CIRCULAR
ISSUING THE LIST OF FOODS, FOOD ADDITIVES AND CONTAINERS FOR FOODS, MATERIALS FOR DIRECT CONTACT WITH FOODS THAT HAVE BEEN ASSIGNED COMMODITY CODES IN THE EXPORT AND IMPORT GOODS LIST OF VIETNAM SUBJECT TO STATE CONTROL ON FOOD SAFETY UPON IMPORT UNDER THE MANAGEMENT OF THE MINISTRY OF HEALTH
Pursuant to the Food Safety Law dated June 17, 2010;
Pursuant to the Customs Law dated June 23, 2014;
Pursuant to the Decree No. 08/2015/NĐ-CP dated January 21, 2015 of the Government detailing and providing implementation measures for the Law on Customs regarding customs procedures, inspection, supervision, and control;
Pursuant to Decree No. 59/2018/NĐ-CP dated April 20, 2018 of the Government amending and supplementing certain articles of Decree No. 08/2015/NĐ-CP dated January 21, 2015 of the Government detailing and guiding the implementation of the Customs Law on customs procedures, inspection, supervision, and control;
Pursuant to Decree No. 15/2018/NĐ-CP dated February 2, 2018 of the Government detailing implementation of certain provisions of the Food Safety Law;
Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Food Safety Administration;
The Minister of Health issues this Circular to issue the List of foods, food additives and containers for foods, materials for direct contact with foods that have been assigned commodity codes in the export and import goods list of Vietnam subject to state control on food safety upon import under the management of the Ministry of Health.
Article 1. Scope of Regulation
This Circular issues the List and principles for applying the List of foods, food additives and containers for foods, materials for direct contact with foods that have been assigned commodity codes in the export and import goods list of Vietnam issued together with Circular No. 31/2022/TT-BTC dated June 8, 2022 of the Minister of Finance on issuing the export and import goods list of Vietnam subject to state control on food safety upon import under the management of the Ministry of Health (hereinafter referred to as the List).
Article 2. Issuing the List
Issued together with this Circular is the List of foods, food additives and containers for foods, materials for direct contact with foods that have been assigned commodity codes in the export and import goods list of Vietnam subject to state control on food safety upon import under the management of the Ministry of Health.
Article 3. Principles for Applying the List
Clause 1. In cases where there are discrepancies or inconsistencies in classifying and determining commodity codes for goods listed in the List issued together with this Circular, the determination of commodity codes shall be carried out in accordance with the provisions of the Customs Law.
Clause 2. For foods, food additives and containers for foods, materials for direct contact with foods not listed and assigned commodity codes in the List issued together with this Circular, the determination of commodity codes shall be carried out in accordance with the provisions of the Customs Law. After clearance, organizations and individuals exporting and importing such goods shall submit written documents to the Ministry of Health (Food Safety Administration) to serve as the basis for cooperation with the Ministry of Finance to review, unify, update, and issue supplementary Lists.
Clause 3. State control over imported food safety for goods under the responsibility of the Ministry of Health as stipulated in Article 37 of Decree No. 15/2018/NĐ-CP dated February 2, 2018 of the Government detailing the implementation of certain articles of the Food Safety Law shall be implemented as follows:
Point a. For goods named in the List: implement in accordance with the provisions of Article 40 of the Food Safety Law and Article 16 of Decree No. 15/2018/NĐ-CP dated February 2, 2018 of the Government detailing the implementation of certain articles of the Food Safety Law.
Point b. For goods not included in the List but failing requirements during inspections or checks (if any) or having warnings from the Ministry of Health, the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade, People's Committees of provinces and centrally-run cities, or competent authorities abroad, or manufacturers: strict inspection methods shall be applied in accordance with point b and point c, clause 3, Article 17 of Decree No. 15/2018/NĐ-CP dated February 2, 2018 of the Government detailing the implementation of certain articles of the Food Safety Law. Competent authorities under the Ministry of Health shall notify customs authorities of the application and cessation of strict inspection methods for these cases.
Clause 4. Imported foods falling under the following circumstances are exempted from or not subject to state control on food safety:
Point a. Goods named in the List but falling within one of the cases prescribed in Article 13 of Decree No. 15/2018/NĐ-CP dated February 2, 2018 of the Government detailing the implementation of certain articles of the Food Safety Law (except for cases warned about food safety);
Point b. Goods named in the List but not intended for use as food, food additives, or food processing aids;
Point c. Goods being containers or packaging materials named in the List but not containing or not in direct contact with food;
Point d. Goods not included in the List, except for cases prescribed in point b, clause 3, Article 2 of this Circular.
Clause 5. For mixed food additives consisting of two (02) or more food additives named in the List, the HS code of the goods shall be determined according to the six (06) general classification rules issued together with Circular No. 31/2022/TT-BTC dated June 8, 2022 of the Minister of Finance on issuing the export and import goods list of Vietnam.
Article 4. Reference Provisions
In case the regulatory legal documents and provisions cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulatory legal documents.
Article 5. Effective Date
Clause 1. This Circular takes effect from November 2, 2024.
Clause 2. Circular No. 28/2021/TT-BYT dated December 20, 2021 of the Minister of Health on issuing the List of foods, food additives and containers, packaging materials for foods that have been assigned commodity codes in the export and import goods list of Vietnam for state control on food safety for imported foods ceases to be effective from the date this Circular takes effect.
Article 6. Responsibility for Implementation
The Director of the Food Safety Administration; Heads of units under and affiliated with the Ministry of Health; Directors of Provincial Health Services, Food Safety Services of provinces and centrally-run cities; Heads of Food Safety Management Authorities under the People's Committees of provinces and centrally-run cities; Heads of health agencies under Ministries and sectors; and relevant organizations, entities, and individuals are responsible for implementing this Circular.
During implementation, if difficulties arise, agencies, organizations, and individuals shall report to the Ministry of Health (Food Safety Administration) for review and resolution./.
