CIRCULAR
Guidelines on positions of civil servants in specialized education administrative affairs

Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
The Minister of Education and Training issues this Circular to provide guidelines on positions of civil servants in specialized education administrative affairs.
Article 1. Scope of Regulation
This Circular provides guidelines on the list of positions, job descriptions, and competency frameworks for positions of civil servants in specialized education administrative affairs.
Article 2. Applicability
This Circular applies to administrative agencies and organizations performing state management functions in the field of education from central to local levels, including:
1. Administrative agencies and organizations under the Ministry of Education and Training and administrative agencies and organizations under other Ministries and ministerial-level agencies assisting the Minister and the head of a ministerial-level agency in managing the state's affairs in the field of education.
2. Specialized agencies performing advisory and assistance functions to provincial People's Committees (referred to collectively as provincial level) in managing state affairs in the field of education.
3. Specialized agencies performing advisory and assistance functions to district-level People's Committees (referred to collectively as district level) in managing state affairs in the field of education.
Article 3. Principles and basis for determining positions of civil servants in specialized education administrative affairs
1. Positions of civil servants in specialized education administrative affairs are determined based on the principles stipulated in Article 3 of Government Decree No. 62/2020/NĐ-CP dated June 1, 2020 on positions and staffing of civil servants (hereinafter referred to as Decree No. 62/2020/NĐ-CP).
2. The basis for determining positions of civil servants in specialized education administrative affairs shall be implemented according to the provisions of Clause 1, Article 4 of Decree No. 62/2020/NĐ-CP.
3. Determination of positions must ensure that the number of civil servant posts does not exceed the approved staffing ceiling.
Article 4. List of positions, job descriptions, and competency frameworks for positions of civil servants in specialized education administrative affairs
1. The list of positions of civil servants in specialized education administrative affairs in the administrative agencies and organizations mentioned in Article 2 is specified in Appendix I attached hereto.
2. Job descriptions and competency frameworks for positions of civil servants in specialized education administrative affairs (hereinafter referred to as Position Descriptions) in the administrative agencies and organizations mentioned in Article 2 are specified in Appendices IIA, IIB, and IIC attached hereto.
3. The level framework for determining requirements for competencies for positions of civil servants in specialized education administrative affairs in the administrative agencies and organizations mentioned in Article 2 is specified in Appendix III attached hereto.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. Based on this Circular, the administrative agencies and organizations mentioned in Article 2 shall develop their position plans and submit them to the competent organization for cadre management at the same level for review and approval by the competent authority in accordance with the law.
2. In cases where the regulatory documents referred to in this Circular are changed, supplemented, or replaced, they shall be implemented according to the newly issued documents.
Article 6. Transitional Provisions
In cases where civil servants currently hold higher ranks (including those who have been recognized as having achieved the results in the examination/promotion to a higher rank before the effective date of this Circular) than the required rank for the position as prescribed in this Circular, they will be retained until new guidance on salary regulations is issued.
Article 7. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from September 28, 2023.
2. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Heads of organizations established by the Government,
