Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006, and the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam dated November 21, 2014;
Pursuant to Decree No.66/2015/NĐ-CPngày 12 tháng 8 năm 2015 của Chính phủ quy định về Nhà chức trách hàng không;

The Minister of Transport bban hành Thông tư sửa đổi, bổ sung một số Điều của Thông tư số 19/2017/TT-BGTVT ngày 06 tháng 6 năm 2017 của Bộ trưởng Bộ Giao thông vận tải quy định về quản lý và bảo đảm hoạt động bay.
Article 1. Amend and supplement some Articles of Circular No. 19/2017/TT-BGTVT dated June 6, 2017 of the Minister of Transport on management and assurance of flight operations (hereinafter referred to as Circular No. 19/2017/TT-BGTVT) and Circular No. 32/2021/TT-BGTVT dated December 14, 2021 of the Minister of Transport amending and supplementing some Articles of Circular No. 19/2017/TT-BGTVT (hereinafter referred to as Circular No. 32/2021/TT-BGTVT).
1. Amending and supplementing Clause 2 of Article 17 as follows:
"2. Non-radar personnel when performing tasks must have valid permits and qualifications. Trainees and those undergoing training at work positions (en-route control, approach control, airport control) must be supervised and guided by a non-radar controller or a non-radar instructor with valid permits and appropriate qualifications. The non-radar controller or non-radar instructor responsible for supervising and guiding shall be accountable for the provision of air traffic control services by trainees and those undergoing training at that work position. The enterprise providing non-radar services shall be responsible for arranging sufficient non-radar personnel suitable for their job positions."
2. Supplement Point i of Clause 1, Article 263 of Circular No. 19/2017/TT-BGTVT (amended and supplemented at Clause 55, Article 1 of Circular No. 32/2021/TT-BGTVT) as follows:
"i) Management of training and instruction for Air Navigation Services personnel (ANS PEL)."
Article 2. Effective Date
This Circular takes effect from July 15, 2024.
Article 3. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Directors of the Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
