CIRCULAR

ABOLISHING CERTAIN LEGAL DOCUMENTS ISSUED BY THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS, JOINTLY ISSUED

THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Law on Issuing Legal Documents dated June 22, 2015 and the Law Amending and Supplementing Certain Provisions of the Law on Issuing Legal Documents dated June 18, 2020;

Pursuant to Decree No.Decision No. 34/2016/NĐ-CPdated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Issuing Legal Documents 2015; Decree No.Decision No. 154/2020/NĐ-CPdated December 31, 2020 of the Government amending and supplementing certain provisions of Decision No.Decision No. 34/2016/NĐ-CPdated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Issuing Legal Documents 2015 and Decision No.Decision No. 59/2024/NĐ-CPdated May 25, 2024 of the Government amending and supplementing certain provisions of Decision No.Decision No. 34/2016/NĐ-CPdated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Issuing Legal Documents which has been amended and supplemented certain provisions pursuant to Decision No.Decision No. 154/2020/NĐ-CPdated December 31, 2020 of the Government;

Pursuant to Decree No.Decision No. 62/2022/NĐ-CPdated September 12, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

At the proposal of the Director of the Legal Department;

The Minister of Labor, War Invalids and Social Affairs issues this Circular to abolish certain legal documents issued by the Minister of Labor, War Invalids and Social Affairs, jointly issued.

This Circular takes effect from January 25, 2026.

Abolish entirely 14 legal documents issued by the Minister of Labor, War Invalids and Social Affairs, jointly issued as follows:

1. Circular No. 08/2013/TT-BLDTBXH dated June 10, 2013 of the Minister of Labor, War Invalids and Social Affairs guiding Decree No. 46/2013/NĐ-CP dated May 10, 2013 of the Government detailing implementation of certain provisions of the Labor Code regarding labor disputes.

2. Circular No. 30/2013/TT-BLDTBXH dated October 25, 2013 of the Minister of Labor, War Invalids and Social Affairs guiding implementation of certain provisions of Decree No. 44/2013/NĐ-CP dated May 10, 2013 of the Government detailing implementation of certain provisions of the Labor Code regarding labor contracts.

3. Circular No. 19/2014/TT-BLDTBXH dated August 15, 2014 of the Minister of Labor, War Invalids and Social Affairs guiding implementation of certain provisions of Decree No. 27/2014/NĐ-CP dated April 7, 2014 of the Government detailing implementation of certain provisions of the Labor Code regarding domestic workers.

4. Circular No. 27/2014/TT-BLDTBXH dated October 6, 2014 of the Minister of Labor, War Invalids and Social Affairs guiding the state management agencies on labor taking opinions from organizations representing employees and employers at local level in building labor policies and laws and issues related to labor relations.

5. Circular No. 23/2015/TT-BLDTBXH dated June 23, 2015 of the Minister of Labor, War Invalids and Social Affairs guiding implementation of certain provisions on wages under Decree No. 05/2015/NĐ-CP dated January 12, 2015 of the Government detailing and guiding implementation of certain contents of the Labor Code.

6. Circular No. 29/2015/TT-BLDTBXH dated July 31, 2015 of the Minister of Labor, War Invalids and Social Affairs guiding implementation of certain provisions on collective bargaining, collective labor agreements, and resolution of labor disputes stipulated in Decree No. 05/2015/NĐ-CP dated January 12, 2015 of the Government detailing and guiding implementation of certain contents of the Labor Code.

7. Circular No. 35/2016/TT-BLDTBXH dated October 25, 2016 of the Minister of Labor, War Invalids and Social Affairs guiding implementation of policies for workers when converting public service units into joint-stock companies according to Decision No. 22/2015/QĐ-TTg dated June 22, 2015 of the Prime Minister.

8. Circular No. 17/2018/TT-BLDTBXH dated October 17, 2018 of the Minister of Labor, War Invalids and Social Affairs stipulating self-inspection of compliance with labor laws by enterprises.

9. Circular No. 20/2018/TT-BLDTBXH dated November 26, 2018 of the Minister of Labor, War Invalids and Social Affairs concerning guidance on mechanisms for cooperation in conducting specialized labor inspections, occupational safety and health inspections during night shifts and outside regular working hours.

10. Decision No. 01/2006/QĐ-BLDTBXH dated February 16, 2006 of the Minister of Labor, War Invalids and Social Affairs promulgating regulations on state inspection activities in labor according to the method of inspectors responsible for regions.

11. Joint Circular No. 28/2010/TTLT-BLDTBXH-BNV dated September 16, 2010 of the Minister of Labor, War Invalids and Social Affairs and the Minister of Home Affairs guiding functions, tasks, powers, organizational structure, and staffing of the Center for Post-Rehabilitation Management.

12. Joint Circular No. 43/2011/TTLT-BLDTBXH-BYT dated December 31, 2011 of the Minister of Labor, War Invalids and Social Affairs and the Minister of Health guiding issuance and management of licenses for voluntary drug rehabilitation facilities.

13. Joint Resolution No. 01/2005/NQLT-BLDTBXH-BCA-BVHTT-UBTWMTTQVN dated November 17, 2005 of the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Public Security, the Ministry of Culture, Sports and Tourism, and the Vietnam Fatherland Front Central Committee regarding provisions and guidance on content of activities, classification, and evaluation of work in building drug-free and prostitution-free communes, wards, and towns.

14. Joint Resolution No. 01/2008/NQLT-BLDTBXH-BCA-BVHTTDL-UBTƯMTTQVN dated August 28, 2008 of the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Public Security, the Ministry of Culture, Sports and Tourism, and the Vietnam Fatherland Front Central Committee regarding issuance of criteria for classification, scoring, and reporting on work in building drug-free and prostitution-free communes, wards, and towns.

Article 2. Effective Date

This Circular takes effect from February 15, 2025.

Article 3. Implementation Organization

The Director of the Department of Legal Affairs, the Director of the Office of the Ministry, relevant state management units under the Ministry of Labor, War Invalids and Social Affairs, and related agencies, organizations, and individuals are responsible for implementing this Circular./.
