CIRCULAR
GUIDANCE ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF PROVINCE AND CITY TOURISM PROMOTION CENTERS UNDER THE CENTRAL GOVERNMENT
Pursuant to the Tourism Law dated June 19, 2017;
Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the central government;
Pursuant to Decree No. 107/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the central government;
Pursuant to Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government stipulating the establishment, restructuring, and dissolution of public service organizations;
Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering goods or services, or tendering for the provision of public products and services using state budget funds from regular expenditure;
Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

The Minister of Culture, Sports and Tourism issues this Circular guiding the functions, tasks, powers and organizational structure of province and city tourism promotion centers under the central government.
Article 1. Scope of Regulation and Applicability
1. This Circular guides the functions, tasks, powers and organizational structure of province and city tourism promotion centers under the central government (hereinafter referred to as provincial tourism promotion centers).
2. This Circular applies to provincial tourism promotion centers; agencies, organizations, and individuals establishing, managing, and related to the activities of provincial tourism promotion centers.
Article 2. Position and Functions
1. Provincial tourism promotion centers are public service units under the Department of Tourism or the Department of Culture, Sports and Tourism of provinces and centrally-administered cities with the function of promoting and introducing local tourism both domestically and internationally; developing and enhancing the local tourism brand; researching and directing market and product development; raising public awareness about tourism; seeking investment opportunities and resources for tourism development; providing public services and supporting state management in accordance with the law; participating in joint promotion and publicity of regional, inter-regional, and national tourism.
2. Provincial tourism promotion centers have legal personality, have headquarters, seals, and bank accounts in accordance with the law.
Article 3. Duties and Authorities
Provincial tourism promotion centers shall perform the following tasks and powers:
1. Developing, submitting to competent authorities for approval, and implementing short-term, long-term, and annual tourism promotion programs and plans of provincial tourism promotion centers; cooperating with professional departments under the Department of Tourism or the Department of Culture, Sports and Tourism to study and advise leadership on long-term, medium-term projects and plans, and development orientations of local tourism to be submitted to the provincial People's Committee;
2. Developing and enhancing the local tourism brand; building and promoting local tourism products; setting market development directions for local tourism;
3. Building, managing, using, and providing tourism promotion materials in digital form, printed versions, and other formats and methods;
4. Building, managing, using, and exploiting local tourism promotion databases;
5. Promoting and introducing local tourism, people, cultural heritage, historical and cultural relics, scenic spots, creative works of people, and local cultural identity both domestically and internationally;
6. Organizing and participating in provincial, inter-regional, national, and international tourism trade fairs, exhibitions, and events;
7. Conducting surveys, collecting data and documents, and investigating tourism resources and markets;
8. Providing information support for tourists and developing community-based tourism in the locality;
9. Supporting connections between tourism businesses and promotional events, attracting tourism investment, and business cooperation in domestic and foreign markets;
10. Implementing efforts to seek investment opportunities and resources for tourism development; diversifying and improving the quality of local tourism services;
11. Promoting and disseminating to raise public awareness about tourism, encouraging organizations and individuals to voluntarily and actively participate in maintaining civilized behavior in public places, environmental hygiene; ensuring security and safety in local tourism exploitation and development activities;
12. Protecting, restoring, and developing the value of local tourism resources;
13. Organizing and coordinating training and capacity building for tourism human resources in the locality;
14. Participating in environmental, science and technology, biodiversity, climate change response programs, projects, and tasks in the field of tourism in the locality;
15. Cooperating, exchanging, and networking with relevant organizations domestically and internationally to develop tourism in accordance with the law;
16. Managing the organizational structure, personnel, finance, assets, and facilities provided in accordance with the law;
17. Implementing statistical work and reporting in accordance with the law;
18. Performing other tasks assigned by the Director of the Department of Tourism or the Director of the Department of Culture, Sports and Tourism in accordance with the law.
Article 4. Organizational Structure
1. Leadership of provincial tourism promotion centers includes a Director and Deputy Directors as prescribed by law; the Director of the provincial tourism promotion center is responsible before the Director of the Department of Tourism or the Director of the Department of Culture, Sports and Tourism and before the law for all activities of the provincial tourism promotion center; Deputy Directors of the provincial tourism promotion center are responsible before the Director of the provincial tourism promotion center and before the law for the areas of work they are assigned.
2. Professional and technical organizations:
Provincial tourism promotion centers have administrative, general, internal management, support service departments, and specialized and technical departments to implement the tasks prescribed in Article 3 of this Circular.
Based on their functions, tasks, powers, number of staff, nature, characteristics, and actual conditions, the Director of the provincial tourism promotion center shall submit to competent authorities for specific regulations on the organizational structure of the provincial tourism promotion center in accordance with the law.
3. The establishment of rooms and the number of deputy heads of rooms under the provincial Tourism Promotion Center shall be carried out in accordance with point d, Clause 1 and Clause 3 of Article 6 of the Government's Decree No. 120/2020/NĐ-CP dated October 7, 2020 on the establishment, reorganization, and dissolution of public service units.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The advisory agency assisting the Minister of Culture, Sports and Tourism in performing state management functions over tourism shall guide, urge, and inspect the implementation of this Circular.
2. The Department of Tourism, the Department of Culture, Sports and Tourism shall establish the functions, tasks, powers, and organizational structure of the provincial Tourism Promotion Center in accordance with the laws on the establishment, reorganization, and dissolution of public service units and the guidance provided in this Circular, and submit them to the competent authority for promulgation in accordance with the law.
Article 6. Transitional Provisions
1. The Department of Tourism, the Department of Culture, Sports and Tourism shall review and complete the Project and the Proposal for the establishment or reorganization of the Tourism Promotion Center that has been submitted to the competent authority before the effective date of this Circular to ensure compliance with the provisions of this Circular.
2. The Department of Tourism, the Department of Culture, Sports and Tourism shall review and submit to the competent authority for issuance of regulations on the functions, tasks, powers, and organizational structure of the Tourism Promotion Center established before the effective date of this Circular to ensure compliance with the provisions of this Circular within twelve months from the date this Circular takes effect.
Article 7. Effective Date
1. This Circular shall take effect from February 14, 2023.
2. During the implementation process, if any difficulties arise, agencies and individuals are requested to promptly reflect them to the Ministry of Culture, Sports and Tourism for research and appropriate amendments./.
