BASED ON THE CINEMA LAW ON JUNE 29, 2006, THE AMENDMENT AND SUPPLEMENTATION LAW TO SOME PROVISIONS OF THE CINEMA LAW ON JUNE 18, 2009; Article of the Cinema Law on June 18, 2009;

Article 2. THESE REGULATIONS SET OUT THE ORGANIZATION AND OPERATIONS OF THE SCREENWRITING LITERATURE REVIEW BOARD FOR FILMS USING STATE BUDGET FUNDS.

IS ANY MINISTRY, GOVERNMENT-LEVEL AGENCY, GOVERNMENT AGENCY, POLITICAL ORGANIZATION, POLITICAL-SOCIETAL ORGANIZATION AT THE CENTRAL LEVEL, LOCAL LEVEL, AND THE PEOPLE'S COMMITTEE OF PROVINCES AND MUNICIPALITIES DIRECTLY UNDER THE CENTRAL GOVERNMENT (HEREINAFTER REFERRED TO AS THE PROVINCE-LEVEL PEOPLE'S COMMITTEE) THAT USES STATE BUDGET FUNDS TO PRODUCE FILMS.THE AGENCY MANAGING THE PROJECT FOR THE PRODUCTION OF FILMS USING STATE BUDGET FUNDS (HEREINAFTER REFERRED TO AS THE PROJECT MANAGEMENT AGENCY)

 

 

 

 

 

REGULATIONS

IS THE AGENCY ASSISTING THE PROJECT INVESTOR IN THE PRODUCTION OF FILMS, SPECIFICALLY AS FOLLOWS:
(Annexed to Circular No. 15/201a) THE PROJECT MANAGEMENT AGENCY UNDER ANY MINISTRY, GOVERNMENT-LEVEL AGENCY, GOVERNMENT AGENCY, POLITICAL ORGANIZATION, POLITICAL-SOCIETAL ORGANIZATION, AND OTHER ORGANIZATIONS AT THE CENTRAL LEVEL AND LOCAL LEVEL NOT COVERED BY POINTS b AND c OF SUBARTICLE 2 OF THIS ARTICLE IS A UNIT DIRECTLY UNDER THE PROJECT INVESTOR;b) THE PROJECT MANAGEMENT AGENCY OF THE PROVINCE-LEVEL PEOPLE'S COMMITTEE IS THE DEPARTMENT OF CULTURE, SPORTS AND TOURISM OR THE DEPARTMENT OF CULTURE AND SPORTS;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

c) THE PROJECT MANAGEMENT AGENCY OF THE MINISTRY OF CULTURE, SPORTS AND TOURISM IS THE NATIONAL CINEMA AGENCY.

Article 2. Applicability

This Regulation applies to organizations and individuals related to the review of literary scripts for films using state budget funds.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. The investor of the film production project using state budget funds (hereinafter referred to as the Investor) are ministries, ministerial-level agencies, government agencies, political organizations, political-social organizations at the central and local levels, and People's Committees of provinces and centrally governed cities (hereinafter referred to as provincial People's Committees) that use state budget funds to produce films.

2. Agency, unit managing reason film production project usingstate budget funds (hereinafter referred to as the managing agency) reason project) is the agency or unit assisting the investor in the film production project, specifically as follows:

a) The project management agency under ministries, ministerial-level agencies, government agencies, political organizations, political-social organizations, and other organizations at the central and local levels not falling within the provisions of points b and c, Clause 2 of this Article is a unit directly subordinate to the project investor;

b) The project management agency of the provincial People's Committee is the Department of Culture, Sports and Tourism or the Department of Culture and Sports;

c) The project management agency of the Ministry of Culture, Sports and Tourism is the Cinema Department.

Article 4. Authority of the Project Investor

The Project Investor decides to establish the Film Literary Script Review Board for films using state budget funds, including:

1. The Feature Film Script Review Board;

2. The Documentary, Scientific, and Animation Film Script Review Board.

Article 5. Responsibilities of the Project Management Agency

1. Advising and assisting the Project Investor in establishing the Film Literary Script Review Board, serving as the permanent body of the Film Literary Script Review Board for films using state budget funds (hereinafter referred to as the Board).

2. Organizing and ensuring necessary conditions for the Board's operation.

3. Sending the script for review (accompanied by the Script Review Form for films using state budget funds) to Board members at least ten working days before the Board convenes.

4. Appointing staff to serve as the Board's secretary.

5. Drafting and signing the Script Evaluation Document based on the opinions of the Board members' script reviews.

6. Submitting the Script Evaluation Document and other relevant documents (if any) to the Project Investor for approval to produce films using state budget funds.

Chapter II

ORGANIZATION AND OPERATIONS OF THE BOARD

Article 6. Functions, Tasks, and Organizational Structure of the Board

1. Functions and Tasks of the Council

The Board, established by the Project Investor pursuant to Article 4 of this Regulation, performs advisory functions for the Project Investor in literary script reviews according to Clause 4, Article 1 of the Law Amending and Supplementing Certain Provisions of the Cinema Law No. 31/2009/QH12 dated June 18, 2009.

2. Organizational Structure and Composition of the Council

a) Organizational Structure:

The Board consists of nine to eleven members, including the Chairperson, Vice-Chairpersons, and members.

b) Composition of the Council:

- The Board includes: representatives of state management agencies with authority over cinema; the Project Investor; the Project Management Agency; experienced and reputable film screenwriters, directors, and film theory critics; and other positions.

- In cases where necessary, the Chairperson may invite additional experts for consultation after reaching agreement with the head of the Project Management Agency.

3. Term of Office of the Board:

The term of operation of the Board is two years.

Article 7. Principles and Working Methods of the Board

1. The Board operates under the principle of collective discussion to democratically assess and classify the quality of scripts.

2. The Chairperson presides over all Board script review sessions. In the absence of the Chairperson, one Vice-Chairperson is authorized to preside.

3. The timing of Board meetings is determined based on the production project requirements for the year and the actual number of scripts for review. The Board convenes annually at least once to evaluate its activities and draw lessons.

4. At least two-thirds of the total number of Board members must attend each meeting; absent members must submit their Review Forms as stipulated in Clause 3, Article 8 of this Regulation. The Board's conclusions must be approved by at least two-thirds of the total number of member reviews, and recorded in the Meeting Minutes.

5. The opinions and Review Forms of Board members must be recorded and compiled for the Project Management Agency to draft the Script Evaluation Document.

Article 8. Responsibilities of Board Members

1. Board members have the right and responsibility to contribute opinions, comments, evaluations, and scores for scripts under review.

2. Board members are responsible for submitting their Review Forms to the Board Secretary at least one day before the Board convenes.

3. Board members are required to fully participate in all script review sessions; in case of absence, they must report to the Chairperson or Vice-Chairperson and submit their Review Forms to the Project Management Agency before the Board convenes.

4. Board members are not allowed to disclose the content of discussions and conclusions of the Board; the Chairperson is the spokesperson for the Board.

5. If a Board member is absent without a valid reason for three consecutive script review sessions, the Project Management Agency will propose to the Project Investor to remove them from their position.

Article 9. Criteria for evaluating and classifying scripts

1. Scripts are classified based on the average score given by the members of the Council:

a) A script classified at level I has an average score from 5 to 6.5 points;

b) A script classified at level II has an average score from over 6.5 to 8.5 points;

c) A script classified at level III has an average score from over 8.5 to 10 points.

2. Members of the Council are responsible for reviewing and evaluating each script under examination, recording their comments on the Examination Form, and scoring according to the following criteria:

a) A script classified at level I (for scores of 5; 5.5; 6.0; 6.5) includes the standard: meeting requirements regarding ideological content, having social significance but with artistic imagery not yet highly generalized; the script is incomplete in professional expertise, still containing occupational errors that can be corrected and improved to meet film production conditions;

b) A script classified at level II (for scores of 7.0; 7.5; 8.0; 8.5) includes the standard: having good ideological content, carrying humanistic value and high social worth; artistic expression is appropriate to the content, with a fairly high level of professional expertise, creating appeal for the work;

c) A script classified at level III (for scores of 9.0; 9.5; 10) includes the standard: having profound ideological content, high humanistic value, generalizing major societal issues, making unique discoveries about life and people; the script is written attractively, with distinctive and creative expression at a high level of professional expertise;

d) If a member's score differs by more than 2.0 points from the average score of the Council members, it will not be accepted.

2. If the script does not meet quality standards, the Council member records this on the Examination Form and scores below 5 points.

3. A script proposed by the Council for production must reach level II or level III. The author's remuneration for the script is paid according to the provisions of Articles 4, 5, and 6 of Decree No. 21/2015/NĐ-CP dated February 14, 2015 of the Government on remuneration for literary and artistic works, including films, fine arts, photography, theater, and other performing arts.

4. Based on the Council's conclusion (Minutes of the Council Meeting), Script Appraisal, the head of the project management agency reviews and submits to the project investor for a decision to allow film production.

5. Within 15 (fifteen) working days from the date of the Council's conclusion, the project management agency is responsible for sending the examination results to the organization or individual who submitted the script for examination.

Chapter III

FEES AND REMUNERATION FOR SCRIPT APPRAISAL

Article 10. Fees for script appraisal

Organizations and individuals submitting scripts for appraisal must pay fees according to the current regulations of the competent state management agency simultaneously with the submission of the script.

Article 11. Remuneration for script appraisal

1. Members of the Council present during the script appraisal session are entitled to remuneration according to the current system.

2. Members absent from the appraisal session but who submit the Examination Form are entitled to 70% of the remuneration of present members.

Chapter IV

COMPLAINTS AND COMPLAINT HANDLING

Article 12. Complaints

1. Organizations and individuals submitting scripts for appraisal have the right to file a complaint in writing if they disagree with the appraisal result.

2. The complaint must clearly state the reasons for disagreement with the appraisal result and be sent to the project management agency.

Article 13. Handling Complaints

The project management agency shall be responsible for handling complaints from organizations and individuals with appraisal scripts in accordance with the provisions of the law./.
