domestic agencies and organizations
a) Blue background, white letters and numbers, using the following series of 20 letters in sequence: A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z for vehicles of Party agencies; Office of the President; Office of the National Assembly and National Assembly agencies; Office of Delegations of the National Assembly, People's Councils at all levels; Central Steering Committees; Public Security, Courts, Procuratorates; Ministries, agencies equivalent to ministries, government agencies; National Traffic Safety Committee; People's Committees at all levels and specialized agencies under provincial and district People's Committees; political-social organizations; public service units, except for state-owned driving test centers; Project Management Boards with state management functions.
b) Blue background, white letters and numbers with "CD" symbol for special-purpose motorcycles of the Public Security force used for security purposes.
c) White background, black letters and numbers, using the following series of 20 letters in sequence: A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z for vehicles of enterprises, project management boards under enterprises, social organizations, social-professional organizations, non-state public service units, state-owned driving test centers, and individual vehicles.
d) Yellow background, red letters and numbers, with the registration area code and two-letter abbreviation of special economic zones or border gates granted to vehicles of special economic zones or international border gates according to the Government's regulations.
đ) Some cases have their own series symbols:
- Registration plates with "KT" symbol for military vehicles engaged in economic activities.
- Registration plates with "LD" symbol for vehicles of foreign-invested enterprises, leased foreign vehicles, and foreign companies that won bids.
- Registration plates with "DA" symbol for project management boards funded by foreign investments.
- Registration plates with "R" symbol for trailers and semi-trailers.
- Registration plates with "T" symbol for temporary registration.
- Registration plates with "MK" symbol for tractors.
- Registration plates with "MĐ" symbol for electric motorcycles.
- Registration plates with "TĐ" symbol for domestically produced and assembled motor vehicles approved by the Prime Minister for pilot implementation.
- Registration plates with "HC" symbol for passenger cars with limited operating range.
Vehicles with a structure similar to a certain type of vehicle shall be issued registration plates corresponding to that type.
7. License plates for vehicles of foreign agencies, organizations, and individuals
a) White background, black numbers, with the series symbol "NG" in red for vehicles of diplomatic missions, consular offices, and foreign nationals holding diplomatic identification cards from those offices. For the registration plates of Ambassadors and Consuls General, the registration number is 01 and a red line crosses the middle of the digits indicating nationality and registration number.
b) White background, black numbers, with the series symbol "QT" in red for vehicles of international organization missions and foreign nationals holding diplomatic identification cards from those organizations. For the registration plates of heads of United Nations agency missions, a red line crosses the middle of the digits indicating the international organization's vehicle code and registration number.
c) White background, black letters and numbers, with the series symbol "CV" for vehicles of administrative and technical staff holding service identification cards from diplomatic missions, consular offices, and international organizations.
d) White background, black letters and numbers, with the symbol "NN" for vehicles of foreign organizations, representative offices, and individuals (excluding the subjects specified in points a, b, and c above).
8. The production and supply of vehicle license plates shall be carried out upon the request of the vehicle registration authority. Production facilities for license plates, local public security agencies that have invested in production lines for vehicle license plates and have been inspected and accepted by the General Department of Administration of Public Order and Traffic Safety under the Ministry of Public Security to meet the prescribed standards shall be permitted to produce vehicle license plates. License plates must be strictly managed according to the prescribed regulations.
9. The issuance of series of vehicle license plates by local public security agencies must be conducted sequentially according to the numerical order of license plate symbols from low to high and must exhaustively use twenty series before switching to a new symbol. The issuance of a new series of license plates at the local level can only be carried out after obtaining written approval from the Highway Police Corps.
Article 32. Regulations on marking license plates and characters on the body and doors of automobiles
For various types of automobiles (excluding automobiles with nine seats or fewer), the vehicle owners must comply with the following regulations:
1. Mark the license plate on the rear panel and both sides of the vehicle body.
2. Mark the name of the organization/unit and the load capacity/gross weight on both sides of the car doors (except for personal vehicles).
Article 33. Authority to sign various types of documents
1. The Director of the Highway Police Corps signs the vehicle registration certificate and related documents concerning the registration and management of vehicles registered at the Highway Police Corps.
2. The Head of the Traffic Police Department signs the vehicle registration certificate and related documents concerning the registration and management of vehicles directly registered by the Traffic Police Department.
3. The Head of the County-level Public Security Agency signs the vehicle registration certificate and related documents concerning the registration and management of vehicles directly registered by the County-level Public Security Agency.
Chapter V
IMPLEMENTATION
Article 34. Effective Date
This Circular takes effect from June 1, 2014, and replaces the following Circulars:
a) Circular No. 36/2010/TT-BCA dated October 12, 2010, issued by the Minister of Public Security regarding vehicle registration.
b) Circular No. 75/2011/TT-BCA dated November 17, 2011, issued by the Minister of Public Security amending and supplementing Point 3.1.7 Clause 3 Article 7 of Circular No. 36/2010/TT-BCA regarding vehicle registration.
c) Circular No. 12/2013/TT-BCA dated March 1, 2013, issued by the Minister of Public Security amending and supplementing Clause 3 Article 20 of Circular No. 36/2010/TT-BCA dated October 12, 2013, regarding vehicle registration.
2. Motor vehicles, tractors, trailers, or semi-trailers towed by motor vehicles or tractors that have transferred ownership multiple times will be processed for transfer registration according to the provisions of Article 24 of this Circular until December 31, 2014.
3. Two-wheeled motorcycles, three-wheeled motorcycles, motorbikes (including electric motorcycles), and similar vehicles that have transferred ownership multiple times will be processed for transfer registration according to the provisions of Article 24 of this Circular until December 31, 2016.
4. The model of the motorcycle and motorbike registration certificate (Model No. 08, Model No. 13) issued together with Circular No. 36/2010/TT-BCA dated October 12, 2010, issued by the Minister of Public Security regarding vehicle registration; the model of the application form for transfer registration and relocation issued together with Circular No. 12/2013/TT-BCA dated March 1, 2013, issued by the Minister of Public Security amending and supplementing Clause 3 Article 20 of Circular No. 36/2010/TT-BCA, which has already been printed, may continue to be used until December 31, 2014.
Article 35. Responsibility for Implementation
1. The Director of the General Department of Administration of Public Order and Traffic Safety is responsible for directing, inspecting, and guiding public security units and localities in implementing this Circular.
2. The Directors of the General Departments, heads of units subordinate to the Ministry of Public Security, the Director of the Highway Police Corps, the Directors of Provincial Public Security Departments, centrally-administered city public security departments, and the Directors of Provincial Fire Prevention and Fighting Departments, centrally-administered city fire prevention and fighting departments are responsible for implementing this Circular.
During the implementation of this Circular, if any difficulties arise, public security units and localities shall report them to the Ministry of Public Security (through the General Department of Administration of Public Order and Traffic Safety) for timely guidance./.
