Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decision No. 62/2013/QD-TTg dated October 25, 2013 of the Government on policies to encourage the development of cooperation and linkage in production linked with agricultural product consumption and building large fields;
At the request of the Director of the Department of Cooperative Economy and Rural Development,
The Minister of Agriculture and Rural Development issues this Circular guiding the implementation of certain provisions of Decision No. 62/2013/QD-TTg dated October 25, 2013 of the Government on policies to encourage the development of cooperation and linkage in production linked with agricultural product consumption and building large fields.
Article 1. Scope of Regulation and Applicability

This Circular sets out criteria for large fields; guides planning and organizing the implementation of concentrated agricultural production areas according to the model of large fields in the field of crop cultivation.

a) Enterprises have contracts for cooperation and linkage in production linked with processing and consumption of agricultural products and building large fields with cooperatives, cooperative unions (referred to collectively as organizations representing farmers) or households, individuals, farms (referred to collectively as farmers).
b) Organizations representing farmers have contracts for cooperation and linkage in production linked with processing and consumption of agricultural products and building large fields with enterprises or farmers.
c) Farmers participate in contracts for cooperation and linkage in production linked with processing and consumption of agricultural products and building large fields with enterprises or organizations representing farmers.
Article 2. Interpretation of Terms
1. A Project or Plan for a Large Field is a project or plan for developing cooperation and linkage in production linked with agricultural product consumption and building large fields established by enterprises or organizations representing farmers and approved by competent authorities.
2. A Contract for Production and Consumption Linkage is a contract for cooperation and linkage in production linked with agricultural product consumption and building large fields (hereinafter referred to as a contract for production and consumption linkage) signed between enterprises and organizations representing farmers or farmers; between organizations representing farmers and farmers.
Article 3. Criteria for Large Fields
Approval and approval of Projects or Plans for Large Fields must meet the following criteria:
1. Mandatory Criteria
a) Consistent with local planning regarding: Economic and social development; land use; overall development of the agricultural industry; new rural areas and other plans.
b) Application of a unified production process agreed upon by all parties involved in the linkage, suitable for the type of crop and ensuring sustainable development.
c) Having at least one of the following forms of production and consumption linkage through contracts:
- Linkage between consumption enterprises - supply enterprises with organizations representing farmers or farmers;
- Production linkage between enterprises and farmers;
- Production linkage between enterprises and organizations representing farmers;
- Production linkage between organizations representing farmers and farmers.

d) Scale of area of large fields:
The People's Committee of provinces and centrally governed cities (hereinafter referred to collectively as the Provincial People's Committee) based on local conditions shall stipulate the minimum scale of area for Projects or Plans for Large Fields that are appropriate to specific conditions and each type of agricultural product, forming raw material zones.
2. Encouraging Criteria
a) Having economic infrastructure such as internal field transportation systems, irrigation, electricity, and other facilities serving production that meet the requirements of production and consumption of products and gradually improve towards centralized commodity production;
b) Large-scale concentration and application of comprehensive mechanization; advanced technology (production according to safety standards, VietGAP, GlobalGAP...) and having procurement, storage, and processing facilities for agricultural products near the production site;
c) Other criteria as specified by the Provincial People's Committee if deemed necessary.
Article 4. Guidelines for the Planning or Plan of Large Fields
Depending on specific conditions of each locality, choose to build either a Planning or a Plan of Large Fields as the basis for approving Projects or Schemes of Large Fields in the locality.
1. Basis for Building the Planning or Plan of Large Fields
a) Land use planning and plans at all levels that have been approved;
b) Agricultural production development planning (including: The overall agricultural production development planning until 2020 and vision 2030 according to Decision No. 124/2012/QD-TTg dated February 2, 2012 of the Prime Minister; other local planning approved by competent authorities);
d) Criteria for the scale of large fields as stipulated in Article 3 of this Circular;
đ) Local advantages, market demand forecasts for the type of product expected to be produced, and socio-economic development orientation in the locality;
e) Requirements for building large fields from enterprises and organizations representing farmers.
2. Implementation Time for the Planning or Plan of Large Fields
The Planning or Plan of Large Fields must be stable for a minimum of 10 years; regular inspections, evaluations, and adjustments shall be conducted.
3. Procedures for Building, Reviewing, and Approving the Planning or Plan of Large Fields
a) Procedures for building, reviewing, and approving the Planning of Large Fields: Implemented according to Circular No. 05/2013/TT-BKHĐT dated October 31, 2013 of the Ministry of Planning and Investment guiding the organization of preparation, review, approval, adjustment, and announcement of overall socio-economic development planning; industry, sector, and key product planning;
b) Procedures for building, reviewing, and approving the Plan of Large Fields
- The provincial People's Committee assigns the Department of Agriculture and Rural Development to lead the construction of the provincial Plan of Large Fields;
- The Department of Agriculture and Rural Development leads and collaborates with relevant departments, industries, and district People's Committees (hereinafter referred to collectively as district-level People's Committees) to construct the Plan of Large Fields and submit it to the provincial People's Committee;
- The provincial People's Committee establishes a review board to approve and announce the Plan of Large Fields.
Article 5. Provisions on Building Projects or Schemes of Large Fields
Depending on specific conditions of each locality, enterprises or organizations representing farmers may choose to build either a Project or a Scheme of Large Fields.
1. Approval of the Initiative
Enterprises or organizations representing farmers who wish to participate in linkage within large fields, submit a proposal to build a Project or Scheme of Large Fields to the Department of Agriculture and Rural Development for approval (application form according to Appendix 2).
After receiving the proposal, the Department of Agriculture and Rural Development leads and collaborates with relevant departments, industries, and district-level People's Committees to examine and respond in writing within 15 working days from the date of receipt. In case of non-approval, the reasons must be clearly stated.
2. Construction of Projects or Schemes of Large Fields
Based on the approval opinion of the Department of Agriculture and Rural Development, enterprises or organizations representing farmers construct Projects or Schemes of Large Fields (project or scheme model according to Appendix 3).
The implementation plan for preferential and support measures specified in Point c Clause 2 Article 4 and Point b Clause 2 Article 5 of Decision No. 62/2013/QĐ-TTg must be reflected in the Project or Scheme of Large Fields built by enterprises or organizations representing farmers.
3. Application Documents for Review and Approval
a) Application for approval of Projects or Schemes of Large Fields (application form according to Appendix 4);
b) Projects or Schemes of Large Fields;
c) Business license in accordance with laws on business activities with conditions (certified copy);
d) Information on the capacity to consume agricultural products of enterprises or organizations representing farmers calculated based on the average domestic consumption or export volume of agricultural products over the last three years; or processing and storage capacity calculated based on the current warehouse, factory, and equipment capacity for processing. These information are self-reported by enterprises or organizations representing farmers and they bear legal responsibility for the accuracy of the information.
4. Review and Approval Procedures
a) After being approved for the initiative, enterprises or organizations representing farmers submit Projects or Schemes of Large Fields to the Department of Agriculture and Rural Development with at least seven sets of documents for review;
b) Within three working days from the date of receiving documents via postal service or immediately if received directly, the Department of Agriculture and Rural Development is responsible for checking the completeness and validity of the documents and requesting the submitting unit to complete the documents if they are incomplete;
c) At the latest fifteen working days from the date of receiving valid documents, the Department of Agriculture and Rural Development leads and collaborates with relevant departments, sectors, and district-level People's Committees to review and submit to the provincial People's Committee for approval of Projects or Schemes of Large Fields;
If the Project or Scheme is not approved, the provincial People's Committee instructs the Department of Agriculture and Rural Development to notify the enterprise or organization representing farmers in writing, stating the reasons.
5. Implementation Time
The implementation time for Projects or Schemes of Large Fields must ensure a timeline of five years for annual crops and seven years for perennial crops.
6. Construction Schedule for Raw Material Demand
To ensure compliance with the raw material area regulations stipulated in Point b Clause 2 Article 4 of Decision No. 62/2013/QĐ-TTg, Projects or Schemes of Large Fields must follow the minimum construction schedule specified in Point b Clause 6 of this Article and calculated as follows:
a) Formula for calculating the ratio of raw material demand fulfillment (according to Appendix 5).

c) Annually, enterprises and farmer representative organizations shall develop a raw material region roadmap to report to the Department of Agriculture and Rural Development.
7. Implementing the Project or Large Field Scheme
Based on the approved Project or Large Field Scheme, enterprises and farmer representative organizations shall annually develop implementation plans and detailed budgets to send to the Department of Agriculture and Rural Development for consolidation and submission to the provincial People's Committee for approval.
8. Adjustments, supplements, and extension of the implementation time for the Project or Large Field Scheme
Enterprises or farmer representative organizations that need to adjust, supplement, or extend the implementation time of the Project or Large Field Scheme shall submit a request along with the supplementary Project or Scheme to the Department of Agriculture and Rural Development.
The review and approval of adjustments, supplements, and extensions of the implementation time for the Project or Large Field Scheme shall be carried out according to the provisions of Points b and c Clause 4 of this Article.
Article 6. Support Provisions for Farmers
The People's Committee at the commune level, based on contracts and acceptance certificates for joint production and consumption agreements signed between enterprises or farmer representative organizations and farmers within the framework of projects or large field schemes implemented in the commune, shall confirm the fulfillment of contracts by farmers to serve as the basis for considering farmers' eligibility for benefits and support under Clause 2 of Article 6 of Decision No. 62/2013/QD-TTg.
The People's Committee at the district level, based on confirmation of contract fulfillment, shall implement preferential treatment and support for farming households in accordance with current laws.
Article 7. Implementation Organization
1. Directorate of Cooperative Economy and Rural Development
a) Taking the lead and coordinating with relevant units to assist the Ministry of Agriculture and Rural Development in directing, monitoring, and guiding the implementation of this Circular;
b) Inspecting, supervising, summarizing, and evaluating the implementation of Decision No. 62/2013/QD-TTg periodically, and reporting to the Minister of Agriculture and Rural Development.
2. Directorate of Crop Production
Taking the lead and coordinating with the Plant Protection Directorate, the Directorate of Processing of Forestry, Aquaculture, and Salt Industry, and related agencies under the Ministry to guide the application of integrated production processes and advanced technologies.
3. National Agricultural Extension Center
Integrating agricultural extension projects to build and expand models of collaboration, providing technical guidance and participating in training for farmers, directing provincial agricultural extension centers to support technical staff in assisting participating units in building large fields.
4. Department of Agriculture and Rural Development
a) Depending on the needs for developing large fields in each locality, the Department of Agriculture and Rural Development shall advise the provincial People's Committee to consider and decide on establishing a Steering Committee or Management Board for large field construction headed by a Deputy Chairman of the provincial People's Committee or integrated with other provincial steering committees to assist the provincial People's Committee in directing and organizing the implementation of planning and policies for large fields in the locality;
b) Advising the provincial People's Committee to issue criteria for minimum area size and other criteria for large fields and specific levels of support from the locality for large field construction;
c) Carrying out tasks stipulated in Clause 3 of Article 4 and Article 5 of this Circular;
d) Taking the lead and coordinating with the Department of Planning and Investment, the Department of Finance to advise the provincial People's Committee on preparing annual budget plans to support enterprises, farmer representative organizations, and farmers participating in large fields for submission to the provincial People's Council for approval;
đ) Guiding, inspecting, supervising, and urging the implementation of Projects or Large Field Schemes and reporting results as prescribed;
e) Advising the provincial People's Committee to handle disputes and violations during the implementation of contracts between parties involved in collaboration; reviewing and deciding or recommending competent authorities to recover state support and preferences for parties violating production-linked sales contracts;
g) Advising the provincial People's Committee to direct relevant agencies and local authorities to encourage land consolidation and reallocation; guiding and advising parties involved in collaboration to implement Projects or Large Field Schemes.
Article 7. Effective Date
This Circular takes effect from June 15, 2014.
During the process of implementation, if there are emerging issues or difficulties, localities should reflect them to the Ministry of Agriculture and Rural Development for timely supplementation and amendment./.
