Circular No. 15/2023/TT-BCT amends and supplements certain contents in related circulars concerning the functions, tasks, and authorities of the Department of Industry and Trade at provincial and district levels. CIRCULAR
Amending and supplementing some Circulars issued by the Minister of Industry and Trade
guiding the functions, tasks, and authorities of the Department of Industry and Trade

Based on Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government stipulating the organization of specialized agencies under provincial People's Committees and central city People's Committees, and Decree No. 107/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government stipulating the organization of specialized agencies under provincial People's Committees and central city People's Committees;
On the basis of Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government stipulating the organization of specialized agencies under district, town, and city People's Committees under provinces and central city People's Committees, and Decree No. 108/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 37/2014/NĐ-CP dated May 5, 2014 of the Government stipulating the organization of specialized agencies under district, town, and city People's Committees under provinces and central city People's Committees;
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
The Minister of Industry and Trade issues this Circular amending and supplementing some Circulars issued by the Minister of Industry and Trade guiding the functions, tasks, and authorities of the Department of Industry and Trade.
Article 1. Amending, supplementing, and abolishing some provisions of Circular No. 04/2022/TT-BCT dated January 28, 2022 of the Minister of Industry and Trade guiding the functions, tasks, and authorities of specialized agencies on industry and trade under provincial People's Committees and central city People's Committees and district, town, and city People's Committees under provinces and central city People's Committees
1. Amending and supplementing Clause 1 of Article 1 as follows:
"The Department of Industry and Trade is a specialized agency under the provincial People's Committee; it performs the function of advising and assisting the provincial People's Committee in managing state affairs concerning industry and trade, including the following sectors and fields: mechanical engineering; metallurgy; electricity; new energy; renewable energy; energy efficiency and conservation (if applicable); chemicals; industrial explosives; mining and mineral processing industries (excluding common building materials and cement production); consumer goods industry; food industry; supporting industry; other processing industries; small-scale handicraft industry; promoting small-scale industry; commercial activities and commodity circulation within its jurisdiction; sustainable production and consumption; export and import; border trade (for provinces with borders); logistics services; trade promotion; e-commerce; trade services; competition management; protection of consumer rights and management of multi-level marketing business activities; anti-dumping measures; economic integration; management of industrial clusters within its jurisdiction."
2. Amending and supplementing Point d of Clause 1 of Article 2 as follows:
"d) Draft decision specifying the functions, tasks, authorities, and organizational structure of the Department of Industry and Trade;"
3. Amending and supplementing Paragraph 5 of Point c of Clause 4 of Article 2 as follows:
"Organizing guidance, inspection, and supervision of training, examination, and issuance of Electric Power Inspector cards in accordance with regulations of the Ministry of Industry and Trade."
4. Amending and supplementing Paragraph 9 of Point c of Clause 4 of Article 2 as follows:
"Organizing plans for inspecting and urging key energy-consuming establishments within its jurisdiction to apply energy management models; Inspecting and supervising the implementation of technical standards, norms, and regulations on energy efficiency and conservation issued by competent state agencies in industry, commerce, and residential areas; Compiling a list of key energy-consuming establishments within its jurisdiction and reporting to the provincial People's Committee to submit a report to the Ministry of Industry and Trade."
5. Abolishing Paragraph 3 of Point g of Clause 4 of Article 2.
6. Amending and supplementing Paragraph 4 of Point l of Clause 4, Article 2 as follows:
"Taking the lead or participating in opinions on files and procedures related to the implementation of infrastructure projects for industrial clusters and production and business projects within industrial clusters in accordance with the law."
7. Supplementing Point q of Clause 4 of Article 2 as follows:
“q) Managing state affairs and inspecting the acceptance of construction works belonging to investment projects for specialized industrial construction works within the province in accordance with laws on construction."
8. Amending and supplementing Paragraph 1 of Point a of Clause 5 of Article 2 as follows:
"Advising on and organizing the implementation of planning, programs, mechanisms, and policies for management and development according to its functions and authority: various types of commercial infrastructure such as markets, shopping centers, retail stores, wholesale stores, trading houses, exhibition centers, auction centers, logistics centers, and other types of commercial infrastructure; various forms and methods of commercial operations such as cooperative trade, wholesale, retail, commercial agencies, franchising, and commercial services within the province in accordance with the law;"
9. Supplementing Point n of Clause 5 of Article 2 as follows:
"n) Regarding logistics services:
Taking the lead and coordinating with relevant departments and units to advise on and organize the implementation of mechanisms, policies, laws, plans, and programs for developing logistics services within the province;
Coordinating and supporting departments, local associations in developing logistics services and enhancing the capacity of logistics enterprises within the province;
Promoting, disseminating, developing the market, and connecting logistics service enterprises with production and import-export enterprises within the province."
Article 2. Amend and supplement 19/2018/TT-BGTVT) which has been amended and supplemented by Clause 7, Article 1 of Circular No. 08/2024/TT-BGTVT dated April 4, 2024, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 19/2018/TT-BGTVT 25/2020/TT-BCT dated September 29, 2020 of the Minister of Industry and Trade stipulating the preparation of plans and reports on the implementation of plans for energy efficiency and conservation; conducting energy audits
Amending Clause 1 of Article 6 of Circular No. 25/2020/TT-BCT as follows:
“1. The Department of Industry and Trade shall be responsible for compiling a list of key energy-consuming facilities in the previous year (N-1) within its jurisdiction, and submitting it in writing to the People's Committee of the province or centrally-run city before February 1, year N.”
Article 3. Responsibilities implementation organization
1. The People's Committee, and the Chairman of the People's Committee at the provincial level shall be responsible for directing and organizing the implementation of this Circular.
2. During the implementation of this Circular, if there are any difficulties or need for supplementation or amendment, the provincial People's Committee, the Department of Industry and Trade, and related organizations and individuals are requested to report to the Ministry of Industry and Trade for consideration and resolution within their authority.
Article 4. Effective date
1. This Circular takes effect from August 22, 2023.
2. This Circular revokes Decision No. 612/QD-BCT dated April 4, 2022 of the Minister of Industry and Trade amending Circular No. 04/2022/TT-BCT dated January 28, 2022 of the Minister of Industry and Trade guiding the functions, tasks, powers of the specialized agencies under the provincial People's Committees and centrally-run city People's Committees and district-level People's Committees./.
